r Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 Excavation and/or filling pursuant to NCGS 113-229 Permit Number 103-21 Issued to Mitchell and Kathleen Varner et al., 4700 Cotton Creek Dr., Charlotte, NC 28226 Authorizing development in Brunswick County at adi. to a man-made canal. at 192 Greensboro St.. in Holden Beach, as requested in the permittee's application dated 4/22/21, including attached workplan drawings (3), Page 1 of 3 dated 4/12/21, Page 2 of 3 dated 4/14/21 and Page 3 of 3 dated 6/10/21. This permit, issued on August 13, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Existing Docking Facility Reconfiguration and Second Docking Facility 1) This permit authorizes only the repositioning of the existing jet ski lift associated with the existing west docking facility, and the pier and boat lifts associated with the second east docking facility and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent,part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed four feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. ADDITIONAL CONDITIONS Permit No. 103-21 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit authorizes two (2) additional formalized boat slips for a maximum of 3 formalized boat slips at this docking facility. One (1) formalized boat slip is located at the west docking facility and two (2) formalized boat slips are located at the east docking facility. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent western property owner's area of riparian access. 6) Should the Lot to the east be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian setback, and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. USACE Conditions 9) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at httos://www.fws. ovg/raleigh/.Vdfs/ManateeGuidelines20l7.pdf. General 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) All debris associated with the removal or construction of the permitted docking facilities shall be contained within the authorized project area and removed to an appropriate upland location. 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local Permits, approvals or authorizations that may be required. Mitchell and Kathee Varner et al. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-1061. NOTE: Future development of the permittee's property may requim a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $250 was received by DCM for this project. PROJECT DESCRIPTION The proposed project is located at 192 Greensboro Street, on the feeder canal directly across from the north end of Burlington Street, on the west end of Holden Beach, Brunswick County. The property can be reached by traveling NC HWY 17 south towards Holden Beach. At the Supply intersection, turn left onto NC 211 S. Travel .3 miles down NC 211 S and turn right onto Stone Chimney Road SW. Drive down Stone Chimney Road for 5.5 miles and continue onto Old Ferry Connection SW for 1.1 miles. Turn right onto Sabbath Home Road SW and then take the next left onto NC 130 E towards Holden Beach. Travel over the Holden Beach bridge and take a right onto Ocean Blvd W. Continue for 1.8 miles and take a right onto Greensboro Street. Drive 1 mile and the project location will be located on the right hand side. The project site is approximately .17 acres and is vegetated primarily with domestic grasses and ornamental landscaping. The high ground portion is elevated approximately 5' above the normal high water (NHW) level, and the shoreline (+/- 75 linear feet) is stabilized by bulkhead. Waterward of the bulkhead, there is a band of Coastal Wetlands, which consist primarily of Spartina alterniJlora, spanning the length of the property with a width of approximately 12%15' out from the bulkhead. The applicant's property sits on a feeder canal, directly across from the north end of Burlington Street. Residential properties border the project site to the east and west, Greensboro Street borders the north, and the feeder canal borders the south side of the property. The width of the feeder canal measures approximately 102' feet at the proposed project site. Existing structures on the project site include a single family residence, bulkhead and a private one (1) slip docking facility. The existing docking facility is accessed by a fixed access pier (6' x 18'). From the east side of the terminus of the fixed access pier, an access finger platform (4' x 3') leads to a fixed uncovered platform (12' x 12') extending over the water to the south and east. From the terminus of the fixed access pier, a gangway leads south to an existing floating dock (8'x 18') which is oriented parallel with the shoreline. From the east side of the floating dock, a jet ski floating platform (6' x 12') extends parallel with the shoreline. The property is jointly owned by 12 parties (Mr. Grosse is one owner), however all parties have signed a joint agent authorization to authorize Mr. Curt Grosse to pursue this project on the property (see Signing Authority Letter dated as received by DCM 6/24/21). The waters of the canal system are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. PROPOSED PROJECT The applicant proposes to construct a second fixed finger access pier and two additional boatlifts, reconfigure an existing jet ski dock, increasing the total slip count from one (1) to three (3) in the Holden Beach canal system. Approximately 30' to the east of the existing fixed pier, the applicant is proposing to construct a fixed finger pier (40' x 4'), extending to the south, perpendicular to the existing bulkhead. To the immediate west and east of the terminal end of the proposed forger pier, the applicant is proposing to build two boat lifts (each 13' x 13'XSee Site Plan Page 2 of 3). The applicant proposes to reposition the existing jet ski dock from its current position on the eastern side of the existing floating dock to a new position on the immediate western side of the floating dock, and turned 90 degrees back towards shore, in an orientation parallel with the existing access pier. The proposed new location of the floating jet ski dock would encroach into the western riparian corridor setback, however the appropriate waiver has been obtained. The proposed easternmost boatlift would encroach into the eastern riparian corridor setback, however the appropriate waiver has been obtained. ANTICIPATED IMPACTS The proposed docking facility expansion would incorporate an additional 442 sq. ft. of Estuarine Waters and Public Trust Area and shade 56 sq. ft. of Coastal Wetlands. The proposed docking facility would encroach into the 15-foot riparian corridor setback of the eastern and western property owners however the waivers have been obtained.
