Two copies of all resulting archaeological reports, as well as one copy of the updated site form, shall be forwarded to the offices of Sate Archaeology for review and comment as soon as they are available and in advance of any construction oz ground disturbance activities. All activities associated with the archaeological investigations shall be conducted in close coordination with the Office of State Archaeology (OSA). Consultation with the OSA by the consultant shall take place prior to the commencement of any field wor15. Written notice from the OSA of the satisfactory completion of this condition shall be submitted to LLCM prior to initiation of any development activities authorized by this permit. This permit action may be appealed by the permtttee or other qualified persons within Menty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. Permit 4 IW07 Page 2 of 5 to JDI'TIQN A L COPTDITIONS hocking Facility 2) Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the attached permit application and workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this 9-slip dockin; facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 3) No sewage, whether treated or untreated, shall be discharged at ary time from any boats using the docking facility, Any sewage discharge at the docking, facility shall be considered a violation of this permit for which the perriittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) 15A NCAC 07H .0208(b)(6)(D) of the Rules of the Coastal Resources Commission require that the combined area of all "T's, finger piers, platforms, and decks not exceed a combined total area of four square feet per linear foot of shoreline. In order to ensure consistency with this requirement, a deed restriction shall be placed on lot 21 dedicating the entire shoreline of this lot to the proposed community access facility. The deed restriction shall further state that no "T's", fingei piers, platforms, or decks shall be allowed off of Lot 21 in the future as long as the permitted facility is in place. This deed restriction shall be recorded with the Onslow County Register of Deeds, and copies of the recorded deed provided to the Division of Coastal Management, prior to the initiation of construction -of the access facility. 5) All portions of the access pier located over Coastal Wetlands shall not exceed a width of 6 feet and shall be elevated a ruin um of 3 feet above ibe Coastal Wettand substrate as measured from the bottom of the decking. 6) No portion of the permitted structure, including any tie pilings, shall be located within 80 feet of the near bottom edge of the federally maintained Atlantic Intracoastal Water Way channel. 1) The pier and associated structures shall have a nn.inimurn setback distance of 15 feet between any parts of the structure and the adjacent southwestern property owner's riparian access corridor. This corridor is determined by drawing a tine parallel to the channel, then drawin(y a line perpendicular to the channel line that intersects with. the shore at the point where the upland property line meets the water"s edge. 8) In order to ensure compliance with Condition Nos. 6 and 7 of this permit, an as -built survey showing the I ocation and dimensions of the constructed structure, the distance to the riparian corridor to the southwest, and the location of the COE 80 foot setback, shall be performed on the facility, and copies of the survey shall be provided to the Division of Coastal Management, within 60 days of completion of construction. NOTE: 1 ailure to provide the survey required in Condition No. 8 shall result in a violation of this permit. 9) No atten::pt shall be wade by the permittee to prevent Che fall and freeuse by th4 public of all navigable waters at or adjacent to the authorized work. ADDITIONAL (--l'ONDITIONS Permit # 199-07 Page 3 of 5 10) The permittee. shall maintain the authorized work in good condition and in, conformance with the terms L and conditions of this permilt. The permittee is not relieved of this requirement if to abandons the permitted activity without having it transferred to a third party. 11) This permit does not authorize the interference with any existffig or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury that ma 6cen by the United States in the public _y be caused from existing or future Opel-atIORS undert interest. 12) The permittee shall install and maintain at his expense any signal Lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. T 3) This permit authorizes a maximum of 9-slips. At DO time shall more than 9 vessels be moored or docked at the facility. The restriction of the number of vessels shall , in types, apply to all marine vessel tyv- s inclu ding but. not Iimited to motorboats, sailing vessels and personal watercraft. NOTE: The permittee is cautioned that due to the proximity of the AMFW, boats utilizing the docking facility shall be subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve the pc=ittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats.
