Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X . Excavation and/or filling pursuant to NCGS 113-229 Permit Number 28-21 Issued to Hadley F. Twiddy, PO Box 301, Corolla, NC 27927 Authorizing development in Currituck County at adj. to tributaries connecting to Raccoon Bay, at 1170 Persimmon St., in Corolla as requested in the permittee's application dated 9/14/20 (MP- 1) and 10/12/20 (MP-2,3,4), including attached workplan drawings (3), Sheets 1-3 of 3 all dated 11/24/20. This permit, issued on March 16, 2021 , is subject tocompliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization — Rip Rap Revetment 1) The rip rap revetment shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No vegetated wetlands shall be excavated or filled, even temporarily. 3) No open water shall be excavated or filled, even temporarily, outside of the approved rip rap revetment alignment. 4) This permit does not authorize any excavation waterward of the approved alignment. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Twiddy ADDITIONAL CONDITIONS Permit No. 28-21 Page 2 of 3 5) The alignment of the authorized rip rap shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. 6) This permit does not authorize any excavation waterward of the approved alignment. 7) The fill material shall be clean and free of any pollutants except in trace quantities. 8) The rip rap material shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. Docking Facilities 9) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facilities without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 10) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 11) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 12) This permit authorizes a maximum of two (2) formalized boat slips, one (1) at each of the authorized docking facilities. 13) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 14) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. Boat Ramp 15) Unless specifically altered herein, this permit authorizes one gravel and hog slat boat ramp, as indicated on the attached workplan drawings. 16) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. 17) Placement of fill materials below normal water level shall be limited to the ramp structure. Twiddy ADDITIONAL CONDITIONS Permit No. 28-21 Page 3 of 3 18) ' Excavation and ground disturbing activities, associated with the placement of the boat ramp, above and below the normal water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the attached permit application and workplan drawings. Upland Development with Section 404 Wetland Fill 19) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the gravel driveway, approximately 504 ft2 of Section 404 wetland fill, and other associated infrastructure, all as expressly and specifically set forth in the attached permit application and workplan drawings. General 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 21) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 22) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-01576). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-1676. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. Please see below of a complete description of the conditions in the area. The depths and coverage of SAV does not allow for much improvement, but an additional 20 feet of pier gets another -0.25 feet of depth at NWL. This would put the pier and slip in approximately -2.5 foot of water at NWL in mostly milfoil, which is greater than the minimum depth needed for a slip in SAV under our GP. I would like to see what other comments come in related to this. I thought we would be OK due to the presence of the existing pier which is actually in shallower water. We extended the proposed pier to get out a little deeper than the existing. If the pier went out another 20 ft, it would be 2.5 ft off the end. This also places it waterward of the SAV that has been mapped by the State. It doesn't really get any deeper in the bay and you cannot get out of the SAV altogether. Once you do hit the 2.4-2.5 ft water depth on our experience, you are getting out of areas that have any Widgeon grass and Milfoil is the only species. The milfoil is the only species that will grow in this turbid water in water 2.5 ft, only because it grows so long. Other species don't successfully survive due to lack of photic penetration. The site of the proposed development is located at 1170 Persimmons Street, Corolla, Currituck County, adjacent to unnamed tributaries connecting to Raccoon Bay of the Currituck Sound. The development proposal involves the Coastal Wetland (CW), Public Trust Area (PTA), Estuarine Waters (EW), and Estuarine Shoreline (ES) Areas of Environmental Concern (AEC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 1 SA NCAC 07K 0208 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a) (1) States "Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur;" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6) (B) states, "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas;" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6) (C) states, "Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking;" Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6) (F) states "Piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use" Consistent: The proposed development is consistent with the intent of this rule. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one- fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier - head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body." Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation shall be permitted if impervious areas are not increased and the applicant designs the project to comply with the rule to the maximum extent feasible." DATE: November 16, 2020 Consistency Determination: The request is consistent with/not in conflict with the Currituck County 2006 Core Land Use Plan (LUP) certified by the CRC on May 18, 2007 as amended through July 2, 2019. Overview: The 52.92 acre subject property consists of a primary parcel located at the western terminus of Persimmon Street with shoreline along a tributary of Raccoon Bay and the Currituck Sound, and seven (7) islands located nearby in the Currituck Sound. The primary parcel contains upland area with yard grasses and trees, Section 404 Wetlands and Coastal Wetlands, and the islands are mostly made up of Coastal Wetlands. The shoreline area on the north side of the primary parcel, near grassed uplands, contains Section 404 and Coastal Wetlands fringe. North of the primary parcel, water depths range from -2 feet to -3.25 feet and average -2.5 feet below Normal Water Level (NWL). South of the primary parcel, water depths are -2.25 feet below NWL approximately 60 feet from the shoreline. The primary parcel has an elevation of approximately 2 feet above NWL. The primary parcel is predominately within the AE (4) Floodzone, with a small area of AE (3) to the northeast. Existing improvements are limited to the primary parcel. Existing site improvements consist of a single family house (former Lighthouse Hunt Club), a pool, two (2) sheds, septic system, gravel driveway, and a walkway that crosses over wetlands. The shoreline to the north is unimproved. Installation of an 8 foot wide by 382 foot long riprap revetment sill, an 8 foot wide by 32 foot long boat ramp with two (2) 4 foot wide by 30 foot long access piers and an 8 foot wide by 125 foot long gravel access driveway, a 4 foot wide by 16 foot long pier with two (2) tie piles, and a 6 foot wide by 204 foot long walkway transitioning to a 6 foot wide by 51 foot long pier with an "L" shaped 10 foot by 20 foot terminus platform and a 212 sq. ft. wrap around lower platform and three (3) tie piles is proposed. The sill, boat ramp with access piers and driveway, and 16 foot long pier will be located along the northern shoreline of the primary parcel and the 255 foot long walkway/pier with terminus platform will be located along the southern shoreline of the primary parcel. The existing walkway/pier/platform and pilings to the south will be removed. The sill will be located a maximum distance of 6 feet waterward of NWL and 2 feet landward of NWL within the shoreline area containing Section 404 wetlands and Coastal Wetlands. The sill will have a maximum height of 12 inches above the adjacent wetland substrate. The sill will be constructed in two (2) sections to allow for installation of the boat ramp. The gravel driveway will connect the boat ramp to the existing gravel driveway. Tie pilings will create one (1) designated slip to the north and one (1) designated slip to the south. The waters of the Currituck Sound in this area are classified as SC and are closed to shellfish taking. Submerged Aquatic Vegetation (SAV) was observed on the southern side of the primary parcel. No archaeological sites are on or near the subject property. Anticipated impacts resulting from this project are expected to include: the filling of 2,468 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC) and 2,280 sq. ft. 'of Estuarine Shoreline AEC, and; the shading of 866 sq. ft. of Public Trust Area/Estuarine Waters AEC. Approximately 200 sq. ft. of Coastal Wetlands AEC and 1,244 sq. ft. of Section 404 wetlands will be filled. Basis for Determination: The site is located within the "Corolla Sub -Area". The project area is designated as "Conservation Areas" on the Currituck County Future Land Use Map (FLUM). Areas of Environmental Concern (AECs) are also designated as "Conservation Areas" as indicated on Page 11-1. As indicated on Page 11-1, "(t)he purpose of the Conservation class is to provide for the long- term management and protection of significant, limited, or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The Conservation class should be applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features." The proposed project occurs within an area with a historical record of supporting submerged aquatic vegetation (SAV), and the presence of SAV was noted in the field report. SAV is a highly valuable habitat, both environmentally and economically. These habitats provide nursery, foraging, and/or spawning areas for various recreationally and commercially important fish and invertebrate species. Additionally, SAV plays a critical role in natural erosion control and shoreline stabilization, as well as water quality enhancement, primary production, and nutrient cycling. Therefore, it is crucial that SAV be protected in order to maintain and enhance these critical environmental contributions. The structures proposed for the southern side of the property would be placed directly over SAV, and would terminate while within the historical record of SAV. The DMF would recommend that the structure be extended in order to ensure that it does not terminate within SAV habitat. This would aid in minimization of potential impacts to SAV during installation of the structures (i.e. through increased turbidity, direct burial and/or removal, etc.). Placement of the terminus outside of SAV habitat would also minimize the potential negative impacts associated with the use of the structure after installation, such as prop scarring. PROJECT SUMMARY: The applicant proposes to construct a boat ramp and gravel access driveway within areas of 404 wetlands, construct 4 piers, 2 platforms, a walkway over wetlands, place riprap along the shoreline waterward of delineated Coastal and 404 wetlands, and install 5 piles designating 2 wet -slips. Proiect Setting The property is located at the western end of Persimmons Street and is ± 2,305,195 ft2 (52.92 acres) in size, mostly made up of islands vegetated by coastal wetlands within Raccoon bay, and has an elevation approximately 2' above NWL. The property contains an unhardened shoreline with a single family dwelling, a pool, 2 sheds, and a walkway through wetlands connecting to a pier with a platform. According to the USDA's Natural Resources Conservation Service's Web Soil Survey, the soil on the property is made up of Duckston fine sand and Currituck mucky peat. Based on available information, no archaeological sites are on or near this property. Vegetation includes 404-wetlands, coastal wetlands, yard grasses, and trees. The adjacent riparian properties to the north and south are unhardened marshes made up of primarily coastal wetlands. The location of the proposed work is within the natural tributaries of Raccoon Bay, which connects to the Currituck Sound, and is classified as Joint waters by agreement with the Marine Fisheries Commission and Wildlife Resources Commission. The Division of Environmental Management's water quality classification for this area is SC and it is closed to shellfish taking. Water depths within the project site range from -2' to -3.25 and average -2.5'. Submerged aquatic vegetation, as per DMF's definition, was only observed on the southern side of the property (see project narrative forRWEIVED survey results). Development Proposal OCT 2 6 2020 HD The applicant proposes to construct a 382' x 8' riprap revetment located on the no h side of l TY the property along the shoreline immediately adjacent to USACE jurisdictional 404 wetlands. The sill will be located a maximum distance of 6' waterward of normal water level (nwl) and 2' landward of nwl within the shoreline area containing coastal and 404 wetlands. The revetment will have a maximum height of 12" above the adjacent wetland substrate. The wetland sill will be constructed in 2 sections allowing for the installation of a 32' x 8' boat ramp. This boat ramp will be constructed 130' from the east end of the revetment. The boat ramp was positioned at this location to limit the amount of 404 wetland fill. The boat ramp will be constructed out of hog slats and gravel and will have a slope of 8 to 1. The boat ramp will be lined by 1.5' wide rip rap along the entire length. Combined the revetment and the boat ramp will fill approximately 100' liner feet of a Coastal Wetland fringe and 484 ft2 of delineated 404 wetlands. In conjunction with the boat ramp, the applicant proposes to construct a gravel access driveway connecting the boat ramp to an existing gravel driveway. The access driveway will be 125' long and 8' wide. The gravel access will flair out to a width of 28' over the distance of 14' on the southern side to connect to the existing gravel driveway. The proposed access driveway will result in the filling of ±504 ft2 of delineated Hadley Twiddy Field Investigation Report Page,3 404-wetlands. Immediately adjacent to the boat ramp, on each side the applicant proposes to construct 2 identical 30' x 4' piers. These piers will parallel the boat ramp and will extend 16' out over water and 14' over 404 wetlands. 63' west of the boat ramp the applicant proposes to construct a 16' x 4' pier extending 9' over water and T over 404 wetlands. Immediately adjacent to this pier the applicant proposes to install 2 tie -piles designating 1 formalized wet slip. The water depth in this location is-2.25'. No SAV was observed in this area. Lastly, on the south side of the property, the applicant proposes to replace the existing walkway with a new 204' x 6' walkway elevated 3' above the wetland substrate. This walkway will connect to a new 51' x 6' pier with a L shape 20' x 10' platform and a 212 ft2 wrap around L shape lower platform. At the southern end of the platform the applicant proposes to install 3 tie -piles designating 1 formalized wet slip. The water depth in this location is -2.25. Dense rooted SAV, primarily dominated by Eurasian Milfoil (M. spicatum) with patches of Widgeon Grass (R. martima), was observed in this location. Anticipated Impacts • The construction of the boat ramp will fill 176 ft2 of shallow bottom within the EW and PTA AEC. • The boat ramp will fill 176 ft2 of 404 wetlands along a 11' wide portion within the ES AEC. • In total the construction of the gravel access way will result 1140 ft2 of fill. The Site is waterfront, located on unnamed tributaries of the Currituck Sound on three sides. The vast majority of the total property is comprised of marshlands. The main (upland) portion of the property contains a residential home (former Lighthouse Hunt Club). There are 404 non -coastal wetlands as well as coastal wetlands surrounding the homesite. To the north of the home, there are 404 non - coastal wetlands that were delineated by Quible and field approved by US Army Corps of Engineers (USACE) in July 2020; see attached PJD map. The coastal wetlands were similarly delineated and approved by NC Division of Coastal Management (NCDCM) in May 2020. The full property (see green shaded area on Sheet 1) includes marsh islands and submerged lands. A full boundary survey of the property was performed in 2019. A virtual interagency scoping meeting was held on 8/19/2020 to discuss the project. Based on feedback from the meeting, the proposed scope has since been modified to address agency concerns associated with shoreline stabilization and the boat ramp (discussed below). Pr000sed Work South Side Pier System: On the south side of the homesite, there is an existing pile -supported pier/dock/boardwalk that is proposed to be replaced in the same general configuration, but is planned to extend an additional +/-25 ft with a platform and slip at the end. This will be an elevated pile -supported structure and the width of the pier will not exceed 6 it wide. Ramp: On the north side of the home in the pond/basin, the owner proposes to construct a boat ramp for small motorboats and for paddle craft. This ramp would involve grading and stabilization with gravel as well as slotted concrete panels (2 rows of 2 ft wide panels for trailer wheels to ride on) that will be anchored and stabilized with additional gravel and rip rap (along sides). Access to the ramp will include a gravel drive and would require 660 sq ft (0.02 ac.) of Section 404 impacts for placement of gravel to provide a reliable drive surface. The proposed ramp is a residential style ramp for launching and retrieving small vessels. This is completely within a private property, including the basin. Current and past owners have and continue to use this basin and connecting waters for private boat usage. The size of the ramp is well under the maximum dimensions set forth in the CAMA GP rules per 15A NCAC 07H .1300. The reason for needing a CAMA Major Permit for this particular ramp has to do with the minor Section 404 impacts needed provide a gravel driveway to the edge of the basin. Based on the discussion during our scoping meeting, the location of this ramp has shifted to the west from what was previously proposed to further minimize 404 impacts, while utilizing a section of shoreline that will still allow minimal grading to create a ramp (see attached photo of the currently proposed ramp location). As discussed during this meeting, this site was a former hunt club, and small waterfowl hunting boats launched from the earthen ramp area indicated on the CAMA Plan, and likely launched from other areas along the boat basin. There were not any formal ramps constructed to the owner's knowledge, only earthen areas that had been sloped to RECEIVED R@CEind OCT 2 6 1020 OL' 119 2::1 DCM-MHD CITY CAMA Major Narrative- Lighthouse Hunt Club Property 1170 Persimmon St., Currituck County, NC Updated 10/12/2020 the basin. The selected ramp location is a natural saddle and will not require extensive excavation/earth work to create a ramp (current photo referenced above). After our scoping meeting, it was explained to Ms. Twiddy that it would be helpful to obtain additional information related to the historical and continued use of the subject property to launch small boats and to safely operate. Based on this, Ms. Twiddy requested statements from two of her neighbors with long histories of this specific use, the waterways, former hunt club and current conditions, to provide statements of anecdotal evidence. Please see attached letters that we would like to include in the CMA Major application package. While this property was an active hunt club, there were no other ramps in the nearby vicinity. Today, the boat ramp at the Whalehead Club exists as a public ramp, but the water depth at that ramp has been at least 1 ft shallower than this subject location. There is no dredging or widening of the water body proposed in association with this small vessel ramp. The owner operates a small outboard center console boat with power trim that draws a minimum amount of water, and a jon boat along with an assortment of paddle craft. These are the type of boats that local residents with water experience use in Corolla. The total proposed length of this ramp has been minimized to the extent practical to further restrict the size of boats/trailers able to utilize the ramp. This ramp will not be made available to the public and is for private/residential use. Another ramp adjustment from the scoping meeting is the length of the ramp staging pier that has been reduced to 13.75 ft long to observe the quarter width rule. Please also note that we added a staging pier on the opposite side of the ramp as well. In all likelihood, only one of the staging piers will be constructed, but we are unsure at this time which pier is more important. Shoreline Stabilization: The shoreline of this pond/basin has had noticeable erosion over time. This is not a high energy water body, but bank collapse is evident along with nutria and/or muskrat tunnels that are causing erosion. Based on agency concerns during our scoping meeting, we are requesting rip - rap stabilization in -lieu of the low bulkhead that was initially proposed. Please see attached plan. North Side Boat Slip: Previously proposed (going into our scoping meeting) was a platform and side -to slip. Due to the rock now proposed, that slip has also been adjusted to keep the slip off of the rip rap. This includes a 16 ft x 4 ft pier and two stand-alone mooring piles. Water Depth and SAV Survey On Wednesday, May 6t", qualified environmental scientist along with a surveyor from Quible performed a water depth and SAV survey of the Project Areas at the Site. Water depths collected (relative to NWL) are plotted on Sheet 3. North Side: Shoreline parallel transects were walked from the shoreline out past the waterward limits of the proposed bulkhead and ramp. Brian Rubino walked this area to review bottom conditions and to take shallow cores with a hand auger to look for rhizomes (visibility less than 2 ft), and walked transacts with a steel rake to further sample the bottom. The substrate QLtbe nearshore area was predominately a sand and several feet from the edge of the shoreline was dominantly soft organic silt with some clay. South Side: The entire zone in the existing pier footprint and adjacent waters (covering the complete extent of the proposed new pier, platform and adjacent waters) was evaluated for SAV growth and habitat. This area is SAV habitat and was found to be dominated by Eurasian Milfoil (M. spicatum) with minor amounts of Widgeon Grass (R. maritima). SAV in the existing pier footprint is best described as "patchy" in water depths greater than approximately 1.5 feet. There are consistent beds of Milfoil in the shallower waters (1.5 feet to 2.5 feet or less) with coverages in excess of 50%. Please note, there is no rooted SAV found in waters shallower than 1.5 feet (immediately adjacent to the marsh edge. It has been our experience in the last several years that Milfoil is the dominant species, but Widgeon grass and other species are present in small percentages.
