Vinson, 920 Stone Falls Trail, Raleigh, NC 27614 Authorizing development in Carteret County at adi. to Town Creek. at 501 & 513 Turner St.. in Beaufort -,as requested in the permittee's application dated 4/29/21, including attached workplan drawings (2), Overview dated 4/28/21 and Slip Count dated "Revised 9/8/21". This permit, issued on October 4, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation it these terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null ana voia. Residential Marina Expansion and Reconfiguration This permit authorizes only the finger pier extensions, platform, boatlifts, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the established Town of Beaufort pier -head line. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Vinson ADDITIONAL CONDITIONS Permit No. 132-21 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit authorizes a maximum of 18 formalized boat slips (labeled 1-10 and Ll-L8) and 3 temporary boat slips (labeled A, B, C) located as shown on the drawing dated "Revised 9/8/21". The docking of vessels at any location not shown on the permitted drawings shall be considered a violation of this permit. 5) The marina shall display a sign showing the location of the nearest pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. Easement 7) The project may require easements for multiple utilities crossing the creek, marsh and State-owned land provided the applicant qualifies for an easement. The permittee shall contact the North Carolina State Property Office at (984) 236-0270 for this determination. Sedimentation and Erosion Control' 8) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. USACE Conditions 10) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.pdf. General 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. Britt D. Vinson ADDITIONAL CONDITIONS Permit No. 132-21 Page 3 of 3 12) All construction debris associated with the removal or construction of the permitted marina shall be contained within the authorized project area and disposed of in appropriate waste receptacles in an upland location. 13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2009-01121). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-1128. NOTE: Future development of the pennittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $250 was received by DCM for this project. The proposal is to re -configure the existing 16- slip docking facility by extending the existing t-head platform 8' to the west and 8' to the east along slips 5 and 10 as well as widen slip #5 from 20' to 30' wide by moving and placing three pilings to the west. Slip five would also have a 5' x 30' Floating finger extending to the west which would delineate two new slips with boadifts (6 pilings to accommodate the new lifts) installed as well as add a 5' x 30' Floating extension to the existing floating finger along the east side of slip # 5. There would be a total of three slips within this area (1 existing and 2 new). The final portion of the proposed development is to widen slip #10 from 20' wide to 30' wide by relocating the existing outer pilings to the east. The proposed development would add two slips to the existing 16 slip docking facility (plus three transient slips) for a total of 18. All work would be landward of the existing pier head length, would not extend over the Town of Beaufort Harbor line, would not exceed 1/3 the width of the water body (per Jonathan Howell) and would remain a minimum of 15' from both riparian access lines. No high ground work is proposed. The proposed work is consistent with 15A NCAC 7H.0208 therefore the Morehead City District Office recommends the project be authorized as proposed on plat dated received May 12, 2021, contingent upon all applicable general conditions and the following standard conditions: • The number of slips shall not exceed 12 as shown in the application and plat dated received 5/12/2021. • The length of the proposed docks and fingers shall not exceed the distance as shown on the plats. • No work shall hinder navigation in any way. • All work shall remain a minimum of 15' from the riparian access lines. Overview: This is a major permit request bu Turner Westward LLC. The project site is located at 501 and 513 Turner St, Beaufort, Carteret County. The site is adjacent to Town Creek and the USACE Federal Harbor Turning Basin as well as the Town of Beaufort Harbor Line. The high ground property (two tracts) is 1.3 acres (56836 sf) in its entirety and is an average of 4'-5' above NHW. The property has been developed with single family homes. The high ground is comprised mostly of grasses, a few cedars, oak trees, holly trees and scrub bushes. There is an undeveloped residential property to the north with a public street right of way to the south. The original project was previously permitted through the major permit (157-09) for a 10-slip marina with dredging and a bulkhead. A major modification was issued on 5/20/13 for the upland development which included a six lot low density subdivision, riprap shoreline stabilization, boardwalks and all required infrastructure (electric, roads, wateretc.) and in March of 2015 but has since expired. The existing docking facility has 16 formalized slips with three transient slips. The N.C. Division of Water Quality previously authorized the proposed project under General Water Quality Certification No. 3641 (DWQ Project No. 070648), which was issued on 5/10/07. The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No. SA W-2009-01121. The project fronts Town Creek, the creek carries a water classification of SC. The creek is not designated as Primary Nursery Area, and is closed to the taking of shellfish. Riparian corridors were determined through the previous major permit 157-09. Substrate is silty sand. No SAVs or shellfish beds were observed within the proposed development area. There are scattered fringes of coastal marsh waterward of the existing riprap. The coastal wetlands consist of Spartina alterniflora (Smooth Cordgrass). A shellfish survey was conducted for the original major permit on 10/9/09 due to DMF concerns with the previous dredging area. Anticipated impacts The proposed slips, boatlifts, platform extensions and fingers would shade 428 ft2 of estuarine bottom and incorporate 2,700 ft2 of Public Trust open water. The setting of pilings has the potential to cause a temporary increase in turbidity during construction. No coastal marsh would be filled or excavated during this project. There is no encroachment within the Federal Basin and Town of Beaufort Harbor Line. Basis for Determination: The project site is located in the Town of Beaufort subject to the 2006 Town of Beaufort Core Land Use Plan. The Future Land Use Map (FLUM) classifies the land uses as Low Density Residential with all parts of the AEC classified Conservation. The following LUP policies are applicable to this request: 4.2.6 Areas of Environmental Concern Policy 1: The Town of Beaufort supports state and federal law regarding land use and development in AECs (pg. 84). The construction of the docking facility may not cause any additional closure of shellfishing waters by Shellfish Sanitation as this would be considered a violation of 15A NCAC 0213.0201(f) and 15A NCAC 02B.0221(1). In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 6. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733- 5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 7. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 8. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 9.The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 10. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of -3- 1973 (North Carolina General Statutes Chapter I I3A Article 4). 11. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. PROJECT SUMMARY: The proposed project is for the re -configuration of two existing slips, two new slips with Field Investigation Report: Turner Westward LLC and Taylors Creek Holdings Page 02 boatlifts, piling addition and relocation, one new finger pier, finger pier extension and the extension of the existing platform in two locations (east side and west side). The original project was previously permitted through the major permit (157-09) for a 10- slip marina with dredging and a bulkhead. A major modification was issued on 5/20/13 for the upland development which included a six lot low density subdivision, riprap shoreline stabilization, boardwalks and all required infrastructure (electric, roads, water etc.) and in March of 2015 but has since expired. The existing docking facility has 16 formalized slips with three transient slips. The N.C. Division of Water Quality previously authorized the proposed project under General Water Quality Certification No. 3641 (DWQ Project No. 070648), which was issued on 5/10/07. The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No. SAW-2009-01121. 9. Narrative Description The Turner Westward LLC project is at 501 and 513 Turner Street in Beaufort, Carteret County and is adjacent to Town Creek and the USACE Federal Harbor Turning Basin as well as the Town of Beaufort Harbor Line. The high ground property (two tracts) is 1.3 acres (56836 st) in its entirety and is an average of 4'-5' above NHW. The property has been developed with single family homes There are scattered fringes of coastal marsh waterward of the existing riprap. The coastal wetlands consist of Spartina alterniflora (Smooth Cordgrass). The high ground is comprised mostly of grasses, a few cedars, oak trees, holly trees and scrub bushes. There is an undeveloped residential property to the north with a public street right of way to the south. The Town of Beaufort's Land Use Plan classifies this property as Low Density Residential with all AECs classified Conservation. Town Creek is not designated as a Primary Nursery Area and is closed to the taking of shellfish. Town Creek within this area carries a water classification of SC and is approximately 1100' wide. Riparian corridors were determined through the previous major permit 157-09. Substrate is silty sand. No SAVs or shellfish beds were observed within the proposed development area. A shellfish survey was conducted for the original major permit on 10/9/09 due to DMF concerns with the previous dredging area. 10. The current proposal would increase the slips to 18 formalized slips and three transient slips. The applicant is proposing the addition of two new slips with 13' x 13' boatlifts and a new 5' x30' finger pier within slip # 5. They are also proposing to add an 8' x 8' platform extension along the south west side of slip 5, shifting an existing piling and two new pilings to the west along slip 5 to widen it from 20' to 30' and adding a 5' x 30' finger pier extension to the existing floating finger along the east side of slip 5. They are also proposing to shift the existing tie pilings for slip # 10 to the east to widen the slip from 20' to 30' as well as add an 8' x8' platform extension along the south east side of slip 10. All work would be landward of the existing pier head length, would not extend over the Town of Beaufort Harbor line, would not exceed 1/3 the width of the water body (per Jonathan Howell) and would remain a minimum of 15' from both riparian access lines. The existing water depths within this area are an average of— 6' nlw. The typical boat using the marina would be 30'to 50' with mixed types such as sail, charter, yachts and sports fishing. The marina policy would prohibit overboard discharge with no overnight or live aboard dockage and would be equipped with a pump out and signs that were previously permitted. The width of Town Creek within this area is 1100'. All parts of the development would also be 15' from the riparian corridors. 11. Anticipated Impacts: The proposed slips, boatlifts, platform extensions and fingers would shade 428 ft2 of estuarine bottom and incorporate 2,700 ft2 of Public Trust open water. The setting of pilings has the potential to cause a temporary increase in turbidity during construction. No coastal marsh would be filled or excavated during this project.
