Tantum PA, 604-C Cedar Point Blvd., Cedar Point, NC 28584 NORTH CAROLINA CARTERET COUNTY ACCESS EASEMENT AND RIPARIAN CORRIDOR EASEMENT This Access Easement and Riparian Corridor Easement hereinafter "Easement', made and entered into this Q -7 day of September 2021, by and between the Town of Cedar Point, a North Carolina Municipal Corporation hereinafter referred to as "Grantor"; and Eva R. Pruitt and husband Jeffrey K. Pruitt, Sr., owners of property located at 119 Sunset Drive, Cedar Point, North Carolina, hereinafter referred to as "Grantees". WITNESSETH WHEREAS, Grantor maintains a municipal street within the Town of Cedar Point styled "Sunset Drive," being a 50-foot wide right of way, running from Jones Street in an easterly direction and bordered occasionally on the south by the high-water mark of Bogue Sound; and WHEREAS, Grantees have a house and lot on the north side of Sunset Drive which has a street address of 119 Sunset Drive, Cedar Point, NC and a Carteret County Tax Parcel Number of 537415620882000, hereinafter the "Lot," and; WHEREAS, Grantees desire to construct a pier and dock in Bogue Sound across Sunset Drive from the Lot; and submitted electronically by "John E. Tantum, PA" in compliance with North Carolina statutes governing recordable documents and the terms of the submitter agreement with the Carteret county Register of Deeds. [2] WHEREAS, it appears that the high-water mark of Bogue Sound across from the Lot is at or within the southern boundary of Sunset Drive; and WHEREAS, to obtain a CAMA permit that will allow the pier and dock to be built, it is necessary for Grantees to obtain an Easement to access Bogue Sound across Sunset Drive from the Lot and to obtain a Riparian Easement to allow the pier to extend into Bogue Sound; and WHEREAS, the Town Board of Commissioners for the Town of Cedar Point, at a regularly scheduled meeting, have voted unanimously to grant to Grantees the Access Easement as requested, together with a Riparian Corridor Easement to allow Grantees to access Bogue Sound and to construct a pier from the southern boundary of Sunset Drive into Bogue Sound. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the receipt of which is duly acknowledged, the Grantor, does hereby grant and convey to the Grantees a perpetual, non-exclusive Access Easement across Sunset Drive that is located directly south of the Grantee's Lot for the purpose of allowing the Grantees to access Bogue Sound from their Lot. See Map attached as Exhibit "A" that marks the Easement Area. The Grantor further grants and conveys to the Grantees, their successors and assigns, a perpetual non-exclusive Riparian Corridor Easement to allow the Grantees to construct a pier and dock together with any utilities required by the dock and with the right to maintain and repair and replace said pier and dock from the point where the southern boundary of Sunset Drive meets the high-water mark of Bogue Sound and within the riparian corridor area extended into Bogue Sound from the east and west boundaries of the Access Easement area as described in the preceding paragraph. The easements granted herein are subject to the following: 1. Nothing in this Easement grants to the Grantees any exclusive possessory rights in any part of the full width of Sunset Drive above the high water mark of Bogue Sound. Grantees will have the same right of access over Sunset Drive as the general public. 2. Grantees may install utility lines under the Sunset Drive right-of-way from the Lot to the pier and dock subject to the following: a. Utility installations must be subsurface and no portion of the utility installations may extend above grade within the right -of way of Sunset Drive. The utility installations under the pavement of Sunset Drive must be made by boring. No cutting of pavement is permitted while Grantee's utility lines are being installed, maintained, or replaced. The boring of utility lines must be made in a good and workmanlike manner to avoid damage to the pavement whether by puncturing, future settling of the soil around the bores, or other conditions. C. While utility lines may be installed, maintained , and replaced by excavating into that portion of the right-of-way of Sunset Drive that is not paved, such excavation [3) must be made in a good and workmanlike manner to avoid damage to the pavement. As soon as possible after excavation, the Grantees are responsible for filling any excavation and returning the surface to as near its condition before excavation as possible. d. Prior to installation of utility lines, the Grantees will notify the Grantor's Town Manager as to the proposed location of such lines, and after installation will give the Grantor's Town Manager a sketch showing the approximate location of the utility lines as installed. e. Before any maintenance work is conducted on the utility lines under Sunset Drive, the Grantees will notify the Grantor's Town Manager. f. Grantees will avoid damaging any Grantor or third -party utility lines within the right-of-way of Sunset Drive as they install, maintain or replace their utility lines. g. The Grantees will have liability to the Grantor for the full costs of repairing any future damage to the pavement of Sunset Drive, and to unpaved areas of the street, caused by defects in, or failures of, their utility installations. h. Grantor has no liability to Grantees for damage to Grantees' utility lines under the Sunset Drive right -of --way arising from Grantor's or the rpublic'street,repaving, maintenance, etc., in the future.3. The structure of Grantees' pier must be kept a minimumfeVet from the southern edge of the pavement of Sunset Drive. 4. The Grantor will have no liability to Grantees for damage to Grantees' pier and docks incurred in repairing, maintaining, or replacing the pavement of Sunset Drive or in maintaining the unpaved portion of the street. 5. The Riparian Corridor Easement granted herein is deemed an appurtenance to the title of the Lot and such easement may not be severed from such title without the express written permission of Grantor. Grantees' benefits, burdens, requirements, responsibilities, and release of liabilities, hereunder touch and concern the land, run with the title to the Lot, and bind and enure to the benefit of Grantees' successors in title to the Lot. To have and to hold the "Easements" hereby granted to the Grantees, their successors and assigns, for the use and purpose herein set forth.
