This permit, issued on June 11, 2021 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
)t tnese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Expansion
1) This permit authorizes only the additional floating platform, boatlift, and other structures and uses
located in or over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
6) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the
federally maintained AI W W channel.
7) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
8) This permit authorizes an additional two (2) slips for a maximum of four (4) formalized boat slips.
9) The boatlift and floating platform shall have a minimum setback distance of 15 feet between any parts of
the structure and the adjacent northern property owner's area of riparian access.
USACE / FEDERAL CONDITIONS
10) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
14) All debris associated with the removal or construction of the permitted docking facility shall be
contained within the authorized project area and removed to an appropriate upland location.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2021-00637).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2021-0831
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water.
NOTE: An application processing fee of $250 was received by DCM for this project.

boadift located at the existing floating dock. The remainder of the tract is a lot with typical shrubs, trees, and grasses.

The applicant proposes to add a 34' long x 6' wide floating dock with access ramp and 13' x 13' boatlift to the northern portion
of the existing faced pier and docking facility. The purpose of the project is to generate an additional boat slip and an additional
boat lift to the existing docking facility, providing additional water access to the residential property.

This letter is in reference to the application submitted for Sue Turner, for a Coastal Area
Management Act Major Permit to undertake development activities to expand an existing
docking facility, in New Hanover County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary that
the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c)
which would make August 14, 2021 the new deadline for reaching a decision on your request.
However, we expect to take action prior to that time and will do so as soon as possible. In the

The total area of floating dock and platform was calculated as follows:
Shoreline length =120' x 8 sq. ft. = 960 ftz allowable
Proposed floating dock = 6' x 34'= 204' ft2
Proposed boatlift =13' x 13' =169 ftz (not counted)
Existing uncovered platform = (2)10' x 12' = 240 ftz
Existing gazebo =16' x 12' =192 ftz
Existing floating dock = 8' x 40' = 320 ftz
Existing boatlift =13' x 13' =169 ftz (not counted)
Existing fixed pier = 6' x 678' = 4,068 ftz (access credit)
Total = 956 ftz
The expansion would provide docking space for the total up to four (4) vessels at this location. It appears that the project is
consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the %width rule, the eight square foot rule
and the pier width rule, The proposed structures would be located entirely over open water. If the project is determined to
be consistent with NCAC 07H .0208(b) and (6), it is recommendedthat any permit issued should include standard
conditions for piers and docks.

The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request dated received by this office on March 23, 2021. The proposed project is located within the
waters of the Atlantic Intracoastal Waterway near Middle Sound which are class SA;HQW waters by DWR.
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in your
application do not require written authorization to utilize GC 4175. However, you are required to follow
the conditions listed in the attached certification.
You should also obtain and comply with any other federal, state and local requirements including (but
not limited to erosion and sedimentation control regulations and state stormwater requirements before
you proceed with your project). Also, the approval to proceed with your proposed impacts to waters a
depicted in your application shall expire upon expiration of the 404 or CAMA Permit.

CONSISTENCY DETERNIINATION:
This project is consistent with the 2006 Wilmington -New Hanover County Joint
Land Use Plan Update.
The applicant is proposing to install a second boat lift and another floating dock for a
total of 4 slips at an existing private docking facility. The project is located at 414
Summer Rest Road in Wilmington, New Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PTA.
Waters at the project site are classified as SA-ORW and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County CAMA Land Use Plan and offer the following comments.
The general area of the project is classified as Residential and Conservation.
In general, the Wilmington -New Hanover County Joint Land Use Plan allows
development in Residential and Conservation classified AECs, which is consistent with
the State's minimum use standards. The Wilmington -New Hanover County Joint Land
Use Plan contains some policies, which exceed the State's minimum use standards,
however none of these policies are applicable to this project.
This project appears to be consistent with the 2006 Wilmington -New Hanover
County Joint Land Use Plan Update.

Description of project area and activity: The proposal is to expand the existing docking facility by adding another Boating dock
and a second boatlift for a total of 4 slins. The proposed expansion would include a second ramp extending north from the
access vier to a 6' by 34' Boating dock positioned perpendicular to the shoreline. Additionally, a 13' by 13' boatlift is proposed
for the north landward side of the orovosed Boating dock to provide docking space for uo to four (4) vessels.
Please note, a Coastal Area Management Act (CAMA) permit authorization must be obtained from the North
Carolina Division of Coastal Management (DCM) prior to commencing any work on this project.

1 administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit
authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional
general permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below,
provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit
authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and
conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to
commence in reliance upon the nationwide and/or regional general permit, will remain authorized provided the activity is completed
within twelve months of the date of the nationwide and/or regional general permit's expiration, modification or revocation, unless

9. PROJECT DESCRIPTION:
The project site is located at 414 Summer Rest Road in Wilmington, adjacent to the Atlantic Intracoastal
Waterway (AIWW), in New Hanover County. To locate the property, travel east on Eastwood Road (US Hwy 74)
from Military Cut -Off Road (US Hwy 17) for approximately 1 mile towards Wrightsville Beach. Before crossing
the drawbridge turn left onto Summer Rest Road and the destination will be at the end of the road on your right.
The project area is undeveloped except for a small patio / seating area and is located east of Summer Rest
Road. It is bordered to the north and south by undeveloped parcels that have existing docking facilities and
bordered to the east by the AIWW. West of the project area is the 415 Summer Rest Road parcel with the same
ownership as the project area. The west parcel has a single-family residence. The project area parcel is
approximately 2.74 acres in size and varies from 6'-25' above normal high water (NHW). Upland vegetation on
the property currently consists of lawn grasses and ornamental landscaping. The approximately 120 linear feet
of shoreline frontage is currently stabilized by a brick retaining wall, with a narrow strip of highground that
descends into Coastal Wetlands approximately 50-60' wide consisting primarily of black needlerush (Juncus
roemerianus) and smooth cordgrass (Spartina alterniflora),
The applicant currently maintains an existing private docking facility most recently reconfigured under General
Permit # 74872D, which was issued on 2/19/2020 and expired on 6/19/2020, The current configuration includes
an access pier extending approximately 678' in length by 6' in width over coastal wetlands to reach the edge of
the AIWW. A ramp extends to the south from the access pier to a 8' by 40' floating dock, located perpendicular
to the shoreline. A 13' by 13' boatlift is located to the south of the floating dock in the 15' riparian set back. The
access pier ends in a T-Head that includes a 12' by 16' gazebo with two 10' by 12' platforms located on the north
and south sides of the gazebo. The existing docking facility currently accommodates up to two (2) vessels (See
Sheets 1 and 3).
The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion at
the property as R-20. The waters ofthe AIWW / Middle Sound in the project area are classified as SA-ORW by
the Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division
of Marine Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
9. The applicant proposes to expand the existing docking facility by adding another floating dock and a second
boatlift for a total of 4 slips. The proposed expansion would include a second ramp extending north from the
access pier to a 6' by 34' floating dock positioned perpendicular to the shoreline. Additionally, a 13' by 13'
boatlift is proposed for the north landward side of the proposed floating dock.to provide docking space for up
to four (4) vessels. The application states that the existing water depth in the area of the proposed docking
structures would be approximately A.0' to -10' normal low water (NLW) (See Sheet 3 and 4).

10. ANTICIPATED IMPACTS:
The proposed structures would incorporate approximately an additional 373 ft2 of Estuarine Waters and Pubic
Trust Area. The proposed structure would not extend further into the waterbody than the existing docking
facility. The proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area. No
impacts to the highground or coastal wetlands are anticipated. Minor increases in turbidity should be expected
during construction.

3.1 Section 6. a. Project Narrative
3.1.1 Project Location and Existing Conditions
The project is located on the Atlantic Intracoastal Waterway at 414 Summer Rest Road in Wilmington, New
Hanover County. There are two single family residences located on the west side of Summer Rest Road. Work
is proposed on the undeveloped east side of Summer Rest Road. 404 and Coastal Wetlands were interpreted
from aerial photography and have not yet been verified. Normal High Water was determined by LMG and
verified by DCM staff on January 22, 2021. There is an existing fixed pier leading to a 12' x 16' covered gazebo
with two attached 12' x 10' platforms on the eastern waterfront portion of the tract. There is also an access
ramp that leads to an 8' wide x 40' long floating dock on the southern portion of the fixed pier. There is one
boat slip and one boatlift located on the existing floating dock. Waters in the project area are classified as SB
and are not open to shellfishing. There are no SAV or shellfish resources present.
3.1.2 Proposed Action
There is no upland work proposed on the waterfront lot. In order to provide additional Intracoastal Waterway
boating access to the property, a 34' long x 6' wide floating dock with access ramp and 13' x 13' boatlift on the
northern side of the existing fixed pier is proposed. The proposed dock would add one wet slip and one boatlift.
See Appendix A for details. Due to sufficient water depths surrounding the proposed floating docks, no dredging
is proposed.

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.

development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
