Wrightsville Beach—, as requested in the permittee's application dated 4/6/21, including attached workplan
drawings (4), 1 of 3 dated 3/9/21 and 2,3 of 3 both dated 4/6/21 and 1 of 2 dated 3/9/21.
This permit, issued on July 23, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
rr tnese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Reconfiguration
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the established Wrightsville Beach pier -head line.
3) This permit authorizes 2 additional formalized boat slips for a maximum of 4 formalized boat slips at
this docking facility.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall he attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) 'fhe authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
USACE Conditions
8) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) All debris associated with the removal or construction of the permitted docking facility shall be
contained within the authorized project area and removed to an appropriate upland location.
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2021-00980).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2021-0961.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the mean high-water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

Hi Jimmy,
I spoke to Gregg Bodnar, our Assistant Major Permit Coordinator in Morehead City and we need a bit more information
from you to add to the permit:
1. Distance from the terminal float to the pier headline. Like we discussed this distance should remain consistent
since that float is not proposed to move per the application.
2. Length of the new fixed pier from the bulkhead.
Also with your permission we would like to use the drawing submitted with the application that was included with the
old GP as the 'existing condition' drawing since it has the pier headline included.

Proposed Pier = 6' x —100'= 600 ft2 (credit)
Reconfigured platform =12' x 16' with a 6' access credit =10' x 12' =120 ft2
Existing floating dock = 8' x 30' = 240 ft2
Proposed floating dock = 6' x 20' =120 ft2 (credit)
TOTAL = 360ft2
The proposed construction will result in 120 Win additional incorporated waters but will not count towards additional platform
space.
It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the
pierhead line, the eight -square foot rule and the pier width rule. The proposed structure would not encroach into the
adjacent 15' riparian corridor setback area. This office has no objection to the proposed work, provided it is consistent with
all other local, state, and federal permitting requirements. Any permit issued should include standard conditions for private
docking facilities.

PROPOSED PROJECT: Expansion of an existing docking facility to provide dockage for four (4) vessels.
The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request dated received by this office on May 6, 2021. The proposed project is located within the waters of
Banks Channel are class SA;HCW waters by DWR. The docking facility is permitted for four (4) slips.
Dockage of vessels other than the permitted slips will require re-evaluation by DWR of the use of the
dockage facility.
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in your
application do not require written authorization to utilize GC 4175. However, you are required to follow
the conditions listed in the attached certification.
You should also obtain and comply with any other federal, state and local requirements including (but not
limited to erosion and sedimentation control regulations and state stormwater requirements before you
proceed with your project). Also, the approval to proceed with your proposed impacts to waters a
depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a written
petition for an administrative hearing to the Office of Administrative Hearings (hereby known as OAH). A

Consistency Determination:
This project is consistent with the Wrightsville Beach Land Use Plan update.
The applicant proposes to add an additional floating dock landward of the existing,
shorten the fixed pier and reconfigure the fixed platform for a total of 4 boat slips. in
Banks Channel, for a total of four (4) slips. The project is located at 304 Water Street,
adjacent to Banks Channel in Wrightsville Beach, New Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SA-HQW and, are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Wrightsville Beach Land
Use Plan and offer the following comments.
The general area of the project is classified Low Density Residential, while the AECs
impacted by the work are classified as Conservation.
In general, the Town of Wrightsville Beach allows development in Low Density
Residential/Conservation classified AECs which is consistent with the State's minimum
use standards. The Town of Wrightsville Beach Land Use Plan contains some policies,
which exceed the State's minimum use standards including those for piers and marinas.
However, none of these more restrictive policies seem to be applicable to this project.
This project is consistent with the Town of Wrightsville Beach Land Use Plan.

9. PROJECT DESCRIPTION
The project site is located at 304 Water Street, on Banks Channel, in the town of Wrightsville Beach, in New
Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel east approximately
3.0 miles on Eastwood Rd towards Wrightsville Beach. Cross the drawbridge and the Banks Channel bridge and
take a right onto Waynick Boulevard. Travel approximately 1.2 miles on Waynick Boulevard, follow the road as it
turns to the left and becomes Sunset Avenue, and then take a right at the stop sign onto South Lumina Avenue.
Travel approximately 0.3 miles and take a right onto Albright Street and in approximately 417 feet and take a left
onto Water Street and the project site will be approximately 92 feet down on the right.
Currently, the property has an existing single family home, a retaining wall, and a 2 (two) slip private docking facility.
The project site is bordered to the north, south, and east by existing single family homes. Banks Channel borders
the property to the west. Elevation at the site averages approximately 4' above normal high water (NHW). The
high ground portion of the property contains ornamental landscaping and lawn grasses. A sand beach is located
along the approximately 50' shoreline of the property. The adjacent riparian neighbors have bulkheads that appear
to tie into the subject property's wall that is located approximately 11-12' above NHW. The existing docking facility
consists of a 6' by 130' access pier extending waterward into Banks Channel. The 130' pier section terminates at a
12' by 20' fixed platform. A ramp extends waterward to an 8' by 30' floating dock positioned perpendicular to the
shoreline (see Sheet 3 of 3).
The first pier on the property appears to predate 1970 based on authorization from the Town of Wrightsville Beach
for pier repairs on 5/20/1970. An exemption was issued on 4/1/1997 to rebuild the pier after Hurricane Fran. Most
recently, General Permit 76228-D was issued on 2/19/2020 to enlarge the floating dock to 8' by 30'.
The Town of Wrightsville Beach Land Use Plan classifies the area in the vicinity of the project area as Low Density
Residential. The waters in the project area are classified as SA-HQW by the N.C. Division of Water Resources.
They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are
closed to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to add an additional floating dock landward of the existing, shorten the fixed pier, and
reconfigure the fixed platform for a total of 4 boat slips. According to the applicant the existing 8' by 30' floating
dock will remain in the existing footprint so as not to exceed the pier headline noted on General Permit 76228-D. A
6' by 20' Floating dock would be added to the landward end of the existing 8' by 30' float. The existing fixed platform
will be removed and replaced with a 16' by 12' fixed platform in an L-position at the end on the fixed pier. During
the DCM site visit, water depths in the vicinity of the proposed floating dock range from -4.6' to -3' normal low water
(NLW). The existing fixed pier would be shortened to accommodate the proposed new floating dock (see Sheet 1
of 3)
10. ANTICIPATED IMPACTS
As proposed, the new 6' by 20' floating dock and 16' by 12' fixed platform would result in the incorporation of
approximately 312 ft2 additional Public Trust Area and Estuarine Waters. The overall footprint 99"WhPacility
will remain unchanged except for reduction of square footage in the platform from 240 ft2 to 192 ft2 and the platform

moving into an L-position. The existing docking facility has 2 slips and the proposed new floating dock would add
an additional 2 slips for a total of 4 slips. The project area consists of open water, and there would be no impact to
vegetated wetlands or to the high ground area. As proposed, the constructed features would not encroach into the
adjacent 15' riparian corridor setback from properties on both the northern and southern borders, nor encroach into
the established pierhead line. There appear to be no SAV present in the project area. Minor increases in turbidity
should be expected during project construction.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for Michael
Travis for State approval for development of the subject property located at 304 Water Street adjacent to Banks
Channel, in Wrightsville Beach, in New Hanover County. It was received as complete on May 4, 2021 and appears to
be adequate for processing at this time. The projected deadline for making a decision is July 18, 2021. An additional
75-day review period is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from May 4, 2021, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

The Department of Environmental Quality hereby gives public notice as required by NCGS 113A-
119(b) that the following applications were submitted for a development permits in Areas of Environmental
Concern as designated under the CAMA: On May 4, 2021, Michael Travis proposed to add an additional
,floating dock, shorten the fixed pier & reconfigure the fixed platform for a total of four (4) boat slips at 304

3. Slips need to be labeled on the drawings.
