Rd., in Hertford , as requested in the permittee's application dated 5/17/20, including attached workplan drawings
(3), Drawing 1 of 1 dtd 5/17/20, Cross Section dtd "Rec DCM-EC 9/15/20" and Bulkhead dtd "REC DCM-EC 8/5/2011.
This permit, issued on February 2, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the pier, platform, boathouse and finger pier, and other structures and
uses located in or over the water that are expressly and specifically set forth in the permit application.
No other structure, whether floating or stationary, shall become a permanent part of this docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission.

Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) This permit authorizes a maximum of two (2) formalized boat slips.
4) The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the
authorized workplans.
5) The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
Shoreline Stabilization - Bulkhead
8) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan
drawings.
9) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the
approved bulkhead alignment.
10) The alignment of the authorized bulkhead/rip rap shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within
a maximum of 30 days prior to the new expected start of construction.
11) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.
12) The bulkhead shall be constructed prior to any backfilling activities.
13) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
14) The fill material shall be clean and free of any pollutants except in trace quantities.
15) Unless altered herein, all backfill material shall be obtained from a high ground source and confined
behind the permitted bulkhead.
16) No backfill material is to be placed within 30 feet of the normal water level, except that which will be
used to backfill the area behind the permitted bulkhead.
17) All fill material to be placed below normal water level shall be confined behind the.permitted bulkhead.

18) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
19) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
20) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
General
21) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
22) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
23) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-01956).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-1395.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $475 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

The applicant proposes to replace 245 linear feet of bulkhead out an average of 2 feet out
from Normal Water Level except for one section that is 9 feet out and construct a 125 foot
by 6 foot pier with a 17 foot by 17 foot "L" end platform surrounded by a 3 foot by 35 foot
lower platform and a 20 foot by 20 foot boathouse with a 40 foot by 1.5 foot finger pier
underneath the roof line. The property is located at 168 Ainsley Road, Hertford,
Perquimans County adjacent to the Perquimans River.
The development proposal involves the Public Trust Area (PTA), Estuarine Shorelines
(ES), Public Trust Shorelines (PTS), and Estuarine Waters (EW) Areas of Environmental
Concern.
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to
this project and my findings are as follows:
15A NCAC 07H .0208 USE STANDARDS
(a) addresses General Use Standards, and subparagraph (1) requires that uses which are
not water dependent shall not be permitted in coastal wetlands, estuarine waters, and
public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks,
private roads, factories, and parking lots are examples of uses that are not water
dependent. Uses that are water dependent include: utility crossings, wind energy facilities,
docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments,

bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels,
access channels and drainage ditches.
Consistent: The applicant proposes to construct a bulkhead and docking facility
which are listed as water dependent.
(a)(2)(A) requires that the location, design, and need for development, as well as the
construction activities involved shall be consistent with the management objective of the
Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and
designed to avoid significant adverse impacts upon the productivity and biologic integrity
of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine
Fisheries Commission, and spawning and nursery areas.
Consistent: The development is consistent with the intent of this rule.
(a) (2) (B) requires that the development shall comply with state and federal water and air
quality
Consistent: This development will not violate water and air quality.
(a)(2)(C) requires that the development shall not cause irreversible damage to
documented archaeological or historic resources as identified by the N.C. Department of
Cultural resources.
Consistent: There are no known archaeological or historic resources on the
property.
(a)(2)(D) requires that the development shall not increase siltation.
Consistent: It does not appear that this development will measurably increase
siltation.
(a)(2) (E) requires that the development shall not create stagnant water bodies.
Consistent: It does not appear that the development will create stagnant water
bodies.
(a) (2) (F) requires that the development shall be timed to avoid significant adverse impacts
on life cycles of estuarine and ocean resources.
Consistent: The development will have minimum adverse effects on life cycles or
estuarine resources.

(a)(2)(G) requires that the development shall not jeopardize -the -use -of the waters for-
navigation or for other public trust rights in public trust areas including estuarine waters.
Consistent: The development proposal minimal effects on navigation. — —
(b) Specific Use Standards
(b)(6) Addresses Piers and Docking Facilities.
(b) (6) (A) Piers shall not exceed six feet in width. Piers greater than six feet in width shall
be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur;
Consistent: The proposed pier will only be 6 foot in width.
(b)(6)(B) requires that the total square footage of shaded impact for docks and mooring
facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline
with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open
water slips shall not be counted in the total. Projects requiring dimensions greater than
those stated in this Rule shall be permitted only if the greater dimensions are necessary for
safe use, to improve public access, or to support a water dependent use that cannot
otherwise occur. Size restrictions shall not apply to marinas.
Consistent: The proposed boathouse with dock will result in the shading of 794
square feet with a total allowed for the 245 foot of shoreline being 1,960 square feet.
(b)(6)(D) requires that a boathouse shall not exceed 400 square feet except to
accommodate a documented need for a larger boathouse and shall have sides extending no
farther than one-half the height of the walls and covering only the top half of the walls.
Measurements of square footage shall be taken of the greatest exterior dimensions.
Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline.
Consistent: The proposed boathouse is 400 square feet which is allowed through
this rule.
(b)(6)(F) requires that piers and docking facilities shall be single story. They may be
roofed but shall not be designed to allow second story use.
Consistent: The proposed docking facility will not have second story use.
(b)(6)(G) requires that pier and docking facility lengths shall be limited by:
(i) not extending beyond the established pier or docking facility length along the same
shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length
unless necessary to avoid unreasonable interference with navigation or other uses of the
waters by the public);

Consistent: The proposed boathouse and dock will be 125 feet and the established
pier line length along the shoreline.is approximately 140_feet.
(ii) not extending into the channel portion of the water body; and
Consistent: The proposed dock will not extend into the channel portion of the
waterbody.
(iii) not extending more than one-fourth the width of a natural water body, or human -made
canal or basin. Measurements to determine widths of the water body, canals or basins shall
be made from the waterward edge of any coastal wetland vegetation that borders the
water body. The one-fourth length limitation does not apply in areas where the U.S. Army
Corps of Engineers, or a local government in consultation with the Corps of Engineers, has
established an official pier head line. The one-fourth length limitation shall not apply when
the proposed pier is located between longer piers or docking facilities within 200 feet of
the applicant's property. However, the proposed pier or docking facility shall not be longer
than the pier head line established by the adjacent piers or docking facilities, nor longer
than one-third the width of the water body.
Consistent: The proposed docking facility will extend 125 feet which is less than %
width of the waterway which is 1,450 feet of the 5,800 foot width.
(b)(6)(I) requires that piers and docking facilities shall not interfere with the access to any
riparian property and shall have a minimum setback of 15 feet between any part of the pier
or docking facility and the adjacent property owner's areas of riparian access. The line of .
division of areas of riparian access shall be established by drawing a line along the channel
or deep water in front of the properties, then drawing a line perpendicular to the line of the
channel so that it intersects with the shore at the point the upland property line meets the
water's edge.
Consistent: The proposed boathouse with dock will not be within the 15 foot
setback.
(b)(7) Addresses Bulkheads.
(b)(7)(A) requires that bulkhead alignment, for the purpose of shoreline stabilization, shall
approximate the location of normal high water or normal water level.
Possible Inconsistency: The proposed bulkhead is to be placed 2 foot out along most
of its alignment except for one section that will be 9 foot out.
(b)(7)(B) requires that bulkheads shall be constructed landward of coastal wetlands in
order to avoid significant adverse impacts to the resources.
Consistent: The propose bulkhead will not be constructed near wetlands.

(b)(7) (C) requires that bulkhead backfill material shall be obtained from an upland source
approved by the Division of Coastal Management pursuant to this Section, or if the
bulkhead is a part of a permitted project involving excavation from a non upland source,_
the material so obtained may be contained behind the bulkhead.
Consistent: The applicant has indicated that the fill will contain sand from an
location:- -
(b)(7)(D) requires that bulkheads shall be permitted below normal high water or normal
water level only when the following standards are met:
(i) the property to be bulkheaded has an identifiable erosion problem, whether it results
from natural causes or adjacent bulkheads, or it has unusual geographic or geologic
features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under
the other provisions of this Rule.
Consistent: The property does have a steep grade bank and unusual geographic
features along with a failing bulkhead.
(ii) the bulkhead alignment extends no further below normal high water or normal water
level than necessary to allow recovery of the area eroded in the year prior to the date of
application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship
resulting from the unusual geographic or geologic features.
Consistent: The proposed alignment is to mitigate the unusual geographic features
of the shoreline.
(iii) the bulkhead alignment will not adversely impact public trust rights or the property of
adjacent riparian owners
Consistent: The proposed bulkhead meets the intent of this rule.
(iv) the need for a bulkhead below normal high water or normal water level is documented
by the Division of Coastal Management; and
Consistent: The need for a bulkhead below NWL is documented by the Division of
Coastal Management.
(v) the property to be bulkheaded is in a non -oceanfront area.
Consistent: The proposed bulkhead is in a non -oceanfront area.
(b)(7) (E) requires that where possible, sloping rip rap, gabions, or vegetation shall be used
rather than bulkheads.

of a 42 foot by 50 foot area near the shoreline; at 168 Ainsley Road, in Parkville,
Perquimans County.

Consistency Determination: The request is consistent with/not in conflict with the
Perquimans County / Town of Hertford / Town of Winfall Land
Use Plan (LUP) certified by the CRC on February 10, 2016, as
amended through March 5, 2018.
Overview: The subject property is a .74 acre lot with 245 linear feet of shoreline along the
Perquimans River. Water depths are approximately -2.67 feet below Normal Water Level (NWL)
at a distance of approximately 125 feet from the shoreline. Property elevation is approximately 3
feet above NWL at the shoreline. Vegetation on the property consists primarily of indigenous yard
grasses, pine trees, ornamental shrubs and cypress trees. The shoreline is located in the AE
Floodzone, with the remainder of the property being outside of a Floodzone.
Existing site improvements consist of a single-family house with a deck. Existing shoreline
improvements consist of a bulkhead that is in need of repair. The bulkhead alignment includes a
cut in section.
Installation of 245 linear feet of bulkhead, a 6 foot wide by 125 foot long pier with a 12 foot by 12
foot boat lift, a 17 foot by 17 foot upper "L" end terminus platform surrounded by a 3 foot by 35
foot lower platform, and a 20 foot by 20 foot boathouse with a 1.5 foot wide by 40 foot long finger

The new bulkhead will be installed in a straight alignment, 2 feet out from the existing alignment
except for the cut in which will be removed. Grading will provide a gentler slope down to the
bulkhead.
The waters of the Perquimans River in this area are classified as Class SB waters and Joint
Waters and are closed to shellfish taking. A review of submerged aquatic vegetation (SAVs) was
not provided. A review of historic, cultural or archaeological resources was not provided.
Anticipated Impacts resulting from this project are expected to include: the filling of 498 sq. ft. of
Public Trust Area/Estuarine Waters Areas of Environmental Concern and. 12 acre of High Ground
within the Estuarine Shoreline AEC, and; the shading of 794 sq. ft. of Public Trust Area/Estuarine
Waters AEC.
Basis for Determination:
The subject property is designated as "Residential' on the Perquimans County Future Land Use
Map. The project area located on the Perquimans River is classified as "Designated
conservation/open space areas'. As indicated on Page IX-34 "(t)he precise location of
protected/regulated areas that have a conservation or open space connotation such as coastal
wetlands, estuarine waters, estuarine shoreline, public trust areas, and Section 404 wetlands
must generally be determined by field investigation on a case by case basis. These areas,
scattered throughout the County and generally found along creeks and rivers, are not individually
identified on the future land use map"

record of SAV being present in the area, but it appears to be around 20-40 feet away from the proposed

Reference the application of Barbara Thorne for a Department of the Army permit to
replace an existing bulkhead and construct a new pier, boat lift, and a boat house, on property
located at 168 Ainsley Road, adjacent to the Perquimans River, near the Town of Hertford, in
Perquimans County, North Carolina
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must he performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
IF N
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
4. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
5. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
6. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
7. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

PROJECT SUMMARY:
The applicant proposes to construct a pier with an upper and lower platform, boathouse and
boatlift as well as replace the existing bulkhead straightening out it's alignment.
Project Setting
The property proposed for development is located at 168 Ainsley Road in Perquimans
County and consists of approximately 32,424 square feet or 0.74 acres adjacent to the
Perquimans River. The property currently contains a single family residence with a deck and a
bulkhead stabilizing the shoreline that is in need of repair. The properties to the east and west
are developed similarly with single family residences, bulkheaded shorelines and docking
facilities.
Vegetation on the site includes, but is not limited to, indigenous yard grasses, pine trees,
ornamental shrubs, and Cypress trees. Soil Types include Conetoe Loamy Sand (CtB). The
property has an elevation of approximately 3 feet above normal water level (NWL) along the
shoreline.
The shoreline is 245 feet in length and has been hardened by a bulkhead along its entirety that
is in need of repair. The water classification for this area is Primary Recreation, Salt Water (SB)
and are joint waters that are closed to shellfishing. The water depths at the terminus of the pier
are -2.67 feet. An SAV survey was not conducted on this site.
Development Proposal
The applicant proposes to construct a new 125 foot by 6 foot pier with a 17 foot by 17 foot
upper"U end platform surrounded by a 3 foot by 35 foot lower platform. Located on the east
side of the platform a 20 foot by 20 foot boathouse with a 40 foot by 1.5 foot finger pier
underneath the roof line will be constructed. The applicant also proposes to install a 12 foot by
12 foot boatlift on the East side of the proposed pier on the landward side of the proposed
boathouse as well as within the boathouse. The applicant also proposes to replace the existing
245 feet of bulkhead 2 foot out from the existing except for one area where it is cut in
approximately 9 feet from the rest of the alignment. The bulkhead is proposed to be
straightened out to eliminate this cut in section. The applicant also proposes to grade a 50 foot
by 42 foot area to create a gentler slope down to the bulkhead.
Anticipated Impacts
The proposed development will result in the shading of 794 square feet and filling of 498
square feet of Estuarine Waters and Public Trust Areas of Environmental Concern. As well as
the filling of 2,945 square feet and disturbance of 2,080 square feet of Estuarine Shorelines
Area of Environmental Concern. Temporary turbidity will possibly occur during construction.

Thorne Bulkhead/Pier/Boathouse Project QUA -EC
I propose to replace the existing damaged bulkhead at my property
located at 168 Ainsley Rd Hertford. I propose to replace the
bulkhead along the same general alignment at an average of 2 ft
from the existing bulkhead with the exception of a 23 ft by 9 ft
area that I propose at a greater alignment from NWL to straighten
out the existing alignment to create a stronger bulkhead without
sharp turns. I also propose to construct a 125 ft by 6 ft pier with a
400 sq ft platform that includes a step down area and a 400 sq ft
boathouse that includes a lift and a 1.5 ft by 40 ft finger pier under
the boathouse roofline. I also propose a 12 ft by 12 ft boatlift
along the pier. Along with the expected 15 ft wide area from NWL
that will be disturbed due to the bulkhead construction I also
propose to grade and slope a 50 ft by 42 ft area down to create a
gentler slope down to the bulkhead that would decrease erosion for
that area. I submitted the DWR Pre -Filing Meeting Request on

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval to construct a pier with an upper and lower platform, boathouse and boatlift as
well as replace the existing bulkhead at 168 Ainsley Road in Perquimans County.
It was received complete on October 12, 2020 and appears to be adequate for processing at this
time. The projected deadline for making a decision is December 26, 2020. An additional 75-day
review period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider the
review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from October 12, 2020, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS l 13A-1 19(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted

DEVELOPMENT PERMIT
The NC Department of Environmental Quality hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an AEC as
designated under the CAMA was received on 10/12/20. Barbara Thorne proposes to
construct a pier with an upper and lower platform, boathouse, boatlift and replace the
existing bulkhead at 168 Ainsley Road in Perquimans County.
A copy of the entire application may be reviewed at the office of the Division of
Coastal Management, located at 401 S Griffin St, Ste 300, Elizabeth City, NC, 252-264-
3901 during normal business hours. Comments mailed to Braxton Davis, Director, DCM,
400 Commerce Avenue, Morehead City, NC 28557, prior to 12/2/20, will be considered
in making the permit decision. Later comments will be considered up to the time of permit
decision. Project modification may occur based on review & comment by the public, state
& federal agencies. Notice of the permit decision in this matter will be provided upon
written request.
