in Hertford as requested in the permittee's application dated 8/20/20,
including attached workplan drawings (5), Pages 1-5 of 5 all dated 8/20/20.
This permit, issued on January 13, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
if these terms may be subject to tines, imprisonment or civil action; or may cause the permit to be nuts ana vora.
Docking Facility Expansion
1) This permit authorizes only the boat lift and boathouse, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this docking facility
expansion without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) This permit does not authorize any new formalized boat slips. The docking facility is authorized for no
more than one (1) formalized boat slip.
5) In accordance with commitments made by the permittee, the boathouse shall be not be enclosed. The
footprint of the boathouse shall not exceed the dimensions on the authorized workplans.
6) The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
General
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) All debris associated with the removal or construction of the permitted docking facility shall be
contained within the authorized project area and removed to an appropriate upland location.
11) The permittee and/or his or her contractor shall meet with.a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-01592).
NOTE: The N.C. Division of Water Resources assigned the project DWR Project No. 2020-1156.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

. Major Permit Recommendations
The applicant proposes to construct a 30'-8" x 20'-4" open -sided boathouse with a 12' x 10'
cradle pontoon boat lift over portions of an already existing platform, pier, boat slip, and finger
pier. During the construction, existing decking will be replaced with new decking on the existing
piers and platforms. The site of the proposed development is located at 117 Cherokee Trail
within the Snug Harbor subdivision, Hertford, Perquimans County, adjacent to the Yeopim
River.
The development proposal involves the Public Trust Area (PTA) and Estuarine Waters (EW)
Areas of Environmental Concern (AFC's).
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this
project and my findings are as follows:
15A NCAC 07H.0208 Use Standards
Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are
not water dependent within the EW and PTA and lists uses that may be considered water
dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks,
wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts,
groins, navigational aids, mooring pilings, navigational channels, access channels and drainage
ditches.
Consistent: The applicant proposes to construct a boathouse and boat lift. This sub-
paragraph lists these structures a water dependent.

Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the
construction activities involved shall be consistent with the management objective of the
Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse
impacts upon the. productivity and biologic integrity of coastal wetlands, shellfish beds,
submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning
and nursery areas.
Consistent: The development is designed to not interfere with shellfish beds, submerged
aquatic vegetation (SAV), and/or spawning and nursery areas. The location is not within
any primary nursery areas; a SAV survey was conducted with none being found; and the
Yeopim River is closed to shell fishing.
Paragraph (a)(2)(B) states that development shall comply with state and federal water and air
quality standards.
Consistent: The proposed development will not violate water and air quality.
Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented
archaeological or historic resources as identified by the N.C. Department of Cultural Resources.
Consistent: There are no known archaeological or historical resources on the property.
Paragraph (a)(2)(D) states that development shall not increase siltation.
Consistent: It does not appear that the development will measurably increase siltation.
Paragraph (a)(2)(E) states that development shall not create stagnant water bodies.
Consistent: It does not appear that the development will create stagnant water bodies.
Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts
on life cycles of estuarine and ocean resources.
Consistent: The development will have minimum adverse effects on the life cycles of
estuarine resources.
Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for
navigation or for other public trust rights in public trust areas including estuarine waters.
Consistent: The development proposes minimal effects on navigation.
Paragraph (b) addresses Specific Use Standards. Of these, subparagraphs (6) Piers and Docking
Facilities pertain to this project, and those subparagraphs not liste e, et 1' to this

Paragraph (b)(6)(A) states that piers shall not exceed six feet in width. A19P SECTION W 6A
Consistent: The existing pier and finger pier will not be expanded and are currently 4' and
3'-4" respectively.
Paragraph (b)(6)(B) states that the total square footage of shaded impact for docks and mooring
facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a
maximum of 2,000 square feet.
Consistent: The existing shading impacts on the property is t 797 ft2 and with the
construction of the proposed boathouse and replacement decking, the cumulative shading
would increase to f 1,249 W. Therefore, the total area of applicable shading impacts will be
less than 2,000 W.
Paragraph (b)(6)(C) states piers and docking facilities over coastal wetlands shall be no wider
than six feet and shall be elevated at least three feet above any coastal wetland substrate as
measured from the bottom of the decking.
Consistent: The development will not impact any wetlands.
Paragraph (b)(6)(D) states a boathouse shall not exceed 400 square feet except to accommodate a
documented need for a larger boathouse and shall have sides extending no farther than one-half
the height of the walls and covering only the top half of the walls. Measurements of square
footage shall be taken of the greatest exterior dimensions. Boathouses shall not. be allowedon
lots with less than 75 linear feet of shoreline.
Consistent: The proposed boathouse is 30'-8" x 20'-4" for a total square footage of f 623 ft2
exceeding the 400 ft2 rule. However, because the. boathouse is encompassing some existing
shaded areas, the new shading impacts added from the proposed boathouse will be f 447
W. This design minimizes the excess of the 400 ft2 rule to only f47 W. This design also
accommodates a documented need for a larger boathouse in order to afford the applicants
maximum protection and safe access to their 23' pontoon boat.
Paragraph (b)(6)(E) states the total area enclosed by an individual boat lift shall not exceed 400
square feet except to accommodate a documented need for a larger boat lift.
Consistent: The proposed boat lift is 12' x 10' for a total square footage of f 120 112.
Paragraph (b)(6)(F) states piers and docking facilities shall be single story. They may be roofed
but shall not be designed to allow for second story use.
Consistent: The proposed boathouse will be roofed and is single story.
Paragraph (b)(6)(G) states piers and docking facility length shall be limited by:
(i) not extending beyond the established pier or docking facility length along the same shoreline
for similar use.

Consistent: The pier is existing and consistent with other established piers along the same
shoreline. The existing pier will not be extended.
(ii) not extending into the channel portion of the water body.
Consistent: The pier is existing and will not be extended into the channel portion of the
water body.
(iii) not extending more than one-fourth the width of a natural water body, or human -made canal
or basin.
Consistent: The estimated width of the adjacent waterbody at that location is estimated to
be — 2,225' across. The existing pier will not be extended and is considerably below one-
fourth the width of the natural water body.
Paragraph (b)(6)(H) states piers or docking facilities longer than 400 feet shall be permitted only
if the proposed length gives access to deeper water at a rate of 1 foot each 100 foot increments of
length longer than 400 feet.
Consistent: The pier is existing, less than 75', and will not be extended.
Paragraph (b)(6)(I) states piers and docking facilities shall not interfere with the access to any
riparian property and shall have a minimum setback of 15 feet between any part of the pier or
docking facility and the adjacent property owner's area of riparian access.
Consistent: The drip line of the proposed boathouse will be f 59 feet from the adjacent
property line and will not encroach with the 15' setback
Paragraph (b)(6)(J) states applicants for authorization to construct a pier or docking facility shall
provide notice of the permit application to the owner of any part of a shellfish franchise or lease
over which the proposed dock or pier would extend. The applicant shall allow the lease holder
the opportunity to mark a navigation route from the pier to the edge of the lease.
Consistent: The location of the proposed development is adjacent to the Yeopim River
which is closed to shell fishing so no leases or franchises exist within the location.
Based on my review of the applicable subsections of the North Carolina Administrative Code,
the permit application, and plans, I recommend a permit be issued to Mark and Marina Taylor for
the development as proposed.

County.

Consistency Determination: The request is consistent with/not in conflict with the
Perquimans County / Town of Hertford / Town of Winfall Land
Use Plan (LUP) certified by the CRC on February 10, 2016, as
amended through March 5, 2018.
Overview: The .89 acre subject property has approximately 410 linear feet of shoreline along
the Yeopim River. Water depths range from 3.5 feet to 4.25 feet below Normal Water Level
(NWL). The property has an average elevation of 8 feet above NWL. It is vegetated with lawn
grasses and a few trees and ornamental plants. The property is located primarily outside of a
floodzone, with areas along the shoreline located in the AE F000dzone.
Existing site improvements consist of a single-family house with pool and deck, a two-story
garage, three (3) storage sheds, a kayak rack, and a gravel driveway. Existing shoreline
improvements consist of bulkhead and two (2) piers: a pier with an on -land deck and a partially
covered terminus platform, and; a pier with a finger pier, uncovered boat slip and terminus
platform.

The waters of the Yeopim River in this area are classified as Class SC waters and are closed to
shellfish taking. No submerged aquatic vegetation (SAV) was found growing within the project
area. A review of historic or archaeological resources was not provided.
Anticipated Impacts resulting from this project are expected to include: the shading of 451 sq. ft.
of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC).
Basis for Determination:
The project area is located on the Yeopim River. This area is considered "Designated
conservation/open space area".
As indicated on Page IX-34 "(t)he precise location of protected/regulated areas that have a
conservation or open space connotation such as coastal wetlands, estuarine waters, estuarine
shoreline, pubic trust areas, and Section 404 wetlands must generally be determined by field
investigation on a case by case basis. These areas, scattered throughout the County and
generally found along creeks and rivers, are not individually identified on the future land use map."

Reference the application of Mark C. Taylor for a Department of the Army permit to
construct a 31 foot long by 20 foot wide boat house, on property located at 117 Cherokee Trail,
on Lot 9-A in the Snug Harbor Subdivision, adjacent to the Yeopim River, in the Town of
Hertford, Perquimans County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
4. The authorized -structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
5. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
6. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Project Setting
The proposed development is located on property owned by Mark and Marina Taylor at 117
Cherokee Trail, Lot #9-A within the Snug Harbor subdivision. The property is in the town of
Hertford, Perquimans County, and is adjacent to the Yeopim River which empties into the
Albemarle Sound.
The property is platted at ± 38,768 ft2 (± 0.89 acres) in size and contains 410' of shoreline.
Elevation averages 8' above normal water level (NWL). Man-made features within the
property include a single-family residence with a deck and pool area, two-story garage, gravel
driveway, kayak rack, and three storage sheds. The property is vegetated with domestic lawn
grasses, bald cypress, oak tree species, and ornamental species including rose of sharon,
palms, yucca, and banana.
The shoreline of the property is hardened and contains man-made features including a
bulkhead and two piers located towards the western and eastern sides of the property. Both
piers contain platforms with one pier also containing a finger pier and uncovered boat slip.
The other pier has a small, on land deck at its base and a covered area over a portion of its
platform.
The applicants purchased a total of three lots beginning in 2013. On 4/04/2014, CAMA Minor
Permit #04042014 was issued for the construction of a pool and pool apron behind the
residence. Then on 6/08/2017 all three lots were combined into one large lot. The following
year on 2/05/2018, CAMA Minor Permit #02052018 was issued for the construction of a two-
story garage. Most recently on 5/03/19, CAMA General Permit #72549 was issued for 410' of
replacement bulkhead.
The waters of the Yeopim River are joint waters, classified as SC and closed to shellfish
taking. The property is located approximately one mile up river from the mouth and it is-2,255'
across the water body to the opposite shoreline. The bottom substrate is hard bottom sand
and water depths within the project site range from ± 3.5' to ± 4.25' below NWL. No wetland
areas were found to exist along the shoreline. A Submerged Aquatic Vegetation (SAV) survey
was conducted and no SAV was found growing in the project area. The shorelines of adjacent
properties are also hardened with bulkheads and each property also contains a pier with a
platform.
Development Proposal
The applicants are proposing the construction of a 30'-8' x 20'-4" open -sided boathouse with
a 12' x 10' boat lift to accommodate a 23' (including motor) pontoon boat. They are proposing
to construct the boathouse on the existing pier containing the boat slip and finger pier located
on the west side of the property. Under a CAMA General Permit in section 7H.1200, the total
square footage of shading impact has a maximum of 800 ft2. With the recombination of the
three properties into a singular one, the current total shading impact on the property is ± 797
W. With the construction of the propose boathouse (± 447 ft2) and some additional shading
added (± 4 ft2) due to replacement of decking on the existing platform, the cumulative shading
would increase to ± 1,249 ft2. Therefore, a CAMA major permit is required t(RWE%*ED
additional shading up to 2,000 ft2 total.

The proposed boathouse dripline of 30'-8" x 20'-4" will have a square footage of ± 623 W.
However, because the boathouse is encompassing some existing shaded areas, the new
shading impacts added from the proposed boathouse will be ± 447 ft2.
Water depths at the proposed site (inside the one existing boat slip) are ± 3.5' below NWL
and no SAV is present. The decking on the existing pier and platforms will be replaced during
the construction of the proposed boathouse, but the dimensions of the existing structures will
not change. The existing structure is similar to the others in the area, meets the %width rule,
and does not encroach within the 15' setback. The existing and proposed structure is also
- 93' away from adjacent docking structures.
Anticipated Impacts
• The proposed boathouse over the existing docking facility and replacement decking on
the existing structures will result in the additional shading of±451 ftz of Estuarine Waters
and Public Trust Area AEC's.
• The proposed boathouse will increase the cumulative shading of the property to ± 1,249ft2.

History and Existing Conditions:
The applicant's Mark and Marina Taylor own 410' of waterfront property along
the Yeopim River, at 117 Cherokee Trail, in Snug Harbor Subdivision, Perquimans
County, North Carolina. The applicant's purchased lots 3 lots in Snug Harbor
Subdivision (Deeds enclosed with application) beginning in 2013 when they
purchased lot 9 and %z of lot 8 that included a dwelling, bulkhead and a pier with a
platform. In 2014 the Taylor's purchased lot 7 and the remaining 1/2 of lot 8 that
also included a dwelling, storage buildings and pier with a platform. In 2014 they
also obtained a CAMA Minor Permit to construct a swimming pool behind their
dwelling on lot 9. In 2017 the Taylors combined the three lots into a single parcel
and demolished dwelling on lot 7. In 2018 they obtained a CAMA Minor Permit
and constructed a three -bay garage on part of lots 7 and 8, and relocated the
storage shed. The applicants also obtained a CAMA General Permit in 2018 to
replace their bulkhead.
The process of combining the three lots resulted in two piers extending from a
single parcel, bringing the existing shading on a single parcel to 797.72sf.

The water bottom along the applicant's property is a fine sandy muck with no
submerged aquatic vegetation present. The project area was raked and no
vegetation was observed. Water depths within the project site are -44" to -45"
below normal water level. The waters of Yeopim River at the applicant's property
are classified as "Joint" and are Estuarine Waters. The Yeopim River is closed to
shell fishing, is within a known habitat for anadromous fish, and is within River
Herring and Striped Bass Management Areas. The distance across Yeopim River

The property is located within the Perquimans County Planning District, and is
zoned RA-25. Uses adjacent to the property are residential and both adjacent i)CM-EC
riparian property owners have piers and mooring facilities. The closest pier to any
pier extending from the Taylor is property is 93'. The pier is also 61' from the
nearest adjacent riparian line.
Vegetation on the property includes but is not limited to a Rose of Sharon,
Cypress, Magnolia, Red Bud, Oak, Banana, Yucca, grass, and a variety of flowering
shrubs. There are no wetlands on the property. The average elevation of the
property is —8' above normal water level.
Proposed Development
The applicants purchased a 20' pontoon boat and would like to maintain the boat
on a lift in a boathouse. Coastal Management's Major Permit allowance for
shading is 2,000sf, far more that the applicant needs or wants. Enclosed is a Site
Plan of existing structures showing the two piers. The Taylors would like to
construct the boathouse over the existing slip at Pier #2. The boat house roof drip
line dimensions will be 30'- 8" x 20'- 4" (623.32sf), of that area 176sf will be over
existing pier, platform and finger pier. New shading of shallow water bottom will
be 447.32sf.
Decking on the existing pier will be replaced and cover (2) 2sf cutouts on the
platform for an additional 4sf, making the total of new shading 1,245.12sf.

Within the 10' — 5" slip the applicant proposes to install a 12' x 10' pontoon cradle
lift. The roof of the boathouse will be a 4-sided hip roof. The height of the
boathouse measured from the decking to the top of the roof will be —13' — 6". The
bottom of the roof will be enclosed to prevent birds from nesting over the boat
(No storage is proposed), and there will be no side walls around the boathouse.

Major Permit condition 07H .0208 (D) under "Piers and Docking Facilities" states
that the area of the boathouse shall not exceed 400sf accept to accommodate a
documented need for a larger boathouse. It is important to note that while the
total roofed area will be 623.32sf, new shading from the proposed boathouse will
exceed 400sf by only 47.32sf. The remaining structure will be over an existing
pier, platform and finger pier; which, if requested separately from the boathouse
could be roofed without a dimensional limitation.
The applicant's boat is 20' in length with an additional 3' measuring to the back of
the motor for a total of 23'. The particular design is to give maximum protection
and safe access to the boat. Both applicants are retired senior citizens.

DEVELOPMENT PERMIT
The NC Department of Environmental Quality hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an AEC as
designated under the CAMA was received on 08/31/20. Mark and Marina Taylor
proposes to construct a 30'.8" x 20'.4" open -sided boathouse with a 12' x 10' cradle
pontoon boat lift over portions of an already existing docking facility. Existing decking will
be replaced at 117 Cherokee Trail in Perquimans County.
A copy of the entire application may be reviewed at the office of the Division of
Coastal Management, located at 401 S Griffin St, Ste 300, Elizabeth City, NC, 252-264-
3901 during normal business hours. Comments mailed to Braxton Davis, Director, DCM,
400 Commerce Avenue, Morehead City, NC 28557, prior to 10106/20, will be considered
in making the permit decision. Later comments will be considered up to the time of permit
decision. Project modification may occur based on review & comment by the public, state

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval to construct an open -sided boathouse with a cradle pontoon boat lift and replace
existing decking at 117 Cherokee Trail in Perquimans County.
It was received complete on August 31, 2020 and appears to be adequate for processing at this
time. The projected deadline for making a decision is November 14, 2020. An additional 75-day
review period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider the
review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from August 31, 2020, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:
