This permit, issued on January 20, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation 7i mese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion 1) This permit authorizes only the boatlifts, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes three (3) additional formalized boat slips for a maximum of five (5) formalized boat slips. The northern facility is authorized a total of three (3) slips and the southern facility is authorized a total of two (2) slips. (See attached sheets for Additional Conditions) 'I his permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 8) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 9) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 10) The roof of the gazebo shall not be designed for second story use. USACE Conditions 11) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at hqp://www.fws.izov/nc-es/mammal/manatee guidelines.pdf. General 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2020-01354). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-1794. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water. NOTE: An application processing fee of $250 was received by DCM for this project. The proposed development would provide dockage for up to five (5) vessels. The waterbody in the area of the proposed pier measures approximately 115' across, which is CONSISTENT with NCAC 07H .0208 (b)(6)(G). The application also appears to be CONSISTENT with the remaining use standards set forth in NCAC 07H .0208(b)(6), including those which dictate the maximum allowable platform area (the 8 square foot rule), the 15' riparian setback and existing channel setback. It appears the project would not impact beds of SAV, and would therefore be CONSISTENT with NCAC 07H .0208(b)(1). Provided the resource agencies do not have any concerns regarding significant adverse impacts resulting from the proposed project, this office has no objections to the issuance of a permit. PROJECT DESCRIPTION: The project site is located at 7 Cedar Island, off Greenville Loop Rd., adjacent to the Cedar Island Basin, along Masonboro Sound, in New Hanover County. To locate the property from Oleander Drive, turn onto Greenville Loop Road and travel west approximately 1.5 miles just before Bradley Creek Elementary School. Turn left onto Old Military Road and travel east approximately 0.5 miles until you reach Cedar Island. Continue to 7 Cedar Island, which is split across the road with the single family home on the left and docking facility on the right. The property transects a peninsula, so there are two shorelines associated with this property, one referred to as the "basin" shoreline and the other the "canal" shoreline. The property consists of approximately 2.74 acres and the average elevation is approximately 7' above normal high water (NHW). Upland vegetation consists primarily of lawn grass and native trees and shrubs. The property borders Cedar Island Basin and the entrance canal, which is also shared by the adjacent riparian property owners and the residents of Cedar Island directly across the basin to the west from the property of interest. The property has approximately 473 linear feet of shoreline (both shorelines combined) which is stabilized by an existing timber bulkhead. Waterward of the bulkheads is a swath of Coastal Wetlands averaging approximately 20'-25' in width consisting primarily of Smooth Cordgrass (Spartina alternii fora). The applicant maintains an existing private docking facility along the basin shoreline. The previous pier at this location was damaged during Hurricane Florence and was permitted to be rebuilt under CAMA General Permit 76591-D on 7/27/2020. The existing pier extends from the bulkhead a distance of approximately 40 feet. From there, an approximate 8' x 60' floating dock runs northeast/southwest, parallel to the shoreline. In this area of the basin, the shoreline measures approximately 150 feet. There are three independent single pilings located to the north, west and east of the existing floating dock. It is assumed these are tie pilings for larger vessels moored at the existing facility. At this time, there are no proposals to replace or remove either of these pilings. The New Hanover County/City of Wilmington Land Use Plan 2006 Update classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. In the project area, the waters of Cedar Island Basin are classified as SA, by the NC Division of Water Resources, and they are CLOSED to the harvest of shellfish. These waters ARE designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. PROPOSED PROJECT: The applicant proposes to install a boat lift at an existing docking facility and construct a new docking facility on the opposing shoreline, creating a total of five (5) boat slips. According to the application package and site plan drawings, the applicant intends to install a 13' x 13' boatlift along the northern end of the existing floating dock located within the basin. In this location, water depths range from approximately -2.5' to -3.0', relative to normal low water. Kurt and Anna Taylor Page 3 The proposed boatlift would be located in alignment with the outer edge of the existing floating dock, meaning it would conform to the''/4 width requirement. Additionally, due to the location, the pier would be located well within the applicant's area of riparian access, thus requiring no initialed waiver. In addition to the three (3)-slip docking facility proposed within the basin, the applicant is Proposing to construct a two -slip docking facility along the canal or access channel located along the property's southern shoreline. As proposed, a 6' x 40' access pier would originate from the shoreline, just inland of the existing bulkhead. From there, the pier would span in a southerly direction and terminate in a 14' x 14' covered gazebo, which would be located along the eastern side of the proposed pier. An 8' x 32' section of floating dock would extend from the terminus of the propose pier, and would run east/west, parallel to the shore. This structure would extend to the west and would provide dockage for up to two vessels. As designed, the proposed floating dock would be located along the inshore edge of the existing channel. Water depths at this location range from -2.9' to — 4.5', relative to normal low water. The proposed pier/dock at this location would be located well within the'/4 width limitation, inshore of the existing channel and within the applicant's area of riparian access. As a result, the applicant did not require a waiver from neither neighbor for the proposed development. 10. ANTICIPATED IMPACTS The proposed five (5) slip docking facility (two existing and three proposed) would result in the incorporation of approximately 861 sq. ft. of estuarine and public trust area. Additionally, the proposed development would be located outside of the 15' riparian corridor setbacks on both sides, would be constructed within %4 of the width of the waterbody and outside of the adjacent channel setback. There is a single-family residence and tennis court currently located on the property. There is an existing bulkhead located on the northwest and southeast portions of the property constructed under unknown CAMA Permit numbers. There is an existing fixed pier with floating dock (2 wet slips) located on the northwest portion of the property constructed under an unknown CAMA Permit number. LMG staff flagged Normal High Water, 404, and Coastal Wetlands in July 2020 and submitted a Jurisdictional Determination Package on July 30, 2020. 404 Wetlands were approved by USACOE on November 3, 2020. Normal High Water and Coastal Wetland Lines are currently awaiting review by DCM. See Appendix B for details. Waters in the project area are classified as SA and are open to shellfishing.
