Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 Excavation and/or filling pursuant to NCGS 113-229 Permit Number 57-21 Issued to Sunset House FBI, LLC, 4401 Bent Tree Farm Road, Winston-Salem. NC 27106 Authorizing development in New Hanover County at adj. to Masons Channel. at 4 Sandy Point. in Figure 8 Island as requested in the permittee's application dated 12/1/20, including attached workplan drawings (3), dated 12/1/20. This permit, issued on May 7, 2021 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation )r mese terms may ue suoject to tines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion 1) This permit authorizes only the floating platform, boatlift replacement, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions) This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The general area of the project is classified as Developed while the AECs impacted by the work are classified as Conservation. In general, New Hanover County allows development in Conservation classified AECs, which is consistent with the State's minimum use standards. The New Hanover County Comprehensive Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel south approximately 0.5 miles. Turn right onto Sandy Point, travel approximately 300' to the destination on the right. The property is located on a man-made finger of upland at the end of the man-made Figure Eight Island Canal adjacent to Banks Channel and Middle Sound on the southern end of Figure Eight Island. The 0.42 acre parcel has an existing single family residence and is approximately 5' above normal water level (NWL). Upland vegetation on the property currently consists of ornamental landscaping and lawn grasses. The approximately 86' of shoreline frontage is currently stabilized by a timber bulkhead. Waterward of the bulkhead is a band of Coastal Wetland ranging from 21' to 31' wide descending into open water. Normal high water (NHW) is approximately 9' to 18' waterward of the existing bulkhead. The applicant currently maintains an existing private docking facility. A fixed pier extends east from the bulkhead a short distance then angles north into the man-made canal, measuring approximately 55' in length by 6' in width, terminating in a 8' by 8' L-head platform. An access ramp extends from the platform onto a floating dock, also positioned in a northern direction and in approximately 25' in length by 8' in width. A boatift, measuring approximately 13' by 13' is located on the eastern side of the floating dock. No permit history was found for the docking facility or bulkhead; however, aerial imageryindicates the facility in the current configuration was constructed sometime between 1993 and 1998. The docking facility in the current position encroaches 0.T into the 15' setback on the west side and 12.1' into the 15' setback on the east side due to the boatlift. The private facility accommodates up to two,(2) vessels. The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion at the property as Conservation. The watersof this canal, Banks Channel, and Middle Sound are classified SA-ORW by the Division of Water Quality. They are:NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED -PROJECT The applicant proposes to add a new 6' by. 12'floating dock and replace the existing boatlift for a total of 3 slips. The proposed 6' by 12' floating dock would be,attached.to the end of the existing 25' by 8' floating dock extending west to form an 'L'. The boatlift eicisli_ng to the east of the existing floating dock is proposed to be replaced in the same footprint (see Drawing 2 of 3). Water depths confirmed by DCM during the site visit are approximately -6 normal low water (NLW) on the waterward edge of the existing floating dock. Waivers were obtained from both adjacent property owners since the development will encroach into both riparian corridors. 10. ANTICIPATED IMPACTS As proposed, the new floating dock would result in the incorporation of approximately an additional 72 1`12 of Public Trust Area and Estuarine Waters. No additional incorporation of Public Trust Area is planned for the proposed boatlift replacement. The project area consists of open water, and there would be no impact to vegetated wetlands or to the high ground area. The proposed.development will encroach into the adjacent 15' riparian setback for both- adjacent properties. The existing floating dock is currently encroaching 0.7' into the 15' 4 Sandy Point, Sunset House FBI, LLC Page Three setback and the proposed floating dock will add an additional 12' for a total of 12.7' of encroachment into the 15 setback.
