This permit, issued on May 13, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Bulkhead and Retaining Wall 1) The bulkhead and retaining wall shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 4) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Richard and Beth Stitt Permit No. 65-217 r Page 2 of 3 ADDITIONAL CONDITIONS 5) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. 6) The bulkhead and retaining wall shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The bulkhead and retaining wall shall be constructed prior to any backfilling activities 8) The bulkhead and retaining wall shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 9) All backfill material shall be clean and free of any pollutants except in trace quantities. 10) The alignment of the authorized bulkhead and retaining wall shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Sedimentation and Erosion Control 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 15) All debris associated with the removal or construction of the permitted bulkhead and retaining wall shall be contained within the authorized project area and removed to an appropriate upland location. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to any authorizations required from the U.S. Army Corps of Engineers. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. The applicant states in the project narrative that the purpose of replacing the bulkhead will be to alleviate the concerns of the failing bulkhead and to prevent tidal water from frequently flooding the water. The agent has stated he cannot replace the bulkhead in the original footprint due to erosion concerns. The applicant has demonstrated an attempt to minimize impacts to coastal wetlands by scaling back the alignment landward from their original proposal. Use Standards for Bulkheads and Shore Stabilization Measures states "the bulkhead alignment extends no further below approximate mean high water or normal water level than necessary to allow recovery of an area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from unusual geographic or geologic features". In general, the Town of Carolina Beach allows development in Developed classified AECs which is consistent with the State's minimum use standards. The Town of Carolina Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the CAMA Major Permit and General Permit(s) 198000291 or 197800056 issued by the US Army Corps of Engineers (USACE). This Certification allows you to use the CAMA Major Permit when the Division of Coastal Management issues it. In accordance with the attached General Certification #4175 (GC 4175), the impacts described in your application do not require written authorization to utilize GC 4175. However, you are required to follow the conditions listed in the attached certification. You should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations. This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as OAH). A petition form may be obtained from the OAH at htto://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-3000 for information. Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition is considered filed when the original and one (1) copy along with any applicable OAH filing fee is received in the OAH during normal office hours (Monday through Friday between 8:00am and 5:00pm, excluding official state holidays). PROJECT DESCRIPTION: The project is located at 211 Florida Avenue, adjacent to the Carolina Beach Yacht Basin/Myrtle Grove Sound, in the Town of Carolina Beach, New Hanover Co. To locate the project site from the Wilmington Regional Office (WiRO), travel from Wilmington to Carolina Beach south on College Road (NC Hwy 132) to Carolina Beach Road for approximately 12 miles south. Continue over Snows Cut Bridge on N. Lake Park Blvd. for approximately 1.2 miles south until you reach Carl Winner Drive. Turn left onto Carl Winner Drive until you reach Canal Drive. Turn left on Canal Drive and continue north approximately 1.3 miles until you reach Florida Avenue, which will be located on the left. Continue traveling on Florida Avenue until you reach the project site on the left. The property parcel is approximately 0.49 acres in size (21300 SF) and features approximately 90 LF of shoreline frontage along the Carolina Beach Yacht Basin. The upland portion contains an existing single family residence and driveway, ornamental grasses and vegetation. The shoreline is currently stabilized with a deteriorating bulkhead. Waterward of the bulkhead, there is coastal wetlands vegetation consisting primarily of smoorth chordgrass (spartina alternii fora), and black needlerush (juncus roemerianus). Within the coastal wetlands vegetation and immediately waterward of the bulkhead, there is a large amount of concrete rubble and debris fill, most likely placed in the wetlands several decades ago based on biofouling and appearance. The current docking facility consists of a fixed pier (58' x 5') extending from the high ground in a waterward direction and leading to a u-shaped floating dock. The U shaped floating dock is comprised of three sections. The first section (40'x6') is parallel with the pier alignment. From the landward, north side of the floating dock, another section (6' x 30') extends parallel with the shoreline, and lands on another section of floating dock, (6' x 40') extending perpendicular to the shoreline. Currently the facility accommodates at least 4 vessels. CAMA General Permit 76425D, issued 7/l/20, authorized the replacement of the fixed pier portion in its original footprint. The Town of Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Carolina Beach Yacht Basin are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to install a new vinyl bulkhead 1' waterward of an existing deteriorating bulkhead, and construct a retaining wall along the southern property line. According to the application materials, the proposed bulkhead would be 90 feet in length. The applicant's, agent originally proposed an alignment 2' waterward of the existing bulkhead, but based on comments from NC DWR and USACE regarding coastal wetland impacts, the proposal has scaled back to the current requested alignment (V waterward) to limit impacts on coastal wetlands. The project narrative submitted by the agent indicates that the new bulkhead (with a higher vertical height), will prevent high tides from frequently flooding the property, as is the case with the current, lower bulkhead. The applicant's agent is also proposing a retaining (return) wall, 50 feet in length, roughly 15" above grade, and F below grade along the southern property boundary, aligned perpendicular to the shoreline. The requested alignment for the proposed retaining wall would follow the existing walkway and access pier, along the property line, and not impact 404 wetlands, which are adjacent to the walkway. The project narrative provided in the application states that the applicant intends to stop frequent flooding on the property during high tides, due to the low profile of the current bulkhead and lack of retaining wall along the side of the property.
