I'dini'Nass NEW Pcrmit Numhcr 35-21 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Vermit for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Charles Sprague, 401 Beards Creek Dr., Arapahoe, NC 28510 Authorizing development in Pamlico County at adj. to Beards Creek, at 401 Beards Creek Dr., near Arapahoe , as requested in the permittee's application dated 8/19/20 (MP-1,2) and 10/22/20 (MP-4), incl all workplan drawings (4), Page 2 of 12 dtd 10/30/20, Pages 5,6 of 12 dtd 8/20 and Boat Lift Awning dtd 9/2/20. This permit, issued on March 31, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation m mese terms may oe sunJect to noes, imprisonment or Civil action; or may cause me permit to be null and void. 1) In accordance with commitments made by the permittee and in consultation with the appropriate resource agencies, any and all reference to the originally proposed in -water disposal of dredge spoil and Coastal Wetland planting in the attached permit application and workplan drawings is hereby considered null and void. Excavation 2) No excavation shall take place outside of the area indicated on the workplan drawings. 3) Excavation shall not exceed -4.5 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. APR 26 2021 j f CM-MHD CITY Signature of Permiuee Charles Sprague Permit No. 35-21 Page 2 of 4 ADDITIONAL CONDITIONS 4) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 5) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 6) This permit does not authorize any fill or excavation of Coastal Wetlands. Spoil Disposal 7) No spoil material shall be placed within 30 feet of the normal water line. 8) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the site is graded and stabilized. 9) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. Maintenance Clause 10) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. Docking Facility Expansion 11) This permit authorizes only boatlift and canvas awning, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 12) This permit authorizes one (1) additional formalized boat slip for a maximum of two (2) formalized boat slips at this docking facility. ...0a Charles Sprague ADDITIONAL CONDITIONS Permit No. 35-21 Page 3 of 4 13) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the authorized workplans. 14) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 15) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 16) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. Boat Ramn 17) Unless specifically altered herein, this permit authorizes one hog slat boat ramp, as indicated on the attached workplan drawings. 18) Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. USACE Conditions 19) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at httns://www.fws.2ov/ralei¢h/i)dfs/ManateeGuidelines2Ol7.ydf. General 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 21) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 22) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-02011) issued 3/31/21. NOTE: The N.C. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Neuse River buffer regulations in place at the time of such development. NOTE: An application processing fee of $400 was received by DCM for this project. The proposed project is located at 401 Beards Creek Drive, Arapahoe, Pamlico County, North Carolina. The applicant is proposing to install an additional 16 foot by 20 foot boat lift along the northern side of an existing finger pier, install a canvas covered roof over the existing boat lift, and excavate 770 square feet of creek bottom in order to install a boat ramp. The excavated material would be placed in front of the existing coastal marsh and replanted with marsh species plants in hopes of widening the wetland area. DMF has concerns with the placement of excavated materials being placed over potential SAV and/or wetland habitat, potentially resulting in a habitat conversion. Per discussion with NCWRC staff, the applicant has agreed to remove the portion of the project involving placement of excavated material into the wetlands area, and will instead place material on a different area of the property. Overview: The project location is at 401 Beards Creek Dr. on Beard Creek in Arapahoe, NC in Pamlico County. The .68-acre lot has ±125 feet of shoreline. Existing onsite development includes one single family dwelling, a dock with one slip, boatlift, bulkhead, retaining wall and paved driveway that extends to the back portion of the lot where the proposed boat ramp would begin. Current water depth, where ramp is proposed, at NWL are 7" at 10' waterward to 32" at 50' waterward. Beyond this, the water level drops to 54" and greater out past the existing boat lift. The applicant is proposing install an additional 16' x 20' boat lift along the north side of existing finger pier. This would bring the total number of slips to two. The existing boatlift would then be covered by a canvas covered roof measuring 12' x 29.5'. The applicant proposes to excavate an area waterward of the excluded section of bulkhead and along the south side of the pier 11 ft. x 70 ft. to a maximum depth of 54" to create a boat ramp. This is approximately 770 square feet of creek bottom. Existing grade landward will be leveled to 10 degrees and 2x10 ft. concrete hag slats will be used to form an approach to the ramp. Five 5x10 ft. hog slats will be placed waterward of NWL at the same grade to produce the ramp. Beyond this out to 70 ft., 2x10 ft. hog slats will be used to extend the ramp. The applicant proposes to redistribute the approximately 25 cubic yards of spoil waterward of the existing coastal marsh and plant the area in coastal species in hopes to widen the wetland area. Areas of Environmental Concern affected include: Public Trust Shoreline (PTS), Estuarine Shoreline (ES), Estuarine Waters (EW) and Public Trust Areas (PTA). Beards Creek is classified as SC;Sw;NSW. Submerged Aquatic Vegetation (SAV) was not observed during the site visit on 7/28/2020. The application package states that Coastal Wetlands are present, and two areas of coastal marsh exist in front of the bulkhead on the north side of the pier and beyond the bulkhead to the property line on the south side. The project is subject to the Neuse River Riparian Buffer Rules. The presence of non -coastal wetlands, and cultural/historic resources was not indicated in the field report. Anticipated impacts resulting from this project are expected to include: The project will create localized turbidity from installing the boatlift pilings and excavation of the ramp area to grade. The project will have a total of770 square feet of disturbance to shallow bottom. A total of 25 cubic yards of spoil will be placed back into adjacent shallow bottom area and graded to create habitat conducive to planting coastal wetland species. Current platform area is 550 sq. ft. and the addition of boat house awning will add 377 sq. ft. for a total of 927 sq. ft. of platform. Basis for Determination: The project is subject to the Pamlico County Joint CAMA Land Use Plan. The Future Land Use Map (FLUM) classifies the site as "Rural with Services", "Conservation I" (due to Estuarine Waters AEC), "Conservation II" (due to the properties shoreline that border Estuarine Waters and Public Trust Waters). Three of the four conservation land use designations defer to CAMA use standards. • Conservation I - "The purpose of this classification is to protect and to assist in the long- term management of the county's estuarine and public trust waters.... The counties primary goal is to "(1) to allow only those water uses and land uses in this classification that are consistent with conservation of these waters; and (2) to protect the public's rights to access, navigation and recreation. The county also allows development activities in this classification that require water access and that cannot function elsewhere, if these uses are designed, developed, and operated in a manner that is consistent with the primary goal. Examples of these uses include erosion control structures, docks and piers, marinas, and mooring pilings. • Conservation II - "establishes a permanent conservation zone for all land within 75 feet of the natural mean high water level for all shorelines bordering primary nursery areas, estuarine waters, and public trust waters. Man-made ditches, canals, and basins are excluded from this classification ...... All construction activities are prohibited in this zone, except forthose permitted underthe CAMA use standards for estuarine waters and coastal wetlands". The policy is not intended to apply to forestry operations that comply with "best management practices." 2.3.3.3 The conservation zone applies to all subdivisions of land after January 26, 1990, regardless of the intended use, and to all divisions of land after the certification of this plan. 5.0 Water Quality 5.1 The county recognizes the importance of water quality to preserving the life-style and economic well being of its residents and property owners and will implement measures to address both point -source and non -point source discharges in order to protect and restore water quality. 5.1.1 The county will continue to enforce a 75-foot permanent conservation zone along its water bodies. The applicant proposes to use the excavated spoil to increase the area of wetland vegetation waterward of the existing bulkhead along the property. Charles E. Sprague 9/22/2020 401 Beards Creek Drive Arapahoe, NC Pamlico County Prolect setting: Mr. Sprague has submitted a CAMA Major Permit application to install a private boat ramp, excavation, fill for coastal wetland planting, additional boatlift and construction of roof over existing boat lift on his property located at 401 Beards Creek Dr. on Beard Creek in Arapahoe, NC in Pamlico County. The .68 acre lot with +- 125 feet of shoreline, consist of one single family dwelling, various trees and shrubs, and a paved drive extending into the back portion of the lot where the proposed boat ramp would begin. Most of the property and all the structures are +11 ft. above normal water level. +- 75 ft. of the shoreline is stabilized with existing bulkhead along with some of the high ground stabilized with retention walls. An existing pier extends 90 ft. waterward of the bulkhead and has one existing boatlift on the south side, a 10x30 ft. L-Head platform turning north, and 5x28 ft. finger pier off of the platform. Directly adjacent to the south side of the pier, is a 15 ft. section of bulkhead left open and stabilized with return walls. This area was left out of original bulkhead permit in anticipation of installing a boat ramp. This area has been washed out during previous storm events. Mr. Sprague has stabilized the area with temporary silt fencing. Two areas of coastal marsh exist: in front of the bulkhead on the north side of the pier and beyond the bulkhead to the property line on the south side. Current water depth, where ramp is proposed, at NWL are 7" at 10' waterward to 32" at 50' waterward. Beyond this, the water level drops to 54" and greater out past the existing boat lift. Adjacent to the property both upstream and downstream are other developed residential lots. This section of Beards Creek is listed as inland waters and classified SC,,Sw,NSW by the Environmental Management Commission. It is in the Neuse River Basin. No SAV was observed during site visit on 7/28/2020 and the site is not in a PNA. Prolect description: The applicant proposes to install an additional 16' X 20' boat lift along the north side of existing finger pier. This would give Mr. Sprague a total of two slips. The applicant proposes to install a canvas covered roof over the existing boat lift measuring 12' X 29.5'. The applicant proposes to excavate an area waterward of the excluded section of bulkhead and along the south side of the pier 11 ft. x 70 ft. to a maximum depth of 54" to create a boat ramp. This is approximately 770 square feet of creek bottom. Existing grade landward will be leveled to 10 degrees and 2x10 ft. concrete hog slats will be used to form an approach to the ramp. Five 5x10 ft. hog slats will be placed waterward of NWL at the same grade to produce the ramp. Beyond this out to 70 ft., 2x10 ft. hog slats will be used to extend the ramp. The applicant proposes to redistribute the approximately 25 cubic yards of spoil waterward of the existing coastal marsh and plant the area in coastal species in hopes to widen the wetland area. The project will have a total of 770 square feet of disturbance to shallow bottom. Current platform area is 550 sq. ft. and the addition of boat house awning will add 377 sq. ft. for a total of 927 sq. ft. of platform. Sprague & Dianne Conrad (spouse) 401 Beards Creek Drive Arapahoe, NC 28510 August 19, 2020 (610)496-2703 At the time we purchased this property in Pamlico County (E091-81) in April of 2005, we had a conversation with Brad Connell, Coastal Field Representative for the Division of Coastal Management regarding the unique aspects of the lot, including a natural sloping path from the street to the water. This feature lends itself very readily to use as a boat ramp. During construction in 2013/2014, appropriate retaining walls, marine bulkheading, dock, 13k boat lift and a boat ramp well were all installed and the general approach slope was established. The current intention is to add an awning to our exiting boat lift, add a second (24k 6-post) boat lift and finish the boat ramp and make it operational for the type of boat(s) that we currently own and intend to own in the future. The bottom contour is such that excavation of roughly 23 yards will be needed to achieve the necessary ramp profile and provide access to the deep water in Beards Creek. As a method of minimizing impact, we propose excavation of only the minimum amount of material necessary and distributing that material immediately waterward of existing coastal wetlands so as to provide areas for the planting of additional coastal wetlands vegetation species. We also propose using precast hog slats as the load -bearing surfaces, placing those slats in such a manner as to minimize the area of covered bottom. We have met with the current DCM Field Representatives and discussed best practices and options as set forth in the attached DCM MP-1 and MP-2 applications. We are open to any suggestions or proposals that will help move this project to completion.
