Spivey, 820 Santa Maria Ave., Wilmington, NC 28411 Authorizing development in New Hanover County at adj. to Pages Creek. at 820 Santa Maria Ave.. in Wilmington as requested in the permittee's application dated 3/11/21, including attached workplan drawings (3), Sheets 1-2 of 3 dated 11/16/20, and Sheet 3 of 3 dated "Received DCM Wilmington 3/8/21. This permit, issued on July 8, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation Dr mese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion 1) This permit authorizes only the access pier extension and floating platform, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this •docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions) Phis permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Spivey Permit No. 84-21 Page 2 of 3 ADDITIONAL CONDITIONS 3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 4) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 5) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 6) This permit authorizes an additional two (2) slips for a maximum of six (6) formalized boat slips. Four (4) formalized boat slips shall be located at the eastern expanded docking facility and two (2) formalized boat slips shall be located at the existing western docking facility. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. Access Stairs within Easement 8) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the docking facility access stairs within the deeded easement, all as expressly and specifically set forth in the attached permit application and workplan drawings. USACE / FEDERAL CONDITIONS 9) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.12df. General 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 13) All debris associated with the construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 197800056 (Action ID SAW-2021-00693). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0832. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water. NOTE: An application processing fee of $250 was received by DCM for this project. Jerry & Teresa Spivey Page 2 9. PROJECT DESCRIPTION: The project site is located at 820 Santa Maria Avenue in Wilmington, adjacent to Pages Creek in New Hanover County. To locate the property, travel north on Market Street (US Hwy 17) and turn left onto Porters Neck Road and travel approximately 0.9 miles to the round -a- bout and take the first exit onto Edgewater Club Road. Travel approximately 1.2 miles down Edgewater Club Road and turn right on to Spring Peeper Lane and travel 0.1 miles to the T and then take a left onto Wild Cherry Lane. Travel down Wild Cherry Lane for approximately 217' then turn right, back onto Spring Peeper Lane. Travel approximately 0.1 miles down Spring Peeper Lane and turn right onto Santa Maria Avenue and the destination will be approximately 141' down on the left. The project area is associated with a 0.81 acre parcel with a single family residence and 2 sets of retaining walls to terrace the property that averages 12' above normal high water (NHW). The property is bordered to the west and east by residential homes that have existing docking facilities, to the north is undeveloped land, and to the south is Pages Creek. Upland vegetation on the property currently consists of hard wood trees such as live oaks and hickory trees as well as lawn grasses and ornamental landscaping. The approximately 128 linear feet of shoreline frontage is currently stabilized by a concrete bulkhead with a concrete walkway on top that ranges in width from 4' to 8.5' that was installed around 1982. Located in front of the bulkhead is scattered rubble within a strip of Coastal Wetlands approximately 10' wide consisting primarily of smooth cordgrass (Spartina alterniflora). Waterward of the Coastal Wetlands is a historically dredged access channel that gains depth quickly. The applicant currently maintains an existing private docking facility that was partially rebuilt after Hurricane Florence under General Permit # 73501 D, which was issued on 3/15/2019 and expired on 10/2012019. The re- built configuration was based on a previous State Permit # 30-96 and includes two access piers, one extending from the western side of the property approximately 13' over the Coastal Wetlands into open water to a roofed gazebo approximately 14' by 14' extending over openwater to the east. Waterward of the gazebo is a small 6' by 3' access pier extension that connects the ramp down to the approximately 28' by 8' floating dock positioned parallel to the shoreline. On the eastern end of the 28' by 8' floating dock is an additional 12' by 8' floating dock that extends landward perpendicular to the shoreline. The second access includes a 12' by 6' pier that extends from the bulkhead on the eastern side of the parcel to 34' by 6' fixed pier that extends west parallel with the shoreline. A ramp extending from the western end of the fixed pier connects to an 8' by 20' floating dock positioned perpendicular to the shoreline. The previous State Permit, #30-96 included one additional floating dock that is included in the proposed project described below. State Permit#30-96 was issued on March 8,1996 and expired on December 31,1999. The existing docking facility currently accommodates up to four (4) vessels (See Sheet 2 of 3). The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacentwaters and high ground portion at the property as Conservation. The waters of Pages Creek in the project area are classified as SA-HQW by the Division of Water Quality. They are designated as Permanent Secondary Nursery Area but NOT as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to expand the existing docking facility by adding another floating dock and a small fixed pier extension to support access to the proposed floating dock for a total of six (6) boat slips. The docking facility authorized by the previous State Permit #30-96, was intended to add slips to serve the Jerry t£ Teresa Spivey Page 3 parcels that were subdivided by the applicant. After a partial rebuilding following Hurricane Florence damage the applicant is proposing to add one floating dock to complete the previously authorized configuration. The proposed expansion would include extending the parallel fixed pier an additional 6' by 6' in an easterly direction. The proposed floating dock would be approximately 20' by 8' in a perpendicular position to the shoreline extending from the area of the 6' by 6' fixed pier expansion on the eastern side of the parallel fixed pier to provide docking space for up to six (6) vessels. The width of the water body is approximately 370' wide to the marsh grass / oyster bar island and according to the applicant the current docking facility extends 52' from the bulkhead into openwater with the proposed structure not exceeding this length. Water depths in the area of the existing 8' by 20' floating dock ranged from 2.1' to 5.2' based on the DCM site visit during low tide on March 24, 2021. Additional proposed highground impacts include stairs in the easement on the east side of the property for the landward parcels that are granted boat slips. The stairs would be drip through material measuring approximately 6' wide by 15' long connecting the existing bulkhead to the highground (see Sheet 2 of 3). 11. ANTICIPATED IMPACTS: The proposed structures would incorporate approximately an additional 160 ft2 of Estuarine Waters and Pubic Trust Area, shade approximately 36 ft2 of Coastal Wetlands, and disturb approximately 90 f12 of highground in the buffer. The proposed structure would not extend further into the waterbody than the existing docking facility. The proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area. Minor increases in turbidity should be expected during construction.
