This permit, issued on January 19, 2022 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

1) This permit authorizes only the reconfiguration of the docks, lifts and other structures and uses
located in or over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the established pier -head line.
(See attached sheet for additional conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is 'consistent with the North Carolina Coastal
Management Program.

3) The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the
authorized workplans.
4) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches are
permitted. Lattice is specifically excluded from being used under this authorization.
5) The roof of the covered platform/boathouse shall not be designed for second story use.
6) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
7) This, permit does not authorize any additional formalized boat slips.
General
8) All debris associated with the removal or construction of the permitted marina shall be contained within
the authorized project area and removed to an appropriate upland location.
9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
10) This Minor Modification shall be attached to the original Permit No. 93-21, which was issued to the
permittee on 7/20/21, as well as all subsequent modifications, refinements, and renewals, and copies of
all documents must be readily available on site when Division personnel inspect the project for
compliance.
11) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the project Action ID SAW-2021-01143.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2021-0983.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project._

Mr. Rick Penny, agent for the permittee — Timothy Sloan, has submitted a request to modify CAMA
Major Permit No. 93-21, which was issued on July 20, 2021, and is scheduled to expire on December 31,
2024.
The permittee is requesting approval to re -configure the authorized docking facility which is located
along the AIW W, within the waters of Topsail Sound, in Hampstead, Pender County.
As proposed, the permittee would alter the layout of the 4-slip docking facility, while remaining within
the authorized footprint. Essentially, the permittee is requesting to "flip-flop" the terminal end of the
docking facility, by placing the floating dock and single boatlift along the northern side of the access pier
(location of pier to remain the same). As a result, one of the permitted 13' x 13'boatlifts (along the
northern side) would be re -located to the southern side of the access pier, along the inshore section of the
fixed finger pier, and the authorized boathouse (18' x 35') would be shifted to the south to cover the other
13' x 13' boatlift.
The proposed changes are not quite a mirror image of the permitted docking facility, but the re -design
would stay within the existing footprint, and would not create any additional slips. However, the changes
would place the 12' x 12' jet -ski boatlift in an area that was previously void of development, but water
depths at this location are reported to be approximately -2'8" @ NLW so no additional impacts to SAV of
shallow bottom habitat would be expected. Additionally, the proposed changes would result in an increpse
in total platform area (approximately 48 sq. ft.), which appears to be within the 8 sq. ft./per If of shoreline
Rule allowance.
Based on the information provided, regarding the minor modification request (plans and documents),
there does not appear to be any impacts to any wetlands, and the size/footprint of the development plan
would remain consistent with DCM's Rules concerning the Estuarine Shoreline and Public Trust AECs.
At this time, this office has no objection(s) to this renewal request. The applicant has submitted a check
(No. 1930) in the amount of $100 to cover the processing fee.

The configuration of the boat house, floating dock, and the boat lifts have been modified as
shown on the attached drawings. The number of slips has not changed, and the projects area
calculations are shown below.

Floating Dock: 192 SF
Finger Pier: 150 SF (Increased from 102 SF)

Shoreline from survey = 132 linear Feet x 8 = 1056 SF allowable.
The adjacent neighbors have been notified and have signed the Adjacent Riparian Property
Owner Statements with no objections.
