AIWW in Supply , as requested in the permittee's application dated 7/30/21,
including attached workplan drawings (4); Sheets l & 2 dated "8/5/21", Sheets 3 & 4 dated "revised 9/1/21 ".
This permit, issued on November 15, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Docking Facility Expansion
I) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) This permit authorizes reduction in formalized boat slips from 5 to a maximum of 4 formalized boat
slips at this docking facility.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the pernittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six
feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured
from the bottom of the decking.
5) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings. -
6) No portion, of the permitted structure shall be located within 80 feet of the near bottom edge of the
federally maintained AIW W channel.
7) , No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the docking facility shall be considered a violation of this permit
for which the permittee is responsible. This prohibition shall be applied and enforced throughout the
entire existence of the permitted structure.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
USACE Conditions
10) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to.all requirements therein.

General
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) All construction debris associated with the removal or construction of the permitted docking facilities
shall be contained within the authorized project area and disposed of in an approved upland location.
13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2021-01997).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 20211385.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the mean high-water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

and the 15ft. riparian setback rule. The docking facility would be located entirely over open water.

The applicant is proposing to extend the length of the existing docking facility to the edge
of the USACE setback and install a floating dock, boathouse, and two boatlifts for a total
of four formalized slips along the AIWW. The project is located at 825 Salt Water Lane
SW, on the mainland side of Holden Beach on the AIWW in Supply, Brunswick County.
Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine Waters
and Public Trust Area. Waters at the project site are classified as SA; HQW and are open
to the harvesting of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2007 Brunswick County Land Use
Plan and offer the following comments.
The general area of the project is classified as LDR.
In general, Brunswick County allows development in LDR classified AECs which is
consistent with the State's minimum use standards. The Brunswick County Land Use
Plan contains some policies, which exceed the State's minimum use standards. However,
none of these standards appear to be applicable to this proposal.

9. PROJECT DESCRIPTION

The proposed project is located on the AIWW at 825 Salt Water Lane SW, on the mainland side of Holden
Beach in Supply, Brunswick County.
The property can be reached from Wilmington by traveling south on NC HWY 17 towards South Carolina.
Continue 30 miles south on NC HWY 17 and make a left turn onto Stone Chimney Rd SW and drive for 5.9
miles. Turn right onto Glenmora Ave SW and then take a left onto Loreauville Dr SW. Continue down and take
a left onto Natchez St SW. Continue straight onto Beauregard Ave SW and then onto Island View Rd SW. Then
turn right onto Salt Water Lane SW and the project site will be on the left.
Existing structures on the project site include a single family residence, bulkhead, and a 5-slip docking facility
located on the south side of the property. The project site is approximately 0.6 acres and is vegetated primarily
with domestic grasses and native trees. According to the application, high ground is elevated approximately 7'
above the normal high water (NHW) level, and the shoreline (+/- 118 linear feet) is stabilized by a bulkhead.
High Marsh Coastal Wetlands within the applicant's riparian corridor include a 35' deep swath of Black
Needlerush (Juncus roemerianus) and Salt Meadow Cordgrass (Spartina patens) that extends from the edge of
high ground out to the normal high water mark. The Low Marsh extends approximately 155' waterward of the
High Marsh and consists of a dense stand of Smooth Cordgrass (Spartina alternii lora).
The applicant's existing docking facility starts on the high ground and extends south into the AIWW. A 243' x
4' access pier (208' as measured from NHW) leads to a 20' x 14' gazebo with a 16' x 26' boathouse (Slip #5,
Sheet 1 of 4) off the west side of the gazebo. Open decking measuring 3' wide borders the west side of the
gazebo and the north side of the boathouse. A 2' x 26' open deck borders the south side of the boathouse and
gives access to an open boatlift (Lift #4, Sheet 1 of 4). To the south of the gazebo is a 6' x 9' open platform
with PWC lifts on both sides (Slips #2 and #3, Sheet 1 of 4). The open platform gives way to a ramp and 8' x
16' floating dock (Slip #1, Sheet 1 of 4) which is located approximately 27' landward of the USACE Federal
Channel Setback.
Residential properties border the project site to the east and west, Salt Water Lane SW borders the property to
the north, and the AIWW runs along the southern bounds of the property. According to the applicant, the width
of the AIWW measures approximately 442' from the edge of the applicant's marsh to the edge of marsh
opposite the project site. The existing docking facility extends approximately 103' into the Shallotte River (as
measured from the edge of marsh) or approximately 23% of the waterbody width. Permit history at this property
includes GP 28313 issued on 10/23/2001 for a bulkhead and 2 slip docking facility and a rewritten permit (GP
28317, issued on 11/7/2001) that included the addition of the existing boathouse. It should be noted that the
design of the existing docking facility does not match the permitted design on GP 28317. Also, the property
address appears to have been changed from 825 Nazar Ave, Supply to 825 Salt Water Lane SW, Supply since
the previous permit was issued.
The waters of the AIWW are classified SA by the Division of Water Quality and ARE NOT designated as a
Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. This site is OPEN to the harvest of
shellfish. Based on visual observations made by DCM staff during the August 2021 site visit, there appears to
be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. According to the applicant, water
depths in the vicinity of the existing docking facility range from 2' NLW near the boathouse to >3' NLW at the
waterward end of the floating dock. Water depths were confirmed by DCM staff during the August 25, 2021
site visit. According to the applicant, tidal amplitude in the project area is approximately 4ft. between NLW and
NHW.

PROPOSED PROJECT
The applicant proposes to extend the length of the existing docking facility to the edge of the USACE setback
and install a floating dock, boathouse, and two boatlifts for a total of four formalized slips along the AIWW.
The applicant proposes to extend the existing docking facility waterward approximately 27' to match the
western pier head line at the edge of the USACE 80' Federal Channel Setback. The applicant proposed to install
a 4' x 16' fixed walkway to the south of the existing 6' x 9' open platform that leads to a gangway and 6' x 16'
floating dock (Slip #1, Sheet 3 of 4). A proposed 16' x 16' boatlift (Slip #2, Sheet 3 of 4) would be located to
the west of the 6' x 16' floating dock and extend waterward to the edge of the USACE 80' Federal Channel
Setback. The applicant is also planning to remove the 2 existing PWC from the docking facility and increase the
size of the existing open boatlift from 6' x 8' to 12' x 12' (Slip #3, Sheet 3 of 4). Lastly, the applicant has
proposed to reconfigure the existing boathouse cradle to hold a PWC rather than a boat (Slip #4, Sheet 3 of 4).
Water depths in the vicinity of the proposed floating dock and boatlift (Slips # 1 and #2, Sheet 3 of 4) range
from -2' NLW to -3+' NLW. As proposed, the docking facility would be located within the applicant's area of
riparian access and not encroach into either adjacent neighbor's 15' riparian setback.
According to the application, the waterward edge of the proposed docking facility would be built at the pier
head line and would not encroach into the USACE 80' Federal Channel Setback. As proposed, the docking
facility would exceed the '/. width, extending approximately 130' beyond the edge of marsh to approximately
29% of the waterbody width.
10. ANTICIPATED IMPACTS
Although the proposed design would reduce the total slip count from 5 to 4, it would result in the incorporation
of an additional 560 sq. ft. of Estuarine Waters and Public Trust Area. As proposed, the docking facility would
exceed the'/, width of the waterbody but not the UP width. The waterward end of the docking facility would
terminate at the western pier head line and the edge of the USACE 80' Federal Channel Setback. The proposed
4-slip docking facility would be located over an area of open water (-2' to -3+' NLW) within the existing
docking facility footprint. The applicant has received a signed waiver to encroach into the eastern 15ft. riparian
corridor setback. Turbidity associated with the piling installation would be kept to a minimum.

addition to the existing docking facility. The existing docking facility has two jet ski lifts, a floating
dock, and a 10,0001b boat lift under a roofed structure. The proposal is to extend a pier walkway
(-16 linear feet) from the existing fixed platform waterward to a 6' x 16' floating dock adjacent to a
16' x 16' boat lift. This proposal is designed to give the greatest water depths without crossing the
USACE Federal Navigation Channel Setback. A jet ski platform is to be placed under the roofed

addition to the existing docking facility. The existing docking facility has two jet ski lifts, a floating
dock, and a 30,00DIb boat lift under a roofed structure. The proposal is to extend a pier walkway (-16
linear feet) from the existing fixed platform waterward to a 6' x 16' floating dock adjacent to a 16' x
16' boat lift. This proposal is designed to give the greatest water depths without crossing the USACE
Federal Navigation Channel Setback. A jet ski platform is to be placed under the roofed structure and
a boat lift for a skiff (12' x 12') is to be located waterward of the roofed structure (see drawings 1 of 2
and drawing 2 of 2).

The Division of Coastal Management hereby acknowledges receipt of your application for State approval for the
addition and reconfiguration of an existing docking facility located at 825 Salt Water Lane SW, Supply, Brunswick
County, NC. It was received complete on September 21, 2021 and appears to be adequate for processing at this
time. The projected deadline for making a decision is November 16'", 2021. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a final action
by the initial deadline stated above, you should consider the review period extended. Under those circumstances,
this letter will serve as your notice of an extended review. However, an additional letter will be provided on or
about the 75th day.
If this agency does not render a permit decision within 70 days from September 2nd, 2021 you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such
a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
