Ross, 118 Fairway Dr., Washington, NC 27889 Authorizing development in Beaufort County at adj. to Broad Creek and the Pamlico River, at 816 McCotters Marina Rd., in Washington as requested in the permittee's application dtd 4/8/21 (MP-112) and 2/7/21'(MP-4), incl att workplan drawings (2), Sheets 1-2 of 2 both dtd "Surveyed and Drawn October 2020". This permit, issued on July 1, 2021 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation u tnese terms may oe suolect to rmes, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization - Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Ross Permit No. 82-21 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The fill material shall be clean and free of any pollutants except in trace quantities. 8) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 9) No backfill material is to be placed within 30 feet of the normal water level, except that which will be used to backfill the area behind the permitted bulkhead. 10) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 13) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Docking Facility 14) This permit authorizes only the docks, piers, boathouse and boat lifts, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 15) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 16) This permit authorizes a maximum of 3 formalized boat slips. Ross ADDITIONAL CONDITIONS Permit No. 82-21 Page 3 of 3 17) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the authorized workplans. 18) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 19) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 20) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. General 21) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 22) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 23) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2021-00786). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0267. NOTE: Future development of the pernuttee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal high water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations in place at the time of such development. NOTE: An application processing fee of $400 was received by DCM for this project. Also a wood pier and boathouse will be built in the river. The pier pilings will be driven with a hydraulic excavator. Also included in his application is the proposed installation of a pier with platform, boathouse, boatlift and additional jet ski lift located at his property off SR# 1134 at 816 McCotters Marina Rd. in Washington, Beaufort County, North Carolina. This office has reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in an Estuarine Water and Public Trust Area. It is staff s recommendation that the proposed project is consistent with 07H.0208 (6)(B) which states in part "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet." Mr. Ross' proposal includes a 400ft2 platform and a 544ft2 boathouse making his total shading impact 944ft2 of his allowed 1184ft2. The project is also consistent with rules found in 15A NCAC 07H.0208 (7)(13)(i) which state in part, "the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads", (ii) "the bulkhead alignment extends no further below normal water level than necessary ....to align with adjacent bulkheads", (iii) "the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners", (iv) "the need for a bulkhead below normal water level is documented by the Division of Coastal Management". It is also staffs recommendation that the proposed project is consistent with 15A NCAC 07H .0209 (e) which states "The buffer requirements in paragraph (d) of this rule shall not apply to Coastal Shorelines where the EMC has adopted rules that contain buffer standards". Seeing how everything looks certainly helps me out, and I think that this alleviates the concerns that were mentioned in the comments previously submitted. It doesn't appear that this project will result in any impacts to SAV; therefore, the previous recommendations to minimize SAV impacts are no longer necessary. In regard to the bulkhead, as the neighboring property already has a bulkhead, concerns with this structure are minimal. Based on discussion with Ashley the white string noted in a few pics is generally the alignment of the bulkhead as proposed. In pic titled "Ross 3" it is slightly waterward and you can see where the adjacent bulkhead ends, which is where Ross intends to connect. Ashely did not see any SAV up to approximately 75ft offshore and did not encounter while in the water. The sediment is has a lot of slick clay. In the pics -1�4 you can see there is minimal tree debris and most is above the NWL. Maria did not have any concerns with the project as proposed as well. Hope this helps and let me know if this alleviates your concerns detailed in your previous comments. DCM does not have any issues as proposed beyond standard conditions for bulkheads and docking facilities. The proposed work is located at 816 McCotters Marina Road, Washington, within Beaufort County, North Carolina. The applicant is proposing to construct a 148 linear feet vinyl bulkhead that tie into the bulkheads of the neighboring properties, and backfill behind the bulkhead. The bulkhead would be positioned an average of 24' from the normal water line (NWL), with a maximum of 38' from NWL in the most heavily eroded area. Additionally, the applicant is proposing to construct a 6' by 180' pier with a 20' by 20' platform, 13'by 13' boatlift, jet ski lift, and a 34' by 16' covered boathouse. The proposed project occurs within an area that has been designated as Secondary Nursery Area (SNA). SNAs are waters in which the later stages of juvenile development take place. These areas are often transition zones, and species found within these areas often include a diverse mix of juveniles, sub -adults, and adults. The shallow waters of SNAs provide fish species with the necessary ecosystem services for post -larval development, and their protection is critical to ensure growth to maturity for numerous commercially, ecologically, and economically important species. Therefore, DMF would recommend that, if the project is permitted, the permit include a moratorium of 1 April through 30 September for all in - water work. Additionally, although not noted in the application package, this location has a history of supporting submerged aquatic vegetation (SAV). SAV is an important habitat, providing a variety of habitat services for species, including nursery, forage, and refuge. Many of the species benefitting from these services are those that are also protected by the nursery area designation noted above. Furthermore, SAV provides numerous benefits to the surrounding area, including shoreline stabilization, natural wave energy reduction, nutrient uptake, and water quality improvements. In order to prevent further erosion on the site, DMF would recommend that, rather than a bulkhead connecting to the neighboring properties, the applicant utilize riprap along the existing shoreline. In addition to providing prevention of further erosion, this would provide three-dimensional habitat structure that could be utilized by the fish species that use this area for nursery habitat. If this is not feasible, DMF would recommend that the fill of shallow water habitat be minimized and reduced by shifting the alignment of the proposed bulkhead to be closer to the existing shoreline, and angling the bulkhead to parallel the shoreline. DMF is also concerned with the impact that the proposed structure would have on SAV within the area. Positioning the boathouse over SAV would significantly reduce light availability, one of the most important factors associated with SAV growth. The record of SAV appears to end approximately 145' from the propose bulkhead alignment. Therefore, shifting the position of the boathouse slightly further out would minimize the increased shading this structure would cause. Increases in shading of this area could also be minimized by including building materials that allow better light penetration than traditional building materials, such as grated decking. Lastly, DMF is concerned with the proposed boat and jet ski lifts, and the impact these structures can have. Due to the water depths at this location being less than 4', DMF would recommend that sling -style lifts be used. These minimize the impacts associated with the lift usage by using elements that are less detrimental to the seafloor habitats. If it is not possible to incorporate this type of lift, DMF would recommend that stops be included in the structure design in order to prevent the lift reaching the seafloor during use. Beaufort County Proledsetting Mr. Ellis Ross has submitted a CAMA Major Permit application for the installation of a new bulkhead, pier with platform, boatlift, covered boathouse and jetski lift located on his property offSR#1134 at 816 McCotters Marina Rd. Washington in Beaufort County, North Carolina. There are currently no man- made features on the project site however the site is suited for a single-family residence. There are two lots on site totaling .48 acres or 20,908ft2 in size and has a total shoreline length of ±148 linear feet on the Pamlico River and ranges from 1.0'- 3.0' in elevation above the Normal Water Level (NWL). The lot is a heavily eroding low sediment bank with a sandy beach front rising towards a maintained wooded lot mostly vegetated with a few scattered upland grasses and established pines. The downstream edge of the property abuts rip rap and old bulkhead used for shoreline stabilization the upstream edge of the property abuts a return wall connected to an existing bulkhead also used for shoreline stabilization. This property has the only non -stabilized shoreline west of the point at the mouth of Broad Creek facing the Pamlico River. Both the downstream and upstream properties have bulkheads along with piers, platforms and boatlifts. The upstream and downstream property each have upland development consisting of a single family residence. The Pamlico River is classified as SB NSW by the Environmental Management Commission at the project site. The Pamlico River is classified as coastal fishing waters at this site and the site is not located in a primary nursery area. The property is subject to the Tar -Pamlico Riparian Buffer rules enforced by the N.C. Division of Water Resources. Proiect description The applicant proposes to construct a vinyl bulkhead 148 linear feet extending waterward 5' to attach to the existing vertical return wall on the upstream neighbor's property and extending 5' waterward to match the old bulkhead and rip rap toe on the downstream neighbor's stabilized shoreline. Upon review of this project it was found that the applicant had taken measurements of the area to be filled from the normal high water mark. After a field visit by DCM staff more accurate measurements were taken from NWL to more accurately describe the scope of the project fill area. Using DCM staff measurements, the new bulkhead would extend a minimum of 5' waterward at each end and to a maximum of 38' from NWL in the most heavily eroded area with an average distance of 24' from NWL. This proposed project would result in the applicant filling f3552ft' of river bottom. The applicant also proposes to construct a 6' by 180' pier with a 20' by 20' platform, 13' by 13' boatlift, jetski lift, and a 34' by 16' covered boathouse. The pi e{�tp boathouse and boatlift will be located in estuarine waters and the Public Trust Area. Ashley Grandy — 8 April 2021 RECEIVED APR 12 2021 DCM-MHD CITY Narrative Ellis Ross and Laura Beth Ross are seeking a CAMA major permit for water front property we purchased in May of 2020. We are proposing development of a bulkhead that extends water ward of the normal water level of a maximum of 38 ft. There are several needs for the amount of water ward distance from the existing shore line. The adjacent properties have had bulkheads for the last 20 years which has caused one of the reasons for excessive erosion. When we purchased the property there was full grown trees at the water's edge. After the storms we have had this year the trees were uprooted and we started losing more shore line. After the tree loss the erosion had increased a great bit. Another need for the bulkhead is so that we can connect to each property owner on each side. When we purchased the property there was a septic tank permit that came with the property. It is up to date and current with all state regulations. With the excessive erosion the septic permit could now be in jeopardy according to the buffer zones. The boat house has to be this large to accommodate a 26ft long by 8'6" wide boat which he currently owns. The boathouse will be on the river side extending out a total amount of two hundred feet from shore. The boat house will need to be larger than the 400 sq ft to keep the boat from the weather. The homeowner would like to install a swinger jet ski lift on the pier. Bulkhead will be a vinyl seawall on the river. All projects are to be used for private/family use only. The boathouse will be on the river side extending out a total amount of two hundred feet from shore. The boat house will need to be larger than the 400 sq ft to keep the boat from the weather. The homeowner would like to install a swinger jet ski lift on the pier. Bulkhead will be a vinyl seawall on the river. All projects are to be used for private/family use only.
