Authorizing development in New Hanover County at adi to the Cape Fear River, at 123 & 127
Island Bridge Way, in Wilmington , as requested in the permittee's application dated 11/16/20 (MP-1) and
9/15/20 (MP-4) including attached workplan drawings (4), Sheet 1 of 3 dated "Revised" 2/18/21, Sheets 2-3 of
3 dated "Revised" 2/22/21 and Page 1 of 1 dated 8/24/20.
This permit, issued on June 25, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Reconfiguration
1) This permit authorizes only the reconfiguration of docks, piers, boatlifts, gazebo, and uses located in
or over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this docking facility
reconfiguration without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024

ADDITIONAL CONDITIONS
3) This permit authorizes a maximum of eight (8) formalized boat slips.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
6) Any portion of the permitted access pier and docking facilities built above Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as
measured from the bottom of the decking.
7) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches are permitted.
Lattice is specifically excluded from being used under this authorization.
8) The roof of the gazebo shall not be designed for second story use.
9) Should the lot to the north be sold prior to the initiation of construction of the docking facility, the
permittee shall obtain a written agreement from the new owner(s) waiving the 15 foot riparian corridor
setback and submit it to the Division of Coastal Management prior to initiating construction of the
docking facility.
USACE Conditions
10) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
13) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2021-0502).

ADDITIONAL CONDITIONS
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2021-0568.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

It is the staffs recommendation that the construction of the new private community docking facility,
resulting in the incorporation of 3998 SF of public trust waters, and shading of 168 SF of coastal wetlands,
is CONSISTENT with the Rules of 15 NCAC 7H.0208 (b) (6) Specific Use Standards for Piers and Docking
Facilities.
The application states that the docking facilities would provide docking space for eight (8) vessels at this
location for a total of 8 slips in water depths of -5.0' to -6.0' @ NLW. The proposed structure would be
located over open water and encroach into the riparian corridor setback of the northern riparian property

The applicant proposes to construct, replace and reconfigure an 8-slip docking facility
damaged by Hurricane Isaias to include an access pier. Fixed covered gazebo, four (4)

Fear River. The project is located off River Road at 123 and 127 Island Bridge Way,
south of the Riverlights subdivision in New Hanover County.
Areas of Environmental Concern (AFC's) impacted by the proposal are ES, EW, and PT.
Waters at the project site are classified as SC and are not open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the New Hanover County
Comprehensive Land Use Plan and offer the following comments.
The general area of the project is classified as Developed while the AECs impacted by
the work are classified as Conservation.
In general, New Hanover County allows development in Conservation classified AECs,
which is consistent with the State's minimum use standards. The New Hanover County
Comprehensive Land Use Plan contains some policies, which exceed the State's
minimum use standards. However, none of these standards appear to be applicable to this
proposal.
This project is consistent with the New Hanover County Comprehensive Land Use Plan.

The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request dated received by this office on March 10, 2021. The application proposes to construct a docking
facility with fixed platform, finger piers, and eight (8) boatlifts. The proposed project is located in the
waters of the Cape Fear River which are classified as SC by DWR. Please understand that the waters
around your project area have been identified by the Division of Marine Fisheries as Primary NurseryArea
(PNA). Should the need for dredging within the proposed project area arise in the future, please be aware
that new dredging within a PNA is not permitted under 15A NCAC 02B .0221 as it results in degradation
of water quality standards and therefore is considered a water quality violation. [15A NCAC 02B .0221]
DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the Regional
General Permit 291 issued by the US Army Corps of Engineers (USACE). This Certification allows you to
use the Regional General Permit 291 when issued by the US Army Corps of Engineers. In accordance with
the attached General Certification #4175 (GC 4175), the impacts described in your application do not
require written authorization to utilize GC 4175. However, you are required to follow the conditions listed
in the attached certification. You should get or otherwise comply with any other federal, state and local
requirements before you go ahead with your project including (but not limited to) erosion and sediment
control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150E by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as

Reference the application by River Island HOA to replace and reconfigure an 8-slip docking
facility damaged by Hurricane Isaias to include an access pier, fixed covered gazebo, four (4)
fixed finger piers, and eight (8) boat lifts for a total of 8 formalized boat slips in the Cape Fear
River. The existing docking facility will be removed. The new community docking facility will
include a 360' by 6' fixed access pier (total length) extending from the high ground to the west,
perpendicular with the shoreline. Approximately 230' waterward from the edge of wetlands, the
pier will transition to a fixed covered platform (12' x 24'). Extending from the proposed platform,
the access pier will continue another 80' waterward to the west, and from this extension the
applicant is proposing to construct four (4) fixed finger piers (30'x T), with two extending to the
north, and two extending to the south. To the east and west of the proposed fixed finger piers, the
facility will include eight (8) boat lifts (12.5' x 12.5') serving as 8 formalized boat slips. The
proposed community docking facility will extend approximately 230' waterward from the edge
of the marsh.
The reconfigured 8-slip docking facility will result in the coverage and shading of
approximately 3,998 square feet of estuarine Waters of the US, a reduction of 828 square feet
from the existing dock.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.

We recommend that the following conditions be included in the State authorization:
Special Conditions
1. All work authorized by this permit must be performed in strict compliance with the submitted
plans and drawings dated August 24, 2020 and September 15, 2020 and revised February 18 and
22, 2021, which are a part of this permit. Any modification to these plans must be approved by
the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office
at (910) 772-2191.
3. Approval of the structure is based on determinations that there would be no obstruction to
navigation. The structure may be damaged by wave wash from passing vessels. Issuance of this
permit should not be construed, as relieving the permittee of taking proper steps to ensure the
structure and moored boats will not be damaged by wave wash.
4. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from'fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
5. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
6. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or thepovement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973
7. The activity will be conducted in such a manner as to prevent a significant increase in turbidity
outside the area of construction or construction -related discharge. Increases such that the
turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the
North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.

applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly

9. PROJECT DESCRIPTION
The project site is located at 123 and 127 Island Bridge Way, on the Cape Fear River, in Wilmington, New
Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel north on
Cardinal Drive towards Market Street. Turn left onto Market Street. Travel approximately 0.3 miles and turn
left to College Drive, travel 9.5 miles south and then turn right onto Sanders Road. Travel approximately 0.9
miles, and at the traffic circle, take the 2nd exit onto River Road. Travel approximately 2.4 miles south, and
then turn right onto Island Bridge Way. The subject property will be at the end of the street.
According to the applicant, the River Island neighborhood is a 9.3 acre area with has approximately 460' of
shoreline frontage, and the 123 Island Bridge Way parcel is currently stabilized by a wooden bulkhead. The
property in the neighborhood ranges in elevation from 0' to 17' above normal high water (NHW). The
neighborhood consists of 10 lots with 6 existing homes and features an access bridge for vehicular traffic to
access from River Road. The existing vegetation ranges from Pine Canopy, Maritime Shrub communities,
ornamental landscaping, maintained lawn grasses and Coastal/404 Wetlands.
The existing community docking facility was heavily damaged during Hurricane Isaias in August 2020. The
existing 8-slip community docking facility incorporates approximately 4826 ftz (1848 SF in shading platform)
and includes a fixed access pier, an uncovered platform, a fixed covered platform, 8 finger piers, and 8
boatlifts. The River Island neighborhood, bridge, and docking facility was originally authorized with State
Permit No.144-90. A major modification was issued in 1992 to authorize the excavation of a pond in the
area of the bridge. More recently, River Island HOA has been issued several General Permits No. 42358D
(issued 2005), 42359D (issued 2005), 59231 D (issued 2012), 59331 D (issued 2012), 60728D (issued
2012), for the minor modification of the facility, including the repositioning of finger piers and installation of
boat lifts.
The New Hanover County Land Use Plan classifies the area near the project area as Conservation Area.
The waters in the project area are classified as SC by the N.C. Division of Water Resources. They are
designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed
to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to replace and reconfigure an 8-slip docking facility damaged by Hurricane Isaias to
include an access pier, fixed covered gazebo, four (4) fixed finger piers, and eight (8) boat lifts for a total of
8 formalized boat slips in the Cape Fear River. The existing docking facility will be removed. As proposed,
the new community docking facility would include a 360' by 6' fixed access pier (total length) extending from
the highground to the west, perpendicular with the shoreline. Approximately 230' waterward from the edge
of wetlands, the pier would transition to a fixed covered platform (12' x24'). Extending from the proposed
platform, the access pier would continue another 80' waterward to the west, and from this extension the
applicant is proposing to construct four (4) fixed finger piers (30'x 6), with two extending to the north, and
two extending to the south. To the east and west of the proposed fixed finger piers, the facility would
include eight (8) boat lifts (12.5' x 12.5') serving as 8 formalized boat slips. The proposed community
docking facility would extend approximately 230' waterwarl from the edge of the marsh. Due to the width of
the HOA parcel (127 Island Bridge Way), the proposed community docking facility would encroach into the
15' Riparian Corridor setback from the adjoining property owner to the north, however the applicant has
secured the waiver. As proposed, the facility would extend across the riparian corridor of the next property
to the south, however the HOA president owns that property and has provided an agent authorization form,
and according to the HOA covenants, all of the individual parcels in are restricted from building private piers

(See Declaration of Restrictions River Island, Page 2). According to the application water depths is near the
new docking facility range from -5' to -6' @ normal low water (NLM (See drawings 1-3 of 3).
10. ANTICIPATED IMPACTS
As proposed, the reconfigured 8-slip docking facility would result in the incorporation of approximately 3998
SF of Public Trust Area and Estuarine Waters, a reduction of 828 V. The fixed access pier would shade
168 SF of coastal wetlands and incorporate approximately 60 SF of high ground area. As proposed, the
docking facility would extend 230' into a watetody measuring 4290' across. The proposal includes
constructed features that would encroach into the northern 15' riparian corridor setback, however the proper
waiver has been obtained. Minor increases in turbidity should be expected during project construction.

Hey man, hope you're doing well. Attached is the agent authorization form I need you to sign so I can get CAMA to
change me to their point of contact for your project. Also attached is the estimate from Chris Holmes for structural
engineering. I spoke with New Hanover County and they told me that both electrical and plumbing must be on the plans
as well. I have spoken to Greg McDowell with McDowell Engineering in Hampstead and he told me that once Chris
Holmes is done with the structural he can engineer the Electrical and Plumbing portion for the plans. He said to budget
$2,000 for this portion. I have the barge lined up and plan to close the deal once we have the contract signed. I have
talked to Jon Jones with Oceanside electrical as well who is someone I would recommend for the electrical portion of
this project. I'm still trying to figure out what stage your major permit is in and have talked with Land Management
group and am waiting, still, to hear back from CAMA. I will follow up with them again today. Just email me over the
signed authorization when you can and I'll keep the ball rolling forward.

We are closer but there is an insurance issue. Our insurance agent thinks Nathan & Judi should

PARCEL 1: All of the real estate conveyed or attempted to be
conveyed in that certain deed from Ocean Forest Lakes Associates to
Pilots Ridge Development Corporation dated December 9, 1986 and
recorded on December 10, 1986 in Book 1353, Page 1609 of the New
Hanover County Registry consisting of approximately 238.75 acres of
land in Tract one thereof and approximately 40 acres of land in
Tract Two thereof as described in said deed, the description being
incorporated herein by reference.
PARCEL 2: All real estate the record title to which was vested in
Ocean Forest Lakes Associates, a North Carolina Limited
Partnership, on February 12, 1987, and being that property which
was conveyed or attempted to be conveyed by deed dated February 12,

A detached or attached garage for not less than two (2) care
must be constructed on each lot in the Subdivision at the time of
construction of the primary dwelling located thereon.
In cases where the square footage area computed as provided
( ❑ �. herein is not more than ten percent (10%) below the minimum
requirements established herein, the Developer or its designated
agents may, in its sole discretion, approve the construction of the
dwelling if it is in conformity with the general development of the
Subdivision.
Driveways on each lot shall be constructed of black or dark
gray concrete, brick, asphalt, exposed aggregate or other material
approved by the Developer.
3. DETACHED STRUCTURES: All detached structures, including
pump houses, constructed on any lot in the subdivision shall
conform to the design and material specifications and colors
approved for the dwelling constructed thereon.

any of the individual private lots.
5. EXTERIOR COMPOSITION: No concrete block, concrete brick,
asbestos siding, aluminum siding, cinder block or tar paper
composition shall be used for the exterior of any dwelling
constructed on any lot located in the Subdivision, it being
intended that only conventional frame, clay brick, stucco, or vinyl
exteriors be constructed on the lots subject to these covenants.
6. SETBACK RSWIR61®TS: Since the establishment of standard
inflexible building setback lines for the location of houses on
lots tends to force construction of houses directly to the side of
other houses with detrimental effects on privacy, views,
preservation of important trees and other vegetation, ecological,
and related considerations, no specific setback lines are
established by these restrictions. In order to assure, however,
that the foregoing considerations are given maximum effect, the
Developer reserves the right to control and approve absolutely the
site and location of any structure upon any lot.

9. FENCING: The Developer reserves the right, in its sole
discretion, to approve all fencing plane for any lot in the
Subdivision. Any owner of any lot who desires to erect a fence
thereon must first submit a perimeter plan for said fencing, along
C 4:Sae with the specifications on materials and design to the Developer
and obtain the Developer's approval prior to the beginning of
construction of said fence. Developer encourages fencing, but it
must be of an historical style.
10. CWTURS LINES: The outdoor drying of clothes and the
erection of outdoor clothes lines or similar devices in the
Subdivision Shall be subject to the approval of the Developer, and
then only when thoroughly screened from view.
11. TANG SALES; No yard sales or garage sales shall be
permitted upon any lot in the Subdivision_
12. SIGHS: No advertising signs or billboards shall be erected
on any lot or displayed to the public on any lot, except that one
sign per lot, not to exceed five (5) square feet in area, may be
used to advertise a completed dwelling for eels. No "For Sale -
signs are allowed on any unimproved lot. This covenant shall not
apply to coigne erected by the Owner of the lot (individual or
Developer) used to identify and advertise the Subdivision as a
whole, by the general contractor/builder of the residence doing the

13. FUEL TANKS, STORAGE RECxpTACLES, ETC.; No fuel tanks or
similar storage receptacles located on any lot may be exposed to

the main dwelling house, within an accessory building, within a
screened area, or buried underground.

(b) No animals, livestock or poultry of any kind shall be
raised, bred or kept on any lot in the Subdivision, except that
dogs, cats or other household pets may be kept for the purposes of
providing companionship for the private family. Barking dogs shall
be restrained by their owners to the satisfaction of the
surrounding residents. Animals are not to be raised, bred or kept
for commercial purposes or for food. It is the purpose of these
provisions to restrict the use of any lot so that no person shall

fowls, chicks, goose, rabbits, chickens, turkeys, skunks, snakes,
or any other animals that may interfere with the quietude, health

within a fenced area of the owner's yard, it is the pet owner's
responsibility to remove any pet debris left by their pet upon any
of the lots or common areas within the subdivision. Any costs
incurred by the other lot owners or the Association as hereinafter
established, for the removal of pet debris left by the pet of a lot
owner upon any lot or upon any part of the common areas shall be a
charge against the pet owner'e lot and shall he assessed against
that individual lot owner an a special assessment and subject to
the regulations regarding liens and assessments as hereinafter Set
forth. The Association may, in addition, establish a schedule of
fines for violations of this Paragraph and such fines shall be
assessed as a special assessment and collected in the same manner
as costs of removal provided herein.
(c) Unsightly or inoperative junk cars, equipment, _
materials and like exposures cannot be maintained on the property
either prior to or after the residence has been erected on any lot.
Further, automobile maintenance and repair should occur inside the
garage, and at no time shall automobiles be allowed to be placed on
jacks or blocks, in the view of neighboring residents, even for a
brief time period.
16. CONSTRUCTION ApPROvAL6:
(a) It is the intent of the Developer to create a
"historic looking" neighborhood and that all home construction and
landscaping should be in and consistent with the -Old South-,
•Antebellum^, or other styles or blends of styles aS may be found
in the Historic Districts of New Bern, North Carolina, Wilmington,
North Carolina, Charleston, South Carolina, or Savannah, Georgia.

Association with the expenses incurred for the same to be assessed
against the individual lot owner as a special assessment and
subject to the regulations regarding liens and assessments as set
forth herein in Paragraph 24.
19. STORNMATER RUROPP REOULATIONSS Restriction of built upon
areas:
(a) Built upon area, defined: Built upon area shall mean
that portion of each lot that is covered by impervious or partially
impervious cover, including building, pavement, rerrearional
facilities, etc., but not including decking. The built upon area
for each lot shall not exceed 6,350 square feet, unless and until,
the State of North Carolina shall revise its stormwater runoff
regulations to permit a greater built upon area for each lot.
(b) Built upon area, restricted: No more than 6,350
square feet of any lot of River Island Subdivision shall be covered
by structures and/or paved surfaces, including walkways, driveways
or patios of brick, stone, elate or similar materials, all of which
constitute effective impervious cover which is controlled by North
Carolina Coastal Stormwater Regulations. The Developer reserves
the absolute right to re -calculate the maximum allowable built upon
area for each lot if required by North Carolina Coastal Stormwater
Regulations. This covenant is intended to insure continued
compliance with stormwater runoff rules adopted by the state of
North Carolina, and therefore compliance may be enforced by the
State of North Carolina.
20. UTILITT SaSRNRmTg: The Developer reserves the right to
subject the real property in this Subdivision to a contract with
Carolina Power and Light Company for the installation of
underground electric cables and/or the installation of Street
lighting, either or both of which may require an initial payment
and/or continuing monthly payment to Carolina Power and Light
Company by the owner of each residence.
21. MAIL BOXES AND NEWSPAPER BOXES: Each lot in the
Subdivision shall have only one (1) mailbox and one (1) newspaper
box to be mounted on a single post, and all such boxes and poste
shall be of a historic style and must be approved by the Developer.
Such mailboxes or paper boxes My be provided by the Developer.
Any boxes provided by the Developer shall be considered an
improvement and must remain with the lot.

22. WATER A" SxRBA:
(a) All water to be used in said subdivision for domestic
purposes shall be obtained from the c0®ounity water system, unless
13 *mmm other sourcea are approved by the city -county Board of Health and
the owner of the community water System, or their Successors. Lot
owners may, however, drill shallow wells for irrigation purposes
and for non -domestic usage. An eight (8) foot radius from each
water meter shall be an easement for maintenance and repair of such
meter. Additionally, the front (10) feet of each lot is hereby
reserved for utility easements.
The Developer hereby grants an easement to the
community water company along all streets and roads in the
subdivision for the purpose of installing, maintaining, repairing
and replacing water lines.

The Developer hereby expressly retains the right to
provide for the water needs of each individual lot to be supplied
by the drilling of individual wells by the individual lot owners,
as an individual alternative or a collective alternative to the
community water system described herein.
( Sewage disposal systems shall be only into the New
Hanover County sewage collection system, or private sewage
collection system for the Subdivision, or through individual septic
tanks, only if a sewage collection system is not available.
13. BOAS SLIPS:
(a) Each lot set forth on the Subdivision plat recorded
in Map Book , at page of the New Hanover County
Registry, shall include and be assigned, one non -severable boat
slip in the marina dock area in the RIVER ISLAND Subdivision ae
shown in Exhibit A hereto attached and incorporated herein by
reference. Assignment of the slips pursuant to this paragraph Shall
be made by the homeowners association as hereinafter established,
and slip assignments shall be made on a first -come, first -serve
basis as each of the lots in River Island is conveyed by the
Developer. The homeowners association shall maintain, as part of
the corporate records, a record of the assignment of slips and may
issue such documents to the association members as it shall deem
necessary to evidence such slip assignments.

of such rules and regulations may be made by the levying of fines
for violations, which shall be assessed, collected, and enforced
against the responsible lot owner(s) in the same manner as a lot
assessment pursuant to Paragraph 25 of this Declaration.
24. OWNERS ASSOCIATION: To provide for the maintenance,
repair, upkeep and replacement of the private streets, bridge,
street signs, pier, dock, boat slips, walkways, gazebo, fire
protection water tank and appurtenances, irrigation system, and
other amenities, and other common areas, the Developer has formed
RIVER ISLAND OWNERS ASSOCIATIO•, INC., a non-profit corporation
organized pursuant to Chapter 55A of the General Statutes of North
Carolina_ The Association shall be responsible for providing any

assessment for any calendar year may be increased without limit by
a vote of two-thirds (2/3) of the members who are voting in person
or by proxy at a meeting called for this purpose.
(d) In addition to the annual assessments authorized
above, the Association may levy, in any calendar year, a special
assessment for the purpose of defraying in whole or in part, the
costs of any construction, reconstruction, repair or replacement of
a capital improvement to the common areas (including but not
limited to common bridge, common pier, amenities and streets),

their heirs or assigns, or any other party subject hereto, shall
violate or attempt to violate any of the covenants herein, it shall
be lawful for any person or persons owning any real property
situated in said RIVER ISLAND to prosecute any proceedings at law
or in equity against the person or persons violating or attempting
to violate any such covenants, and either to prevent him or them
from doing so or to recover damages or other dues for such
violation.
20. VALIDITrs All covenants, restrictions and affirmative
obligations set forth in these Restrictions shall run with the land
and shall be binding On all parties and persons claiming under then
to specifically inClmds, but not be limited to the successors and
assigns, if any, of the Developer, for a period of twenty (20)
years from the date hereof after which time all said covenants
shall be automatically extended for successive periods of ten (10)
years unless an instrument signed by the owners of a majority of
the lots (not including mortgagees or trusteee under deeds of
trust) substantially affected by such changes in covenants, has
been recorded, agreeing to change said covenants in whole or in
part.
29. DRVELOpsq,g RIOeT TO AM=: Developer shall have the
right, at any time prior to December 31, 2005, to amend these
Restrictions, in whole or in part, without the consent or joinder
Of any owner of any lot in said subdivision, so long as such
amendments do not inpair the property values of the other lots in
RIVER ISLAND.
