NC 28469 Authorizing development in Brunswick County at ado. to the AI W W and Middle Sound. at 502 Shoreline Dr. E., in Sunset Beach , as requested in the permittee's application dated 4/5/21 (MP-1) and 3/30/21 (MP-4), including attached workplan drawings (2), Sheet I and 2 of 2 both dated "Revised 4/7/21". This permit, issued on July 9, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the docks, piers, gazebo, boatlifts, floating platforms, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) In order to satisfy concerns of the resource agencies, physical stops shall be placed on boat lift and floating dock at a minimum height of 18" above the bottom substrate to prevent the boat lift and floating dock from disturbing the bottom substrate. The physical stops shall remain in place for the life of the permitted docking facility. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature Scott W. and Heather Quaintance ADDITIONAL CONDITIONS Permit No. 86-21 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) Any portion of the permitted access pier and docking facilities built above Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 5) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the existing pier headline. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 9) This permit authorizes a maximum of four (4) formalized boat slips. 10) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 11) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 12) The roof of the gazebo shall not be designed for second story use. USACE Conditions 13) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at httn://www.fws.eov/nc-es/mammal/manatee guidelines odf. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. Scott W. and Heather Quaintance Permit No. 86-21 Page 3 of 3 ADDITIONAL CONDITIONS 15) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. i NOTE: This permit does not eliminate, the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2021-00776). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0496. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. However, I wanted to present the option of installing a piling along the eastern side of the floating dock so that your goal of tying up your vessel perpendicular to the channel to avoid boat wake along the AIWW may still be possible. I didn't know if this would be an amenable option to achieve both your use of the floating dock and avoid the resource impacts of the floating dock. Let me know what your thoughts are and I will continue to relay this information to the resource agencies. But if I don't have a choice then obviously I will. Any dock that I have ever built that is parallel to the waterway has not lasted due to the wave crash on the long side of the pier from large vessels. The short side has always held up better facing that way. Also, it makes it impossible to keep a boat moored to it unless you can put the boat on the landward side, which we can't do that with the ramp. The applicant proposes to install a private pier with a gazebo, open platform, floating dock, boatlift, and two PWC lifts for a total of four formalized slips at 502 Shoreline Drive E., on the mainland side of Sunset Beach, Brunswick County on the AIWW. The waters of the AIWW are classified SA by the Division of Water Quality and are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. Surrounding waters are closed to the harvest of shellfish. The proposed four - slip docking facility would be located over an area of shallow water (-1.8ft. MLW) according to applicant's measurements and confirmed by DCM staff on 3/10/2021. PNAs are estuarine waters where initial post -larval development occurs. Species within this area are early post -larval to juvenile and include finfish, crabs, and shrimp. Shallow soft bottom is an important foraging habitat for juvenile and adult fish and invertebrates, and aids in storing and cycling of sediment, nutrients, and toxins between the bottom and water column. Soft bottom habitat is used to some extent by most native coastal fish species in North Carolina. The habitat is particularly productive and, by providing refuge from predators, is an important nursery area. Species dependent on shallow soft bottom include clams, crabs, flounder, spot, Atlantic croaker, sea mullet, and rays. Many benthic predators are highly associated with the shallow soft bottom habitat, including flounders, weakfish, red drum, sturgeon and coastal sharks, although almost all fish will forage on microalgae, infauna, or epifauna on the soft bottom. Due to the shallow water depths the applicant proposes physical stops to be installed 18" above the substrate on the floating dock and on the boatlift pilings to minimize impacts to the soft bottom habitat. To further minimize impacts to the soft bottom habitat, it is the recommendation of the Division that the proposed 8ft. x 16ft. floating dock be reconfigured to be positioned parallel to the ICW so more of the floating structure will be in deeper water. Existing structures on the .47-acre project site include a single-family residence and an in -ground pool. The high ground is vegetated primarily with domestic grasses and ornamental landscaping. High ground elevations are approximately 2ft. above the normal high water (NH ) level, and the applicant's entire shoreline (+/- 98 linear ft.) is stabilized by native vegetation. High Marsh Coastal Wetlands within the applicant's riparian corridor include a 20ft. wide swath of Saltmeadow Cordgrass (Spartina patens) and Black Needlerush (Juncus roemerianus). The Low Marsh extends approximately 549ft. waterward of the High Marsh and consists of a dense stand of Smooth Cordgrass (Spartina alterniflora). A 20ft. wide high -ground hummock of Sea Oxeye (Borrichia frutescens) is located at the waterward edge of Coastal Wetlands and nuns parallel with the shoreline across the applicant's entire riparian corridor. The proposed docking facility would be located entirely over open water in the AIWW. A residential property borders the project site to the east and a vacant lot sits to the west of the project site. The applicant owns a second parcel (PID # 256CD00301) located south of the residence that extends from the NHW mark out to the AIWW. The width of the AIWW measures approximately 558ft. feet from edge of marsh at the proposed project site. The waters of the AIWW are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the March 2021 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) or live oysters in the surrounding waters. According to the applicant, water depths in the vicinity of the proposed docking facility are approximately -1.8ft. MLW. DCM staff verified water depths in the project vicinity during a site visit on 3-10-2021 at 12:20pm. Tidal amplitude in ap area is approximately 4.5ft. between MLW and MHW (See Sheet 2 of 2). PROPOSED PROJECT APR 0 9 2021 The applicant proposes to install a private pier with a gazebo, open platform, floating dock, boaK%NIQ CITY PWC lifts for a total of four formalized slips on the AIWW. The applicant proposes to build a 6ft. x 704ft. access pier that would originate from an upland point and extend south into the AIWW. Approximately 668ft. down the access pier, the applicant proposes a 6ft. x 33ft. finger pier which would extend off the east side of the access pier, leading to a south -facing gangway and a proposed 8ft. x 16ft. floating dock (Slip #1). A 13ft. x 16ft. boatlift (Slip #2) would be accessed off the west side of the proposed floating dock and sit approximately 125ft. waterward of the edge of marsh. According to the applicant, water measurements in the vicinity of the boatlift show approximately -1.8ft. MLW. Physical stops would be installed on the floating dock and boatlift pilings no lower than 18in from the substrate to reduce prop dredging during periods of low tide. The proposed access pier would continue another 31 ft. south of the finger pier with a proposed 13ft. x 13ft. covered gazebo and an 8ft. x Scott & Heather Quaintance April 7, 2021 12ft. open platform located on the east side of the access pier. Two 511. x Oft. PWC lifts (Slips #3 & #4) would be located on the west side of the access pier, opposite the gazebo and open platform (Sheet 1 of 2). As proposed, the docking facility would be located within the applicant's area of riparian access and would not encroach within either adjacent neighbor's 15ft. riparian setback. According to the applicant, water depths in the vicinity of the proposed docking facility are approximately -1.8ft. MLW. DCM staff verified water depths in the project vicinity during a site visit on 3-10-2021 at 12:20pm. The applicant has proposed to install physical stops 18in. above the substrate to help protect the soft bottom in the Primary Nursery Area. As proposed, the waterward edge of the docking facility would be built approximately 3OR, beyond the existing pier -head line to access deeper water but would terminate at the '/, width and the 80' Federal Channel Setback. According to the applicant, water depths at adjacent docking facilities range from -0.8ft. to -1.6ft. MLW. As proposed, the docking facility would extend approximately 139.511. from the edge of marsh to approximately 25% of the waterbody width. 10. ANTICIPATED IMPACTS The proposed four -slip docking facility would be located over an area of shallow water (-1.8ft. MLW according to applicant's measurements) in a Primary Nursery Area. Installing physical stops 18in. above the substrate on the floating dock and boatlifts could reduce impacts to soft -bottom habitat and limit usage to periods of mid and high tides. Despite using stops to physically limit the structures' height above the substrate, prop scouring in critical habitat is still a concern during ingress and egress. The proposed four -slip docking facility would result in the shading of 3,414 square feet of Coastal Wetlands and the incorporation of approximately 1,709 square feet of Estuarine Waters and Public Trust Area. As proposed, the docking facility would be located waterward of the pier -head line but not exceed the '/a width of the waterbody, or the 80' Federal Channel Setback. The proposed development would be located outside the 15' riparian corridor setbacks to the east and west. Turbidity associated with the piling installation would be kept to a minimum.
