Charlotte. NC 28210 Permit Number 131-21 Authorizing development in Currituck/Dare County at within Currituck Sound and adjacent to the Wright Memorial Bridge , as requested in the permittee's application dated 5/26/21, including attached workplan drawings (10), Drawings 1-10 of 10 all dated 5/18/21. This permit, issued on September 24, 2021 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Exposed Pipeline Stabilization Remediation 1) In accordance with commitments made by the permittee and to prevent unnecessary siltation into the adjacent water body, a turbidity curtain shall be left between the construction area and the surrounding water until the project areas has returned to ambient conditions. 2) The stabilization remediation shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 3) No open water shall be excavated or filled, even temporarily, outside of the approved stabilization remediation alignment. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modifcation not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No. 131-21 Page 2 of 2 ADDITIONAL CONDITIONS 4) The fill material shall be clean and free of any pollutants except in trace quantities. 5) Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. 6) Stabilization remediation materials shall be of a sufficient size and design to prevent its movement from the approved alignment by wave or current action. The permittee shall be responsible for immediate removal of any materials or debris that becomes dislodged or moves outside the authorized alignment. Sedimentation and Erosion Control - Staging Area 7) In order to protect water quality, runoff from staging and loading of vessels shall not visibly increase the amount of suspended sediments in adjacent waters. 8) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in appropriate waste receptacles in an upland location. 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior t6 project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2021-01766). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0698. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. At this time I am waiting on the Division of Water Resources (DWR) to supply their final determination before I can complete our review. I requested comments from DWR yesterday, but to date have not received a reply. Please accept this email as notification that the project has been extended. Currituck Sound Pipeline Exposure Remediation Project Major Permit Recommendations The applicant proposes to install stabilization bags over the exposed, or soon to be exposed, areas of the existing sub -aqueous natural gas pipeline. The site of the proposed development is located in the open water area within the Piedmont Natural Gas, Inc. easement which runs parallel to the Wrights Memorial Bridge on the southern side approximately 5,000' from shore. The development proposal involves the Public Trust Area (PTA) and the Estuarine Waters (EW) Areas of Environmental Concern (AEC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H.0208 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a) (1) States "Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish bed, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(B) states that development shall comply with state and federal water and air quality standards. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural Resources. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(D) states that development shall not increase siltation. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(E) states that development shall not create stagnant water bodies. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(G) states that development shall notjeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Paragraph (d) (2) states "All development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to service the primary purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation shall be permitted if impervious areas are not increased and the applicant designs the project to comply with the rule to the maximum extent feasible." Consistent: The proposed development is consistent with the intent of this rule. Paragraph (d) (3) states "All development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973: (A) All development projects, proposals, and designs shall provide for a buffer zone along the margin of the estuarine water that is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. Consistent: The proposed development is consistent with the intent of this rule. (B) No development project proposal or design shall propose an angle for graded slopes or fill that is greater than an angle that can be retained by vegetative cover or other erosion -control devices or structures. Consistent: The proposed development is consistent with the intent of this rule. (C) All development projects, proposals, and designs that involve uncovering more than one acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of completion of the grading; unless the project involves clearing land for the purpose of forming a reservoir later to be inundated." Paragraph (d) (6) states "No public facility shall be permitted if such a facility is likely to require public expenditures for maintenance and continued use, unless it can be shown that the public purpose served by the facility outweighs the required public expenditures for construction, maintenance, and continued use." Paragraph (d) (7) states "Development shall not cause irreversible damage to valuable, historic architectural or archaeological resources as documented by the local historic commission or the North Carolina Department of Natural and Cultural Resources." Paragraph (d) (8) states "Established common-law and statutory public rights of access to the public trust lands and waters in estuarine areas shall not be eliminated or restricted. Staging will occur approximately 340 feet landward of Normal Water Level (NWL) at the ferry dock. The stabilization bags will be filled, placed on pallets and allowed to harden through the absorption of water vapor. Once hardened, pallets will be shrink wrapped and loaded onto a vessel. The bags will be carried by vessel to the project site where they will be lowered to a dive crew for hand placement. Weather permitting, the project will be completed within 22 days. The waters of the Currituck Sound are classified as SC waters and Coastal Waters and are closed to shellfishing. No Submerged Aquatic Vegetation (SAV) is located within the project area. A review of historic and archaeological resources was not included in the Field Investigation Report. Anticipated Impacts resulting from this project are expected to include: the filling of 1.18 acres of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC). Basis for Determination: A portion of the Currituck Sound and the existing ferry dock are located in Currituck County. The ferry dock property is designated as "Limited Service" on the Currituck County Future Land Use Map (FLUM). Areas of Environmental Concern (AECs) are designated as "Conservation Areas" as indicated on Page 11-1. The ferry dock property is also located in the "Point Harbor' sub area. The following LUP policies may be applicable to this request: Land Use Compatibility: Policy ES5, Page 9-6. "Uses allowed in ESTUARINE WATERS must be water dependent (public access, docks, piers, erosion control, and other CAMA-approved uses) and must not interfere with the proper function, cleanliness, salinity, and circulation of the resource..." PROJECT SUMMARY: The applicant proposes to install stabilization bags over the exposed, or soon to be exposed, areas of the existing sub -aqueous natural gas pipeline. Project Settinq The location of the site proposal is an open water area within the Piedmont Natural Gas, Inc. easement which runs parallel to the Wrights Memorial Bridge on the southern side. The original location for the pipeline was authorized under CAMA Major Permit 136-04. In this area the Currituck Sound is approximately 14,550' wide, has a sandy bottom, and averages -10' deep. This area is classified as coastal waters by agreement with the Marine Fisheries Piedmont Natural Gas, Inc. Field Investigation Report Page 2 Commission and Wildlife Resources Commission. The Division of Environmental Management's water quality classification for this area is SC and it is closed to shellfish taking. Submerged aquatic vegetation, as per DMF's definition, was not observed in the proposed project location. Development Proposal The applicant proposes to install 2,570 liner feet of stabilization bags along 2 sections of the existing pipeline alignment which has become exposed or is soon to be exposed in areas where the pipeline is less than 3' below the substrate. The proposed stabilization bags will act as a barrier to protect the pipeline from direct damage and to limit the pipeline from rising further to the surface. The staging area for this project will be located at 143 South Albetuck Road, the site of an existing ferry dock, and will be located approximately 340' landward of NWL. Each stabilization bag is constructed of 100% jute fiber material and contain dry mixture of 3 portions of sand to 1 portion of cement. The stabilization bags will measure 24" x 30". Once filled the stabilization bags will be palletized and staged for a period of time to allow for natural absorption of water vapor. Once hardened the pallets will be wrapped in shrink wrap and loaded onto a vessel by use of a flatbed truck and a forklift. The water depth in this area range from -2' to -5'. Once loaded onto the vessel the stabilization bags will be carried to the proposed project site where the bags will be lowered to a dive crew who will place the bags by hand over the pipeline. The first repair section will be located approximately 5,000' from the western shoreline. This area will be 1,412' long and 20' wide and will have a height of 1' above the substrate. The second repair area will be located 600' east of the first repair area and will be 1,158' long and 20' wide and will have a height of 1' except for the eastern most 108' which will have a height of 2'. A turbidity curtain will surround the project area while the sedimentation bags are being installed. The curtain will move as the work progresses. For safety concerns, and to assist with navigation, a spotter vessel will be on site at all times while work is taking place below the surface. Weather permitting this project is planned to be completed within 22 days. Project Introduction ONYX Services has been contracted by Piedmont Natural Gas, Inc. to restore cover over a segment of the 6", #208 Pipeline which crosses Currituck Sound. The repair area is located near the center of Currituck Sound on the southside of the Wright Memorial Bridge (GPS Coordinates: 36.0858401, - 75.768463°). The pipeline crosses Currituck Sound in both Dare and Currituck County, North Carolina. Recent field surveys indicate that the pipeline is exposed along the channel bed and has areas of minimal cover. The reduction of cover over the pipeline is estimated to be the result of natural channel bed erosion. The installation of the pipeline was originally permitted by the United States Army Corps of Engineers (permit #200411492) and safely put into service on April 25th, 2005. The installation permit is attached as Appendix J of this submittal. The methods for installing the pipeline were a combination of horizontal directional drilling, open cut trenching, and jetting. Per the recent field surveys, the pipeline is exposed for a length of 108' and has areas of minimal cover that measure approximately 2,462' in length. Areas of minimal cover are considered to be less than 3'. For your review, attached to this cover letter is a CAMA Major Permit Application (Appendix A) along with all supporting documentation which includes a permit fee payment of $400. B. Project Scope The proposed pipeline protection system includes two (2) repair areas. The first repair area measures 1,158' x 20' and the second measures 1,412' x 20'. Both repair areas have a typical thickness of 1 ; however, along the 108' length of exposed pipeline, the thickness is increased to 2'. Both repair areas nun parallel to the Wright Memorial Bridge and are perpendicular to the East and West shorelines. The repair areas are located in close proximity to each other, separated by approximately 600'. Proposed Construction Procedures Material prep and staging will be completed off -site approximately 340' beyond the normal water level of Curituck Sound. The stabilization bags are planned to be filled at the staging location shown on the attached technical drawings (Appendix F). Once filled, the stabilization bags are to be palletized and staged for a period of time to allow natural absorption of water vapor present in the air. The bags harden and become precast units ready for installation. Once hardened, the pallets will be wrapped in shrink wrap and loaded on a flatbed truck for distribution. Although the data referenced does not cover the exact location of the project, the findings can be applied to the entirety of Currituck Sound and can assist in determining the presence of SAV within the project site. 2013 Studv SAV surveys were performed in 2013 by Mr. Brett Hartis in support of a doctoral dissertation submitted to the North Carolina State University titled "Mapping, Monitoring and Modeling Submersed Aquatic Vegetation Species and Communities". The research finds that SAV distribution within the Currituck Sound exhibited a highly patchy distribution (Figure 1) and during the SAV survey, most plants were found at —1 .31 meters (4.3 feet). No plants were detected at a depth greater than 2.89 meters (9.5 feet). According to the map, no SAV habitat is present at the proposed project site (Figure 4) (Quality 2021). Although the research conducted did not occur for the project site specifically, the conclusions can be used to presume that it is unlikely that SAV is located within the proposed project site. Since the proposed project is located near the center and deepest part of the channel, the protection of the pipeline is anticipated to have no impact on current or future SAV. Additionally, the project site is located in an area previously disturbed by natural channel erosion. This known erosion may have been enhanced by the lack of SAV present at the site.
