Wright Memorial Bridge , as requested in the permittee's application dated 5/26/21,
including attached workplan drawings (10), Drawings 1-10 of 10 all dated 5/18/21.
This permit, issued on September 24, 2021 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Exposed Pipeline Stabilization Remediation
1) In accordance with commitments made by the permittee and to prevent unnecessary siltation into the
adjacent water body, a turbidity curtain shall be left between the construction area and the
surrounding water until the project areas has returned to ambient conditions.
2) The stabilization remediation shall be constructed in accordance with the alignment depicted on the
attached workplan drawings.
3) No open water shall be excavated or filled, even temporarily, outside of the approved stabilization
remediation alignment.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modifcation not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The fill material shall be clean and free of any pollutants except in trace quantities.
5) Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the
State.
6) Stabilization remediation materials shall be of a sufficient size and design to prevent its movement from
the approved alignment by wave or current action. The permittee shall be responsible for immediate
removal of any materials or debris that becomes dislodged or moves outside the authorized alignment.
Sedimentation and Erosion Control - Staging Area
7) In order to protect water quality, runoff from staging and loading of vessels shall not visibly increase the
amount of suspended sediments in adjacent waters.
8) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in appropriate waste receptacles in an
upland location.
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior t6
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2021-01766).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2021-0698.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

This project will protect the existing pipeline from further erosion or damage from debris, Impacts or other foreign objects.

Stabilization bags will be hand placed from work vessels overtop the pipeline on areas that are currently exposed or have
minimal cover. Prior to construction, a floating turbidity curtain will be placed in the waterway to surround the worksite and
control turbidity. Below is a list of equipment planned for use in the waterway:

Ron and Robert in our Elizabeth City office forwarded me your request for an update concerning the remediation project
the Division currently has in process. At this time I am waiting on the Division of Water Resources (DWR) to supply their
final determination before I can complete our review. I requested comments from DWR yesterday, but to date have not
received a reply.
Please accept this email as notification that the project has been extended. The 150 day date is 12/4/21. 1 am hopeful
that DWR will provide comment in the near future. Once those comments are in I should be able to finalize our decision
shortly thereafter.

Project Major Permit Recommendations
The applicant proposes to install stabilization bags over the exposed, or soon to be exposed,
areas of the existing sub -aqueous natural gas pipeline.
The site of the proposed development is located in the open water area within the Piedmont
Natural Gas, Inc. easement which runs parallel to the Wrights Memorial Bridge on the southern
side approximately 5,000' from shore.
The development proposal involves the Public Trust Area (PTA) and the Estuarine Waters (EW)
Areas of Environmental Concern (AEC's).
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this
project and my findings are as follows:
15A NCAC 07H.0208 Use Standards
Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are
not water dependent within the EW and PTA and lists uses that may be considered water
dependent.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a) (1) States "Uses which are not water dependent shall not be permitted in coastal
wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels,

hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not
water dependent. Uses that are water dependent include: utility crossings, wind energy facilities,
docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads,
culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and
drainage ditches;"
Consistent: The proposed development is considered water -dependent.
Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the
construction activities involved shall be consistent with the management objective of the
Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse
impacts upon the productivity and biologic integrity of coastal wetlands, shellfish bed,
submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning
and nursery areas.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(B) states that development shall comply with state and federal water and air
quality standards.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented
archaeological or historic resources as identified by the N.C. Department of Cultural Resources.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(D) states that development shall not increase siltation.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(E) states that development shall not create stagnant water bodies.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts
on life cycles of estuarine and ocean resources.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(G) states that development shall notjeopardize the use of the waters for
navigation or for other public trust rights in public trust areas including estuarine waters.

Paragraph (d) (1) states "All development projects, proposals, and designs shall preserve natural
barriers to erosion, including peat marshland, resistant clay shorelines, and cypress -gum
protective fringe areas adjacent to vulnerable shorelines."
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (d) (2) states "All development projects, proposals, and designs shall limit the
construction of impervious surfaces and areas not allowing natural drainage to only so much as is
necessary to service the primary purpose or use for which the lot is to be developed. Impervious
surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can
demonstrate, through innovative design, that the protection provided by the design would be
equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding
the 30 percent impervious surface limitation shall be permitted if impervious areas are not
increased and the applicant designs the project to comply with the rule to the maximum extent
feasible."
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (d) (3) states "All development projects, proposals, and designs shall comply with the
following mandatory standards of the North Carolina Sedimentation Pollution Control Act of
1973:
(A) All development projects, proposals, and designs shall provide for a buffer zone along the
margin of the estuarine water that is sufficient to confine visible siltation within 25 percent of
the buffer zone nearest the land disturbing development.
Consistent: The proposed development is consistent with the intent of this rule.
(B) No development project proposal or design shall propose an angle for graded slopes or fill
that is greater than an angle that can be retained by vegetative cover or other erosion -control
devices or structures.
Consistent: The proposed development is consistent with the intent of this rule.
(C) All development projects, proposals, and designs that involve uncovering more than one acre
of land shall plant a ground cover sufficient to restrain erosion within 30 working days of
completion of the grading; unless the project involves clearing land for the purpose of forming a
reservoir later to be inundated."
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (d) (4) states "Development shall not have a significant adverse impact on estuarine
and ocean resources. Significant adverse impacts include development that would directly or

Paragraph (d) (5) states "Development shall not interfere with existing public rights of access to,
or use of, navigable waters or public resources."

Paragraph (d) (6) states "No public facility shall be permitted if such a facility is likely to require
public expenditures for maintenance and continued use, unless it can be shown that the public
purpose served by the facility outweighs the required public expenditures for construction,
maintenance, and continued use."
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (d) (7) states "Development shall not cause irreversible damage to valuable, historic
architectural or archaeological resources as documented by the local historic commission or the
North Carolina Department of Natural and Cultural Resources."
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (d) (8) states "Established common-law and statutory public rights of access to the
public trust lands and waters in estuarine areas shall not be eliminated or restricted. Development
shall not encroach upon public accessways nor shall it limit the use of the accessways."
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (d) (10) states "specific information, degrade the water quality or outstanding resource
values. (10) Within the Coastal Shorelines category (estuarine and public trust shoreline AECs),
new development shall be located a distance of 30 feet landward of the normal water level or
normal high water level, with the exception of the following:
(A) Water -dependent uses as described in Rule 07H .0208(a)(1) of this Section;"

Based on my review of the applicable subsections of the North Carolina Administrative Code,
the permit application, and plans, I recommend issuing a permit be issued to Piedmont Natural
Gas, Inc. for the development intended for preserving the existing natural gas pipeline which
crosses the Currituck Sound.

associated staging at the ferry dock are proposed. Bag placement will occur in two (2) sections,
a 20 foot wide by 1,412 section to the west, and a 20 foot wide by 1,158 long section to the east,
with a separation of 600 feet. Stabilization bags made of 100%jute fiber, measuring 24 inch by

30 inch and filled with a sand/cement mix will be placed by hand over the pipeline in these sections
to a height of 1 foot, except for the easternmost 108 feet where bags will be placed to a height of
2 feet. Staging will occur approximately 340 feet landward of Normal Water Level (NWL) at the
ferry dock. The stabilization bags will be filled, placed on pallets and allowed to harden through
the absorption of water vapor. Once hardened, pallets will be shrink wrapped and loaded onto a
vessel. The bags will be carried by vessel to the project site where they will be lowered to a dive
crew for hand placement. Weather permitting, the project will be completed within 22 days.
The waters of the Currituck Sound are classified as SC waters and Coastal Waters and are closed
to shellfishing. No Submerged Aquatic Vegetation (SAV) is located within the project area. A
review of historic and archaeological resources was not included in the Field Investigation Report.
Anticipated Impacts resulting from this project are expected to include: the filling of 1.18 acres of
Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC).
Basis for Determination:
A portion of the Currituck Sound and the existing ferry dock are located in Currituck County. The
ferry dock property is designated as "Limited Service" on the Currituck County Future Land Use
Map (FLUM). Areas of Environmental Concern (AECs) are designated as "Conservation Areas"
as indicated on Page 11-1. The ferry dock property is also located in the "Point Harbor' sub area.
The following LUP policies may be applicable to this request:

shall be discouraged."
A portion of the Currituck Sound is located in Dare County. As indicated on Page 217 of the Dare
County Land Use Plan, the "Conservatio classification applies to all CAMA AECs and all federal
lands except for the bombing ranges on te Mainland and some state-owned lands in Frisco and
Buxton. The following LUP policies may �e applicable to this request:

Reference the application of Piedmont Natural Gas, Inc. for a Department of the Army
permit to install stabilization bags over exposed sections of an existing sub -aqueous gas pipeline,
adjacent to the Wright Memorial Bridge and the Currituck Sound, between Currituck County and
Dare County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAAINATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as authorized by this permit or any USACE approved modification to this

permit, no excavation, fill or mechanized land -clearing activities shall take place atany time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
4. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
5. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at [phone],
Ext. 526 or [phone] and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
6. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
7. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
8. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

8. PROJECT SUMMARY: The applicant proposes to install stabilization bags over the
exposed, or soon to be exposed, areas of the existing sub -aqueous natural gas pipeline.
Project Settinq
The location of the site proposal is an open water area within the Piedmont Natural Gas,
Inc. easement which runs parallel to the Wrights Memorial Bridge on the southern side. The
original location for the pipeline was authorized under CAMA Major Permit 136-04. In this
area the Currituck Sound is approximately 14,550' wide, has a sandy bottom, and averages
-10' deep. This area is classified as coastal waters by agreement with the Marine Fisheries

Commission and Wildlife Resources Commission. The Division of Environmental
Management's water quality classification for this area is SC and it is closed to shellfish
taking. Submerged aquatic vegetation, as per DMF's definition, was not observed in the
proposed project location.
Development Proposal
The applicant proposes to install 2,570 liner feet of stabilization bags along 2 sections of the
existing pipeline alignment which has become exposed or is soon to be exposed in areas
where the pipeline is less than 3' below the substrate. The proposed stabilization bags will
act as a barrier to protect the pipeline from direct damage and to limit the pipeline from
rising further to the surface.
The staging area for this project will be located at 143 South Albetuck Road, the site of an
existing ferry dock, and will be located approximately 340' landward of NWL. Each
stabilization bag is constructed of 100% jute fiber material and contain dry mixture of 3
portions of sand to 1 portion of cement. The stabilization bags will measure 24" x 30". Once
filled the stabilization bags will be palletized and staged for a period of time to allow for
natural absorption of water vapor. Once hardened the pallets will be wrapped in shrink wrap
and loaded onto a vessel by use of a flatbed truck and a forklift. The water depth in this area
range from -2' to -5'. Once loaded onto the vessel the stabilization bags will be carried to the
proposed project site where the bags will be lowered to a dive crew who will place the bags
by hand over the pipeline.
The first repair section will be located approximately 5,000' from the western shoreline. This
area will be 1,412' long and 20' wide and will have a height of 1' above the substrate. The
second repair area will be located 600' east of the first repair area and will be 1,158' long
and 20' wide and will have a height of 1' except for the eastern most 108' which will have a
height of 2'. A turbidity curtain will surround the project area while the sedimentation bags
are being installed. The curtain will move as the work progresses. For safety concerns, and
to assist with navigation, a spotter vessel will be on site at all times while work is taking
place below the surface. Weather permitting this project is planned to be completed within
22 days.
Anticipated Impacts
• The proposed addition of the stabilization bags above the existing natural gas
pipeline will result if the filling of 51,400 sf of shallow bottom and 1,984 yd' of open
water fill within the Public Trust Area (PTA) Estuarine Water (EW) Areas of
Environmental Concern (AEC)

Project Narrative:
A. Project Introduction
ONYX Services has been contracted by Piedmont Natural Gas, Inc. to restore cover over a segment of
the 6", #208 Pipeline which crosses Currituck Sound. The repair area is located near the center of
Currituck Sound on the southside of the Wright Memorial Bridge (GPS Coordinates: 36.0858401, -
75.768463°). The pipeline crosses Currituck Sound in both Dare and Currituck County, North Carolina.
Recent field surveys indicate that the pipeline is exposed along the channel bed and has areas of minimal
cover. The reduction of cover over the pipeline is estimated to be the result of natural channel bed
erosion.
The installation of the pipeline was originally permitted by the United States Army Corps of Engineers
(permit #200411492) and safely put into service on April 25th, 2005. The installation permit is attached
as Appendix J of this submittal. The methods for installing the pipeline were a combination of horizontal
directional drilling, open cut trenching, and jetting. Per the recent field surveys, the pipeline is exposed
for a length of 108' and has areas of minimal cover that measure approximately 2,462' in length. Areas of
minimal cover are considered to be less than 3'.
For your review, attached to this cover letter is a CAMA Major Permit Application (Appendix A) along
with all supporting documentation which includes a permit fee payment of $400.
B. Project Scope
The proposed pipeline protection system includes two (2) repair areas. The first repair area measures
1,158' x 20' and the second measures 1,412' x 20'. Both repair areas have a typical thickness of 1 ;
however, along the 108' length of exposed pipeline, the thickness is increased to 2'. Both repair areas
nun parallel to the Wright Memorial Bridge and are perpendicular to the East and West shorelines. The
repair areas are located in close proximity to each other, separated by approximately 600'.
Stabilization bags are proposed to be placed overtop these areas to protect the pipeline at locations
with less than 3' of cover and where the pipeline is exposed.

Each stabilization bag is made of 100% jute fiber material that is eco-friendly. Each bag meaasurresMHD CITY
approximately 24" x 30" in dimension. The bags are filled with a dry mixture consisting of 3 portions
sand to I portion cement. The volume of a filled bag is approximately''/2 cubic foot. See section
Proposed Construction Procedures for further details.
C. Proposed Construction Procedures
Material prep and staging will be completed off -site approximately 340' beyond the normal water level of
Curituck Sound. The stabilization bags are planned to be filled at the staging location shown on the
attached technical drawings (Appendix F). Once filled, the stabilization bags are to be palletized and
staged for a period of time to allow natural absorption of water vapor present in the air. The bags harden
and become precast units ready for installation. Once hardened, the pallets will be wrapped in shrink wrap
and loaded on a flatbed truck for distribution. The staging area and water access point are below for
further reference. The use of the staging area and water access point have been pre -approved for use
under a private lease agreement (Appendix K) which has been mutually accepted by all parties.

At the water access point, the pallets will be off-loaded with a forklift and placed on a material handling
vessel which is positioned in the water. A spotter boat will accompany the material handling vessel, to
ensure safe transport to the project location. The material handling vessel will meet a dive boat with crew
at the project location. The vessels will be surrounded by a floating turbidity curtain for precautionary
erosion control purposes. The stabilization bags will then be lowered to divers and hand -placed over the
pipeline. The turbidity curtain will be moved as construction progresses.
D. Technical Drawings
Technical drawings are attached for reference as Appendix F.
E. Proposed Construction Schedule
Work within Currituck Sound is planned to be complete in 18-22 days, weather permitting.
F. Riparian Property Owners:
Eight (8) property owners have been identified as riparian property owners adjacent to the work operation.
Landowner notification letters have been issued and are attached as Appendix G for reference. The

Submerged Aquatic Vegetation Assessment �/ %t
In preparation for the V-Line #208 Exposure Remediation Project, ONYX Services has performed
preliminary desktop research into the density and distribution of native submerged aquatic vegetation
(SAV) within the Currituck Sound. Although the data referenced does not cover the exact location of the
project, the findings can be applied to the entirety of Currituck Sound and can assist in determining the
presence of SAV within the project site.
2013 Studv
SAV surveys were performed in 2013 by Mr. Brett Hartis in support of a doctoral dissertation submitted
to the North Carolina State University titled "Mapping, Monitoring and Modeling Submersed Aquatic
Vegetation Species and Communities". The research finds that SAV distribution within the Currituck
Sound exhibited a highly patchy distribution (Figure 1) and during the SAV survey, most plants were
found at —1 .31 meters (4.3 feet). No plants were detected at a depth greater than 2.89 meters (9.5 feet).
The majority of SAV were found to be present at depths of 0.3 meters to 2.2 meters (0.99 feet to 7.2)
(Hartis 2013).

2020 Studv
In 2020, SAV data was collected and presented by Ms. Natasha G. Biarrieta in support of a Master's
Thesis and submitted to East Carolina University titled "SAVE Currituck Sound: Submerged Aquatic
Vegetation Evaluation in Currituck Sand, NC". SAV distribution between 1990 and 2012 was analyzed
(Figure 2) and compared to local bathymetry data to examine the historical relationship between depth
and SAV density (Figure 3).

The research conducted by Ms. Biarrieta, concludes SAV within Currituck Sound is not present beyond
a depth of 1.8 meters (5.9 feet) and are preferentially located at depths shallower than 1.0 meter (3.3
feet). The lack of SAV present in deeper areas of the Sound, may be caused by lack of light availability
in deeper water depths (Biarrieta 2020).

Additionally, the North Carolina Environmental Quality Submerged Aquatic Vegetation Habit Map was
reviewed to determine the current extent of SAV habitats within North Carolina. According to the map,
no SAV habitat is present at the proposed project site (Figure 4) (Quality 2021).

Conclusions
The research conducted and presented by Hartis, Biarrieta and the North Carolina Department of
Environmental Quality all conclude that SAV is primarily found within shallow areas of water along the
coastline of Currituck Sound. Although the research conducted did not occur for the project site
specifically, the conclusions can be used to presume that it is unlikely that SAV is located within the
proposed project site. Since the proposed project is located near the center and deepest part of the
channel, the protection of the pipeline is anticipated to have no impact on current or future SAV.
Additionally, the project site is located in an area previously disturbed by natural channel erosion. This
known erosion may have been enhanced by the lack of SAV present at the site.

If any change in the authorized work is required because of unforeseen or altered conditions

SPECIAL CONDITIONS

workplans, as depicted in the fay 2004 permit application document, which are a pan of this
pennit.

certifications. In addition, all construction and compliance monitoring will adhere to the
specific Phase ',D Environmental Compliance Manual (ECA9).
iv. Excavation, filling, and/or mechanized land clearing will not be undertaken at any time

includes all burrow and wasting activities associated with construction of this project.

ix. Construction methodologies at all Aretland and open water areas must he date in
accordance with the methodologies set out in 'I;tbles G-1 and 6-2 of the May 2004 pennit
application package.
x. No in -water excavation or tilling will he permitted between February 15 anti

This letter is confirming an agreement between ONYX Set -vices and Atlantic Sewage/Bryan Smith,
for temporary access to Currituck Sound from 143 S Albetuck Rd. Point Harbor, NC 27964 and
waterfront location 36.077321,-75.793797 for construction work in the water. The work will consist
of loading and unloading equipment and materials onto barges.
This agreement is for a period of approximately 30-60 days, beginning , 2021.
At the conclusion of the work, ONYX Services will restore the site to pre -construction quality.
ONYX Services will require a signature at the conclusion of the land repairs by the property
owner or a designated representative of the property owner, signifying approval of the land repairs.
This agreement is by and between ONYX Services and Atlantic Sewage/Bryan Smith only.
No other parties or entities are involved.
Payment:

The NC Division of Coastal Management hereby acknowledges receipt of your application
submitted for State approval for development to install stabilization bags over the exposed, or soon
to be exposed, areas of the existing sub -aqueous natural gas pipeline located at the south side of
the Wright Memorial Bridge between Currituck County and Dare County.
It was received complete July 7, 2021 and appears to be adequate for processing at this time. The
projected deadline for making a decision is September 20, 2021. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from July 7, 2021, you may request
a meeting with the Director of the Division of Coastal Management and permit staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of
your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
