This permit, issued on May 18, 2021 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) This permit authorizes only the docks, piers, gazebo, floating platform, boatlift, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whetherl floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or, otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or of er Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing dat . of the Coastal Resources Commission. This permit must be accessible on -site to Dep personnel when the project is inspected for compliance. Any maintenance work or project modification not hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees your project is consistent with the North Carolina Coy Management Program. &-2 For Braxton C. Davis, Director Division of Coastal Management This permit and its conditions are hereby accepted. - Signature of Permittee Lester Phillips Permit No. 68-21 Page 2 of 3 ADDITIONAL CONDITIONS 3) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the established Carolina Beach pier headline. 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) This permit authorizes a maximum of 2 formalized boat slips. 6) Should the lot to the south be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian rights, and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner to the north's area of riparian access. 8) Any portion of the permitted access pier and docking facilities built above Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 9) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 10) The roof of the gazebo shall not be designed for second story use. Bulkhead 11) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 12) The relocation of the existing stormwater outfall pipe shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 13) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 14) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 15) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. F er Phillips Permit No. 68-21 Page 3 of 3 CONDITIONS 16) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. 17) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 18) The bulkhead shall be constructed prior to any backfrlling activities. 19) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 20) All backfill material shall be clean and free of any pollutants except in trace quantities. 21) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. General 22) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of CoastI Management. 23) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 24) All debris associated with the removal or construction of the permitted bulkhead wall shall be contained within the authorized project area and rerrIoved to an appropriate upland location. NOTE: This permit does not eliminate the'need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to any authorizations required from the US Army Corps -of Engineers. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0443. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. The applicant states in the project narrative that the bulkhead is in need of replacement, and the existing stormwater pipe must be replaced and moved. The impacted area affected by the proposed relocation of the stormwater pipe also incorporates the same coastal wetland area that the applicant is asking to fill with the alignment of the proposed bulkhead. The applicant has also stated the desired alignment will result in the removal of historic non -authorized fill in the coastal wetlands and prevent future accumulation of trash. The applicant has demonstrated an attempt to minimize impacts to coastal wetlands by requesting an alignment as close to the existing bulkhead as possible for as long as feasible on the property before reaching the stormwater pipe area (See sheet 1 of 3). The facility does extend into the 15' riparian corMor setback of the adjacent neighbor to the south, however, the appropriate waiver has been obtained and included in the application materials. In the absence of any concerns from the commenting agencies, it is recommended that a permit be issued. This office has no objection to the!proposed work, provided it is consistent with all other state and federal permitting requirements. PROJECT DESCRIPTION: The project is located at 1213 Canal Drive, adjacent to the Carolina Beach Yacht Basin/Myrtle Grove Sound, in the Town of Carolina Beach, New Hanover Co. To locate the project site from the Wilmington Regional Office (WiRO), travel from Wilmington to Carolina Beach south on College Road (NC Hwy 132) to Carolina Beach Road for approximately 12 miles south. Continue over Snows Cut Bridge on N. Lake Park Blvd. for approximately 1.2 miles south until you reach Carl Winner Drive. Turn left onto Carl Winner Drive until you reach Canal Drive. Turn left on Canal Drive and continue north approximately 1.0 miles until you reach the project site, which will be located on the left'. The property parcel is approximately 0.36 acres in size (15681 SF) and features approximately 106 LF of shoreline frontage along the Carolina Beach Yacht Basin. The upland portion contains a single family residence and driveway, and the vegetation consists of domestic grasses and natural grasses. The shoreline is currently stabilized, with an existing bulkhead (106 LF) with an irregular alignment forms a 'pocket' in the southerg n corner failing the property (See sheet 1 of 3). Waterward of the bulkhead, there is coastal wetland vegetation consisting of primarily of smooth chordgrass,(Spartina altemflora) and black needle rush (Juncus Romerianus). On the property there is an 138 LF stormwater pipe that bisects the property from southeast to northwest. The stormwater pipe collects stormwater from Canal Drive and discharges it into the Yacht Basin. Around the discharge area of the pipe, there is a considerable amount of historic masonry rubble'and construction debris placed in the wetlands, estimated to be several decades ago based on appearance. The current docking facility; permitted under CAMA GP 43381 D in 2005, consists of afxed pier (88' x 6') extending from the high ground in a waterward direction. From the fixed access pier, an uncovered 'bumpout' platform (21' x 6') extends to the north. The fixed pier terminates on a fixed, covered platform (10' x 12') over open water. From the waterward edge of the covered platform, a ramp (parallel with the pier) extends down to a floating dock (1 Tx 6') that extends parallel with the shoreline. Slightly to the north and east of the floating dock, there is an existing boatlift. Currently.the facility,accommodates a total of 2 vessels. The facility was damaged in the past two hurricanes. The Town of Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed and zoned Residential. The waters of the Carolina Beach Yacht Basin are classified SB#. by the Division of Water Resources. They are NOT'designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to install a new vinyl bulkhead an average of 2' waterward and maximum 10' waterward of existing bulkhead and to straighten the alignment, add a 5' return wall, relocate an existing stormwater pipe and add drop inlets, and replace existing docking facility in existing footprint for a total of two (2) boatslips. According to the application materials, the current alignment of the bulkhead has led to a collection point for waterbome debris (this was observed by DCM staff on field visits) around the current stormwater pipe outfall. Since the bulkhead needs to be replaced, and the stormwater pipe needs to be moved across the property, the applicant is requesting a straight alignment for the proposed Lester Phillips Page 3 bulkhead across the property. For most of the shoreline (77 LF out of 106 LF), the requested alignment would be an average and maximum of 2' waterward of the existing bulkhead, according to the application materials. For the remaining 29 LF of the property, the applicant is requesting to fill an area ranging from 3' to 10' waterward of the existing bulkhead in that portion, which would result in the filling of approximately 604 SF of coastal wetlands, a portion of which is below NHW (See sheet 1 of 3). The applicant -originally proposed an alignment that would continue the bulkhead across the property line and tie in to a neighbor's wall horizontally, however permission had not been obtained from the neighboring property owner for the encroachment. Subsequently, this part of the proposal has been amended with the permission of the agent in the workplan drawings, to include a 5' return wall running back to the east, in a landward direction, along the property line, to eliminate any encroachment (see Sheet 1 of 3). According to the agent, the existing stormwater pipe needs to be replaced, and also relocated as it is currently encumbering the lot and driveway. The applicant Is proposing to remove 88 LF of existing stormwater pipe, replace the existing inlet (2.5' x 3.5'), and install two sections of 24" reinforced concrete pipe (22' and 88'), totally approximately 104' in. length, and install one junction box (2.5' x 3.5') [See Sheet 1 of 3]. The relocation of the pipe will require the excavation of 10 CY of material 'below NHW and 90 CY of fill. As part of the relocation of the pipe, the agent is proposing to remove the rubble and rock dumped in the marsh over the years immediately waterward_of the proposed outfall area, as the removal of this unauthorized hysicapla fill is required for the ph cement of the new pipe. The applicant is also proposing to replace the existing fixed pier in the same footprint, replace the existing uncovered "platform in the same footprint, repair the existing fixed gazebo, and replace the existing floating dock in the same footprint. The existing footprint of the docking facility results in the incorporation of 684 SF of.public trust area: The facility does.extend into the 15' riparian corridor setback of the adjacent neighbor to the south, however, the appropriate waiver has been obtained andincluded in the application materials. The existing facility (and proposed replacement) does not encroach the northern riparian corridor setback. The docking facility would accommodate a total of two (2) boatslips. 11. ANTICIPATED IMPACTS: As proposed, the new bulkhead and stormwater pipe relocation would fill approximately 604 SF of Coastal Wetlands, consisting primarily of Smooth Cordgrass (Span`ina altemiflora),a portion of which is below Normal High Water, and disturb approximately 1260 SF of high ground with tie back anchor installation and backfill, pipe relocation, and inlet construction (See Drawing 1 of 3). Replacing the existing docking facility in its same footprint will not create any new impacts, and would incorporate.684 SF of public trust area. Parcel Information: The project is located at 1213 Carolina Beach, within the incorporated area of Carolina Beach, in New Hanover County, North Carolina (see Appendix A). The subject property is zoned residential and encompasses approximately 0.21-acre, has been assigned R0881-003-007-000, by the New Hanover County Tax Office, and was platted in 1939, as shown on Map Book 3 Page 67 (Appendix B). Site Information: The project site abuts Carolina Beach Yacht Basin, which is part of the Cape Fear River Basin and is classified as SB, by ,the North Carolina Division of Water Resources (DWR (see Appendix C)). This area has not been deemed Permanent Secondary or Primary Nursery Area, by the N.C. Division of Marine Fisheries (see Appendix D). According to the North Carolina Division of Health, Shellfish Sanitation Section (HSS), the yacht basin waters are closed to harvesting shellfish (see Appendix E). Project History: A scoping meeting was held with Tara MacPherson, in October of 2019. Additionally, Patrick Amico has been to the site. To SEGi's knowledge, there is no history, for this project,,as it has been developed for many years. SEGi has submitted a request for a 401 WQC Pre -Filing Meeting, on 3 December 2020. The project proponent hereby requests the certifying authority review and act on this CWA 401 certification request, within the applicable reasonable period of time. Site Conditions: Currently, the site contains a single family, two story, dwelling, which is approximately 1150 SF of heated floor space, with wrap around decking, concrete driveway, and -parking area.
