The purpose of the proposed project is to better stablize these two parcels with a bulkhead (with a tie back system and
backfili) and riprap revetment. The Perry lot will be a homesite in the future. At this time, only a pier system is proposed to
be permitted. Any future home will be permitted with a CAMA Minor Permit if improvements extend into the 75 It AEC.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
Barge, dumptruck, skidsteer, vibratory hammer will all be utilized for the construction of a new bulkhead, pier and roofed
platform.
d. List all development activities you propose.
Proposed work includes a new shared bulkhead with assciated backfili and riprap protection in front, and, construction of a
pier/dock with a roofed platform and kayak launch for the Perry lot. See attached project narrative for a detailed desciption of
proposed work.

stabilization. The proposed alignment will tie into an existing bulkhead on an adjacent property to
the north (owned by Mary Susan Walters) �nd will extend ± 217' in a southeasterly direction to
connect with an existing bulkhead on an adjacent property to the south (owned by co -applicant
Jerry Ange). Once the bulkhead is constructed, it is proposed that some of the existing rip rap from
the site will be placed waterward of the bullhead for a length of 212' with an 8' wide base.
In addition to the proposed bulkhead, Applicant David Perry is proposing the construction of a
74'x6' pier terminating in a 20'x20' roofed platform (roofline dimensions of 20'x22') and a 12'x6'
lower platform located south of the pier to b6 placed on his property at 3910 Ivy Lane. That same
applicant proposes the placement of clean fil� in upland areas of his property for the future site of
a single-family residence.
The site of the proposed development is primarily located at 3910 Ivy Lane (Perry property), Lot
31 within Section 2 of the Kitty Hawk. Landing subdivision; however, a portion of the proposed
development extends onto 3904 Ivy Lane (�nge property), Lot 1 within Section 4 of the same
subdivision. Both properties are located within the Town of Kitty Hawk, Dare County, adjacent to
the Albemarle Sound.

Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are
not water dependent within the EW and PTA and lists uses that may be considered water
dependent.
Consistent: The applicants propose the construction of a bulkhead, rip rap revetment, pier,
platforms, and pier access walkway. This sub -paragraph considers these structures as
water dependent.
Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the
construction activities involved shall be consistent with the management objective of the
Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse
impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds of
submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and
nursery areas.
Consistent: The development is designed to not interfere with shellfish beds, submerged
aquatic vegetation (SAV), and/or spawning and nursery areas. The location is not classified
as a Primary or Secondary Nursery Area; a submerged aquatic vegetation (SAV) survey was
conducted and no rooted SAV was reported at that time. The property is adjacent to an area

if the proposed length gives access to deeper water at a rate of 1 foot each 100 foot increments of

Paragraph (d) addresses General Use Standards. Acceptable uses shall be those consistent with
the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those types
of development activities that will not be detrimental to the public trust rights and the biological
and physical functions of the estuarine and ocean system. Every effort shall be made by the permit
applicant to avoid, mitigate or reduce adverse impacts of development to estuarine and coastal
systems through the planning and design of the development project. In every instance, the
particular location, use, and design characteristics shall comply with the general use and specific
use standards for coastal shorelines, and where applicable, the general use and specific use
standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of
this Section. Development shall be compatible with the following standards:
Paragraph (d)(1) states all development projects, proposals, and designs shall preserve and not
weaken or eliminate natural barriers to erosion including peat marshland, resistant clay
shorelines, and cypress -gum protective fringe areas adjacent to vulnerable shorelines.

Paragraph (d)(2) states all development projects, proposals, and designs shall limit the
construction of impervious surfaces and areas not allowing natural drainage to only so much as is
necessary to adequately service the major purpose or use for which the lot is to be
developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the
applicant can effectively demonstrate, through innovative design, that the protection provided by
the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment
of areas exceeding the 30 percent impervious surface limitation may be permitted if impervious
areas are not increased and the applicant designs the project to comply with the intent of the rule
to the maximum extent feasible.
Consistent: The proposed landward development will be constructed using wooden
decking and clean sand as fill material. The development is therefore considered pervious.
Paragraph (d)(3) states all development projects, proposals, and designs shall comply with the
following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973:

of NWL and a maximum distance of 16 feet waterward of NWL. Existing riprap will be placed
waterward of the bulkhead with an 8 foot wide base and a length of 212 feet. Highg round fill will
be provided for construction of a future single-family house. The walkway will provide access
from the highground to the pier. No boat slips are proposed.
The waters of the Albemarle Sound are classified as Joint Waters and SB swimming and are
closed to shellfish taking. The subject properties are adjacent to an area designated as SAV
habitat by the Division of Marine Fisheries. A submerged aquatic vegetation survey was
conducted and no rooted SAV was reported to be growing in the project area at that time. Neither
property has been determined to hold any archaeological significance.
Anticipated Impacts resulting from this project are expected to include: the filling of 2,548 sq. ft.
of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC), .25 acre of
Estuarine Shoreline AEC, and .16 acre of High Ground Areas outside of an AEC, and; the shading
of 956 sq. ft. of High Ground outside of an AEC.
Basis for Determination:
The project area is designated as "Lower Density Residential Areas" on the Town of Kitty Hawk
Future Land Use Map (FLUM). The waters of the Albemarle Sound 100 yards from shore from
the subject properties are indicated as "Shellbank Point" and "ETJ Recreational Beach" on the
Future Land Use Map.

8. PROJECT SUMMARY: The co -applicants propose the construction of a bulkhead along a
hardened shoreline that will tie into existing bulkheads on adjacent properties. A rip rap
revetment is also proposed waterward of the bulkhead. One of the applicants (David Perry)
proposes the construction of a pier, roofed platform, lower platform, and a pier access
walkway on his property. That same applicant proposes the placement of clean fill in
upland areas of his property for the future site of a single-family residence.
Project Setting
The majority of the proposed development is located at 3910 Ivy Lane (Perry property),
Lot 31 within Section 2 of the Kitty Hawk Landing subdivision; however, a portion of the
proposed development extends onto 3904 Ivy Lane (Ange property), Lot 1 within Section 4 of the
same subdivision. Both properties are located within the Town of Kitty Hawk, Dare County,
adjacent to the Albemarle Sound.
The property owned by David Perry is platted at ± 14,927 ft2 (± 0.34 acres) and contains
± 107' of shoreline. The adjacent property, owned by the co -applicant Jerry Ange, is platted at
± 12,751 ft2 (± 0.29 acres) and contains ± 108' of shoreline. Elevation averages ± 3.5' above
Normal Water Level (NWL) in the high ground areas. At this time, both lots are vacant and
undeveloped containing no man-made features. The properties are primarily vegetated with
domestic lawn grasses. The shoreline of the properties is hardened and contains an existing rip
rap revetment that extends an average of 20' landward of NWL and 12' waterward of NWL.
Neither property has been determined to hold any archeological significance.
The applicant (David Perry) purchased the property at 3910 Ivy Lane in December 2020
and the co -applicant (Jerry Ange) has been the property owner of 3904 Ivy Lane since June
2015 and resides on the adjacent property. No permit history was known or submitted by either
applicant, and a search of CAMA records also found no permits issued to either of these
locations.
The waters of the Albemarle Sound are joint waters, classified as SB, and are closed to
shellfish taking. The property is located on the western side of a peninsula and it is ± 5.5 miles
across the water body to the opposite shoreline (Point Harbor, NC). The bottom substrate is hard
bottom sand and the substrate in a portion of the project area contains significant amounts of rip
rap material including concrete, cinder blocks, asphalt chunks, and other debris. Water depths
within the project site range from ± 0' to ± 3.5' below NWL. No wetlands were found to exist
along either shoreline and the location is not classified as a Primary or Secondary Nursery Area
by the NC Division of Marine Fisheries. A submerged aquatic vegetation (SAV) survey was
conducted and no rooted SAV was reported to be growing in the project area at that time. The
property is adjacent to an area designated by NC Division of Marine Fisheries as SAV habitat.
The shorelines of the adjacent properties are hardened with bulkheads and rip rap. Adjacent
properties are also developed with man-made structures including piers and platforms of various
sizes.

Development Proposal/Project Description
The applicants are proposing the construction of a wooden and vinyl bulkhead for the
purpose of shoreline stabilization. The proposed alignment will tie into an existing bulkhead on
an adjacent property to the north (owned by Mary Susan Walters) and will extend ± 217' in a
southeasterly direction to connect with an existing bulkhead on an adjacent property to the south
(owned by co -applicant Jerry Ange). The proposed alignment will average 6' waterward of NWL
with a maximum distance of ± 16' waterward. The proposed alignment terminates in the southern
end at NWL. Back fill material will consist of clean sand brought to the site from an upland
source. Portions of the proposed fill area include areas of sound bottom that contain existing rip
rap debris. Some of the existing rip rap debris located below NWL will be excavated prior to
bulkhead construction. Once the bulkhead is constructed, it is proposed that some of the existing
rip rap from the site will be placed waterward of the bulkhead for a length of 212' with an 8' wide
base.
In addition to the proposed bulkhead, Applicant David Perry is proposing the construction
of a 74'x6' pier terminating in a 20'x20' roofed platform (roofline dimensions of 20'x22') and a
12'x6' lower platform located south of the pier to be placed on his property at 3910 Ivy Lane. No
boat slips are proposed with the pier and water depths within the proposed development location
ranges from ± 2' to ± 3.5' below NWL. The proposed pier and platforms are similar to others in
the area, meet the'/<width rule, and do not encroach within the 15' riparian access setback. The
proposed pier and platforms are located ± 90' and ± 207' away from adjacent docking structures.
Associated highground development proposed is the placement and grading of ± 11,152
ft2 of fill on the Perry Lot in preparation for a future single-family residence. Lastly, the applicant
is proposing the construction of a 10'x6' walkway over land for pier access.
Anticipated Impacts
The construction of the bulkhead and associated rip rap revetment along the proposed
alignment will result in the filling of ± 3,548 ft2 of Estuarine Waters and Public Trust Area
AEC's.
• Bulkhead installation, back fill, upland fill, and associated grading will result in ± 11,063 ft2
(0.25 acres) of land disturbance within the Estuarine Shoreline AEC and existing property
lines.
• The proposed upland fill will result in an increase of upland elevation up to 2' in height.
• The proposed pier & platforms will shade 956 ft2 of Estuarine Waters and Public Trust
Area AEC's.

The Project Site consists of two adjacent lots (3904 & 3910 Ivy Lane), located in Kitty Hawk
Landing Subdivision, Kitty Hawk, Dare County, NC. The properties are on open waters of the
Albemarle Sound. Both of these lots are undeveloped and the only man-made improvements
include a riprapped shoreline primarily consisting of clean concrete pieces. The existing riprap
footprint extends an average of 20 ft landward of the NWL and 12 ft waterward of NWL (see
photos). The applicants are David & Elizabeth Perry for 3910 and Jerry & Jennifer Ange for
3904. These lots contain landscaped grasses at this time and are relatively flat. There are no
existing wetlands on the project Site.
The applicants would like to tie a new bulkhead into the adjacent bulkhead to the south (also
owned by Jerry & Jennifer Ange and run a straight line to the north (217 ft), where it would tie
into the adjacent owner's bulkhead (Mary Susan Walters). Most of the waters that would be
filled in association with this bulkhead contain riprap on the sound bottom. This consists of
concrete, cinder block, brick and other debris, and is completely exposed on a regular basis
when wind tides are low (north-east winds). We have included photos of normal tides and low
tides where this material is exposed. Prior to bulkhead installation, much of this riprap in water
will have to be pulled back, using an excavator in order to be able to drive piles and vinyl
sheeting. After bulkhead construction, some of the existing riprap from the Site will be placed in
front (waterward side) of the new bulkhead for added protection. Similar to adjacent and nearby
properties, the waters immediately adjacent to the shoreline (proposed bulkhead and rip rap
areas) do not support submerged aquatic vegetation (SAV) due to the very shallow water
depths that results in a dry sound bottom when there are north-northeast winds that continually
blow for at least one day. This area is susceptible to high wave energy and most of the nearby
bulkheads in Kitty Hawk Landing on the open sound also have added riprap protection.
In addition to the proposed bulkhead and shoreline stabilization, there is a proposed 74 If by 6-
foot pier extending from the center of Lot 3910 (Perry Lot) into the Albemarle Sound, with a 20-
foot by 20-foot roofed platform on the end. Also proposed is a lower 6 ft x 12 It platform for
kayaks and other paddle craft. Piers up to 100 It long are allowed in The Town of Kitty Hawk.

As adjacent riparian property owner to the above referenced project, it is required by NCDEQ, Division of
Coastal Management (NCDCM) that you be notified of the proposed work that requires a CAMA Major
Permit. Part of this project is a joint application between Mr. Ange (3904) and Mr. Perry (3910). As
depicted on the accompanying site plan, the proposed work requiring a CAMA Major Permit includes the
joint construction of a bulkhead wall along both properties that ties into both existing adjacent bulkheads,
a riprap revetment in front of the newly proposed bulkhead and backfill of the proposed bulkhead. In
addition to the join application Mr. Perry proposes the construction of a pier and platform at 3910 Ivy Lane
and fill to adjacent grades for a future residence at 3910. Please see included CAMA Plan for all
proposed work.

This will be a CAMA Major Permit for shoreline stabilization
bulkheading. The applicant proposes to construct a new bulkhead
that ties into the existing bulkhead corners on the adjacent properties
on both sides. There will also be a proposed pier and platform
system. I am working through the DCWCAMA field rep, Sarah Loeffler
on this project as well. I have attached a preliminary exhibit that we
will refine prior to submitting the complete application package.

The NC Department of Environmental Quality hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an AEC as
designated under the CAMA was received on 04/14/21. Mr. David Perry and Mr. Jerry
Ange proposes to stabilize adjacent property shorelines by constructing a bulkhead and
riprap revetment. Mr. Perry will also construct a pier, roofed platform, lower platform, a
pier access walkway across his property and place clean fill for the future site of a single-
family residence, located at 3904 & 3910 Ivy Lane, in the Town of Kitty Hawk in Dare
County.
A copy of the entire application may be reviewed at the office of the Division of
Coastal Management, located at 401 S Griffin St, Ste 300, Elizabeth City, NC, 252-264-
3901 during normal business hours. Comments mailed to Braxton Davis, Director, DCM,

The NC Division of Coastal Management hereby acknowledges receipt of your application
submitted for State approval for development to stabilize adjacent property shorelines by
constructing a bulkhead and riprap revetment. Mr. Perry will also construct a pier, roofed platform,
lower platform, a pier access walkway across his property and place clean fill for the future site of
a single family residence, located at 3904 &c 3910 Ivy Lane, in the Town of Kitty Hawk in Dare
County.
It was received complete April 14, 2021 and appears to be adequate for processing at this time.
The projected deadline for making a decision is June 28, 2021. An additional 75-day review period
is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from April 14, 2021, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
