This permit, issued on July 16, 2021 1 , is subject to compliance with the application (where consistent with the permit), all applicable reguladions, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) This permit authorizes only the jet ski ) ift and uses located in or over the water that are expressly and specifically set forth in the permit appl cation. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non - water dependent uses of.structures shad be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintar at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation r otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. Any maintenance work or project modification not hereunder requires further Division approval. Signature of Permittee Robert and Christy Peyton CONDITIONS Permit No. 88-21 Page 2 of 2 3) This permit authorizes one (1) additional formalized boat slips for a maximum of four (4) formalized boat slips at this docking facility. 4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dime 1i sions shown on the attached permit drawings. 6) The pier and associated structures shall h ave a minimum setback distance of 15 feet between any parts of the structure and the northern adjacent property owner's area of riparian access. General 7) This permit shall not be assigned, transfe Ted, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 8) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project ea and removed to an appropriate upland location. 9) The permittee and/or his or her contracto shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Enginee s authorized the project byway of Regional General Permit 197800056 (Action ID SAW-201 -01740). NOTE: The N.C. Division of Water Reso ces authorized the proposed project byway of General Water Quality Certification 4175 and assigned the project DWR Project No. 2016-0803 v2. NOTE: Future development of the permit ee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. Hey Greg, There's an existing floating dock that was originally going to relocated but we discovered that the channel location would not allow it so the only development is the addition of the small 2-pole lift. The application narrative notes the only development is the addition of the 6x8 lift, but the MP- 4 form identifies a floater being relocated as well. Also the existing workplan shows the floater being relocated, but the proposed workplan shows it as existing in that location. Can you clarify for me what the proposal is and authorize me to fix any application documents to make the project consistent? In addition, if the relocation of the floater is proposed it sits within the 15 foot setback of the Stone property. Currently I only have a green card signed from the Stone's and do not have a the waiver on file.
