Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No open water shall be excavated or filled , even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that in Ly be required. NOTE: The U.S. Army Corps of Engineer) authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2021-01302). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-1015. NOTE: Future development of the permitttle's property may require a modification of this permit. Contact a representative of the Di ision at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal high water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations in place at the time of such development. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The property is located off SR 1749 on Lot #6 and #7 adjacent the Pamlico River in Kilby Island subdivision near the Town of Bath in Beaufort County, North Carolina. The proposed dwelling will be located in both Zone 1 and Zone 2 of the 50' Tar -Pamlico River Buffer. The applicant has fulfilled their obligation to the Division of Water Resources (DWR) for the 401 prefiling by having an on -site meeting with Mr. Chris Pullinger a representative of DWR as noted through an email correspondence on June 5, 2020. This office has reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in a Coastal Shoreline. It is staffs recommendation that the proposed project is consistent with 07H.0208 (6)(B) which states in part "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet." Mr. Perdue's proposal for a 400ft2 platform is well below his allowable 1360ft2 of platform. The project is also consistent with rules found in 15A NCAC 07H.0208 (7)(Dxi) which state in part, "the Property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads", (ii) "the bulkhead alignment extends no further below normal water level than necessary ....to align with adjacent bulkheads", (iii) "the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners", (iv) "the need for a bulkhead below normal water level is documented by the Division of Coastal Management". This office also feels the development is consistent with 15A NCAC 07H.0209(d)(2) which states in part that "Impervious surfaces shall not exceed 30 percent of the AEC area of the lot". The applicant has proposed 15% of impervious surface with the Estuarine Shoreline Area of Environmental Concern, which is below the maximum allowed. Staff also recommends that the proposed project is consistent with 15A NCAC 07H .0209 (e) which states "The buffer requirements in paragraph (d) of this rule shall not apply to Coastal Shorelines where the EMC has adopted rules that contain buffer standards". If the proposed project is approved by the N.0 Division of Water Resources and the U.S. Army Corps of Engineers rules and regulations, this office recommends issuance of the Permit with standard permit conditions. PROJECT SUMMARY: The applicant proposes to clear and grade the vegetated lots in order to construct a±44' by f40ft single family dwelling with porches and decks as well as a 10' by 14' elevated storage building inside the 75' Coastal AEC with portions of the dwelling extending inside Zone 1 and 2 of the Tar -Pamlico River Buffer. Additionally, f 1778ft2 section of 404 wetlands are proposed to be filled along with the construction and backfill of a bulkhead, pier with platform, boatlift and 2 personal watercraft lifts. Mr. Perry Perdue Kilby Island — Perdue Project Beaufort County Proiect settin Mr. Perry Perdue has submitted a CAMA Major Permit application for the construction of a single- family dwelling including storage building, the filling of Section 404 wooded wetlands, installation of a vertical bulkhead for shoreline stabilization, a pier with platform, boatlift and personal watercraft lifts (PWC) located on his property off SR 1749 on Lot #6 and #7 adjacent to the Pamlico River in Kilby Island subdivision near the Town of Bath in Beaufort County, North Carolina. There are currently no man-made features on the project site, however the site is suited for a single- family residence. The site is f0.4 acres (made up of 2 lots) in size with the Pamlico River on the southern side and a man-made canal located on the northern side. The entrance to Kilby Island, Queen Anne Road runs through the property and is situated parallel to both the river and canal shoreline and is located approximately 20' from the canal edge. The project site has ±170.80 linear feet of shoreline along each waterbody and includes low sediment banks with an approximate elevation of 3' above NWL. The length of the shoreline along the river is bordered by Section 404 wetlands which are separated from the Pamlico River by a vegetated over wash sand berm approximately 15' to 20' in width containing mostly phragmities and scattered Spartina patens (salt meadow grass). There is a lower area of elevation containing a densely covered area of phragmities that is present immediately landward of the sand overwash bean on the upstream side (west) of the property. The remainder of the property is vegetated with various scrub shrub growth, Pinus tacda (Loblolly pine), Liquidambar styraciflua (sweetgum), and phragmities. Both the upstream (west) and downstream (east) properties have developed home sites and have installed shoreline stabilization in the forms of either jetties, vertical bulkheads and riprap rock. The upstream property does not have a pier however the downstream property has a pier, platform, and boatlift. This area of the Pamlico River is classified as SB NSW by the Environmental Management Commission at the project site. The Pamlico River is classified as coastal fishing waters at this site and the site is not located in a primary nursery area. The property is subject to the Tar -Pamlico Riparian Buffer rules enforced by the N.C. Division of Water Resources. The previous owner of Lots #6 & #7 Mr. Don Wilkerson Jr. applied for and received CAMA Major Permit #116-11 for the construction of a single-family dwelling and the filling of Section 404 wooded wetlands. Proiect description The applicant proposes to clear and grade the vegetated lots in order to construct a t44' by ±40' single-family dwelling including decks, porches and gravel parking area f 10' landward of NWL on the river side and ±56' from NWL on the canal side. Additionally, a 10' by 14' storage building is proposed on the west side of the single-family dwelling and a septic system will he installed east of the proposed dwelling approximately 53' landward of the NWL on the riverside and t50' ofNWL on the canal side. The applicant also proposes to fill approximately ±1,778 ft' ofUSACOE Section 404 wetlands that exist on the west end of the property which is separated from the Pamlico River by a sand over wash berm. The proposed RECEIVED JUN 15 2021 DCM-MHD CITY dwelling will be located in both Zone 1 and Zone 2 of the 50' Tar -Pamlico River Buffer. The applicant has Milled their obligation to the Division of Water Resources (DWR) for the 401 prefiling certification by having an on -site meeting with Mr. Chris Pullinger a representative of DWR as noted in an email correspondence dated June 5, 2020. The applicant also proposes the installation ±170.25' of vertical bulkhead extending a maximum of 6.48' waterward of N WL and averaging 3.48' along its alignment. Next, the applicant proposes the installation of a 6' by 100' pier with a 20' by 2O' platform, 13' by 13' boatlift, and two 5' x 12' PWC lifts. The pier, platform, boathouse and boatlift will be located in Estuarine Waters and the Public Trust Area AEC. Anticipated impacts The applicant proposes to disturb f 10,900ft' of land including the filing of t 1,77811' of Section 404 wooded wetlands. The total imperious surface for the site including gravel parking area is f2,528ft' (17%). In addition, the total impervious surface in the Coastal Shoreline Area of Environmental Concern is 1,980ft' (15%). The installation of the bulkhead will result in the fill of 593ft' of river bottom and the pier and docking facilities will result in the shading of t1000ft' of river bottom as well as some short-term localized turbidity throughout the construction process. The construction of the dwelling as proposed takes place in both Zone 1 and Zone 2 of the Tar -Pamlico River Buffer with a total of f 1,076ft' of impact taking place in these zones. In my 7 years residing in this state, in using the waters here in Eastern NC, both as a boat owner and a land dweller, swimmer and former fisherman, I have encountered a number of complainers, upset at the strictness and pickiness of the coastal management. I have not agreed with them at all about any point in their complaining. Like Mr. Spock, I agree that the needs of the many outweigh the needs of the few or the one. The native Americans, here on this north American continent when the Europeans arrived, built small fires and huddled close for warmth and protection from the elements. The Europeans, on the other hand, built large fires, and stood back. Those indigenous people were reduced, not in a small way, by being referred to as Indians, thereby being minimized and belittled. Similarly, stands of trees, filled with many related ecosystems, have come to be called "woods", an equally belittling name for part of our great mothers nurturing quality. Destroying the natural stand of trees and replacing them with another fragile and frankly ugly (my opinion) structure made by man, at the cost of "cutting down woods" seems harmless enough when framed this way. Considered in the bigger picture, taking into consideration the comments I have submitted here, I hope the act of destroying the environment in question will not be dismissed as "harmless enough", and granting a permit, or committing a construction project with any such terminologies, will be denied, provided going forward would be a violation of either the letter, or the spirit, of the law. That new CAMA Major Permit should cover what had been previously approved, as well as your plans to add a bulkhead and pier. Kelly said that you could call him to begin the application process (his phone is 948-3853), as well as to talk with him about whether he'd need to make a site visit to verify whether or not any coastal marsh still exists on the properties, as that could affect the location of any bulkhead.
