SW, in Supply i requested in the permittee's application dated 8n120, including attached workplan drawings (6), Sheets Pl-P6 of 6 all dated 8/3/20. This permit, issued on March 24, 2021 1 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) This permit authorizes only the elevated boat ramp, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this boat ramp and associated facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public. Trust waters without permit modification. 2) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or dther Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. This permit must be accessible on -site to Dep I ent personnel when the project is inspected for compliance. Any maintenance work or project modification not hereunder requires further Division approval. Permit No. 32-_21 Page 2 of 3 ADDITIONAL CONDITIONS 3) No fill material shall be placed below the normal high water line outside of the areas indicated on the attached workplan drawings. 4) . Excavation and ground disturbing activities, associated with the placement of the boat ramp, above and below the normal high water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the attached permit application and workplan drawings. 5) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. 6) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 10) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). Sediment and Erosion Control 11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property. 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. General 13) This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to any authorizations required from the U.S. Army Corps of Engineers. 14) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. Oyster Harbour Homeowner's Association, Inc. Permit No. 32-21 Page 2 of 3 ADDITIONAL CONDITIONS 15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 16) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to any authorizations required from the U.S. Army Corps of Engineers. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2002-15300. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not autho ' ed within 30 feet of the normal high water line. NOTE: An application processing fee of $1'00 was received by DCM for this project. This fee also satisfied the Section 401 applicatiop processing fee requirements of the Division of Water Resources. The existing community elevated boat ramp is in a deteriorated condition and needs to be replaced in the near future. The Oyster Harbour HOA intends to replace the existing elevated boat ramp as soon as agency approval can be obtained and a contractor can be selected. The elevated boat ramp is contained within a private gated facility and used by members of the Oyster Harbour community for boating access to navigable waters for recreation and fishing. c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and where it is to be stored. Barge -mounted crane and equipment will be used to demolish the existing elevated boat ramp, load onto a barge, and transport to an offsile disposal facility. Timber and concrete support piles for the new replacement elevated boat ramp will be driven by a pile -driving hammer that is attached to a barge -mounted crane. A temporary steel sheet piling cofferdam will be installed around the lower portion of the elevated boat ramp (concrete portion) so that the concrete ramp can be constructed to the required below -water elevations. Approx. 215 CY of material (mud) will need to be excavated temporarily from within the cofferdam to allow access for construction. After construction of the new concrete elevated boat ramp is complete, the excavated material will be replaced back in its original locations; and prior to removal of the temporary cofferdam. The upper (timber) portion of the new replacement elevated boat ramp will consist of pile -supported heavy limber framing / stringers with timber decking. The lower (concrete) portion of the new replacement elevated boat ramp will be supported on prestressed concrete piles and reinforced concrete pile caps, and the boat ramp surface will consist of reinforced concrete slabs. The temporary sheet piling cofferdam will be removed once construction of the lower (concrete) portion of the new elevated boat ramp is complete. Construction equipment will consist of: one or two floating barge(s) for equipment and material, one tracked crane with diesel -powered pile -driving hammer, one vibratory hammer for sheeting piling installation and extraction, one tracked excavator, one tug boat, one small dingy for access to land, two small floating work piaffonns, and various small power tools. All demolition and construction will be performed by water - working from the equipment and material barge(s). d. List all development activities you propose. PROJECT DESCRIPTION The proposed project is located on the mainland side of the AIW W at the end of Booties Neck Rd in Supply, Brunswick County. The property can be reached by traveling NC HWY 17 south towards Shallotte. Take a left hand turn onto Mt. Pisgah Rd SW. Continue for 4 miles onto NC HWY 130 E. Take the first right-hand turn onto Oxpen Rd SW and continue for 1.7 miles. Take a right onto Booties Neck Rd SW and continue for 1.9 miles until the road dead ends into the Oyster Harbour private boat ramp located on the AIW W. The Oyster Harbour HOA began construction of the Oyster Harbour Waterway Park under State Permit # 145- 03, consisting of a parking lot, playground, deck, gazebo, bulkhead, boat ramp, and 9 slip docking facility. A minor modification was issued for State Permit # 145-03 on 7/16/2004 to construct a kayak launching facility consisting of an access pier, ramp, and floating dock. A letter of refinement dated 8/5/2004 authorized the Oyster Harbour HOA to straighten the curve in the elevated portion of the ramp to improve safety and usability. An express major permit was issued on 5/13/2009 (State Permit # 50-09) to add two additional finger piers to the existing docking facility and perform maintenance dredging around the existing boat ramp and boat slips. A maintaince-5 renewal was issued on 4/26/2016 to continue dredging within the existing dredge footprint. Another maintaince-5 renewal was requested on 8/12/2020 but has not been issued as of the complete date of this application. The property consists of a gated, private docking facility, boat ramp, parking lot, and high -ground gazebo. The project site is located on a .72-acre parcel approximately 15' above normal high water (NHW) and is vegetated with typical coastal plain tree species. The parcel has approximately 100' of shoreline frontage along the southern edge of the property and is stabilized by bulkhead. The shoreline is comprised of 404-type wetlands and Coastal Wetlands. Coastal wetlands consisting primarily of Smooth Cord Grass (Spartina alterniflora) and patches of Black Needlerush (Juncus romarianus spp.) extend waterward approximately 60' beyond the 404- type wetlands. The width of the waterbody measures approximately 583' from marsh to marsh in the vicinity of the proposed boat ramp. The waters of the AIW W are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harveiRGCEIVED shellfish. PROPOSED PROJECT NOV 13 2020 The applicant proposes to replace the existing boat ramp in the same footprint to serve the Oyster ar urr -IVIHD DIN subdivision. The applicant proposes to replace the existing 16' x 220' elevated boat ramp in the same footprint as previously permitted (State Permit # 145-03). The boat ramp would consist of 2 sections; a 16' x 114' timber portion that would originate from an upland point and extend due south, and a 16' x 107' cast -in -place concrete portion that would connect to the timber section and continue waterward (See Sheet # 3 of 6). The applicant states that due to the close proximity of the boat ramp to the docking facility, much of the existing fixed pier, pilings, and floating docks would have to be temporarily removed prior to the demolition of the existing boat ramp. Following the demolition of the existing boat ramp, the applicant proposes to install a 28' x 120' temporary sheet -pile coffer dam around the perimeter of the proposed concrete portion of the boat ramp to allow the concrete slabs to be cast in place. Approximately 215 CY of material would be temporarily excavated (maximum depth -8' MLW) from an area of approximately 2,120 sq. ft. within the coffer dam and stored on a floating barge (See Sheet # 5 of 6). The applicant states that the excavation would be necessary to ensure the Oyster Harbour Boat Ramp Replacement November 9, 2020 Page 3 lower portion of the proposed concrete elevated boat ramp structure could be constructed at the specified elevations to ensure proper functionality and access during all tide cycles and water levels. Prior to the removal of the coffer dam, the 215 CY of excavated material would be replaced back in the same footprint. The applicant states that upon completion of the proposed boat ramp, all components of the existing docking facility would be reinstalled in the same footprint. All demolition and new construction work would be conducted from the water using floating barges and other small work floats. According to the application, the property has approximately 100 linear feet of shoreline. The proposed boat ramp would encroach within 2' of the adjacent riparian line to the east and within 69' of the adjacent riparian line to the west. Water depths in the vicinity of the proposed boat ramp range from +12.3' MLW to -5.5' MLW near the waterward end of the boat ramp (See Sheet # 5 of 6). The applicant's proposed design extends beyond the '/< width limit (approx. 26% of waterbody width) but terminates approximately 98' landward of the USACE 80' Federal Channel setback. 10. ANTICIPATED IMPACTS The proposed boat ramp would result in the shading of approximately 1,040 sq. ft. of Coastal Wetlands and approximately 3,120 sq. ft. of shallow bottom impacts within Estuarine Waters and the Public Trust Area. According to the application, 215 CY of soft bottom would be temporarily excavated near the water -ward end of the boat ramp to set concrete slabs in place. The excavated material would be placed back in the same footprint prior to the removal of the coffer dam. As proposed, the boat ramp would be located entirely within the existing boat ramp footprint resulting in no additional impacts that were not previously accounted for under State Permit # 145-03 and State Permit # 50-09. There appears to be no Submerged Aquatic Vegetation nor shellfish beds in the project area. This area is a not a Primary Nursery Area and is open to the harvest of shellfish by the Division of Marine Fisheries. The proposed development would be located outside of the adjacent 15' riparian corridor setback to the west and a waiver was obtained to encroach within the 15' riparian corridor setback to the east. Although the proposed boat ramp length would exceed the ''/a width of the waterbody (See Sheet # 3 of 6), the last 70 linear feet of the boat ramp would sit below the MLW mark, allowing for public trust use during normal tidal cycles. As proposed, the boat ramp would remain landward of the 80' Federal Channel setback. Turbidity associated with demolition and new piling installation should be expected. (OHHOA) intends to replace the existing private - community elevated boat ramp. The existing elevated boat ramp has deteriorated over the years to the point that replacement is needed in the near future in order to ensure that community residents can safely launch boats for access to navigable waters for fishing and other recreational purposes. The existing elevated boat ramp consists of two portions. The first portion is constructed of timber support piling, timber pile caps, timber stringers, and timber decking. It begins at the bulkhead that runs along the edge of the upland and extends approximately 114 feet in length out towards the Atlantic Intracoastal Waterway (AIWW). The second portion is constructed of a cast -in -place concrete slab that is supported on timber piling. The existing elevated concrete boat ramp begins at the end of the timber boat ramp (Sta. 1+14) and extends approximately 107 feet; ending at Sta. 2+21. The entire elevated boat ramp, timber and concrete, is approximately 16-feet. in width. A 6" x 8" timber curb guard runs along both sides of the existing boat ramp for the full length. Also, timber guard rails run along both sides of the elevated boat ramp for approximately the first 143 feet. In order to construct the new replacement elevated boat ramp, the existing dilapidated elevated boat ramp will be demolished and disposed offsite. The new replacement elevated boat ramp will be constructed, in place, to the same dimensions (length and width), top elevations, and slopes as the existing structure. The top elevation at the beginning of the new elevated boat ramp will be at+12.3 feet Mean Low Water (MLW) and the top elevation at the lower end of the new elevated boat ramp is -5.5 feet MLW; existing and proposed. The first 114lineal feet of the new replacement elevated boat ramp will be constructed with treated timber, same as the existing timber elevated boat ramp. The new replacement concrete elevated boat ramp (approximately 107 feet in length) will be constructed of reinforced concrete slabs supported on reinforced concrete pile caps and prestressed concrete piles. A temporary steel sheet piling cofferdam will be installed around the perimeter of the area where the concrete portion of the elevated boat ramp is located. This will allow water to be pumped out to provide dry working access to this below -water area during construction. Additionally, approximately 215 cubic yards of mud will need to be temporarily excavated from an area of approximately 2,120 square feet from within the cofferdam. This is necessary so that the lower portion of the new concrete elevated boat ramp structure can be constructed at the specified elevations to ensure proper functionality and access during all tide cycles and water levels. The excavated material will be temporarily stored on the floating work barge during construction and then will be replaced back in its original locations after construction of the new concrete elevated boat ramp is complete. The temporary cofferdam structure will be removed when construction is complete. Existing adjacent fixed access decks, gangway ramps, and portions of the floating dock will need to be temporarily removed to allow access to the work area during construction. These structures will be replaced back in their original locations once all boat ramp construction is completed. All demolition and new construction work will be conducted from the water using one or two floating barges and other small work floats. As noted above, the proposed new replacement elevated boat ramp structure will be constructed in the same location as the existing structure. The existing elevated boat ramp structure is located within the range of approximately 2-feet to 14-feet from the eastern riparian property line and within the range of approximately 69-feet to 80-feet from the western riparian property line.
