This permit, issued on May 7, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization - Bulkhead 1) The bulkhead alignment shall be const Icted in the alignment of the existing bulkhead at the time of construction. 2) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. (See attached This permit action may be appealed by the permittee or qualified persons within twenty (20) days of the issuing d This permit must be accessible on -site to Dep personnel when the project is inspected for compliance. Any maintenance work or project modification not hereunder requires further Division approval. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. USACE Conditions 18) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at httos://www.fins.gov/raleigh/odfs/ManateeGuidelines2Ol7.2df. General 19) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 20) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 21) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2021-00366). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-1956. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. Both entities hold deeds to separate parcels within the same park. The project is located at the intersection of Anne St., Tallman St., and Riverview St. in the downtown area of Jacksonville, Onslow County. The park is located between New Bridge and Marine Blvd. along New River. The property has 740' of waterfront and averages +4' NHW in elevation. The property is cleared and vegetated with various grasses. Existing on high ground is a boardwalk along the shoreline. An existing bulkhead stabilizes the shoreline. There are patches of Coastal Wetlands waterward of the existing bulkhead. Two observation piers extend into the river. The New River is 500 ft. wide in this area and has a muddy substrate. This area of the New River is classified as SB-HQW and is a Primary Nursery Area. The adjacent waters of the New River are closed to the harvesting of shellfish. The city of Jacksonville and Onslow County are proposing to renovate an existing park located at the intersection of Anne St., Tallman St., and Riverview St. in the downtown area of Jacksonville, Onslow County. This area of the New River is classified as SB-HQW and is designated as a Primary Nursery Area (PNA) by the NCDMF. The adjacent waters of the New River are closed to the harvesting of shellfish. The City of Jacksonville, LUP classifies the area within the 75' Estuarine Shoreline AEC as conservation and all other areas commercial. The renovations include a 700' vertical bulkhead in the footprint of the existing bulkhead and one existing 74' pier will be replaced. There are patches of coastal wetlands along the existing bulkhead. PNAs are estuarine waters where initial post -larval development occurs. Species within this area are early post -larval to juvenile and include finfish, crabs, and shrimp. Species inhabit PNAs because they afford food, protection, and proper environmental conditions during vulnerable periods of their life history, thus protection of these areas are imperative. Increased sedimentation raises concern for shellfish and shellfish habitat by either the direct burial of oyster beds or reductions in filtration efficiency, respiration rates, and/or reproduction and settlement. Larval oysters require a clean hard bottom for attachment and sedimentation as little as 1 or 2 mm may inhibit settlement. Duration of sedimentation suspension and water quality degradation has been shown to result in juvenile oyster mortality. Coastal wetlands are considered among the most productive ecosystems in the world. Coastal wetlands are a productive detritus -based system that trap nutrients, toxins and sediment, aid in shoreline erosion control, dissipate wave and storm action, provides a barrier to flood damage, and provide nursery functions and support fish production. For the above -mentioned reasons, the NCDMF would request that a moratorium on in -water work, to include dredging, from 1 April to 30 September is recommended to reduce the negative effects on critical fish life history activities, to include spawning migrations and nursery functions. The site is located within waters of the New River, at the Onslow County New River Waterfront Park, located between Old Bridge Street and NC Hwy 24/17 (Marine Boulevard), in Jacksonville, Onslow County, North Carolina. Coordinates are approximately 34.751806 N,-77.433333 W. The applicant proposes to replace the existing bulkhead, boardwalk, and one observation dock associated with the renovation of the Onslow, County New River Waterfront Park. Specifically, the applicant proposes to replace 700 linear feet of the existing bulkhead by removing the headwall and driving vinyl sheet piles in the same footprint. No fill in waters or wetlands would be required to accomplish bulkhead replacement. Additionally, the applicant will replace one existing observation pier ( 741 X 7'W access, which at about half its total length, widens to approximately 13' as it turns creating an L-Shape, and narrows back to 7'W continuing out in the river, terminating at a 21'X15' observation pier) in the same footprint. There are patches of wetlands along the shoreline and adjacent to the observation pier. All other proposed work is upland development. The applicant's plans state that no impacts will occur to historic sites Pelletier House and Wantland Spring. Dredging is not proposed as a part of this project. The project site is located directly north of the Corps federal channel. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at the intersection of Anne Street, Tallman Street, and Riverview Street adjacent the New River in Jacksonville, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to renovate an existing public park located along the river. A new 700' vertical bulkhead would replace the existing bulkhead in the same footprint. Along the bulkhead cap, a pedestrian boardwalk and sidewalk would also be replaced in the same footprint. All upland structures and development would remain as is; there is no increase of impervious surface. In addition to the upland renovation, one of the observation piers will be replaced within its existing footprint. The 7' wide dock would extend 74' into the river with a 21' by 15'observation platform at the terminus of the structure. No formalized slips are proposed. The New River at this location is classified SB HQW by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries. The NCWRC has reviewed the permit application and supports the project and the public access improvements it will provide. To minimize impacts to important PNA habitats, we request an in -water work moratorium of April I — September 30 be incorporated as a permit condition. It consists of 740'1 of bulkhead, boardwalk, handrail and a 75'f long pier, along the Eastern side of New River in Downtown Jacksonville. It is on several tracts of land owned by Onslow County and The City of Jacksonville. The park was constructed, built and maintained by Onslow County. The structures have encountered many floods and hurricanes over the years. In 2018, Hurricane Florence did extensive damage to the structures, and the County applied for and received FEMA assistance to replace the structures. A detailed survey has been conducted, and plans have been developed to replace the bulkhead, boardwalk, pier and handrails along the New River. It is proposed to drive new vinyl sheet piles 2' from the existing bulkhead, on water side, then remove the existing bulkhead, pier, boardwalk and handrails and replace them. No new impervious area is proposed. New River is classified SB; HQW, NSW, in this area. A scoping meeting was held at which DWR was present. The date of the scoping meeting was 12-14-20 and this project was discussed. This meeting met the requirement for requesting a pre -filing meeting under 40 CFR Part 121 for 401 Certifications in accordance with the Federal Clean Water Act. It consists of 740'f of bulkhead, boardwalk, handrail and a 75'f long pier, along the Eastern side of New River in Downtown Jacksonville. It is on several tracts of land owned by Onslow County and The City of Jacksonville. The park was constructed, built and maintained by Onslow County. The structures have encountered many floods and hurricanes over the years. In 2018, Hurricane Florence did extensive damage to the structures, and the County applied for and received FEMA assistance to replace the structures. A detailed survey has been conducted, and plans have been developed to replace the bulkhead, boardwalk, pier and handrails along the New River. It is proposed to remove the existing bulkhead, then drive new vinyl sheet piles in same location as the existing bulkhead, then remove the existing pier, boardwalk and handrails and replace them. No new impervious area is proposed. New River is classified SB, HQW, NSW, in this area. A scoping meeting was held at which D WR was present. The date of the scoping meeting was 12-14-20 and this project was discussed. This meeting met the requirement for requesting a pre -filing meeting under 40 CFR Part 121 for 401 Certifications in accordance with the Federal Clean Water Act. Pelletier (b. 1819) in the 1840s (Taylor. U.S. Census). The two brothers quickly established themselves as merchants. In July'1846 William Pelletier and two prominent local lbndowners and merchants - George Ward and Edward W. Montford - purchased a turpentine distillery on the New River (Onslow County Deed Book 25, page 359). Rufus probably had some involvement in this partnership, although his name is never mentioned in connection with others. The distillery that Ward, Montford, and Pelletier purchased included "the turpentine still worm tube (and) one vessel or schooner called the Speck and one scow or flat" as wail as a quarter -acre, "still yard" located on the New River waterfront (probably the sere parcel on which the Pelletier House was later built). During this period William Pelletier also bought a lot on the courthouse square where he operated a store (Onslow County Court Records. Onslow County Deed Book 28, page 124). Pelletier's store may have operated in a symbiotic relationship with the partnership's distillery, a combination not uncommon in Onslow County during the nineteenth century' (see Onslow County Multiple Property Documentation Fbrm: Naval Stores and lumber Production in Onslow County, 1734-1938.. Early Commercial Activity, Late Nineteenth Century Naval Stores Production). The 1850 census of industry listed thet product of "Ward Montfort Company" as $50,000 worth of turpentine and other pine products. This value of product ranked third in the county but was only a few thousand dollars less than the product of the top -ranked distillery, that of David W. Sanders at Palo Alto. A year later, in the January 1851 act of amendment to Jacksonville's corporate limits, the distillery was referred to as "William P. Pelletier and Company' '(NC Session Laws, 1850: 707). In June 1851 Pelletier's distillery burned along wr ixfthT" tures, a quantity of spirits, turpentine, rosin, and oak staves [and] also a part of the bridge across New River" at a loss of $2,500 (Wilmington Weekly Journal, June 13, 1851). Even if Ward and Montford absorbed some of the 'loss, the fueprobably proved disastrous for William Pelletier's finances. References in deeds for adjacent lots, dating to 1854 and 1857, identify Rufus Pelletier as the owner of the still yard lot. (Oaslow, County Deed Book 27. page 289; Book 28, page 315). The brothers may have had title transfered in order to protect the property from seizure. 8y 1857 Rufus Pelletier appears to have run into financial difficulties of his own, for in that year the still yard lot was sold at auction to Duncan Frazelle, possibly as a security on a bond (Onslow County Deed Book 45, page 292)• There is evidence that Rufus reserved the right to use the property through private agreement with Duncan Frazelle and his son, Janes Frazelle. There is no indication that the property continued to function as a still yard, although it was described as such until the late nineteenth century. Rufus Pelletier bought the lot back from the Frazzelles in 1885 (Ons1cw County Deed Book 45, page 294). Rufus Pelletier engaged in a number of activities from the 1850s through the 1880s. In 1856 he served a one-year term as Jacksonville's postmaster (Taylor. Jacksorville's postmasters). The 1850 and 1860 censuses list him as a merchant; in the 1870 census he appears as a clerk in an unidentified store.
