Sunnyvale Dr., in Wilmington , as requested in the permittee's application dated 911120, including attached
workplan drawings (7), Sheets 1-7 of 7 all dated 11/23/20.
This permit, issued on February 11, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no
excavation or filling shall be permitted between February 15 and September 30 of any year without
the prior approval of the Division of Coastal Management, in consultation with appropriate resource
agencies.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -38 feet below mean low water (MLW). In no case shall the depth of
excavation exceed the depth of connecting waters.

This permit action maybe appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
5) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding
waters outside of the alignment of the fill area indicated on the workplan drawing.
6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a
spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the
National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
7) In order to prevent leakage, dredge pipes shall be routinely inspected. If leakage is found and repairs
cannot be made immediately, pumping of material shall stop until such leaks are fixed.
Spoil Disposal
8) No spoil material shall be placed within 30 feet of the normal high water line.
9) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the
site is graded and stabilized.
10) The disposal area effluent shall be contained by pipe, trough, or similar device to a point at or beyond
the normal low water level to prevent gully erosion and unnecessary siltation.
11) The terminal end of the pipeline shall be positioned at or greater than 50 feet from any part of the dike
and a maximum distance from spillways to allow settlement of suspended sediments.
12) A water control structure shall be installed at the intake end of the effluent pipe to assure compliance
with water quality standards.
13) The diked disposal area shall be constructed a sufficient distance from the normal high-water level or
any marsh and sufficiently maintained to eliminate the possibility of dike erosion or spoil deposition into
surrounding wetlands or waters.
14) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.
15) If the alignment of the dredge pipe changes from the attached workplan drawings, the permittee and/or
his or her contractor shall meet with a representative of the Division prior to project initiation.

16) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
Stormwater Manaeement
17) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project will require
a Stormwater Management permit. The permittee shall receive a Stormwater Management permit from
DEMLR prior to the initiation of any construction. Submit this plan to the Division of Energy, Mineral
and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC
28405. Any violation of the permit approved by DEMLR shall be considered a violation of this CAMA
permit.
Sedimentation and Erosion Control
18) An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at
least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the
Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension,
Wilmington, NC 28405.
19) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
20) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
21) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.
USACE / Federal Conditions
22) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

23) An as -built survey shall be performed in the dredge footprint area, and copies of the survey provided to
the U.S. Army Corps of Engineers and Division of Coastal Management, within 60 days of completion
of construction of these portions of the project.
'General
24) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
25) All debris associated with the permitted dredging activity shall be contained within the authorized
project area and removed to an appropriate upland location.
26) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit No. 35
(Action ID SAW-1994-03672).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-1776.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water.
NOTE: An application processing fee of $475 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries,
regarding potential impacts to shallow bottom. Should concerns be expressed over potential impacts from any ofthe resource
agencies, the project could then be found to be inconsistent with NCAC 07H .0208(a)(2), which requires that the location,
design and need be consistent with the management objective of the Estuarine System AEC and the project be sited and
designed to avoid significant adverse impacts upon the productivity and biological integrity of spawning and nursery areas.
It is the stafPs recommendation that the proposed excavation is CONSISTENT with the Rules of 15 A NCAC 07H.0208
(b)(1) Specific Use Standards due to the existing maintenance dredge footprint and (F) which states, "Any canal or boat
basin shall be excavated no deeper than the depth of connecting waters. The proposed excavation is also CONSISTENT
with the Rules of 15 A NCAC 07H.0208 (b)(2) Hydraulic Dredging.
This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting
requirements. It is recommended that any permit issued should include standard conditions for excavation.

A North Carolina Division of Marine Fisheries (NCDMF) Fisheries Resource. Specialist has reviewed
the CAMA Major Permit application for proposed actions that impact fish and fish habitats. The
applicant proposes to perform maintenance dredging within the existing belth footprint, which
was previously dredged through State Permit No.102-94. Maintenance excavation is proposed in
an area measuring approximately 1000 ft. wide by 130 ft. long within the existing berthing
footprint. Approximately 17,000 cubic yards of material would be excavated from the Cape Fear
River to a final depth of-38 ft. (-36 ft. plus 2 ft. overdredge) at MLW. The application states that
existing water depths in the project area are an average of -24 ft. at MLW. The New Hanover County
and the City of Wilmington 2006 Land Use Plan classifies adjacent waters as Conservation, and the
adjacent high ground portion of the project area as Urban/Resource Protection. The waters of the
Cape Fear River are classified SC by the Division of Water Resources. They are designated as a .
Primary Nursery Area (PNA) by the NCDMF.
PNAs are estuarine waters where initial post -larval development occurs. Species within this area
are early post -larval to juvenile and include finfish, crabs, and shrimp. Species inhabit PNAs because
they afford food, protection, and proper environmental conditions during vulnerable periods of
their life history, thus protection of these areas are imperative. Increased sedimentation raises
concern for shellfish and shellfish habitat1by either the direct burial of oyster beds or reductions in
filtration efficiency, respiration rates, and/or reproduction and settlement. Larval oysters require a
clean hard bottom for attachment and sedimentation as little as 1 or 2 mm may inhibit settlement.
Duration of sedimentation suspension and water quality degradation has been shown to result in
juvenile oyster mortality. Coastal wetlands are considered among the most productive ecosystems
in the world. Coastal wetlands are a productive detritus -based system that trap nutrients, toxins
and sediment, aid in shoreline erosion control, dissipate wave and storm action, provides a barrier
to flood damage, and provide nursery functions and support fish production.

For the above -mentioned reasons, the N.C. Division of Marine Fisheries would request that a
moratorium on in -water work, to include dredging, from 1 April to 30 September is recommended
to reduce the negative effects on critical fish life history activities, to include spawning migrations
and nursery functions.

A North Carolina Division of Marine Fisheries (NCDMF) Fisheries Resource Specialist has reviewed
the CAMA Major Permit application for proposed actions that impact fish and fish habitats. The
applicant proposes to perform maintenance dredging within the existing belth footprint, which
was previously dredged through State Permit No.102-94. Maintenance excavation is proposed in
an area measuring approximately 1000 ft wide by 130 ft. long within the existing berthing
footprint. Approximately 17,000 cubic yards of material would be excavated from the Cape Fear
River to a final depth of -38 ft. (-36 ft. plus 2 ft. overdredge) at MLW. The application states that
existing water depths in the project area are an average of -24 ft at MLW. The New Hanover County
and the City of Wilmington 2006 Land Use Plan classifies adjacent waters as Conservation, and the
adjacent high ground portion of the project area as Urban/Resource Protection. The waters of the
Cape Fear River are classified SC by the Division of Water Resources. They are designated as a
Primary Nursery Area (PNA) by the NCDMF.
PNAs are estuarine waters where initial post -larval development occurs. Species within this area
are early post -larval to juvenile and include finfish, crabs, and shrimp. Species inhabit PNAs because
they afford food, protection, and proper environmental conditions during vulnerable periods of
their life history, thus protection of these areas are imperative. Increased sedimentation raises
concern for shellfish and shellfish habitat by either the direct burial of oyster beds or reductions in
filtration efficiency, respiration rates, and/or reproduction and settlement. Larval oysters require a
clean hard bottom for attachment and sedimentation as little as 1 or 2 mm may inhibit settlement
Duration of sedimentation suspension and water quality degradation has been shown to result in
juvenile oyster mortality. Coastal wetlands are considered among the most productive ecosystems
in the world. Coastal wetlands are a productive detritus -based system that trap nutrients, toxins
and sediment, aid in shoreline erosion control, dissipate wave and storm action, provides a barrier
to flood damage, and provide nursery functions and support fish production.
For the above -mentioned reasons, the N.C. Division of Marine Fisheries would request that a
moratorium on in -water work, to include dredging, from 15 Febuary to 30 September is
recommended to reduce the negative effects on critical fish life history activities, to include
spawning migrations and nursery functions.

SPECIAL CONDITIONS
1) All work authorized by this permit must be performed in strict compliance with the attached
plans, dated February 28, 2020, May 26, 2020 and Revised June 24, 2020, and October 1, 2020, which
are a part of this permit. The Permittee shall ensure that the construction design plans for this project do not
deviate from the permit plans attached to this authorization. Any modification to these plans must be approved
by the U.S. Army Corps of Engineers (USACE) prior to implementation.
2) Except as authorized by this permit or any gSACE-approved modification to this permit, no excavation,
dredging, filling, or mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or
double handling of excavated or fill material wilthin waters or wetlands outside the permitted area. This
prohibition applies to all borrow and fill activities connected with this project.
3) Except as authorized by this permit or anyl USACE approved modification to this permit, no excavation,
dredging or fill shall take place at any time in the construction or maintenance of this project, in such a manner
as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or
wetlands.
4) The Permittee shall notify the USACE in writing prior to beginning the work authorized by this permit and
again upon completion of the work authorized by this permit. The contractors name, phone number, and
address, including a field contact name and number and dredging method must be provided to the USACE
prior to construction. This notification must provide a full and complete project event description, work time
frame, dredging dimensions and locations, and identified placement areas.

10) The Permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion
of the work will, without expense to the United, States and in such time and manner as the Secretary of the
Army or his authorized representative may direct, restore the water or wetland to its pre -project condition.
11) The Permittee understands and agrees that, if future operations by the United States require the removal,
relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of
the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the
free navigation of the navigable waters, the Permittee will be required, upon due notice from the U.S. Army
Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without
expense to the United States. No claim shall be inade against the United States on account of any such removal,
relocation, or alteration.
12) This permit does not authorize the interference with any existing or proposed Federal project, and the
Permittee will not be entitled to compensation fQr damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United States in the public interest. No
attempt will be made by the Permittee to prevem the full and free use by the public of all navigable waters at or
adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free
navigation on all navigable waters of the United (States.
13) The North Carolina Division of 401 Water Quality (DWQ) certification and the North Carolina Division of
Coastal Management Permit, when issued, must incorporated as special conditions of this permit.
14) All mechanized equipment will be regularly nspected and maintained to prevent contamination of waters
and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of
petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division
of Water Quality and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act
shall be followed.
15) The Permittee shall monitor any dredge pipeline utilized during construction activities, in order to check for
potential leaks, which may emanate from the pipeline couplings. All dredge activities will cease if leaks are
found. Operations may resume upon appropriate I pair of affected couplings, or other equipment.
16) A consent to cross the Corps of Engineers easement of the Federal Channel must be obtained prior to any
work occurring. Please provide Justin Arnette at Justin.R.Amette(@.usace.army.mil with a short narrative
describing the project and maps or drawings.
17)The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase
in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not
limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to
soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas.
Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control
Act of 1973.
18) The activity must be conducted in such a manner as to prevent a significant increase in turbidity outside the
area of construction or construction -related dischaige. Increases such that the turbidity in the waterbody is 50

NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental
Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's

21) In the event an incidental take of a manatee or sturgeon (shortnose and Atlantic) occurs during any
maintenance event, the Permittee shall stop all dredging operations and contact the Corps for consultation to
determine the appropriate action, including the�immediate implementation of additional protective measures.

Disposal Island Conditions: i
26) All excavated materials will be confined landward of the mean high water (MHW)
elevation contour within adequate dikes or other, retaining structures to prevent spillover
of solids into any vegetated wetlands or surrounding waters.
A. The terminal end of the pipeline from IIthe dredge into the diked retention area
shall be positioned at least 50 feet from atty part of the dike and a maximum
distance from spillways to prevent dike erosion and to allow adequate settlement
of suspended solids.
B. A water control structure shall be installed at the intake end of the effluent
pipe leading from the retention area to ensure maximum settlement of
suspended solids.
C. Flow from the diked retention area shad be confined by pipe, trough, or similar
device to a point at or below the mean low water (MLW) elevation contour to
prevent gully erosion and siltation.

This approval is for the purpose and designldescribed in your application. The plans and specifications
for this project are incorporated by reference as part of this Certification. If you change your project,
you must notify the Division and you may be required to submit a new application package with the
appropriate fee. If the property is sold, the new owner must be given a copy of this Certification and is
responsible for complying with all conditions. [15A NCAC 02H .0507(d)(2)].
If you are unable to comply with any of theliconditions of the attached Water Quality General
Certification or with the additional conditions itemized below, you must notify the Wilmington Regional
Office within 24 hours (or the next business day if a weekend or holiday) from the time the permittee
becomes aware of the circumstances.
The permittee shall report to the Wilmington Regional Office any noncompliance with, and/or any
violation of, stream or wetland standards [15A NCAC 02B .0200] including but not limited to sediment
impacts to streams or wetlands. Information shall be provided orally within 24 hours (or the next
business day if a weekend or holiday) from ithe time the permittee became aware of the non-compliance
circumstances.
Additional Conditions:
1. All mechanized equipment operated near surface waters shall be inspected and maintained regularly
to prevent contamination of surface waters1from fuels, lubricants, hydraulic fluids, or other toxic
materials. Construction shall be staged in o�der to minimize the exposure of equipment to surface
waters to the maximum extent practicable. i Fueling, lubrication and general equipment maintenance
shall be performed in a manner to prevent, to the maximum extent practicable, contamination of

2. The Permittee shall adhere specially to 15A NCAC 02B .0220 Tidal Salt Water Quality Standards for
Class SC Waters;

(a) With the exception of mercury a�1d selenium, acute and chronic tidal salt water quality
standards for metals shall be based upon measurement of the dissolved fraction of the
metals. Mercury and selenium shall be based upon measurement of the total recoverable
metal;

aquatic life standards for metals listed in this Sub -Item shall apply as a function of the

Excavation
In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no
excavation or filling shall be permitted between February 15 and September 30 of any year without
the prior approval of the Division of Coastal Management, in consultation with appropriate resource
agencies.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -38 feet below mean low water (MLW). In no case shall the depth of
excavation exceed the depth of connecting waters.

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
5) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding
waters outside of the alignment of the fill area indicated on the workplan drawing.
6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a
spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the
National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed. '
7) In order to prevent leakage, dredge pipes shall be routinely inspected. If leakage is found and repairs
cannot be made immediately, pumping of material shall stop until such leaks are fixed.
Spoil Disposal
8) No spoil material shall be placed within 30 feet of the normal high water line.
9) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the
site is graded and stabilized.
10) The disposal area effluent shall be contained by pipe, trough, or similar device to a point at or beyond
the normal low water level to prevent gully erosion and unnecessary siltation.
11) The terminal end of the pipeline shall be positioned at or greater than 50 feet from any part of the dike
and a maximum distance from spillways to allow settlement of suspended sediments.
12) A water control structure shall be installed at the intake end of the effluent pipe to assure compliance
with water quality standards.
13) The diked disposal area shall be constructed a sufficient distance from the normal high-water level or
any marsh and sufficiently maintained to eliminate the possibility of dike erosion or spoil deposition into
surrounding wetlands or waters.
14) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.
15) If the alignment of the dredge pipe changes from the attached workplan drawings, the permittee and/or
his or her contractor shall meet with a representative of the Division prior to project initiation.

16) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
Stormwater Manaeement
17) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project will require
a Stormwater Management permit. The permittee shall receive a Stormwater Management permit from
DEMLR prior to the initiation of any construction. Submit this plan to the Division of Energy, Mineral
and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC
28405. Any violation of the permit approved by DEMLR shall be considered a violation of this CAMA
permit.
Sedimentation and Erosion Control
18) An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at
least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the
Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension,
Wilmington, NC 28405.
19) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
20) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
21) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.

9. PROJECT DESCRIPTION:
The project site is located at 838 Sunnyvale Drive adjacent to the Cape Fear River, Wilmington, in New Hanover
County. To locate the site from the Wilmington Regional Office (WiRO) take College Road (NC132) south for 3.3
miles and merge to the right onto Shipyard Boulevard. Travel on Shipyard Boulevard for 1.3 miles then turn left
onto Independence Drive, travel 1.7 miles and then take a right onto Carolina Beach Road. From Carolina Beach
Road travel 0.3 miles then take a left onto Sunnyvale Drive and the property of interest is located 1.3 miles down
on the right.
The National Gypsum Company is surrounded by mixed industrial and commercially developed properties.
Specifically, the site is bordered to the north by Kinder Morgan Terminals and Martin Marietta Materials. The
property is bordered to the south by Port Cape Fear Associates,LLC. The National Gypsum manufacturing facilities
are located on the east side of River Road (SR 1100) with a conveyor belt crossing the highway to the property on
the west side. The conveyor continues along a pier perpendicular to the shoreline extending 1,680' into the Cape
Fear River terminating at the shipping berth. The berth area consists of a 195' dock extending north from the pier
running parallel to the shoreline with a historically maintained 845' by 180' basin. Based on the field report for
expired State Permit No. 102-94 this facility was originally constructed in 1975, at which time the adjacent berth
was dredged to a depth of-35'MLW. Maintenance dredging occurred in the berth area again in 1987 to a depth of
-35 MLW. On August 30, 1994 State Permit No. 102-94 was issued to National Gypsum Company to dredge a
portion of the basin around the dock that bad shoaled measuring 530' by 60' to a depth of -35 MLW. This permit
was renewed twice, once on February 181, 1998 and again on April 211, 2003. A Minor Modification was issued
on November 17, 2003, authorizing an increase to dredging depth to -44 MLW. State Permit No. 102-94 expired
on December 31, 2007.
The application states that the project site is approximately 1.35 acres with approximately 1300' of shoreline
frontage. Tbe.tract is vegetated with high ground species, which this transitions to Phragmites sp., black needlerush
(Juncus roemerianus) and Smooth Cordgrass (Spartina alterntiora).
The New Hanover County and the City of Wibmington 2006 Land Use Plan classifies adjacent waters as
Conservation, and the adjacent high ground portion of the project area as Urban/Resource Protection. The waters
of the Cape Fear River are classified SC by the Division of Water Resources. They ARE designated as a Primary
Nursery Area by the N.C. Division of Marine Fisheries.
PROPOSED PROJECT:
The applicant proposes to perform maintenance dredging within the existing berth footprint, which was previously
dredged through State PermitNo. 102-94. Maintenance excavation is proposed in an area measuring approximately
1000 ft. wide by 130 ft. long within the existing berthing footprint (see Narrative). Approximately 17,000 cubic
yards of material would be excavated from the Cape. Fear River to a final depth of -38 ft. (-36 ft. plus 2 ft.
overdredge) at MLW. The application states that existing water depths in the project area are an average of -24 ft.
at MLW (see MP-2 and GA-2). Excavation would be conducted using a combination of both Hydraulic and
mechanical dredging. Hydraulic dredging would require a booster pump and pipeline to dispose of the dredged
material. The applicant has provided a temporary navigation plan (Attached) to address potential navigation
concerns that may occur during maintenance dredging. Excavated material would be contained at an existing
disposal site located in Brunswick County on Parcel 05900006, this site is across the Cape Fear River from the
project site (see GA-1 and GA-3). The proposed spoil site was inspected by DCM staff on September 9, 2020 to
identify wetland lines and high ground placement areas. A letter of permission is attached for use of approximately
25 acres at an existing private spoil disposal location (see Attachment in Section 18). A pipeline is proposed to cross
the Cape Fear River and the application states that equipment would cross to the spoil disposal location in areas
with the narrowest amount of wetlands utilizing wetland mats. According to the applicant any moratorium
conditions required would be adhered to and no material would be placed in any wetland areas (see Section 17 for
Avoidance and Mitigation Measures). The applicant is requesting a 10-year maintenance clause due to the necessity
to maintain this depth for operation.

The application has attached a Wetland Delineation (see Section 9) and application submitted to the USACE on
September 11, 2020 (see Section 19). The application has also included historic permits (see Section 13), a
Biological Assessment and Essential Habitat Study (see Section 14) and Sediment Sampling (see Section 15).
10. ANTICIPATED IMPACTS:
The proposed dredging footprint would impact approximately 130,000 ft of Estuarine Waters and Pubic Trust Area
impacting shallow bottom area with both hydraulic and mechanical dredging. The maintenance dredging footprint
would result in the removal of approximately 17,000 cubic yards of material. The material would be placed on
approximately 25 acres of highground on an existing private spoil island across the river from the project site in
Brunswick County. Spoil disposal would occur outside of the 75 ft. AEC and any required wetland crossings would
be minimized with the use of timber crane mats.
Minor increases in turbidity should be expected during construction.

Dear Ms. Zehringer:
You have our approval for the impacts listed below for the purpose described in your application dated
September 11, 2020 and received by the Division of Water Resources (Division) November 17, 2020 with
subsequent information on December 10, 2020. These impacts are covered by the attached Water
Quality General Certification Number 4175 and the conditions listed below. This certification is
associated with the use of the General Permit Number 198000291 once it is issued to you by the U.S.
Army Corps of Engineers and the CAMA Major Permit when issued by the Division of Coastal
Management. Please note that you should get any other federal, state or local permits before
proceeding with your project, including those required by (but not limited to) Sediment and Erosion
Control, Non -Discharge, and Water Supply Watershed regulations.
