I have a proposed docking facility with a boatlift and floater at 950 Copas Rd SW in PNA. I have been out twice to measure depths. Yesterday preliminary data showed that tides were approx .09' above average which is about as close as you can get...They took my advice and flip flopped the location of the proposed boatlift and floater. Based on Deeper Pro sonar measurements and measuring stick data (to ground truth it) they have enough water for both the boatlift and floater.The boatlift is exactly at-1.5' NLW on the landward side in the proposed location. I am limiting them to the edge of the deep channel because there is a boatlift that was recently installed just adjacent to this proposal to the north so we can't block navigation. I would like to condition the boatlift to include stops to account for any error in tidal data/measurements. Would you be able to sign a GP Waiver recommending stops in this location or would you suggest a major permit?Very productive habitat but also lots of existing boatlifts/floaters immediately adjacent to this property and they previously had a floater that was lost in a storm. Without having been on site I am relying on aerial imagery (which is not updated to show your new additional boatlift) to give rough estimates of where the edge of grass is located. I told them that they would be limited to the pierhead line of your new boatlift and the adjacent dock to the south (assuming that dock meets the 1/4 width). They also cannot block navigation of the channel at low tide. Once I make a site visit I will review the submitted plan. If you choose not to waive the setback they will have to remain outside of the 15' setback. I hope you are doing well. The reason I am contacting you is I have received a proposal for a new /expansion of an existing docking facility for my neighbor to my south. I am including a PDF of the proposal which I have received. I am very concerned that t4,,, AJnnL r.rniont hlnrltc my arrocc nn Inw tide via the sPcnndary channel. this as you informed by Mr. Francis's construction manager that the new dock was to be built on the same location of the old dock, as that may be the case, they have presented a rough plan , without dimensions in respect to property lines, this plan is a violation of my riparian setback corridor (existing dock is approximately 17.5 ft. from property line). Thirdly, Mr. Francis's construction manager stated to me that the CAMA rep told them that the total docking facility could be 130 feet long from the beginning of the old existing dock, this dimension matches the plan submitted to me, but there is no exact starting point, nor the point where the marsh grass (beginning of waterway) is on the dock. Having said that, this overall length of the structure certainly exceeds the 25% waterway width (Grass to Grass) of approximately 385 feet, as measured by Google Earth, the same way I measured the waterway width for my boatlift / dock project. I look forward to your resolution to these issues, as I have spent significant monies and energy to be compliant with the regulations and I do not wish to have my rights to access infringed upon.
