Statement of Compliance and Consistency
This permit is subject to compliance with this application and permit conditions. Any violation of these terms may
subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Jason:
On behalf of Pender County Utilities, Land Management Group is submitting a CAMA General Permit
application for the installation of a water main that extends into a CAMA Area of Environmental
Concern. The project corridor is within a NC DOT Right of Way located along Factory Road and
Broadview Lane in Hampstead, NC (Pender County). This project involves the installation of
approximately 3,000 LF of 8-inch PVC water main, 540 LF 6" PVC water main, 70 LF 16" steel
encasement pipe, fire hydrants, service connections, and blow-off assemblies. The water main will
begin approximately 50 LF northwest from the intersection of Lea Drive and Factory Road and will
terminate approximately 50 LF southwest from the intersection of Howards Channel Drive and
Broadview Lane in Pender County.
This application requests CAMA General Permit 0.1600 to authorize the installation of the water line
within a CAMA Area of Environmental Concern. LMG delineated wetlands within the project area. No
wetlands or Waters of the US were identified within the AEC. One small temporary impact to a
jurisdictional ditch is proposed outside of the AEC. Another wetland/stream outside of the AEC will
be directionally bored.
Since the waterline will be located within a NC DOT Right of Way, the applicant obtained an
encroachment agreement from NC DOT, which is enclosed. Additionally, landowners located
adjacent to the waterline within the AEC have been notified of the project.A copy of the notification
letters and returned green cards are also enclosed.

This letter serves to notify you of work proposed by Pender County Utilities (PCU) within a NC Department
of Transportation Right-of-Way in Hampstead, NC, adjacent to your property.Specifically, PCU is planning to
install a water line along Factory Road and Broadview Lane. Because this proposed work is located within an
Area of Environmental Concern as regulated by the NC Coastal Area Management Act (CAMA), a CAMA
Permit is required. As an adjacent riparian landowner, you are required by the CAMA permit application
process to be notified. I have enclosed the CAMA permit application materials as they have been submitted
to the local Division of Coastal Management office for your review. Should you have any objections to this
proposal, please send your written comments within 10 days of your receipt of this notice to:

Attached for your files is a copy of Right of Way Encroachment contract properly
executed. This contract covers the following:
Water: Approximately 50 LF northwest of Lea Dr(SR 1614) and Factory Rd(SR 1570)
intersection and continuing southeast for approximately 840 LF, crossing SR 1570 and
continuing southeast to Broadview Ln(SR 1606). Crossing SR 1570 at SR 1606 intersection to
connect an existing water line along SR 1606 to end of NCDOT Right of Way. Approximately:
• 3234 LF of 8" PVC WL installed via open cut(3' min cover)
• 210 LF 8" FPVC WL installed via Horizontal Directional Drill (HDD) (13' min cover)
• 70 LF 8" PVC to be installed via bore and jack through approximately 70 LF 16" (Min.
Dia. 0.25") steel encasement pipe under SR 1570 (5' min cover)
• 560 LF 6"PVC to be installed via open cut method, hydrants, and service connections.
All pipes shall be C900 DR18 PVC unless otherwise noted (see PCU Standard Detail SHT
D01.0). This approval is subject to this work being done in accordance with the attached plan

• The Surety Bond is posted with the North Carolina Department of Transportation is
hereby obligated to cover work under this encroachment agreement, The applicant shall
notify NCDOT at [phone] upon completion of the work for a final inspection to be
performed by NCDOT personnel. After the project has been completed for ONE YEAR
and upon request NCDOT personnel will conduct a final inspection. If found satisfactory
the bond will be released.
• Lane closures are as follows:
No lane closures shall be allowed between the hours of 6am—9am and 4pm—7pm(peak hour
restrictions). Further restrictions may apply due to traffic conditions. No lane closures on
weekends.
• Follow all current MUTCD guidelines and NCDOT Roadway Standard Drawings

This letter is in response to your correspondence,which was received by the N.C. Division
of Coastal Management on December 13, 2021, regarding your concerns about the
proposed development by Pender County Utilities, at property located at along Lea's Lane,
Factory Road and Broadview Lane, adjacent to Topsail Sound, in Hampstead, NC. The
project consists of the installation of a subsurface water main. Based on consistency with
the Rule requirements outlined in 15A NCAC 07H .1600 GENERAL PERMIT FOR THE
INSTALLATION OF AERIAL AND SUBAQUEOUS UTILITY LINES WITH ATTENDANT
STRUCTURES IN COASTAL WETLANDS; ESTUARINE WATERS;PUBLIC TRUST WATERS AND
ESTUARINE SHORELINES, a permit has been issued to authorize the development. I have
enclosed a copy of the permit, as well as the relevant statutes.
If you wish to contest our decision to issue this permit,you may file a request for a Third
Party Appeal. The Chairman of the Coastal Resources Commission will consider each case
and determine whether to grant your request to file for a Contested Case Hearing. The
hearing request must be filed with the Director, Division of Coastal Management, in writing
and must be received within twenty (20) days of the permit decision. I have enclosed the
applicable forms and instructions that must be filed prior to that deadline. Please contact

This is in regard to the project Permit 0.1600 Application.
I have concerns about being in the 575' AEC area of this project. My specific concern is that my
well is very close to are area of the waterline corridor/utility line. I am concerned that my well
may be disturbed during the digging process, which will no doubt disturb the earth close to the
projected waterline, which is where my well is located. If there is disruption to my well, I would
like assurance that some one will claim responsibility for the disruption and/or needed well
repair and agree to repair or replace my well if need be.
