Sneads Ferry , as requested in the permittee's application dated 11/3/20, including attached workplan
Count dated "Rec MP Section MHD 2/26/21" and Pages 1-3 of 3 all dated 11/3/20.
This permit, issued on April 8, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Marina Expansion
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this marina expansion without
permit modification. No non -water dependent uses of structures shall be conducted on, in or over
Public Trust waters without permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) This permit authorizes an additional 16 formalized boat slips for a maximum of 48 formalized boat slips.
At no time shall more than 48 vessels be moored or docked at the facility. The restriction of the number
of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels
and personal watercraft.
4) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
USACE Conditions
7) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
9) All debris associated with the removal or construction of the permitted marina shall be contained within
the authorized project area and removed to an appropriate upland location.
10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2021-00085).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-20148.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $400 was received by DCM for this project.

Project Summary: The applicant wishes to expand a marina adjacent to the New
River for commercial use in Sneads Ferry.
Field Investigation Report:
Old Ferry Marina Inc.
Narrative Description:
The property is located adjacent to the New River at 150 Old Ferry Road in Sneads Ferry, Onslow
County. This lot is currently developed with a 32-slip commercial marina with dry stack operations.
The adjacent riparian properties are similarly developed.
The elevation of the adjacent high ground of the parcel is approximately 6' above the normal high
water level (NHL). Vegetation on the parcel mainly consists of lawn grasses. There are no Coastal
Wetlands within the project area. The parcel has 760' of continuous shoreline along Old Ferry Creek.
Immediate offshore water depths adjacent to the parcel range from —3' to —6' normal water level.
The subaqueous substrate is soft without shell.
This proposal is not located near a Federal Channel. There is not a cultural resource in the project
area. This waterbody is approximately 220' across at this location. These estuarine waters are not
classified as a Primary Nursery Area. Submerged aquatic vegetation was not observed at this
location. This area is closed to shellfish harvest and is classified as SA; High Quality Waters. This
parcel is within the White Oak River basin.
Proposed Development:
The applicant is proposing to expand an existing marina within Old Ferry Creek, adjacent to the New
River in Sneads Ferry. The proposed development would take place adjacent to 150 Old FerryRoad,
Onslow County. This proposal is for commercial use. The adjacent properties are similarly
developed.
The marina currently has 32 boat slips and is proposing an additional 15 boat slips, 8 of those for
staging at the haul out, for a total of 47 boat slips. Adjacent to the southeast property corner, the
applicant is proposing to lengthen the two existing haul out staging docks. One is to be expanded by
3' by 25' pier extension and the other is to be expanded by 3' by 75' pier extension. Midway of the
existing marina wet slip docks, the applicant is proposing three new boat slips. These slips are to be
supported by two 3' by 12' finger piers. Due north of the haul out area, the applicant is proposing
three new finger piers to support four new boat slips. Two of the finger piers would be 3' by 25' and
the third would be 3' by 50'.
Anticipated Impacts:
There is not a Federal Channel in the nearby vicinity of this proposed docking facility. This
proposal would not be a hazard to navigation. The proposed docking facility would shade an
additional 647 square feet of Public Trust Area. Traditional marine construction methodology
will be utilized during the construction of this project. Turbidity impacts are not anticipated
during the construction activities in Alligator Bay. There is not a cultural resource in the vicinity
of the project area. These waters of New River are not classified as a Primary Nursery Area and
the presence of submerged aquatic vegetation was not observed. This area is closed to shellfish

SUBJECT: Comments and Recommendations - CAMA Major Permit —Old Ferry Marina Inc, Onslow County
The following is my assessment and consequent recommendations of the above referenced proposal: This proposal
shades 647 square feet of Public Trust Area. The proposal is not adjacent to a Federal Channel. These waters of the
New River are closed to shellfish harvest. This waterbody is not a Primary Nursery Area.
Assuming other state and federal agencies concur, the Morehead City District staff recommends that the project be
authorized as it is proposed with the following conditions:
1. The authorized structures and associated activity must not cause an unacceptable interference with navigation, and
shall not extend more than 55' waterward.
2. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may
become a permanent part of this marina without permit modification. No non -water dependent uses of structures
may be conducted on, in or over public trust waters without permit modification.
3. The piers and associated structures shall have a minimum setback distance of 15 feet between any parts of the
structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel
to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where
the upland property line meets the water's edge.
4. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions
of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having
it transferred to a third party.
5. This permit authorizes a maximum of 47 boat slips. At no time shall more than 47 vessels be moored or docked at
the marina facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not
limited to motorboats, sailing vessels and personal watercraft.

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report and BioReport
for the subject project. The attached notice requests federal agency comments on this project by February 13, 2021.
The site is located within waters adjacent to the New River, at 150 Old Ferry Road, in Sneads Ferry, Onslow County,
North Carolina. Coordinates are 34.575144 N,-77.396074 W.
The applicant is proposing to expand an existing 32-slip commercial marina. Specifically, the applicant proposes to
construct an additional 15 boat slips, 8 of those for staging at the haul out, for a total of 47 boat slips. Adjacent to the
southeast property corner, the applicant is proposing to lengthen the two existing haul out staging docks. One is to be
expanded by 3' by 25' pier extension and the other is to be expanded by 3' by 75' pier extension. Midway of the existing
marina wet slip docks, the applicant is proposing three new boat slips. These slips are to be supported by two 3' by 12'
finger piers. Due north of the haul out area, the applicant is proposing three new finger piers to support four new boat
slips. Two of the finger piers would be 3' by 25' and the third would be 3' by 50'.
Dredging is not proposed as a part of this project.
The project site is located near a Corps federal channel, and is approximately 0.25 miles to the south of the Channel to
Jacksonville.

This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but not
likely adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management
Councils or the National Marine Fisheries Service. The waters within the project area are designated as PNA by the NC

In accordance with 15A NCAC 18A .0911 MARINAS: DOCKING FACILITIES: OTHER
MOORING AREAS, there is an existing shellfish buffer closure extending 400 feet in all
directions from the outer most slips in this basin. This buffer closure is adequately sized for up to
100 slips. There are several properties lining the shore of this basin, and the current slip count
for all of the docks, including those associated with Old Ferry Marina as currently laid out, totals
up to 85. As proposed, the updated layout of Old Ferry Marina would add an additional 21 slips
to this total, which would necessitate an additional closure extending 50 feet further in all
directions. Because the diagram included in the application package is not labeled with what the
applicant is considering slips, it is difficult to determine where the discrepancy is between their
count of 15 slips added through this project versus our count of 21 slips added.
Furthermore, should this project be permitted in a way that fulfills the maximum total slip count of
100 slips, any additional changes at any of the other properties located within the basin will
require an expanded closure. If this project is permitted, it is requested that all future proposed
dock modifications at any properties within this basin be required to go through the CAMA Major
Permit process so that there will be an opportunity to review the impacts of those changes on the
surrounding shellfish buffer closure.

Thank you for your email regarding Shellfish Sanitation comments.
I am attaching a photo of the GIS printout from March 18, 2009. We have
mounted in the Old Ferry Marina office, and keep it labeled with the wet slip
customer's names, it also is labeled with slip numbers 1-32.
Though many boats have changed since this photo, our dock layout has
remained unchanged since original construction, except for the concessions
that we made for Shellfish Sanitation per June 5, 2002 meeting and permit
renewal #233-86. At that time we agreed to 32 boat slips, and a designated
area for the launching and retrieval of boats in our dry dock storage building.
Also attached is a photo of the same map zoomed in and with colors added to
highlight the areas requested in our current permit application. Our primary
need is for additional length of the docks used only for boats that are stored
out of the water in dry dock building. Some boats only go into the water 3 or 4
times a year, of course they all want to go in at the same time, mostly holiday
weekends. In addition to expansion of launching and retrieval area we are
requesting 6 additional slips. RECEIVED

Our first priority is the 75' extension of our retrieval dock, as additional space
is needed primarily on the weekends, especially Saturday and Sunday late
afternoons and evenings. The additional length of the retrieval dock was
calculated from having 360' of dry dock customer's boats return all within one
hour. We retrieve boats as quickly as we can, but need this extra length as
many boats return about the same time. The 25' extension of the drop in dock
would allow us to push a boat forward off of the forklift to unload when
launching. All of Summer 2020 we allocated wet slips labeled 1, 2 & 3 to
accommodate dry dock boats, it helped but was very inefficient, so prompted
this request.
We are also requesting 3 slips for larger boats and 3 slips for small boats to
allow for handicap access for some dry dock customers, we have a few
wounded warriors who store their boats in our dry dock, and have had
requests for wheelchair access. Proposed new docks are shown in green and
how boat slips will be determined are shown in blue.

Dear Mr. Howell:
Reference the application of Mr. Allyn Teilborg, with Old Ferry Marina, associated with
the expansion of an existing docking facility in waters adjacent to the New River, at 150 Old
Ferry Road, in Sneads Ferry, Onslow County, North Carolina.
The applicant proposes to expand an existing 32-slip commercial marina. Specifically, the
applicant proposes to construct an additional 15 boat slips, 8 of those for staging at the haul out,
for a total of 47 boat slips. Adjacent to the southeast property corner, the applicant is proposing
to lengthen the two existing haul out staging docks. One would be expanded by 3' by 25' pier
extension and the other expanded by 3' by 75' pier extension. Midway of the existing marina wet
slip docks, the applicant proposes three new boat slips. These slips would be supported by two 3'
by 12' finger piers. Additionally, due north of the haul out area, the applicant proposes three new
finger piers to support four new boat slips. Two of the finger piers would be 3' by 25' and the
third would be 3' by 50'.
Dredging is not proposed as a part of this project.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report. We recommend that the following conditions be
included in the modification to the State authorization:
1. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at

prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety
Office at (910) 772-2191.
3. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.
4. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
5. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
6. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-
5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
7. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
8. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
9.The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
10. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
-,permit area. This shall include, but is not limited to, the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance('or them RMENED

earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project
must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statutes Chapter 113A Article 4).
11. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
12. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre -project condition.
13. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Hi Gregg,
As follow up on our conversation, attached is a modified version of the image that the applicant sent with some
additional slips noted based on our count. As discussed, as long as the permit is written in such a way to only allow
them dockage in numbered slips as per this diagram, then this redevelopment project will not have an impact on the
existing shellfish closure. The second part of our original comment still stands, however, as this project, once complete,
will lead to a total of 100 slips in this overall basin, which is the maximum number allowed before an expanded closure is

Here is the requested follow up information based on our conversation from earlier. Please let me know if this is
adequate, or if you need additional information.
Shellfish Sanitation and Recreational Water Quality rules define a "marina" as any water area with a structure (dock,
basin, floating dock, etc.) which is utilized for docking or otherwise mooring vessels and constructed to provide
temporary or permanent docking space for more than 10 boats. We are required to evaluate each marina adjacent to or
in shellfish growing waters and to establish a prohibited buffer area based on, among other things, the number of slips
present in the marina. For the purposes of our evaluation here, the slips counts along all properties lining this basin are
combined in order to determine the appropriate buffer closure, and the current prohibited area is adequate for up to
100 slips within the basin, total.
Our current count within this basin includes a total of 52 slips at all other properties besides the Old Ferry property,
meaning that the Old Ferry property can have up to 48 total slips without impacting the existing buffer closure. As
indicated in our original comments, our initial review of this project using the diagrams included in the permit
application indicated that the redesigned dockage layout at this property would create more than 48 slips, and thus
cause an expanded closure around the basin. The more detailed diagrams that the applicant has since provided have
helped to clarify where our differences in slip count seem to arise, and it appears that it is primarily related to the
number of slips being counted in the dry dock staging and retrieval area. In particular, our use of a standard 25 feet per
slip along linear dockage contrasts with the applicant's indication that in some cases, larger boats (i.e. 40 to 50 feet) may
be using certain spots, thus reducing the total number of slips.
As a resolution, we would like to request that the applicant submit a layout of the proposed redesigned marina with all
wet slips specifically numbered to indicate where boats are to be docked along all slips, including temporary docking
spaces. Excluded from this numbering are any areas where the long term docking of a boat would prohibit or
significantly impede the use of an active haul -out, drop zone, or boat ramp. For example, along the green dock labeled
"dry dock retrieve" in the image provided by the applicant titled "Old Ferry Marina Permit Request Illustration 213
2021", we have determined three slips on each side of that dock (25 feet per slip along both sides of a 75 foot length),
but we have not counted any slips in the area labeled "dry dock launch" because the long-term docking of any boats in
that area would preclude use of the drop zone.
Once agreed upon, if that layout is included with the application materials, and if the permit (if issued) indicates that
docking is allowed only in the numbered spaces as indicated in that diagram, then we would use that diagram for
evaluating the slip count within the basin, and would be able to avoid an expanded shellfish harvest closure. That
diagram would also be used to determine permit compliance during future evaluations of this marina basin.

This project at) ears to be consistent and not in conflict with the Onslow County
Land- Use Plan Update.
The applicant proposes to expand a marina adjacent to the New River for commercial use
at 150 Old Ferry Road in Sneads Ferry, Onslow County.
Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine Waters
and Public Trust Areas. Waters at the project site are classified as SA; HQW and are not
open to the harvesting of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Onslow County Land Use Plan
Update and offer the following comments.
The general area of the project is classified as Rural/Conservation.
In general, Onslow County allows development in Rural/Conservation classified AECs
which is consistent with the State's minimum use standards. The Onslow County Land
Use Plan contains some policies, which exceed the State's minimum use standards.
However, none of these more restrictive policies appear to be applicable to this project.
This project appears to be consistent with the Onslow County Land Use Plan
Update.

Dear Ms.Teilborg:
The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request dated received by this office on March 23, 2021. The application proposes to expand an existing
marina facility. The proposed project is located in the waters of New River which are classified as SA:HQW
by DWR. DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the
Regional General Permit 291 issued by the US Army Corps of Engineers (USACE). This Certification allows
you to use the Regional General Permit 291 when issued by the US Army Corps of Engineers. These
impacts are covered by the attached Water Quality General Certification Number4175 and the conditions
listed below.
Please note that you should get any other federal, state or local permits before proceeding with your
project, including those required by (but not limited to) Sediment and Erosion Control, Non -Discharge,
and Water Supply Watershed regulations. Also, this approval to proceed with your proposed impacts
or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404
or CAMA Permit.
The Division has determined that the proposed project will comply with water quality requirements
provided that you adhere to the conditions listed in the enclosed certification and to the additional
conditions itemized below.
The following proposed impacts are hereby approved. No other impacts are approved, including

This approval is forthe purpose and design described in your application. The plans and specifications
for this project are incorporated by reference as part of this Certification. If you change your project,
you must notify the Division and you may be required to submit a new application package with the
appropriate fee. If the property is sold, the new owner must be given a copy of this Certification and is
responsible for complying with all conditions. [15A NCAC 02H .0507(d)(2)].
If you are unable to comply with any of the conditions of the attached Water Quality General
Certification or with the additional conditions itemized below, you must notify the Wilmington Regional
Office within 24 hours (or the next business day if a weekend or holiday) from the time the permittee
becomes aware of the circumstances.
The permittee shall report to the Wilmington Regional Office any noncompliance with, and/or any
violation of, stream or wetland standards [15A NCAC 02B .0200] including but not limited to sediment
impacts to streams or wetlands. Information shall be provided orally within 24 hours (or the next
business day if a weekend or holiday) from the time the permittee became aware of the non-compliance
circumstances.
Additional Conditions:
1. AII'mechanized equipment operated near surface waters shall be inspected and maintained
regularly to prevent contamination of surface waters from fuels, lubricants, hydraulic fluids, or other
toxic materials. Construction shall be staged in order to minimize the exposure of equipment to surface
waters to the maximum extent practicable. Fueling, lubrication and general equipment maintenance
shall be performed in a manner to prevent, to the maximum extent practicable, contamination of
surface waters by fuels and oils. [15A NCAC 02H .0506(b)(3) and (c)(3) and 15A NCAC 02B .0211 (12)]
2. The Permittee shall adhere specifically to 15A NCAC 02B .0221 Tidal Salt Water Quality for
Class SA Waters (3)(g) pH: shall be normal for waters in the area, which generally shall range between
6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of natural
conditions; (1) Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; if turbidity
exceeds this level due to natural background conditions, the existing turbidity level shall not be
increased. [15A NCAC 02B .0221]
3. The docking facility is permitted for 48 number of slips. Dockage of vessels other than the
permitted slips will require re-evaluation by DWR of the use of the dockage facility. HaRECEIVED

devices, including signage, should be used to discourage use of any dock space other than the 48
number of designated slips. [15A NCAC 07H .0208]
4. The construction of the docking facility may not cause any additional closure of shellfishing
waters by Shellfish Sanitation as this would be considered a violation of 15A NCAC 02B.0201(f) and 15A
NCAC 02B.0221(1).
This approval and its conditions are final and binding unless contested. [G.S. 143-215.51
This Certification can be contested as provided in Chapter 150B of the North Carolina General Statutes by
filing a Petition for a Contested Case Hearing (Petition) with the North Carolina Office of Administrative
Hearings (OAH) within sixty (60) calendar days. Requirements for filing a Petition are set forth in Chapter
150B of the North Carolina General Statutes and Title 26 of the North Carolina Administrative Code.
Additional information regarding requirements for filing a Petition and Petition forms may be accessed at

Morning Allyn,
I have attached the correspondence from Shellfish concerning the slip count. As we discussed they had additional
review of the structures outside the travel lift load/offload area. This impacts the project in that it adds 10 additional
slips to the marina for 48 total slips. On the attached drawing they have designated them in black ink without circles, (I
make that distinction because they duplicated your 1-10 numbering). With the 48 total slips identified by Shellfish this
will also put the entire basin slip count at 100, which is the max number of slips allowable by Shellfish for the basin
without extending the shellfish closure. So no other slips will be allowable within the basin.
At this time we will continue to process the application under this configuration unless you have any questions. If so,
please let me know.

Hey all,
Based on discussions with Andy Haines in Shellfish they have revised the slip count within the marina to 48 total slips for
the marina and 100 total slips for the basin. This maxes out the basin without increasing the shellfish closure. I have not
heard back from the applicant but I do not believe there will be any issues unless another property owner requests
another slip.
I'll let you know if anything else comes up, but as of now this is the most updated workplan for Old Ferry Marina.

additional slips noted based on our count. As discussed, as long as the permit is written in such a way to only allow
them dockage in numbered slips as per this diagram, then this redevelopment project will not have an impact on the
existing shellfish closure. The second part of our original comment still stands, however, as this project, once complete,
will lead to a total of 100 slips in this overall basin, which is the maximum number allowed before an expanded closure is

To accommodate;
Dry Dock Boat Launch and Retrieval, Late Arrivals and Early Departures.
A — Double length of current drop in dock, from 25' to 50'.
Double length of retrieval dock from 75' to 150', (widen to 8', for social distancing).
B - Relocate 3 slips by adding 50' slip and 2 — 25' slips.
This allows 3 previous locations to be dedicated to dry dock;
For late arrivals after closing time, and early departing fisherman before we open at 8:00.
Therefore this would be slip count neutral.
C — Add two handicap access finger piers for short term access of dry dock customers only.
All of the above would be built with pilings, wooden cross beams and decking boards at heights the
same as current docks they would attach to. All are intended to facilitate dry dock storage operation.

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located adjacent to the New River at 150 Old
Ferry Road in Sneads Ferry, Onslow County. It was received on December 22, 2020, and appears
to be adequate for processing at this time. The projected deadline for making a decision is March
5, 2021. An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter
will serve as your notice of an extended review. However, an additional letter will be provided
on or about the 75th day.
If this agency does not render a permit decision within 70 days from December 22, 2020, you
may request a meeting with the Director of the Division of Coastal Management and permit staff
to discuss the status of your project. Such a meeting will be held within five working days from
the receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice at
a conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-
of-way fronting your property, or at a point along the road right-of-way where a private road
would lead one into your property. Failure to post this notice could result in an incomplete
application.

APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as required by
NCGS 113A-119(b) that application for a development permit in an Area of Environmental Concern as
designated under the CAMA was received on December 22, 2020. According to said application, Old Ferry
Marina Inc. proposes to make expand an existing marina adjacent to the New River, at 150 Old Ferry Road
in Sneads Ferry, Onslow, County. A copy of the entire application may be examined or copied at the office
of Brad Connell, NC Division of Coastal Management, located at 400 Commerce Avenue, Morehead City,
NC, (252) 808-2808 during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, N.C. 28557, prior to February 9, 2021, will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision. Project
modification may occur based on review and comment by the public and state and federal agencies.
Notice of the permit decision in this matter will be provided upon written request.

Dear Brad,
September 12, 2020
Thank you for your assistance with our permit application, I would
be happy to adjust our requests if you can offer any advice based on
your experience.
A: For many years we have been growing our dry dock business,
finally we are quite busy and feeling the need to expand loading and
unloading docks to accommodate our dry dock customers. On Saturday
and Sunday afternoons we typically have twenty boats returning to the
dry dock late in the afternoon, on August 30th we had 300' of boats arrive
between 3:00 and 3:30. Therefore I have designed a better system. With
the wider concrete drop off we will be able to use 2 forklifts, and
designate one dock for boats going into the water and the other for
boats that are returning to the dry stack building. To accommodate
customers loading the drop in dock the launching dock will function well
at 50' (currently 25'). The retrieval dock is currently 75' extending the
dock to a total length of 150' will allow us to handle 300' of boats
efficiently. RECEIVED

B: Old Ferry Marina uses a mobile pump out service. The dock that
was originally designated for that service we are proposing as new wet -
slips, one 50' and two 25'. These slips are basically offsetting wet slips
that we are now using for temporary dockage for the dry dock building,
to accommodate early morning fishermen.
C: Weekend campers who keep boats in the dry dock like to keep
their boats in Friday & Saturday night, so they can fish early each
morning. We are requesting two 12' docks for this short term use.
Overall these revisions will not change current slip count, as all proposed
changes are to accommodate the dry dock boats temporarily at peak
times. Proper signage would be displayed in each area "LAUNCHING
