This permit, issued on August 17, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docking Facility Expansion 1) This permit authorizes only the platform, covered roof and boat lifts, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Ogan Permit No. 105-21 Page 2 of 3 ADDITIONAL CONDITIONS 3) This permit authorizes two (2) additional formalized boat slips for a maximum of three (3) formalized boat slips at this docking facility. 4) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 5) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 6) The roof of the covered platform shall not be designed for second story use. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 10) The permittee is advised that submerged aquatic vegetation (SAV) habitat exists in close proximity to the authorized project. All available precautions shall be utilized to ensure that damage to SAV habitat does not result from the construction and/or operation of the authorized facilities. Should dredging of these areas be proposed in the future, the permittee is further advised that the Rules of the Coastal Resources Commission prohibit new dredging within SAV beds. General 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. 13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to any authorizations from the Town of Morehead City. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2021-01234). Dean M. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0769. NOTE: Future development of the permittee's property may require a modification of this permit. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. Project Summary: The proposed project is for the addition of a 2nd platform, adding a covered area over the existing platform with roof overhang that would extend beyond the existing platform, a proposed finger pier near the shore and adding two additional slips. This would consist of a jet -ski lift and a 4-pole boatlift for a total of 3 slips (1 ex. and 2 new) within Bogue Sound. 9. Narrative Description: The Dean Ogan project is located at 145 Camp Morehead Drive along Hwy 24 Morehead City, Carteret County. The site is found by following highway 24 into the Morehead City town limits. Turn right onto Camp Morehead Drive (approximately 4.4 Field Investigation Report Dean Ogan 145 Camp Morehead Drive Page 2 of 3 miles east of the Gales Creek Bridge) and follow for approximately 2,199 feet. The property will be immediately on the left. The residential property is .56 acres (24,524 st) in its entirety and an average of 6' above nhw. Bogue Sound runs along the south side ofthe property. The upland vegetation mainly consists of lawn grasses, shrubs, and a few trees. The total shoreline length for the tract is 86'. The waters of Bogue Sound have approximately 2.5'to 3' lunar tidal amplitude. There are coastal wetlands consisting mostly of Smooth Cordgrass (Sp. Alterniflora) in an approximate 12' wide fringe running the length of the shoreline. The Division of Water Resources classifies this area as HQW/SA Waters. This area of Bogue Sound is not designated as a Primary Nursery Area and is open to the taking of shellfish. The Morehead City Land Use Plan classifies this area as Medium Density Residential with Conservation within the AECs. According to Google Earth GIS data, the ICW W is located approximately 952' waterward (south) ofthe existing 1-slip docking facility. There is an existing high ground water access and a shore parallel 50' long x 8' wide boardwalk going to the existing pier. There is also an existing 10' x 10' wooden patio area within the 30' buffer on the west side of the property and pier. There is an existing bulkhead extending approximately three -fourths the length of the shoreline from the east to the west. Water depths within the proposed jet ski lift and the four pole lift area are-2.75'nlw/mlw to -3.5' nlw/mlw depending on location. The bottom substrate is sand and no SAV (approximately 60' landward (north) of the existing platform) were observed within the proposed slip areas and fixed platform area. Bogue Sound is approximately 1.5 miles wide at this location. There are SAV within this location approximately 360' from NHW. No SAV were observed waterward beyond this point. 10) Proposed Development: The applicant has an existing 1-slip docking facility. The current proposal is for the addition of two slips (total of 3 slips) with lifts, a platform addition, a 4' x 32' finger pier extending over marsh and shallow water near the shore and a covered area with a I' roof overhang covering the existing platform to a maximum distance of 391' from NHW. The existing platforms(360sf) as well as the proposed platform additions (264sf) (total of 624st) would not exceed the allowable platform square footage of 688 sf. No SAV was observed within the proposed slip areas. The applicant is proposing to add a 10' x 16' platform addition along the east side of the existing pier access (landward of the t-head platform) as well as a 13' x 16' covered area over the existing 8' x 30' t-head platform and existing 4' x 30' stepdown. The roof would have 1' roof eaves that extend over the water creating 52sf of shading impacts. The applicants are also proposing two additional slips which consist of a jet -ski lift and a new 4 pole boatlift. The 5' x 9' jet -ski lift would be located along the east side of the proposed 10' x 16' platform. The additional 12' x 13' boatlift would be located along the east side of the existing t-head platform. The closest section of the proposed platform would be approximately 35' to 40' waterward of the edge of SAV habitat. The applicants are also proposing a 4' x 32' finger that would be located immediately adjacent to the east side of the existing pier extending from the existing bulkhead over marsh for 19' and extending another 13' waterward from normal high water. Water depths in this area are less than -1' nlw. The most waterward portion of the proposed development would not exceed a maximum of 391' from NHW. All parts of the docking facility would be landward of the ICW W channel (approximately 941' landward) and approximately 40' from the western riparian corridor and 15' from the eastern riparian corridor. Riparian corridors were determined by channel orientation and existing pier alignment. There would be a total of three slips (1 existing slip with boatlift, 2 additional slips with additional boatlift and jet ski lift. The applicant states boat size would be a maximum of 23' and of open runabout design. The water depths within the slip areas are -2.75' nlw Field Investigation Report Dean Ogan 145 Camp Morehead Drive Page 3 of 3 to 3.5' nlw/mlw depending on location, with connecting water depths of -3.5' plus nlw/mlw. 11. Anticipated Impacts: The proposed platform addition, platform covered area and boatlifts would shade 264 ftz and incorporate 420 ft2 of shallow bottom habitat. The development would increase the number of slips from one to three. The increase in suspended sediment and turbidity levels from the piling placement would be temporary, occur while the piling placement is taking place and should be minimal given the bottom composition. The proposed finger pier would be elevated a minimum of three feet above marsh substrate to the bottom of the decking boards. The proposed additions should not be a hindrance to navigation due to the fact all portions would be located landward 951' from the ICW. The proposed development would also meet the minimum 15' setback from the riparian access lines and not exceed a maximum distance of 391' waterward of NHW. No SAV where observed within the proposed platform and slip areas. Rules allow 8sf per linear foot of shoreline for shading impacts which on this case would be 688sf. Therefore, the existing and proposed shaded impacts would not exceed the maximum of 688sf allowed. The applicant is proposing to add two new slips as well as a roof cover, finger dock, and second platform to the existing 1-slip docking facility. There would be a total of three slips (1 existing and two proposed) along this parcel. The proposed additions to the existing docking facility would not extend more than a maximum distance of 391' from NHW and would remain within pier head length within this area. All portions of the development would be landward approximately 952' of the ICW channel setback. The proposed covered platform. New platform, boatlift and jet ski lift would also be located approximately 35' to 40' waterward of any SAV depending on location. The development conforms to the guidelines set forth under 15A NCAC 07H .0208. Assuming that state and federal agencies concur with the proposal, the District recommends the project be authorized as proposed, contingent upon the following conditions: • The total number of slips shall not exceed a maximum of 3. • All parts of the docking facility shall be landward of the ICW channel setback and not exceed a maximum distance of 391' from NHW and shall remain within the length of the existing adjacent docking facilities. • The placement of the boatlifts and platforms shall be placed as shown on plats dated received S/6/2021. The applicant is proposing to add two new slips as well as a roof cover, finger dock, and second platform to the existing 1-slip docking facility. There would be a total of three slips (1 existing and two proposed) along this parcel. The proposed additions to the existing docking facility would not extend more than a maximum distance of 391' from NHW and would remain within pier head length within this area. All portions of the development would be landward approximately 952' of the ICW channel setback. The proposed covered platform. New platform, boatlift and jet ski lift would also be located approximately 35' to 40' waterward of any SAV depending on location. The development conforms to the guidelines set forth under 15A NCAC 07H .0208. Overview: The subject property is located at 145 Camp Morehead Drive, Morehead City, Carteret County, North Carolina. The lot is .56 acres' lot with approximately 861inearfeet of shoreline along Bogue Sound. Existing site improvements consist of a single-family residence, driveway, and septic system. Existing shoreline improvements consists of a wood bulkhead, pier, boatlift and platform. The upland vegetation mainly consists of lawn grasses, shrubs, and a few trees. There are coastal wetlands consisting mostly of Smooth Cordgrass (Sp. Alterniflora) in an approximate 12' wide fringe running the length of the shoreline. The applicant has an existing 1-slip docking facility. The current proposal is for the addition of two slips (total of 3 slips) with lifts, a 10' x 16' platform addition, a 4' x 32' finger pier extending over marsh and shallow water near the shore and a covered area with a 1' roof overhang covering the existing platform to a maximum distance of391' from NHW. The existing platforms(360st) as well as the proposed platform additions (264st) (total of 624st) would not exceed the allowable platform square footage of 688 sf No SA V was observed within the proposed slip areas. AECs involved include: Estuarine Waters and Public Trust Areas. According to Google Earth GIS data, the ICWW is located approximately 952' waterward (south) of the existing Islip docking facility. The waters of Bogue Sound are classified as HQW/SA. This area of Bogue Sound is not designated as a Primary Nursery Area and is open to the taking of shellfish. The is SAV within this location approximately 360' from NHW. No SAV were observed waterward beyond this point. A review of historic and archaeological resources was not provided. The increase in suspended sediment and turbidity levels from the piling placement would be temporary, occur while the piling placement is taking place and should be minimal given the bottom composition. The proposed finger pier would be elevated a minimum of three feet above marsh substrate to the bottom of the decking boards. The proposed additions should not be a hindrance to navigation due to the fact all portions would be located landward 951' from the ICW. The proposed development would also meet the minimum 15' setback from the riparian access lines and not exceed a maximum distance of391' waterward of NHW. No SAV were observed within the proposed platform and slip areas. The proposed work is located at 145 Camp Morehead Drive, Morehead City, within Carteret County. The applicant is proposing to make additions to the existing structure, including a 12' by 13' boat lift, 13' by 16' cover over a platform extension at the terminal end of the pier, and a 10' by 16' platform with a jet ski lift attached to the platform. The applicant is also proposing a 6' by 32' dock coming off of the bulkhead, immediately adjacent to the existing structure. The waters at this site have been designated as SA/HQW waters, and there is submerged aquatic vegetation (SAV) within the project area (but not within the structure footprint). SAV is a critical habitat for numerous commercially, recreationally, and environmentally important species. This habitat type provides nursery, foraging, and refuge for many of these species. Additionally, SAV plays an important role in natural improvements to water quality by increasing the removal of excess nutrients from the environment, and can be used as a bioindicator of water quality. Furthermore, SAV provides natural shoreline protection by decreasing wave energy and improving sediment transport and deposition. Because it provides so many important benefits, protection of this habitat type is critical. Although no SAV was observed within the project footprint, it was observed within close proximity to the proposed additions. DMF believes that the proposed design will not result in significant impacts during the construction or by the continued use of the structure. However, DMF would recommend that care be taken during the construction and during use to ensure that potential impacts are avoided. During construction, workers should be mindful of increases in turbidity, such as during pile installation. If turbidity plumes are observed depositing sediment on nearby SAV, operations should cease until the plume has had sufficient time to dissipate and sediment allowed to re -settle. Altemiflora) in an approximate 12' wide fringe running the length of the shoreline. The Division of Water Resources classifies this area as HQW/SA Waters. This area of Bogue Sound is not designated as a Primary Nursery Area and is open to the taking of shellfish. The Morehead City Land Use Plan classifies this area as Medium Density Residential with Conservation within the AECs. According to Google Earth GIS data, the ICW W is located approximately 952' waterward (south) of the existing 1-slip docking facility. There is an existing high ground water access and a shore parallel 50' long x 8' wide boardwalk going to the existing pier. There is also an existing 10' x 10' wooden patio area within the 30' buffer on the west side of the property and pier. There is an existing bulkhead extending approximately three -fourths the length of the shoreline from the east to the west. Water depths within the proposed jet ski lift and the four pole lift area are-2.75'nlw/mlw to -3.5' nlw/mlw depending on location. The bottom substrate is sand and no SAV (approximately 60' landward (north) of the existing platform) were observed within the proposed slip areas and fixed platform area. Bogue Sound is approximately 1.5 miles wide at this location. There are SAV within this location approximately 360' from NHW. No SAV were observed waterward beyond this point. 10) Proposed Development: The applicant has an existing 1-slip docking facility. The current proposal is for the addition of two slips (total of 3 slips) with lifts, a platform addition, a 4' x 32' finger pier extending over marsh and shallow water near the shore and a covered area with a P roof overhang covering the existing platform to a maximum distance of 391' from NHW. The existing platforms(360sf) as well as the proposed platform additions (264sf) (total of 624sf) would not exceed the allowable platform square footage of 688 sf. No SAV was observed within the proposed slip areas. The applicant is proposing to add a 10' x 16' platform addition along the east side of the existing pier access (landward of the t-head platform) as well as a 13' x 16' covered area over the existing 8' x 30' t-head platform and existing 4' x 30' stepdown. The roof would have 1' roof eaves that extend over the water creating 52sf of shading impacts. The applicants are also proposing two additional slips which consist of a jet -ski lift and a new 4 pole boatlift. The 5' x 9' jet -ski lift would be located along the east side of the proposed 10' x 16' platform. The additional 12' x 13' boatlift would be located along the east side of the existing t-head platform. The closest section of the proposed platform would be approximately 35' to 40' waterward of the edge of SAV habitat. The applicants are also proposing a 4' x 32' finger that would be located immediately adjacent to the east side of the existing pier extending from the existing bulkhead over marsh for 19' and extending another 13' waterward from normal high water. Water depths in this area are less than -1' nlw. The most waterward portion of the proposed development would not exceed a maximum of 39 P from NHW. All parts of the docking facility would be landward of the ICW W channel (approximately 941' landward) and approximately 40' from the western riparian corridor and 15' from the eastern riparian corridor. Riparian corridors were determined by channel orientation and existing pier alignment. There would be a total of three slips (I existing slip with boatlift, 2 additional slips with additional boatlift and jet ski lift. The applicant states boat size would be a maximum of 23' and of open runabout design. Anticipated Impacts: The proposed platform addition, platform covered area and boatlifts would shade 264 ft' and incorporate 420 ft' of shallow bottom habitat. The development would increase the number of slips from one to three. The increase in suspended sediment and turbidity levels from the piling placement would be temporary, occur while the piling placement is taking place and should be minimal given the bottom composition. The proposed finger pier would be elevated a minimum of three feet above marsh substrate to the bottom of the decking boards. The proposed additions should not be a hindrance to navigation due to the fact all portions would be located landward 951' from the ICW. The proposed development would also meet the minimum 15' setback from the riparian access lines and not exceed a maximum distance of 391' waterward ofNHW. No SAV where observed within the proposed platform and slip areas.
