Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-I 18 X Excavation and/or filling pursuant to.NCGS 113-229 Permit Number 114-21 Issued to PCS Phosphate Co. Inc., 1530 NC Hwy 306 S., Aurora, NC 27806 Authorizing development in Beaufort County at adi. to Bath Creek & the Pamlico Sound, at 5624 Archbell Rd., in Aurora , as requested in the permittee's application dtd 3/10/21 (MP-1, 4) and 1/21/21 (MP-2), incl att workplan drawings (6), 030 dtd 2/10/21, 031, 033, 034 dtd 10/26/20 032 did 10/28/20 035 dtd 4/5/21. This permit, issued on September 1, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation )r mese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization — Rio Rap 1) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, construction of the rip rap revetment shall not be undertaken between February 15 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. 2) The alignment of the toe of rip rap shall not exceed the alignment as depicted in the attached,permit application and workplan drawings. 3) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved rip rap alignment. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No. 114-21 Page 2 of 3 ADDITIONAL CONDITIONS 4) The alignment of the authorized rip rap shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. 5) The fill material shall be clean and free of any pollutants except in trace quantities. 6) The rip rap material shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete with no exposed rebar. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. Docking Facility 7) This permit authorizes only the demolition of the existing docking facility and the construction of the docks, pier, platform, covered platform, boat lift and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) This permit authorizes a maximum of one (1) formalized boat slips. 10) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 11) The roof of the covered platform shall not be designed for second story use. 12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 13) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. PCS Phosphate Co. Inc. Permit No.114-21 Page 3 of 3 ADDITIONAL CONDITIONS 15) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2012-00849). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project D WR Project No. 2021-0889. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations in place at the time of such development. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The majority of the property is in active agriculture production. While both Coastal Wetlands and Section 404 Wetlands have been delineated on the property, no wetlands exist in the vicinity of the proposed project. Archaeological site (3 IBF25) is located on the subject property. Staff from the office of state archaeology met with a PCS representative and DCM staff on -site on June 19, 2012 to conduct an evaluation of the project that was previously permitted as CAMA Major #64-12. Anticipated impacts The project as proposed will result in the filling of 20,500 ft2 of river bottom associated with the placement of riprap for shoreline stabilization. Also included in the proposal is the construction of a pier and platforms which will have a total shading impact of 1,648 ft2 of river bottom. The project will result in short term localized turbidity as a result of the construction activities associated with replacing the pier and platforms. Basis for Determination: The project location is mapped in the Beaufort County and Town of Bath Land Use Plans. This project is therefore subject to review of both the county and town plans. Beaufort County The Future Land Use Map (FLUM) classifies the site as Agricultural -Forestry -Rural Housing and Conservation I and Conservation It (overlay). The following LUP policies may be applicable to this request: 2.1.3 Only development and land/water use activities that are consistent with the use standards for coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this classification. Permitted extractive uses in the Aurora area will continue. 2.1.5 Unless in the exempted or allowed, land development and land use activities must comply with the requirements of the Tar -Pamlico Buffer Rule (15A NCAC 02B .0259). 2.2.2 Only development that is consistent with the use standards for the estuarine shoreline AEC and the public trust shoreline AEC (15A NCAC 07H.0209(d)) is allowed. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at on Archbell Point at the confluence of Bath Creek and the Pamlico River near Bath, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Star. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to place 2,050' of granite riprap waterward an existing vertical bulkhead at a 2:1 slope to fortify the structure and provide additional shoreline protection. The total footprint of the 10' wide base riprap would be 20,500 ft=. The rlprep installation is stated to not affect archaeological site 31BF25 located on the property. In addition to the shoreline protection, a 6' by 148' pier with a 10' by 48' T-head and a 16' by 16' platform that includes a 20' by 20' covered section and 15' by 15' uncovered boatlift is proposed. The Pamlico River at this location is classified SB NSW by the Environmental Management Commission and is subject to the NC Division of Water Resources (NCDWR) Tar -Pamlico Buffer Rules. Bath Creek at this location is classified SB NSW by the Environmental Management Commission, is subject to the NCDWR Tar -Pamlico Buffer Rules and is designated a primary nursery area (PNA) by the NCWRC. The NCWRC has reviewed the perntit application and does not object to permit issuance if a February 15 — September 30 moratorium is included as a permit condition for all in -water work. PNAs are defined as those areas inhabited by the embryonic, larval or juvenile life stages of marine or estuarine fish or crustacean species due to favorable physical, chemical or biological factors. As a designated PNA, the creek provides an important rearing area for this variety of estuarine fishes and invertebrates that need relatively undisturbed habitats. The project site is located at53fi8 S�9 Archbell Road off SR 1339 at Archbell Point on the Pamlico River and Bath Creek near the Town of Bath in Beaufort County, North Carolina. PCS is a mining and refining industry located near the Town of Aurora in Beaufort County, North Carolina. PCS has extensive land holdings in the county bordering the Pamlico River, Pungo River, South Creek and their tributaries. The site involves a 451-acre tract of land adjacent to Bath Creek and the Pamlico River partially located within the ETJ of the Town of Bath. The proposed project area is broken into three sections around Archbell Point along the Pamlico River and Bath Creek. Archaeological site (31BF25) is located on the subject property. Staff from the office of state archaeology met with a PCS representative and DCM staff on -site on June 19, 2012 to conduct an evaluation of the project that was previously permitted as CAMA Major #64-12. The project also includes removal and replacement of the existing pier and platform located on Bath Creek with a new pier, platforms, and boatlift in approximately the same footprint. The majority of the shoreline in the project area is vegetated with mowed lawn grass and strips of hardwoods and pine. The majority of the property is in active agriculture production. While both Coastal Wetlands and Section 404 Wetlands have been delineated on the property, no wetlands exist in the vicinity of the proposed project. The adjacent upstream (west) property is approximately 2,000 feet of natural wooded shoreline owned by the applicant and then a subdivision with single family homes, stabilized shorelines and piers. The downstream end of the project area located within Bath Creek is a developed subdivision with single family homes, stabilized shorelines and piers. The site elevation is f8' to 10' above normal water level (NWL) along the Pamlico River and t4' to 10' along the sections of Bath Creek. Pamlico River is classified as SB;NSW at the project location and Bath Creek is classified as SB;NSW at the project site by the Environmental Management Commission. The area along the Pamlico River is coastal fishing waters and the area within Bath Creek is inland fishing waters and labeled as an inland primary nursery area by the North Carolina Wildlife Resource Commission (NC WRC). Project description The applicant proposes to place 2,050' of granite riprap at a 2 to I slope not to exceed 10' waterward of existing wooden vertical bulkhead to repair damage as well as enhance shoreline stabilization along the river. With a base width of 10' the riprap will have a total footprint of 20,500 W. Applicant also proposes a 6' by 148' pier with a 10' by 48' T-head platform with an additional 16' by 16' platform including a 20' by 20' covered section and a 15' by 15' uncovered boatlift placed on the SW side of the pier. Anticipated impacts The project as proposed will result in the filling of 20,500 R2 of river bottom associated with the placement of ripmp for shoreline stabilization. Also included in the proposal is the construction of a pier and platforms which will have a total shading impact of 1,648 ft' of river bottom. The project will result in short tern localized turbidity as a result of the construction activities associated with replacing the pier and platforms. T. Inc. maintains and operates a lodge at our Archbell Point property on Bath Creek for entertaining clients and providing accommodations for company executives. The property has a large amount of 5-SE facing shoreline that is exposed to wind and wave action during storms that is currently bulkheaded. There is also a pier on Bath Creek that is the primary access to the property via boat from our facility in Aurora. The proposed work will aid In shoreline stabilization of deteriorating bulkhead and remedy safety and stability concerns with the replacement of the existing pier. A large portion of this permit and planned work is placement of a total of 2,050ft of riprap. The majority of the property at Archbell Point has existing bulkhead to aid in shoreline stabilization along both Bath Creek and the Pamlico River; however past storms and cumulative erosion impacts have started to affect their stability. Construction will proceed in the following steps: 1) Material and equipment will be staged along the project sections 2) Filter cloth will be attached to existing bulkhead 3) An excavator will place riprap seaward of the existing bulkhead at 2 to 1 slope back to the top of the wall 4) Final clean up and removal of excess material and equipment An existing pier on Bath Creek will also be replaced with new construction in approximately the same footprint with a covered section and boatlift. Based on this work, we have reevaluated the permit application provided for the above project and offer the following comments. Archaeological site 31BF25 is located within the project boundaries. The area adjacent to the existing bulkhead has been disturbed by previous construction activities and did not require inspection. A combination of ground surface inspection and shovel tests were undertaken within seven locations scheduled for rock cache areas. These tests revealed a lack of site integrity within the cache areas. Prehistoric and historic era artifacts were mixed within the presently existing plowzone. There was no evidence of intact cultural features or discrete layers of culturally -derived strata within any of the areas tested. Based on these results and our discussions with representatives of PCs and their construction contractor, we conclude that the undertaking will not have an adverse effect on significant cultural resources. In terns of Condition 7 of Permit #64-12, we recommend that monitoring of construction activities by an archaeologist is not necessary for this project.
