Wilmington , as requested in the permittee's application dated 9/28/20, including attached workplan drawings (2),
Drawing 1 of 2 dated "Received DCM Wilmington" 11/11/20, and Drawing 2 of 2 dated "Received DCM Wilmington" 10/2/20.
This permit, issued on March 4, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any
violation of these terms may be subject to fines, imprisonment, or civil action; or may cause the permit to be
null and void.
Docking Facility
1) This permit authorizes only the docks, piers, tie pilings, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit 'must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program..

ADDITIONAL CONDITIONS
3) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible: This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
6) This permit authorizes a maximum of five (5) formalized boat slips.
7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
USACE Conditions
8) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
12) All debris associated with this development shall be contained within the authorized project area and
removed to an appropriate upland refuse disposal site.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2020-2040).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-1793.

Contact a representative of the Division at (910) 7964215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

It is the staffs recommendation that the construction of the new privath docking, resulting in the incorporation of 772 SF
of public trust waters, is CONSISTENTwith the Rules of 15 NCAC 7H.0208 (b) (6) Specific Use Standards for Piers and
Docking Facilities.
The application states that the docking facilities would provide docking space for five (5) vessels at this location in water
depths of 2.3' to 4.2' @ NLW. The proposed structure would be located over open waterand within the adjacent riparian
corridor of the applicant.
In the absence of any concerns from the commenting agencies, it is recommended that a permit be issued. This office has
no objection to the proposed work, provided it is consistent With all other state and federal permitting requirements. It is
recommended that any permit issued should include standard conditions for docking facilities.

your application do not require written authorization to utilize GC 4175. However, you are required
to follow the conditions listed in the attached certification. You should get or otherwise comply
with any other federal, state and local requirements before you go ahead with your project
including (but not limited to) erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form maybe obtained from the OAH at htto://www.ncoah.com/
or by calling the OAH Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A

This -project appears to be consistent with the 2006 Wilmington -New Hanover County
Joint Land Use Plan.
The applicant proposes to construct a private docking facility on the parcel with fixed
pier, ramp and floating docks for a total of 5-slips within the riparian corridor. The
project is located at 330 Patalanda Road, adjacent to the AIWW in Wilmington.
Areas of Environmental Concern (AEC's) impacted by the proposal are PTA and EW.
Waters at the project site are classified as SA-ORW and are not open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County Joint Land Use Plan and offer the following comments.
The general area of the project is classified as Residential while the AECs impacted by
the work are classified as Conservation.
In general, Wilmington -New Hanover County allows development in Conservation
classified AECs, which is consistent with the State's minimum use standards. The 2006
Wilmington -New Hanover County Joint Land Use Plan contains some policies, which
exceed the State's minimum use standards. However, none of these standards appear to
be applicable to this proposal. .

9. PROJECT DESCRIPTION
The project site is located at 330 Patalanda Road, adjacent to the AIWW, in Wilmington, in New Hanover County. To locate
the property of interest, from the Wilmington regional office take Cardinal Drive north to Market Street. Turn left Market
Street and travel approximately 0.9 miles and turn left onto College Road (southbound). Travel 7.6 miles and turn left onto
Piner Road. Travel1.0 mile and turn right onto Myrtle Grove Road. Travel 1.9 miles and take a left onto Patalanda Road.
The property of interest will be located at the end of the road.
The project site is approximately 0.67 acres in size and has an elevation that ranges from approximately 5'-0' above Normal
High Water (NHW). The property currently has an access gate, gravel driveway, and picnic table with benches. The
property is sparsely vegetated with mixed grasses, and some small thin bands of coastal wetlands (Smooth Chordgrass)
on the southern shoreline. Due to its peninsula shape, the.project site has over 500 LF of shoreline, wrapping from the
north to the south, and most of the shoreline frontage is stabilized by existing rip rap.
Prior to hurricane Florence, there was a private docking facility on the property that was mostly destroyed in the storm.
This facility has been demolished and removed at this time. No permit history was located for the previous facility, except
for an exemption to make repairs after the damages from Florence. The rip rap was authorized under General Permit
25290 D, issued 6/9/2000, to a previous property owner.
The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters as conservation and the high ground
portion of the property as residential (R-15). The waters of this section of the AIWW are classified SA: ORW by the Division
of Water Resources. They ARE designated as a Primary Nursery Area (PNA) and coastal waters, and they are CLOSED to
the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to construct a private docking facility on the parcel with fixed pier, ramp and floating docks, for a
total of 5 boat slips within the riparian corridor: Starting at the same origin point as the previous docking facility, at the
easternmost extent of the parcel, the applicant is proposing a fixed access pier (50' x 6') extending in a easterly direction
from the high ground, perpendicular to the shoreline. The proposed fixed access pier would lead to a gangway, which
would lead down to a proposed floating dock (4' x 16') extending waterward_ in the same direction as the access pier.
The proposed floating dock would connect to a U-shaped floating dock system, with a main spine (6' x2(Y) extending
parallel to the shoreline, and on each end, two floating docks '(6' x 24') extending waterward, each perpendicular to the
shoreline and in the same alignment as the access pier. Please see Drawing "Nucci Proposed Docking Facility Plan View"
for details. The landward most floating dock would serve as two slips, and the outer edges of the most waterward
floating docks would serve as two more slips. The center space in the middle of the U-shaped floating dock would serve
as one slip, as the Nucci family owns a wide vessel they intend to dock in that location. In total the docking facility
would provide docking for five (5) vessels, at water depths ranging from a 2.3' @ NLW at the landward most slips to 4.2'
@ NLW at the most waterward slips (See Nucci Proposed Docking Facility Plan View). These water depths were
collected with NC DCM staff on site.

10. ANTICIPATED IMPACTS
The proposed docking facility would extend 90 ft. into a waterbody measuring approximately 875 ft. across which would
meet the ''/< width distance. The proposed structures would incorporate 772 sq. ft. of public trust area and estuarine
waters. As proposed, the facility would not encroach either 15 ft. riparian corridor setback. The proposed docking facility
would be located approximately 780 ft. from a marina facility to the north, and 415 ft from a private docking facility to the
south. The proposed facility would provide dockage for a five (5) vessels in water depths ranging from 2.3' to 4.2' at NLW.
Minor increases in turbidity should, be expected during the constructioh.

Narrative - 330 Patalanda Dock Proposal
I'd like to thank you for reviewing our plans to build a personal use
dock. We are a family native to Wilmington and have enjoyed the local
waterways for many years. The previous owner maintained a pier and
floating dock system prior to the hurricane dIamage from Florence.
This pier construction will be in a similar length as the previous
owner had prior to the storms, but with additional boat slips. The fixed dock
will extend 50 ft from the paved peninsula and connect to the floating
docks. There will be a transition ramp that connects to the floating dock
system. The width of the dock's walkways will, be 6ft and the total length of
the structure will be 90 ft. The outer slips will be. prioritized for small boats.
and the middle slip will be for one large_ vessel. The total number of slips
proposed for this project is 5.

I'm heading out of town for this upcoming week so I wanted to send you some edits beforehand.
For the drawings:
• Each need to have a title block with a title (Nucci Proposed Docking Facility Plan Yew, Nucci Proposed Docking Facility Cross Section
Vim, etc), drawn by. Jere] Nixon, sheet 1 of x, and label the scale. The scales need to be a standard engineering scale, such as 1:20,
1:40, 1:50 etc. I haven't attempted to print your draft drawings yet so I'm not sure if they are, but they need to be to scale in such a
way that when reviewing agencies are processing the application, they could use a ruler to scale off measurements.
• The drawings need to have a north arrow and label the water body.
• For the top view drawing, we need you to add the dimension of the width of the outer floats
• Please label the proposed slips in their actual locations (slip 1, slip 2, slip 3 etc)
• The top view drawing should show the width of the water body
• The approximate Normal High Water line (NHW) should be shown on the drawing
• Please add water depths on the drawing, for all of the locations that are to be proposed as slips
• Add water depths to the cross sectional drawing
• On the MP-4, you have indicated that the facility would have tie pilings. Can you add their location to the drawing please.
• If you refer to the checklist I sent you, it should help make sure the drawings are complete.
