Authorizing development in Carteret County at adi. to South River, at 229 Tosto Road, near
Beaufort as requested in the permittee's application dated 9/17/20;
includine attached workplan drawing=-s (22). Sheets 1-21 of 21 all dated 7/I/20 and Sheet 1 of I dated 9/3/20.
This permit, issued on January 19, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
it tnese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
Shoreline Stabilization — Bulkhead and Return Wall Extension
1) The northern bulkhead located adjacent to the boat ramp shall not extend waterward more than 2 feet
from the existing bulkhead at any point along its alignment at the time of construction.
2) The return wall extension located at the southern bulkhead shall be constructed in accordance with
the alignment depicted on the attached workplan drawings.
3) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the
approved bulkhead alignment.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024

ADDITIONAL CONDITIONS
4) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction.
5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.
6) The bulkhead shall be constructed prior to any backfilling activities.
7) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
8) The fill material shall be clean and free of any pollutants except in trace quantities.
9) Unless altered herein, all backfill material shall be obtained from a high ground source and confined
behind the permitted bulkhead.
10) No backfill material is to be placed within 30 feet of the normal water level, except that which will be
used to backfill the area behind the permitted bulkhead.
11) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead.
12) In accordance with commitments made by the permittee, no live concrete shall not be allowed to contact
waters of the State or waters that will enter waters of the State during construction of the bulkhead or
return wall extension.
Docking Facility Expansion
13) This permit authorizes only the demolition of the existing pier and construction of the pier, dolphin
removal and/or repair, and other structures and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, shall
become a permanent.part of this docking facility without permit modification. No non -water dependent
uses of structures shall be conducted on, in or over Public Trust waters without permit modification.
14) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
15) This permit does not authorize any new formalized boat slips. The docking facility is authorized for no
more than three (3) formalized boat slips.
16) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

17) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
Boat Rama Expansion
18) Unless specifically altered herein, this permit authorizes one concrete boat ramp, as indicated on the
attached workplan drawings.
19) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or
poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact
waters of the State or waters that will enter waters of the State.
20) Excavation and ground disturbing activities, associated with the placement of the boat ramp, above and
below the normal water line shall be limited to that absolutely necessary to establish adequate ramp
slope and provide a ramp no greater in size than specified in the attached permit application and
workplan drawings.
Sedimentation and Erosion Control
21) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
22) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
23) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
USACE Conditions
24) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
25) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
26) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
27) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-01855).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-1355.
NOTE: Future -development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Neuse River buffer regulations in
place at the time of such development.
NOTE: An application processing fee of $400 was received by DCM for this project.

The facility is utilized by the NC Division of Marine Fisheries mainly as a staging and loading area for the Division's oyster
reef and artifical reef programs. Materials are stored on site and loaded onto vessels at the dock(s) and/or ramp so that they
may be transited to and placed on reefs sites.

of equipment and where it is to be stored.
Standard marine construction equipment will be utilized, included but not limited to barge mounted pile installation equipment
and land -based equipment such as small wheeled and/or tracked construction equipment.

Consistency Determination: The request is consistent with/not in conflict with the Carteret County Land
Use Plan certified by the CRC on December 20, 2010.
Overview: The proposed project is located adjacent to the South River at 229 Tosto Road near Beaufort,
Carteret County. Current on -site development includes a boat ramp, bulkheads, piers, dolphin clusters,
and upland gravel driveway and parking area (CAMA. Major Permit 55-08). This site is used for
government use at an existing loading facility that supports habitat enhancement projects. The adjacent
riparian properties are currently undeveloped.
The elevation of the adjacent high ground of the parcel is approximately 5' above the normal water level
(NWL). Immediate offshore water depths adjacent to the parcel range from -3' to -9' normal water level
(NWL). The subaqueous substrate is firm with shell. Vegetation on the adjacent parcel mainly consists of
pine trees and black needlerush. The parcel has 490' of continuous shoreline along the South River, and
is approximately 4,130' across at this location.
Areas of Environmental Concern (AECs) include Estuarine Waters (EW), Coastal Shorelines (CS) and Public
Turst Areas (PTA). South River is classified as SA; HQW; Nutrient Sensitive Waters, is not classified as PNA,
and is closed to shellfish harvest. There are no Coastal Wetlands, coastal resources, of SAV within the
project area. This proposal is not located near a Federal Channel and is subject to the Neuse River Riparian
Buffer Rules.
The applicant is proposing to replace the existing bulkhead along the center portion of the shoreline on
the parcel; the bulkhead would be 97' long and 2' waterward of the existing bulkhead alignment. This

proposed bulkhead would be made of concrete. The alignment would be encased temporarily while the
poured concrete cures. The bulkhead tie -back rods would protrude 12' into the high ground.
The existing northern most pier along this tract's shoreline would be replaced and expanded. The
proposed pier would be 5' wide and 65' long. The proposed concrete hog slat pier would not extend
beyond the existing dolphin pile cluster at the facility.
The existing concrete boat ramp would be replaced and expanded as a part of this project. The proposed
boat ramp would be 25' wide and 60' long. It would not extend any further waterward than the existing
boat ramp. The proposed concrete boat ramp would be fabricated on the high ground and then pushed
into placed with heavy equipment upon curing.
A retaining wing wall extension is also being proposed as a part of this project. It would be 20' long in the
nearby vicinity of the southeastern property boundary. This wall extension would tie back into the high
ground elevation.
Anticipated impacts: This proposal would be within the existing footprint of the facility. The proposed pier
would shade 325 square feet of Public Trust Area. The proposed boat ramp and bulkhead would fill 694
square feet of Estuarine Waters. The proposed wing wall extension, bulkhead tie back system, and boat
ramp approach would fill 2,890 square feet of high ground. Traditional marine construction methodology
will be utilized during the construction of this project. Turbidity impacts are not anticipated during the
construction activities in the South River.
Basis for Determination:
The project site is located in Carteret County and is subject to the 2005 Carteret County Land Use Plan
Update. The Future Land Use Map (FLUM) designates the site as Rural (land) and Conservation due to the
sites location in Estuarine Shoreline, Public Trust Area, and Estuarine Waters, and Coastal Shoreline AECs
(Areas of Environmental Concern).
The "Rural" land use category is defined as:
"Areas included within the rural classification include lands that are appropriate for or presently used for
agriculture, forestry, mineral extraction, and other uses that should be located in a relatively isolated
and undeveloped area. The predominant land uses are agricultural and residential. However, public
facilities, health care facilities, and scattered industrial and commercial uses are allowed. Areas classified
as rural are usually served by individual wells and septic systems. No central water service is anticipated
during the planning period".
Residential densities average two dwelling units per acre, with a minimum lotsize of 20,000 square feet
(2.2 units per acre). Extensive portions of the Down East area are classified as rural, as are areas in
northwest Carteret County.
Within areas depicted as Conservation on the Future Land Use Map, there may be high -ground areas that
are suitable for development. These high -ground areas shall be considered as Rural and development shall
be consistent with densities and requirements contained in the Rural classification description, policies
contained in the Land Use Plan, and applicable local, state, and federal regulations. Land uses allowed in
Areas of Environmental Concern are those consistent with the State's minimum use standards and state

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report and BioReport
for the subject project. The attached notice requests federal agency comments on this project by December 3, 2020.
The site is located within waters of South River, at 229 Tosto Road, north of Beaufort, Carteret County, North Carolina.
Coordinates are 34.955987 N,-76.583487 W.
The North Carolina Division of Marine Fisheries (DMF) proposes to construct a new retaining wall, expand the existing
boat ramp, replace the existing bulkhead, and replace and expand the existing pier. The applicant proposes to replace
the existing bulkhead along the center portion of the shoreline on the parcel. The proposed concrete bulkhead would be
97' long and 2' waterward of the existing bulkhead alignment. The alignment would be encased temporarily while the
poured concrete cures. Bulkhead tie -back rods would protrude 12' into the high ground. The existing northern most pier
along this tract's shoreline would be replaced and expanded. The proposed pier would be 5' wide and 65' long. The
proposed concrete hog slat pier would not extend beyond the existing dolphin pile cluster at the facility. The existing
concrete boat ramp would be replaced and expanded as a part of this project. The proposed boat ramp would be 25'
wide and 60' long. It would not extend any further waterward than the existing boat ramp. The proposed boat ramp
would be fabricated on the high ground and then pushed into placed with heavy equipment upon curing. A retaining
wing wall extension is also being proposed as a part of this project. It would be 201ong in the nearby vicinity of the
southeastern property boundary. This wall extension would tie back into the high ground elevation. Approximately 694
ft2 of open waters would be filled as a result of the project.
Dredging is not proposed as a part of this project.
The project site is not located near a Corps federal channel.

proposed project.
EFH:
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but not
likely adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management
Councils or the National Marine Fisheries Service. The waters within the project area are not designated as PNA by the
Division of Marine Fisheries, are classified as SA; HQW; Nutrient Sensitive Waters by the Division of Water Resources,
and are closed to shell fishing. Average water depths within the project area range from -3' NLW to -9' NLW. The
application also states that submerged aquatic vegetation (SAV) was not observed in the project area. Substrate is firm,
with shell.
ESA:
The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest
North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project
may affect, but is not likely to adversely affect the West Indian Manatee. The use of Manatee Guidelines may be
required as a permit condition. The project would have No Effect on any other federally listed species.
NHPA 106:
Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and
the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and
records and the latest published version of the National Register of Historic Places and initially determines that no
historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit
area: therefore, there will be no historic properties affected.

Dear Mr. Howell:

The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report. We recommend that the following conditions be
included in the modification to the State authorization:
1. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and

strictly adhere to all requirements therein. The guidelines can be found at
2. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine'' Safety
Office at (910)-772-219I ,_
3. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USAGE) prior to implementation.
4. Except as specifed in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
5. Except as authorized by this. permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
6. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-
5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
7. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
8. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
9.The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, includin o s, shall be

10. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project
must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statutes Chapter I I3A Article 4).
11. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
12. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre -project condition.
13. Violations of these conditions or violations of Section 404 of the Clean Water Actor
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

This approval is for the purpose and design described in your application. The plans and specifications for
this project are incorporated by reference as part of this Authorization and General Certification, If you
change your project, you must notify the Division and you may be required to submit a new application
package. If the property is sold, the new owner must be given a copy of this Authorization and General
Certification and is responsible for complying with all conditions. [15A NCAC 02B .0611(b)(2) - Neuse].
If you are unable to comply with any of the conditions below, you must notify the Wilmington Regional Office
within 24 hours (or the next business day if a weekend or holiday) from the time the permittee becomes

3. During construction of the proposed project, fueling, lubrication and general equipment maintenance
should not take place within 50 feet of a waterbody or wetlands to prevent contamination by fuel and
oils. [15A NCAC 02H .0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(0]
4. When concrete is used during construction, then all necessary measures shall be taken to prevent
direct contact between the uncured concrete and waters of the state. Water that inadvertently contact

Narrative Description:
The property is located adjacent to the South River at 229 Tosto Road near Beaufort, Carteret County.
This property is currently developed with a boat ramp, bulkheads, piers, dolphin clusters, and upland
gravel driveway and parking area (ref. CAMA Major Permit 55-08). This property is located within
the Neuse River basin. The adjacent riparian properties are currently undeveloped.
The elevation of the adjacent high ground of the parcel is approximately 5' above the normal water
level (NWL). Vegetation on the adjacent parcel mainly consists of pine trees and black needlerush.
There are no Coastal Wetlands within the project area. The parcel has 490' of continuous shoreline
along the South River. Immediate offshore water depths adjacent to the parcel range from —3' to —9'
normal water level (NWL). The subaqueous substrate is firm with shell.
This proposal is not located near a Federal Channel. There is not a cultural resource in the project
area. This waterbody is approximately 4,130' across at this location. These estuarine waters are not
classified as a Primary Nursery Area. Submerged aquatic vegetation was not observed at this
location. This area is closed to shellfish harvest and is classified as SA; HQW; Nutrient Sensitive
Waters. This parcel is subject to the Neuse River Riparian Buffer Rules.
Proposed Development:
The applicant proposes to make improvements to an existing boat landing adjacent to the South River,
north of Beaufort. The proposed development would take place adjacent to 229 Tosto Road, Carteret
County. This proposal is for government use at an existing loading facility that supports habitat
enhancement projects.
The applicant is proposing to replace the existing bulkhead along the center portion of the shoreline
on the parcel. This bulkhead would be 97' long and 2' waterward of the existing bulkhead alignment.
This proposed bulkhead would be made of concrete. The alignment would be encased temporarily
while the poured concrete cures. The bulkhead tie -back rods would protrude 12' into the high ground.
The existing northern most pier along this tract's shoreline would be replaced and expanded. The
proposed pier would be 5' wide and 65' long. The proposed concrete hog slat pier would not extend
beyond the existing dolphin pile cluster at the facility.
The existing concrete boat ramp would be replaced and expanded as a part of this project. The
proposed boat ramp would be 25' wide and 60' long. It would not extend any further waterward than
the existing boat ramp. The proposed concrete boat ramp would be fabricated on the high ground and
then pushed into placed with heavy equipment upon curing.
A retaining wing wall extension is also being proposed as a part of this project. It would be 20'long in
the nearby vicinity of the southeastern property boundary. This wall extension would tie back into the
high ground elevation.

Anticipated Impacts:
This proposal is not in the vicinity of a Federal Channel setback. This proposal would be within the
existing footprint of the facility. The proposed pier would shade 325 square feet of of Public Trust
Area. The proposed boat ramp and bulkhead would fill 694 square feet of Estuarine Waters. The
proposed wing wall extension, bulkhead tie back system, and boat ramp approach would fill 2,890
square feet of high ground. Traditional marine construction methodology will be utilized during the
construction of this project. Turbidity impacts are not anticipated during the construction activities
in the South River.
There is not a cultural resource in the vicinity of the project area. This project area is subject to
the Neuse River Riparian Buffer Rules. These waters of the Neuse River are not classified as a
Primary Nursery Area and the presence of submerged aquatic vegetation was not observed. This
area is closed to shellfish harvest and is classified as SA; HQW; Nutrient Sensitive Waters.

The following is a description of the elements for the proposed Dock Structural Repairs (South
River) for the North Carolina Department of Environmental Quality (NCDEQ) Division of
Marine Fisheries (NCDMF) site. The elements proposed by the DMF are herein collectively
referred to as the "Project" or "Proposed Project", which is subject to this application. The
NCDMF proposes the removal and replacement of the northern timber pier, the extension of the
pier, the removal of the pier wave screen, the removal and replacement of the failed timber
fender piles, the removal of the failed 6-pile cluster remnants, and the repair of the 6-pile cluster
wire wrap. Other work will include a 3' tall x 20' long concrete retaining wall bulkhead
extension for slope stabilization, encapsulating the northern bulkhead steel sheet piles with
concrete, removal of the articulated mat boat ramp and replacing it with solid precast concrete
panels and widening of the boat ramp.
Project Location
The South River facility is located on Tosto Road in South River, NC approximately 'h mile east
of South River Road on the western bank of the South River near its confluence with the Neuse
River (Figure 1). The property lies along the western shore of the South River with a waterfront
frontage of approximately 490 feet.

Purpose and Need
There are a variety of reasons necessitating the repairs at the South River Site. The bulk of the
damage to the northern timber pier was caused by Hurricane Florence in September 2018. The
work on the boat ramp is viewed as a safety and efficiency improvement. The bulkhead repairs
are a result of typical corrosion of the existing steel sheet piles.
Existing Conditions
The NCDMF is responsible for the stewardship of the state's marine and estuarine resources.
DMF owns two properties in South River. The facility on the water, which is the subject of this
permit application, is a staging site for their artificial reef program. The South River NCDMF
facility consists of two areas of steel sheet pile bulkhead with concrete cap, two timber piers, a
boat ramp, and offshore timber pile clusters. Original construction of the bulkhead and northern
timber pier was completed in 1998. The boat ramp and southernmost timber pier were
constructed in 2009.
The northern pier was part of the original facility construction in 1998 and was recently
significantly damaged during Hurricane Florence in 2018. The timber decking and stringers are
completely missing, and the timber handrail is significantly damaged. The southern face of the
pier is lined with a solid vinyl sheet pile wave screen. Portions of the wave screen and supporting
timber whalers have also been significantly damaged. Two timber fender piles on the southern
face of the pier have also failed.
The northern bulkhead is approximately 100 linear feet in total. It was originally constructed in
1998 and composed of PZ 22 steel sheet piles. There is also a 2'-3" X 2'-9" concrete cap atop the
sheet piles, which is anchored back by threaded rods to concrete deadman anchors below grade.
The steel sheet piles are exhibiting signs of coating system failure and corrosion is beginning in
the tidal splash zone.
Three (3) 6-pile clusters were installed during the original construction in 1998 on the southern
end of the facility. Three (3) additional 6-pile clusters were later installed in 2009. A 3-pile
cluster aligned with the northern timber pier was also part of the original 1998 construction. The
southeastern -most 6-pile cluster is missing.
The existing boat ramp begins on the landside as a 15-foot-wide by 10-foot-long cast -in -place
concrete slab. Beginning at the landside corner of the bulkhead wall, the boat ramp and
surrounding scour apron is composed of articulated concrete block mats totaling 1,290 square
feet. The boat ramp itself is 15 feet wide and 36 feet long, with the scour apron extending an
addition 10 feet on the southern and eastern perimeter of the ramp. NCDMF staff expressed
concerns over the inability of the mats to retain fill as intended within the void space within and
between individual blocks. The lack of consistent fill within the block mat voids creates a
tripping hazard for personnel as well as creating an uneven surface for vehicles to maneuver
when launching and retrieving vessels. A scour hole at the north corner of the boat ramp near the
interface with the bulkhead was recently detected by NCDW personnel.
North Timber Pier:
A full replacement of existing structure is required, with the exception that certain piles may still
be still intact and in a condition that they can be utilized in the pier replacement. Replacement
will include extension of the pier waterward by approximately 15' to reach an existing 3-pile
dolphin cluster. The width of the new pier will not exceed the width of the existing pier (5').
The new structure will not require a vinyl wave barrier. Therefore, the existing wave barrier will
be removed and not replaced. Hog slat style decking will be utilized to minimize damage
potential during future storms. The structure will be constructed without handrails, as it is not
required for fall protection due to elevation, and further presents a hinderance to operations. No
water or electrical services are required on this pier.
Piling Repair and Removal:
One existing 6-pile dolphin cluster will require replacement of a missing wire wrap. One 6-pile
dolphin cluster was broken off during past storms and the resulting debris must be removed. No
replacement of this broken cluster is proposed as it is not required under future growth plans.
One 6-pile cluster must be removed, as it hiders bulkhead expansion plans. If in good condition,
piles may be saved for future placement.
Bulkhead Repairs and Concrete Encasement:
In order to prevent further deterioration of the bulkhead structural members due to severe
corrosion, the proposed design is to completely encase the bulkhead with concrete tying into the
header. The construction methods for the concrete encasement effort is discussed in detail below.
The southern bulkhead will have a 3' tall x 20' long cast -in -place concrete retaining wall
extension added landward to provide additional slope stabilization near the existing electrical
panel access platform.
Boat Ramp Replacement and Widening_
The boat ramp is presently —15' wide and constructed of articulated blocks. In its current state, it
is heavily damaged by recent vessel activity, heavy use, and poor original design. The south side
of the ramp (or right as you face the water), on land, there exists a small concrete structure with
little apparent purpose. To improve functional use and structural longevity, it is proposed that the
articulated blocks and land -side concrete structure be removed in favor of widening the ramp and
replacing the surface with new concrete slab. These new concrete slabs will be formed in an
upland location and put into place once cured. No "wet" or "uncured" concrete will touch waters
of the State.
Waterside Construction
Construction will utilize a combination of barge -mounted and land -based construction
equipment.
For the construction of the bulkhead repair, the implementation of a full coffer dam may be cost
prohibitive for this work. Instead, since much of this work will be above normal water level, it is
anticipated that the contractor will form up the new area with pour chutes in the top of the form
to allow the concrete in. The contractor would dewater the forms as much as possible prior to
placement of the concrete in the formed void. Allowing the water to be displaced as the concrete
is poured will be avoided so as to decrease the likelihood of wet concrete contamination to the
waters of the South River.
Avoidance and Minimization Measures
The following includes the avoidance and minimizations measures that have been considered and
employed:
- Direct impacts to water quality by construction of the concrete encasement around the
northern bulkhead will be avoided by dewatering the forms as much as possible to place
the concrete in the formed void.
o Allowing the water to be displaced as the concrete is poured will be avoided in
order to decrease the likelihood of wet concrete contamination to the waters of the
South River.
- There will be no shading of coastal wetlands.
- Submerged Aquatic Vegetation was not observed in the project area.
- No portion of the proposed work will take place within or close to the 15' riparian
corridor setbacks (+/- 297' to north, +/- 190' to south).
- The alignment of the refaced bulkhead will be no further waterward from the existing
sheetpile bulkhead than is necessary to carry out the refacing activities.
- Existing pilings will be utilized wherever possible on the reconstructed dock.
- The replacement of the existing wave screen is not proposed.
- There are currently sufficient water depths at both the boat ramp and docking facilities to
accommodate the anticipated vessel usage.
Compliance with N.C. Environmental Policy Act
In accordance with NCGS 113A-12(6), a review under the North Carolina Environmental
Policy Act is not required for projects requiring a CAMA Major Permit.
During a site visit on August 20, 2020, no submerged aquatic vegetation was found by visual
inspection on site. Coastal wetlands do not exist within the footprint of the proposed
maintenance activities, but do exist on the property to the north of the proposed activities.

The following is a description of the elements for the proposed Dock
Structural Repairs (South River) for the North Carolina Department of
Environmental Quality (NCDEO) Division of Marine Fisheries (NCDMF) site.
The elements proposed by the DMF are herein collectively referred to as
the "Project" or "Proposed Project", which is subject to this application. The
NCDMF proposes the removal and replacement of the northern timber pier,
the extension of the pier, the removal of the pier wave screen, the removal
and replacement of the failed timber fender piles, the removal of the failed
6-pile cluster remnants, and the repair of the 6-pile cluster wire wrap. Other
work will include encapsulating the northern bulkhead steel sheet piles with
concrete, removal of the articulated mat boat ramp and replacing it with
solid precast concrete panels and widening of the boat ramp.
Project Location
The South River facility is located on Tosto Road in South River, NC
approximately''/] mile east of South River Road on the western bank of the
South River near its confluence with the Neuse River. The property lies
along the western shore of the South River with a waterfront frontage of
approximately 490 feet.
Please note that a CAMA Major Permit was applied for on September 17th,
at which time we were unaware of this requirement. 1 may be contacted at

Dear Mr. Gupton:
The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of the NC Division of Marine Fisheries property located adjacent
to the South River at 229 Tosto Road near Beaufort, Carteret County. It was received on October
1, 2020, and appears to be adequate for processing at this time. The projected deadline for
making a decision is January 15, 2021. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been notified of a final
action by the initial deadline stated above, you should consider the review period extended.
Under those circumstances, this letter will serve as your notice of an extended review. However,
an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from October 1, 2020, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice at
a conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-
of-way fronting your property, or at a point along the road right-of-way where a private road
would lead one into your property. Failure to post this notice could result in an incomplete
application.

The Department of Environment and Natural Resources hereby gives public notice as required by
NCGS 113A-119(b) that application for a development permit in an Area of Environmental Concern as
designated under the CAMA was received on October 5, 2020. According to said application, the NC
Division of Marine Fisheries proposes to make improvements adjacent to the South River, at 229 Tosto

The North Carolina Division of Marine Fisheries (NCDMF) intends to carry out improvements and maintenance and
repairs to the Division's South River facility, which is located at 229 Tosto Road in eastern Carteret County. The
proposed project, as detailed in the attached permit application package, is summarized as follows:
1. Repair and extend an existing dock,
2. Repair and enlarge an existing boat tamp,
3. Repair/reface an existing sheetpile bulkhead
4. Install a short concrete retaining wall for minor slope stabilization, and
5. Replace missing support banding on an existing pile cluster.
With this information in mind, Moffatt and Nichol, on behalf of the NCDMF, respectfully submits this request for permit

The North Carolina Division of Marine Fisheries (NCDMF) intends to carry out improvements and maintenance and
repairs to the Division's South River facility, which is located at 229 Tosto Road in eastern Carteret County. The
proposed project, as detailed in the attached permit application package, is summarized as follows:
1. Repair and extend an existing dock,
2. Repair and enlarge an existing boat ramp.
3. Repair/reface an existing sheetpile bulkhead
4. Install a short concrete retaining wall for minor slope stabilization. and
5. Replace missing support banding on an existing pile cluster.
With this information in mind, Moffatt and Nichol, on behalf of the NCDMF. respectfully submits this request for permit

ACCORDANCE WITH THE CONTRACT DOCUMENTS.
9. THE CONTRACTOR SHALL KEEP ACCURATE RECORDS OF ANY CHANGES MADE TO THE DRAWINGS ON
A SEPARATE WHITE SET OF PLANS PROVIDED BY THE DESIGNER. THESE ANNOTATED DRAWINGS
SHALL BE RETURNED TO THE DESIGNER PRIOR TO APPROVAL OF THE FINAL PAYMENT APPLICATION.
9, THE NCDMF SOUTH RIVER FACILITY IS AN OPERATIONAL FACILITY. THE CONTRACTOR SHALL
COORDINATE ALL WORK WITH THE OWNER'S REPRESENTATIVE IN REGARDS TO OPERATIONS AND
ACCESS TO THE PROJECT SITE.
10. THE CONTRACTOR SHALL COORDINATE DEMOLITION ACTIVITY, CONSTRUCTION, MATERIAL STORAGE.
AND EQUIPMENT MOVEMENT WITH NCDMF OPERATIONS SO AS TO AVOID INTERFERENCE WITH AND
IMPEDANCE OF FACILITY ACTIVITIES.
11. UNLESS OTHERWISE NOTED, THE CONTRACTOR SHALL, ON A DAILY BASIS, REMOVE FROM THE SITE
ANY DEBRIS RESULTING FROM DEMOUTION/CONSTRUCTION. DISPOSAL OF MATERIALS IS THE
RESPONSIBILITY OF THE CONTRACTOR. ALL MATERIALS TO BE REMOVED SHALL BECOME THE
PROPERTY OF THE CONTRACTOR, UNLESS OTHERWISE NOTED, AND SHALL BE DISPOSED OF AS
SPECIFIED. ALL DEBRIS SHALL BE PROPERLY DISPOSED OF IN A PERMITTED LANDFILL.
12. EXISTING CONSTRUCTION, INCLUDING UTILITIES AND OTHER MISCELLANEOUS ITEMS WHICH ARE TO
REMAIN, SHALL REMAIN UNDISTURBED AND SE PROTECTED, UNLESS OTHERWISE NOTED.
13. THE CONTRACTOR IS RESPONSIBLE FOR REPAIRING, AT HIS OWN EXPENSE, ANY AND ALL DAMAGES
