This permit, issued on October 12, 2021 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
tf these terms may be subject to Imes, imprisonment or civil action; or may cause me permit to oe nuu anu vote.
Shellfish Hatchery Structure Rebuild
1) This permit authorizes only the replacement of the existing non -conforming structure within the
previously existing footprint. No portion of the replaced non -conforming structure shall be located
outside of the previously existing structure footprint. -
2) The non -conforming structure shall not be enlarged beyond existing dimensions.
3) The non -conforming structure shall not change in use, and continue to be utilized as a Shellfish
Hatchery/Fish House.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date. .
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) A turbidity curtain shall be installed around the entire project site and construction site located in
Estuarine Waters and the Public Trust Area during all phases of demolition and construction. The
turbidity curtain shall remain effective and in place for the duration of all work over Estuarine Waters
and the Public Trust Area.
5) The Division of Coastal Management shall be notified immediately in the event of any spillage of any
hazardous, toxic, or harmful materials or substances (e.g. paint, stain, fuel, polyurethane) into the
Estuarine Waters or the Public Trust Area.
NOTE: This docking facility was permitted under the rule of 15A NCAC 07J .0211 for Non -Conforming
Development.
Sedimentation and Erosion Control
6) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
7) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
9) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in appropriate waste receptacles in an
upland location.
10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 3
(Action IDSAW-2021-01725).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2021-1221.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of $400 was received by DCM for this project.

This permit is for rebuilding of a shellfish hatchery building on the same footprint. Previous building was damaged by fire.

We propose to construct a prefab steel arch -style building from www.steelmaster.com. The building will be delivered on flatbed
truck and will be assembled on the existing foundation using the same footprint as the previous structure.

Assembly of the prefab steel building is the only development activity.

and aquaculture operations for over 100 years. We propose to construct a prefab steel arch -style building on the existing foundation.

Consistency Determination: The request is consistent with/not in conflict with the Carteret County Land
Use Plan certified by the CRC on December 20, 2010.
Overview: The property is located project is located at 561 Nelson Neck Rd. in Sea Level, Carteret Co. Core
Sound boarders the property to the East. This developed commercial property, the Mill Point Aquaculture
clam hatchery of Morris Family Shellfish Farms in Sea Level, has a 187' shoreline.
The existing hatchery structure and facility was destroyed by fire on May 9, 2021. The high ground portion
of the property is mostly covered by the existing shellfish nursery and the remaining foundation of the
burned structure. The existing foundation extends 10' into the water body. The applicant states that the
existing wood -framed metal roof building has been part of this commercial fishing waterfront for over 100
years and is currently the only commercial shellfish hatchery in the State.
Areas of Environmental Concern (AECs) in the project area are Estuarine Waters, Estuarine Shorelines,
and Public Trust Areas. The project is located adjacent to Core Sound and is 3 miles wide at this point.
The waterbody is classified as SA-ORW, is not a Primary Nursery Area and is open closed to shellfish
harvest. There are no wetlands underthe project area, and no SAV or shellfish beds were observed.
The Morris family is proposing to re -develop the destroyed structure with a 30'X40' metal building in the
same existing footprint. The proposed metal building would be placed on the existing foundation that
survived the fire. Each 15' riparian setback would be maintained with the placement of the new building.
Pre-engineered drawing of the proposed building is included in the application package. Use of the facility
and daily operations of the shellfish hatchery would not change from current use. No additional dockage
or slips are proposed.

Anticipated impacts
The current proposal would have no new impacts since the structure will be re -developed in the existing
footprint. A lesser chance of flood damage should occur from increased engineering.
Basis for Determination:
The project site is located in Carteret County and is subject to the 2005 Carteret County Land Use Plan
Update. The Future Land Use Map (FLUM) designates the site as Rural and Conservation. due to the sites
location in AECs, and non -coastal wetlands.
In the Conservation land use category, the county states:
"Uses allowed by Carteret County in AECs are those that are consistent with the State's minimum use
standards, except when the policies contained in this plan are more restrictive than State standards" (pg.
94). Regarding non -coastal wetlands, the county "accepts applicable state and federal regulations
regarding development activity in non -coastal wetland areas, with the exception of Land Use
Compatibility Policy 2.1.5 which exceeds state and federal standards" (pg. 94).
The "Rural" land use category is defined as:
"Areas included within the rural classification include lands that are appropriate for or presently used for
agriculture, forestry, mineral extraction, and other uses that should be located in a relatively isolated and
undeveloped area. The predominant land uses are agricultural and residential. However, public facilities,
health care facilities, and scattered industrial and commercial uses are allowed. Areas classified as rural
are usually served by individual wells and septic systems. No central water service is anticipated during
the planning period".
The following LUP policies are applicable to this request:
Policy 2.2
2. Carteret County will allow all uses (such as residential, commercial, industrial, and institutional) in
estuarine shoreline and OR W estuarine shoreline areas, provided all local, state, and federal standards
are satisfied.
Policy 2.4
Carteret County's policies for development in estuarine and public trust waters are as follow:
1. Carteret County will only allow development activities in estuarine and public trust waters that are
associated with water -dependent uses, consistent with state and federal standards, and meet all local
policies contained in this plan.

The waters of Core Sound are classified as SA;ORW by the Division of Water Resources (DWR).
In accordance with the attached General Certification #4175 (GC 4175), the impacts described
in your application do not require written authorization to utilize GC 4175. However, you are

9. Narrative Description
The Morris project is located of 561 Nelson Neck Rd. in Sea Level, Carteret Co. Core
Sound boarders the property to the East. This developed commercial property, the Mill
Point Aquaculture clam hatchery of Morris Family Shellfish Farms in Sea Level, has a
187' shoreline and the waterbody is 3miles wide at this point. There are no wetlands
under the project area. The high ground portion of the property is mostly covered by the
existing shellfish nursery and the remaining foundation of the burned structure. The
existing foundation extends 10' into the water body. The applicant states that the existing
wood -framed metal roof building has been part of this commercial fishing waterfront for
over 100yr and is currently the only commercial shellfish hatchery in the State.,
This section of Core Sound is not designated as Primary Nursery Area, is open to the taking
of shellfish and carries a water classification of SA-ORW. The substrate in this area is mostly
sand and silt. No SAV's or shellfish beds were observed within project area at the time of
site visit.
10. Proiect Description:
The existing hatchery structure and facility was destroyed by fire on May 9, 2021. The
Morris family is proposing to re-developthe destroyed structure with a 30'X40' metal
building in the same existing footprint. The proposed metal building would be placed on
the existing foundation that survived the fire. Each 15' riparian setback would be
maintained with the placement of the new building. Pre-engineered drawing of the
proposed building is included in the application package. Use of the facility and daily
operations of the shellfish hatchery would not change from current use. No additional
dockage or slips are proposed.
11. Anticipated Impacts:
The current proposal would have no new impacts since the structure will be re -developed in
the existin footprint. A lesser chance of flood damage should occur from increased
engineering.
