drawings (4), Drawing 1,2 of 2 and Spoil Site dtd 3/10/21 and Overview of Dredge Footprint dtd 4/23/21.
This permit, issued on August 19, 2021 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
n tnese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted
between April 1 and July 31 of any year without the prior approval of the Division of Coastal
Management, in consultation with appropriate resource agencies.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -3.5 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.

This permit action may be appealed by the permiffee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
5) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding
waters outside of the alignment of the fill area indicated on the workplan drawings.
6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters
and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of
petroleum products or any other hazardous waste, the permittee shall immediately report it to the National
Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
Dredge Material Disposal
7) No dredge material shall be placed within 30 feet of the normal high-water line.
8) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the
site is graded and stabilized.
9) The dredge material disposal area shall be inspected and approved by a representative of the Division of
Coastal Management prior to the commencement of any dredging activities.
Maintenance Clause
10) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for dredge material disposal, and the estimated amount of material to be removed.
The location, design and holding capacity of the dredge material disposal site shall be approved
by a representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
USACE Conditions
11) A "Consent to Cross" authorization from the Corps of Engineers must be obtained for the easement of
the Corps navigation channel prior to material disposal. Provide a written request and a map showing
disposal site and the crossing location to Justin Amette at Justin.R.AmetteAusace.armv.mil.
12) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
14) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2021-00967).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2021-0805.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Pursuant to the CAMA-Corps Programmatic Permit process as per the PGP-291 Permit, the North Carolina Division of
Coastal Management (NC DCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation
Report and BioReport for the subject project. The attached notice requests federal agency comments on this project by
August 13, 2021.
The site is located in Waters adjacent to the AIWW and Shallotte Inlet at 4425 Brantley Circle SW, in Shallotte, Brunswick
County, NC.
The applicant proposes to excavate an access channel and boat basin around/beneath an existing docking facility
adjacent to the AIWW and Shallotte Inlet. The rectangular dredge cut (approximately 175ft. x 50ft. x 3ft. MLWL) would
begin just inshore of the existing boat lifts and extend southeast, perpendicular to the run of the channel, terminating
approximately 70ft. inside of the Army Corps Federal Channel Setback along the AIWW. It should be noted that the
Federal Channel Setback widens from 80ft. to 200ft. in the vicinity of the project area. The proposed dredge cut would
tie into the -6ft. MLWL contour which is located inside the Corps Federal Channel Setback. The proposed dredging would
disturb approximately 8,750 sq. ft. of shallow bottom area.
The applicant is proposing to dredge to a final depth of -3.5ft. @ MLWL, resulting in the removal of approximately 972
cu. yds. of shallow bottom habitat. Dredging would be performed using the "bucket to barge" method, and once loaded
onto the barge, the vessel would transport and offload the material at 43 Causeway Drive, located just over the bridge
on Ocean Isle Beach, NC. The disposal site is located approximately 3.25 miles from the project area (as the crow flies).
The disposal area is the site of two active projects (GP-77599 and State Permit# 33-19). According to the applicant, the
spoil material will be offloaded from the barge and contained with silt fencing a minimum of 30ft. from Coastal
Wetlands.

detailed information concerning the proposed project.

Dear Mr. McMullen:
You have our approval for the impacts listed below forthe purpose described in your application dated
March 10, 2021, received by the Division of Water Resources (Division) May 5, 2021. The application
proposes to excavate a boat basin beneath an existing docking facility. The proposed project is located
within the Atlantic Intracoastal Waterway which are class SA;HQW waters by the DWR. These impacts
are covered by the attached Water Quality General Certification Number 4175 and the conditions listed
below. This certification is associated with the use of General Permit No. 198000291 once it is issued to
you by the U.S. Army Corps of Engineers. Please note that you should get any other federal, state or
local permits before proceeding with your project, including those required by (but not limited to)
Sediment and Erosion Control, Non -Discharge, and Water Supply Watershed regulations.
The Division has determined that the proposed project will comply with water quality requirements
provided that you adhere to the conditions listed in the enclosed certification and to the additional
conditions itemized below.

appropriate fee. If the property is sold, the new owner must be given a copy of this Certification and is
responsible for complying with all conditions. [15A NCAC 02H .0507(d)(2)].
If you are unable to comply with any of the conditions of the attached Water Quality General
Certification or with the additional conditions itemized below, you must notify the Wilmington Regional
Office within 24 hours (or the next business day if a weekend or holiday) from the time the permittee
becomes aware of the circumstances.
The permittee shall report to the Regional Office any noncompliance with, and/or any violation of,
stream or wetland standards [15A NCAC 02B .0200] including but not limited to sediment impacts to
streams or wetlands. Information shall be provided orally within 24 hours (or the next business day if a
weekend or holiday) from the time the permittee became aware of the non-compliance circumstances.
Additional Conditions [15A NCAC 02H .0507(c)]:
1. Moratoriums
The Permittee shall comply with any moratoriums per the INC Division of Marine Fisheries and
the INC Wildlife Resources Commission. Dredging moratoriums shall be observed as required
by the NC Division of Marine Fisheries, NC Wildlife Resources, US Fish and Wildlife and National
Marine Fisheries. If such activities should take place during periods of high biological activity
(e.g. shorebird, or sea turtle nesting), biological monitoring may be required at the request of
other state and federal agencies and coordinated with these dredging activities.
Citation: 15A NCAC 02H .O506(b);15A NCAC 02H.O507(c)
Justification: A project that affects waters shall not be permitted unless the existing uses
(including aquatic life propagation and biological integrity), and the water quality to protect
such uses, are protected. Protections are necessary to ensure any remaining surface waters or
wetlands, and any surface waters or wetlands downstream, continue to support existing uses
during and after project completion. The Division must evaluate if the activity has avoided and
minimized impacts to waters, would cause or contribute to a violation of standards, or would
result in secondary or cumulative impacts.
2. Turbidity Standard
The Permittee shall adhere specially to 15A NCAC 02B .0222 Tidal Salt Water Quality Standards
for Class SB Waters.(12) pH: shall be normal for waters in the area, which generally shall range
between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of
natural conditions; (19) Turbidity: the turbidity in the receiving water shall not exceed 25 NTU;
if turbidity exceeds this level due to natural background conditions, the existing turbidity level
shall not be increased. [15A NCAC 02B .0222]

Justification: Surface water quality standards require that conditions of waters be suitable for all
best uses provided for in state rule (including, at minimum: aquatic life propagation, survival,
and maintenance of biological integrity (including fishing, fish, and Primary Nursery Areas
(PNAs)], wildlife, and secondary contact recreation]; and that activities must not cause water
pollution that precludes any best use on a short-term or long-term basis.
This approval and its conditions are final and binding unless contested. [G.S. 143-215.5
This Certification can be contested as provided in Chapter 150E of the North Carolina General Statutes by
filing a Petition for a Contested Case Hearing (Petition) with the North Carolina Office of Administrative
Hearings (OAH) within sixty (60) calendar days. Requirements forfiling a Petition are set forth in Chapter
150B of the North Carolina General Statutes and Title 26 of the North Carolina Administrative Code.

CONSISTENCY DETERMINATION:
This project is consistent with the Shallotte CAMA Land Use Plan Update.
The applicant proposes to excavate an access channel and boat basin around/beneath an
existing docking facility adjacent to the Shallotte River. The project is located at 4425
Brantley Circle SW in Shallotte, Brunswick County.
Areas of Environmental Concern (AEC's) impacted by the proposal are PTA and EW.
Waters at the project site are classified as SA; HQW and are not open to the harvest of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Shallotte CAMA Land Use Plan
Update and offer the following comments.
The general area of the project is classified as Residential.
In general, Shallotte allows development in Residential classified areas and AECs, which
is consistent with the State's minimum use standards. The Shallotte Land Use Plan
contains some policies and discussion, which exceed the State's minimum use standards.
However, none of these policies are applicable to this project.
This project appears to be consistent with the Shallotte CAMA Land Use Plan
Update.

Dear Mr. Howell:
Reference the application by Barrett McMullan to excavate an access channel and boat
basin around/beneath an existing docking facility adjacent to the AIWW and Shallotte Inlet. The
rectangular dredge cut (approximately 17511. x 50ft. x 311. MLWL) will begin just inshore of the
existing boat lifts and extend southeast, perpendicular to the run of the channel, terminating
approximately 70 feet inside of the Army Corps Federal Channel Setback along the AIW W. The
proposed dredging will disturb approximately 8,750 sq. ft. of shallow bottom area, resulting in
the removal of approximately 972 cu. yds. of shallow bottom habitat.
Dredging will be performed using the "bucket to barge" method, and once loaded onto the
barge, the vessel will transport and offload the material at 43 Causeway Drive, located just over
the bridge on Ocean Isle Beach, NC. The disposal area is the site of two active projects (GP-
77599 and State Permit# 33-19). The spoil material will be offloaded from the barge and
contained within silt fencing a minimum of 30 feet from Coastal Wetlands.
The permit authorization will be for a one-time dredging event.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:

Special Conditions
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans dated March 10 and April 23, 2021, which are a part of this permit. Any
modification to these plans must be approved by the US Army Corps of Engineers
(USACE) prior to implementation.
2. A "Consent to Cross" authorization from the Corps of Engineers must be obtained for
the easement of the Corps navigation channel prior to material disposal. Provide a written
request and a map showing the disposal site and the crossing location to Justin Amette at
Justin.R.Amette@usace.army.mil.
3. No dredging may occur during the moratorium period from April I" to July 31'.
4. Except as authorized by this permit or any USACE approved modification to this permit,
no dredge, fill, or mechanized land -clearing activities shall take place at any time in the
construction or maintenance of this project within waters outside the designated
permitted boundary. This permit does not authorize temporary placement or double
handling of excavated or fill material within waters outside the permitted area.
5. Work in wetlands are prohibited during the dredging, material disposal, or any other
aspects of work associated with this project. All dredged material must be deposited on
high ground.
6. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other
toxic materials. In the event of a spill of petroleum products or any other hazardous
waste, the permittee shall immediately report it to the N.C. Division of Water Resources
at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act will be followed.
7. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall
provide each of its contractors and/or agents associated with the construction or
maintenance of this project with a copy of this permit. A copy of this permit, including all
conditions, shall be available at the project site during construction and maintenance of
this project.
8. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt
fencing or similar appropriate devices around all areas subject to soil disturbance or the
movement of earthen fill, and the immediate stabilization of all disturbed areas.
Additionally, the project must remain in full compliance with all aspects of the
Sedimentation Pollution Control Act of 1973. RECEIVED

9. The activity must be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout
waters by the North Carolina Division of Environmental Management (NCDEM), 25
NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less
in trout waters, are not considered significant.
10. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
permittee must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at
http•//www.fws.gov/ne-es/mammal/manatee euidelines.odf.
11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington
District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of
the violation.

The proposed project is located adjacent to the Shallotte Inlet at 4425 Brantley Circle SW in Shallotte,
Brunswick County.
To locate the project site from the Wilmington Regional Office (WiRO), travel southwest from Wilmington to
Sunset Beach on US 74 W (Martin Luther King Jr Pkwy) & US 17 S for approximately 20 miles until you reach
US-17 S Business on your left. Travel about 2 miles down US-17 S Business and turn left onto Village Rd SW.
Travel to 1.5 miles until you reach the traffic circle and take the 2"d exit continuing onto NC-179 S for 2 miles.
Then take a left onto Brick Landing Rd and continue for 1.3 miles and take another left onto Devane Rd SW.
Continue until Devane Rd SW turns into Brantley Circle SW. The project site is on the right hand side.
Existing structures on the .37-acre project site include a single-family residence, a pool, and a docking facility.
The high ground is vegetated primarily with domestic grasses and ornamental landscaping. High ground
elevations are approximately I Oft. above the normal high water (NHW) level, and the applicant's entire
shoreline (+/- 120 linear ft.) is stabilized by both a bulkhead (GP-35099) and rip -rap (GP-38977) placed
waterward of the bulkhead. The rip rap revetment extends a maximum of 1 Oft. below NHW. There are no
Coastal Wetlands within the applicant's riparian corridor. Presently, the owner maintains a private docking
facility which extends southeast off the bulkhead. A 6ft. x 120ft. access pier leads to a 1Oft. x 22ft. gazebo and
8ft. x 20ft. open platform. Boatlifts are located to the east and west of the gazebo, for a total of two formalized
slips at the applicant's property. Water depths (in the vicinity of the existing water dependent structures) range
from approximately Oft. to-3.Oft., relative to normal low water (NLW). Residential properties border the project
site to the north, east, and west, and the Shallotte Inlet is located to the south. Based on existing documentation,
there is a history of dredging along the AIW W, within the Corp of Engineer's channel setback and within and
Shallotte Inlet (as recently as 3-28-2021); however, there is no record of any privately funded dredging events at
the subject property. Since the applicant's property is located at the mouth of the Shallotte Inlet, exact
waterbody widths will vary, but extending adjacent shorelines across the inlet establishes an approximate
waterbody width of 588ft.
The waters of the AIW W (adjacent to the project site) are classified SA by the Division of Water Quality and
ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are
OPEN to the harvest of shellfish. Based on visual observations made by DCM staff during the April 2021 site
visit, there appears to be NO Submerged Aquatic Vegetation (SAV) or live oysters in the surrounding waters.
Tidal amplitude in the project area is approximately 5.5ft. between NLW and NHW (See Sheet 2 of 2).
PROPOSED PROJECT
The applicant proposes to excavate an access channel and boat basin around/beneath an existing docking
facility adjacent to the Shallotte Inlet.
Based on the site plan, the applicant would dredge an access channel and boat basin in the center of the riparian
corridor extending southeast towards Shallotte Inlet. The rectangular dredge cut (approximately 175ft. x 50ft. x
&5A(y,,tYNLW) would begin just inshore of the existing boat lifts and extend southeast, perpendicular to the run of
the channel, terminating approximately 70ft. inside of the Army Corps Federal Channel Setback along the
KP•Z AIW W. It should be noted that the Federal Channel Setback widens from 80ft. to 200fL in the vicinity of the
project area.
The proposed dredge cut would tie into the -6ft. NLW contour which is located inside the Corps Federal

Channel Setback. Based on information presented in the application package and DCM site visits, existing
water depths (beneath and around the existing docking facility) range from OR. to -311. @ NLW, and the
applicant is proposing to dredge to a final depth of -3.5ft. @ NLW, resulting in the removal of approximately
972 cu. yds. of shallow bottom habitat.
Dredging would be performed using a "bucket to barge" method, and once loaded onto the barge, the vessel
would transport and offload the material at 43 Causeway Drive, located just over the bridge on Ocean Isle
Beach, NC. The disposal site is located approximately 3.25 miles from the project area (as the crow flies). The
disposal area is the site of two active projects (GP-77599 and State Permit # 33-19). According to the applicant,
the spoil material will be offloaded from the barge and contained with silt fencing a minimum of 30ft. from
Coastal Wetlands. Dewatered spoils will be used as backfill material for the vinyl bulkhead permitted under
GP-77599. The applicant has received permission to use the disposal site and it has been approved by DCM
staff.
10. ANTICIPATED EUPACTS
The proposed dredging would disturb approximately 8,750 sq. ft. of shallow bottom area Minor increases in
turbidity should be expected during the dredging event; however, no long term adverse impacts are anticipated.
Spoil disposal would be contained by a 5011. x 50ft. (2,500 sq. ft.) silt fence at least 30ft. from NHW and
eventually used as backfill for a previously permitted bulkhead (GP-77599) at 43 Causeway Drive, in Ocean
Isle Beach, NC. The proposed project would not exceed a final depth of -3.5ft. @ NLW and would extend into
the Army Corps Federal Channel Setback, as approved by USACOE. As proposed, it appears that the dredging
and disposal activities would not impact Coastal Wetlands, SAVs or PNAs.

a. A Project Narrative
The scope of this excavation project includes removing 972 cubic yards of sand and spoil from the
vicinity of the dock located at 4425 Brantley Circle SW, Shallotte, NC 28470 out to the navigable waters
of the Imercoastal Waterway (map/drawing provided). Excavation will be pinpoint through use of an
excavating machine placed on top of a steel barge. Excavated material will be placed on the barge in a
contained area. Once excavation is complete, the material will be hauled via barge to 43 Causeway
drive, Ocean Isle Beach, NC where it will be transferred to clearly marked (see map) silt fence
containment area more than 30' landward of the mean high waterline. The spoil will be dried in this
location and then used as backfill for a bulkhead on the same parcel.
The purpose of the excavation is to allow the property ownerto regain water access for use of boating
where shoaling has occurred in recent years. The existing mean low water depth in this area is -0.5' with
a goal to make the mean low water depth -3.5'.

I will start with the question, yes they can dredge through the setback to the channel, as long as they do not cause any shoaling in the
channel. sometimes dredges can push material around and can push material ahead of them and if that happens to be the federal
channel in front of the dredge it can cause us problems. Typically we just put in a condition that says they can't cause any shoaling in
the channel due to the dredging activities.
Just for your FYI, we have not dredged this channel in almost 3 years (April 2018). Not sure if they are saying this is from that project
or some other project. either way we will be back there dredging the channel most likely next week. So it could be worse or better.
and then in the fall/winter of 2021 we will be doing a "renourishment" project by taking material from the inlet and putting it on the
beach to help with storm damage.

The scope of this excavation project includes removing up to 972
cubic yards of sand and spoil from the vicinity of the dock located at
4425 Brantley Circle SW, Shallotte, NO 28470 out to the navigable
waters of the Intercoastal Waterway. Excavation will be pinpoint
through use of an excavating machine placed on top of a steel barge.
Excavated material will be placed on the barge in a contained area.
Once excavation is complete, the material will be hauled via barge to
43 Causeway drive, Ocean Isle Beach, NC where it will be transferred
to a clearly marked silt fence containment area more than 30'
landward of the mean high water line. The spoil will be dried in this
location and then used as backfiil for a bulkhead on the same parcel.
The purpose of the excavation is to allow the property owner to
regain water access for use of boating where shoaling has occurred
in recent years. The existing mean low water depth in this area is -
0.5' with a goal to make the mean low water depth -3.5'.
The project proponent hereby certifies that all information contained
herein is true, accurate, and complete to the best of rry knowledge

The Division of Coastal Management hereby acknowledges receipt of your application for the excavation of a boat
basin and access channel at 4425 Brantley Circle SW in Shallotte, Brunswick County, NC. It was received complete
on April 231d, 2021 and appears to be adequate for processing at this time. The projected deadline for making a
decision is July Tit, 2021. An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a teal action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from April 23n% 2021 you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such
a meeting will be held within five working days from the receipt of your written request and shall include the

119(b) that the following applications were submitted for a development permits in Areas of Environmental
Concern as designated under the CAMA: On April 28, 2021, Barrett McMullan proposed to excavate an access
channel & boat basin beneath an existing docking facility at 4425 Brantley Cir. SW, adjacent to the Shallotte
Inlet, in Shallone, Brunswick County; and on May 3, 2021, Gary & Patricia Vonatski proposed to install a
finger pier & boatlift to increase slip size from two (2) to three (3) at 940 Copas Rd SW, adjacent to the Shallotte
River in Shallotte, Brunswick County. Copies of these applications can be examined or copied at the office of
Brendan Brock N.C. Dept. of Environmental Quality, Division of Coastal Management, 127 Cardinal Drive Ext.,
Wilmington, NC 28405, (910) 796-7270 during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, NC 28557-3421, prior to May 28, 2021 will be considered in making the permit
