Permit Class Permit Number NEW J119-21 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Vermt"t for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Paul Mills, 68 Pelican Dr., Wrightsville Beach, NC 28480 Authorizing development in New Hanover County at adj. to Lee's Cut, at 66 Pelican Dr.. in Wrightsville Beach , as requested in the permittee's application dtd 3/31/21 (MP-1,4) and 3/25/21 (MP- 2), incl att workplan drawings (6), Sheets 1-5 of 5 all dtd "Rev 5/10/21" and Disposal Site Email did 8/23/21. This permit, issued on September 3, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation rt mese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization - Bulkhead 1) The bulkhead shall extend a maximum of two (2) foot waterward from the waterward edge of the existing bulkhead at any point along its alignment at the time of construction. 2) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Petmittee Paul Mills Permit No.119-21 Page 2 of 5 ADDITIONAL CONDITIONS 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The fill material shall be clean and free of any pollutants except in trace quantities. 8) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 9) No backfill material is to be placed within 30 feet of the normal high-water level, except that which will be used to backfill the area behind the permitted bulkhead. 10) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. Docking Facility 11) This permit authorizes the demolition of the existing docking facility and only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 12) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the established Wrightsville Beach pier -head line. 13) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 14) This permit authorizes a maximum of three (3) formalized boat slips. 15) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 16) The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 17) The roof of the covered gazebo shall not be designed for second story use. Paul Mills Permit No.119-21 Page 3 of 5 ADDITIONAL CONDITIONS 18) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 19) The authorized structure and associated activity shall not exceed the dimensions shown on the attached permit drawings. Excavation 20) No excavation shall take place outside of the area indicated on the workplan drawings. 21) Excavation shall not exceed -5 feet below the mean low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 22) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 23) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). 24) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will.be followed. Dredge Material Disaosal 25) No dredge material shall be placed within 30 feet of the normal high-water line. 26) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the site is graded and stabilized. 27) The dredge material disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. The dredge material disposal area permission letter as referenced in Condition No. 29 of this permit shall be provided to the Division of Coastal Management prior to the commencement of any dredging activities. Paul Mills ADDITIONAL CONDITIONS Maintenance Clause Permit No.119-21 Page 4 of 5 28) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the. original permit. B. A statement that no dimensional changes are. proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for dredge material disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the dredge material disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. USACE Conditions 29) A permission letter must be obtained from the owner of the spoils disposal area prior to dredge material placement. Provide the permission letter to Justin Amette at Justin.R.Amette@usace.army.mil. 30) A "Consent to Cross" authorization from the Corps of Engineers must be obtained for the easement of the Corps navigation channel prior to material disposal. Provide a written request (including name, mailing address, phone number and email) and a map showing disposal site and the crossing location to Justin Arnette at Justin.R.Amette@usace.anny.mil. 31) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.pdf. Sedimentation and Erosion Control 32) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 33) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 34) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 35) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 36) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. y Paul Mills Permit No. 119-21 Page 5 of 5 ADDITIONAL CONDITIONS 37) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2021-01210). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0830. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the mean high-water level. NOTE: An application processing fee of $400 was received by DCM for this project. The proposed bulkhead will extend no further below NHW than necessary to construct a new bulkhead. The alignment should not result in significant adverse impacts to public trust rights or to the property of adjacent riparian property owners because the bulkhead will not extend greater than 2 ft. waterward of the existing failing wall and because both adjacent properties are already bulkheaded. Based on these factors, it is recommended that a permit be issued to authorize the construction of the bulkhead as proposed in the applicant's submittal. It appears that the proposed excavation is CONSISTENT with the Rules of 15 A NCAC 071-1.0208 (b) (1) which states, "Navigation channels, canals, and boat basins shall be aligned or located so as to avoid primary nursery areas, shellfish beds, beds of submerged aquatic vegetation as defined by the MFC, or areas of coastal wetlands except as otherwise allowed within this subchapter.". It also states "Any canal or boat basin shall be excavated no deeper than the depth of connecting waters...'. However, it does appear that the applicant already has water depths ranging from -2' to -5' MLW within the proposed excavation area. Additionally, while the proposed private docking facility is CONSISTENT with most of the use standards set forth in NCAC 07H .0208(b)(6), including the pierhead line and the pier width rule, it is INCONSISTENT with the eight -square foot rule when using the current shoreline allotment, but would be consistent when using the proposed shoreline to cAID platform space allowable. The applicant proposes to step out the bulkhead a maximum of T waterward for replacement to accommodate the bowed sections of the existing alignment. As proposed the 62' bulkhead replacement would fill approximately 120 11:2 of Coastal Wetlands and give the applicant approximately 4 additional feet of shoreline for a total of 66'. The existing docking facility would be removed, and a new access pier would be constructed from the bulkhead measuring approximately 6' by 32'-4". Approximately 18' waterward of the new bulkhead on the western side of the access pier a 18' by 12'-8" gazebo is proposed waterward of the coastal wetlands. Waterward of the access pier a ramp would lead to a 6' by 40" floating dock positioned perpendicular to the shoreline. An additional 10' by 30' floating dock would be attached at the waterward end in an L-position to the west, extending the docking facility approximately 89'-6" into Lee's Cut. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. A permission letter must be obtained from the owner of the spoils disposal area prior to dredged material placement. Provide the permission letter to Justin.R.Arnette@usace.army.mil. A "Consent to Cross" authorization from the Corps of Engineers must be obtained for the easement of the Corps navigation channel prior to dredged material disposal. Except as authorized by this permit or any USACE approved modification to this permit, no dredge, fill, or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project within waters outside the designated permitted boundary. Work in wetlands are prohibited during the dredging, material disposal, or any other aspects of work associated with this project. All dredged material must be deposited on high ground. 6. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 8. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973. 9. The activity must be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or Tess in trout waters, are not considered significant. 10. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the permittee must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. PROJECT SUMMARY: The applicant proposes to replace the existing bulkhead, remove the existing docking facility to construct an expanded 4-slip docking facility, and excavate under the proposed slips. 66 Pelican Drive, Paul Mills Page Two 9. PROJECT DESCRIPTION The project site is located at 66 Pelican Drive, on Lee's Cut, in the Town of Wrightsville Beach, in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel east approximately 3.0 miles on Eastwood Rd towards Wrightsville Beach. Cross the drawbridge and take a slight left turn on to W. Salisbury Street. Travel approximately 0.3 miles on W. Salisbury and then take a left toward Pelican Drive, then take a right onto Pelican Drive and the project site is located approximately 292' down on the left. Currently, the property is a vacant lot with a bulkhead and 2 (two) slip private docking facility. The project site is bordered to the east and west by existing single family homes. Lee's Cut borders the property to the north and Pelican Drive is located on the southern property boundary. Elevation at the site averages approximately 4.5' above normal high water (NHW). The high ground portion of the property is currently a construction site with open sand and erosion control silt fencing. The bulkhead currently stabilizing the approximately 62' of shoreline is warped and bowed in a few sections and appears to be approaching the end of its serviceable life. The western side of the bulkhead is tied straight into the neighboring bulkhead and the east side of the bulkhead is currently approximately 2' waterward of the adjacent neighboring bulkhead. Positioned waterward of the exiting bulkhead are Coastal Wetlands approximately 18' wide that descend into open water. The existing docking facility consists of a 6' by 35' access pier extending waterward into Lee's Cut, The 35' pier section terminates in a 16' by 16' fixed platform. A ramp extends waterward on to a 6' by 24' floating dock positioned perpendicular to the shoreline. According to the applicant water depths in the vicinity of the floating dock are between -5 and -7 mean low water (MLW). The first pier on the property appears to predate 1993 based on Google Earth imagery. The 1993 configuration changed slightly with General Permit 16203-D issued on 2f711996. The current configuration appears to have been authorized by General Permit 20283-D issued on 10/26/1999 for reconstruction due to storm damage and reconfiguration within the footprint. No permit history was found for the bulkhead. The Town of Wrightsville Beach Land Use Plan classifies the area in the vicinity of the project area as Low Density Residential. The waters in the project area are classified as SB by the N.C. Division of Water Resources. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and theyFINCIff$V ft the harvest of shellfish. JUN 0 6 2021 PROPOSED PROJECT DCM-WIND CITY The applicant proposes to replace the existing bulkhead, remove the existing docking facility to construct an expanded 4A 4j .4=slip docking facility, and excavate under the proposed slips. The failing bulkhead is bowed waterward in a few places and appears to be close to failure. The applicant proposes to step out a maximum of 2' waterward for replacement to accommodate the bowed sections of the existing alignment. As proposed the 62' bulkhead replacement would fill approximately 120 ft2 of Coastal Wetlands and give the applicant approximately 4 additional feet of shoreline for a total of 66'. The existing docking facility would be removed, and a new access pier would be constructed from the bulkhead measuring approximately 6' by 32'4". Approximately 18' waterward of the new bulkhead on the western side of the access pier a 18' by 12'- 8" gazebo is proposed waterward of the coastal wetlands. Waterward of the access pier a ramp would lead to a 6' by 40" floating dock positioned perpendicular to the shoreline. An additional 10' by 30' floating dock would be attached at the waterward end in an L-position to the west, extending the docking facility approximately 89'-6" into Lee's Cut. The width of the waterbody at the project site is approximately 384' wide. The 10' by 30' floating dock is proposed to be at the Wrightsville Beach Pier Headline. 66 Pelican Drive, Paul Mills Page Three An 8' by 16' boat lift is proposed for the eastern landward side of the floating dock within the 15' riparian setback. The applicant owns the eastern adjacent lot and therefore waived the 15' setback for the boatlift and the next adjacent property owner to the east was notified. NOTE: The square footage of the proposed docking facility would be inconsistent with the 8 square foot rule based on the current 62 ft. shoreline allotment, however if the replacement bulkhead is permitted 2 ft. waterward of the existing wall, there would be 66' of shoreline. The proposed docking facility would be consistent with the 8 square foot rule based upon the proposed shoreline allotment. New excavation is proposed within an area measuring approximately 30' by 60' (1,800 ft2) to a depth of - 5 MLW. The current depth in the area of the proposed slips ranges from -3 to -9 MLW (See Sheet D1 and D3). 10. ANTICIPATED IMPACTS As proposed, the new bulkhead alignment would f II approximately 120 ftz of Coastal Wetland and extend a maximum of 2' below NHW to accommodate the distortions in the existing failing bulkhead. As proposed, the new docking facility would incorporate approximately 1,088 ftz of Estuarine and Public Trust waters. A waiver was obtained for the proposed boat lift on the eastern side of the floating dock since it would encroach approximately 8' into the 15' riparian setback, no encroachment into the 15' riparian setback on the west side is proposed. The proposed docking facility would extend approximately 89'- 6" into Lee's Cut, meeting the %. width of the approximately 384' wide waterbody, but would not extend beyond the Wrightsville Beach Pier Headline. According to the applicant, approximately 1,800 ftz of new excavation would occur under the proposed slips to a depth of -5 MLW. The waters of the project area are not PNA or ORW and the proposed excavation of shallow bottom would connect to deeper water contours. Approximately 900 ftz of highground would be impacted by spoil disposal located on Money Island. If the permit is obtained the dredge contractor will supply a permission letter for disposal from the spoil island owner prior to work commencing. The project area consists of Coastal Wetlands, Estuarine Shoreline, Estuarine Waters and Public Trust Area. There appear to be no SAV present in the project area. Minor increases in turbidity should be expected during project construction. I can edit the MP-2 to match that dimension if that is the correct one. Also, the boat lift dimension on the MP-4 (16' x16') needs to match the drawing 8' x 14' . Keep in mind the boatlift CANNOT cross the riparian line and the drawing shows they have 15' from the float to the line. I can change the boatlift dimension on the MP-4 also if you like. I usually make any changes in red ink with my initials and date. Let me know how you want to handle these small discrepancies.
