This permit, issued on February 3, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. In-Water Work Moratorium 1) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no excavation or filling shall be permitted between February 15 and June 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. Shoreline Stabilization – Bulkhead and Rip Rap 2) The bulkhead shall not extend more than 5 feet from the normal water level at any point along its alignment at the time of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. Signature of Permittee Blessyng Conway Permit No. 7-22 Page 2 of4 ADDITIONAL CONDITIONS 3) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 4) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re-staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 6) The bulkhead shall be constructed prior to any backfilling activities. 7) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 8) This permit does not authorize any excavation waterward ofthe approved alignment. 9) The fill material shall be clean and free of any pollutants except in trace quantities. 10) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 11) No backfill material is to be placed within 30 feet of the normal water level, except that which will be used to backfill the area behind the permitted bulkhead. 12) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. 13) The toe of rip rap shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 14) The rip rap and offshore sill material shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete with no exposed rebar. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. Docking Facility 15) This permit authorizes only the docks, piers, swing lift, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. Blessyng Conway Permit No. 7-22 Page 3 of4 ADDITIONAL CONDITIONS 16) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharged at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 17) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 18) This permit authorizes a maximum of one (1) formalized boat slip. 19) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner’s area of riparian access. 20) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 21) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. Sedimentation and Erosion Control 22) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 23) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 24) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 25) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 26) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 27) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE:The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No.2021-1842. NOTE: Future development of the permittee’s property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901priorto the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of$250 was received by DCM for this project. Blessings Conway; 706 Southern., Avenue Major Permit Recommendations The applicant proposes to construct 50 linear foot bulkhead along the shoreline with 20 20 foot.returns,10-font-wide by 6-foot-Jong low riprap revetment, and a 20 foot by 6 foot pier with a 16 foot by 16 foot.platform and 16 foot by foot lower platform. The property.is located at 706 Southern Avenue, Elizabeth City, Pasquotank County adjacent to the Charles Creek. The development proposal involves the Public Trust Area (PTA), and Public Trust Shorelines (PTS) Areas of Environmental Concern. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows; 15A NCAC 07H .0208 USE STANDARDS (a) addresses General Use Standards; and subparagraph (1) requires that uses which are not water. dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants,. residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent.. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging; bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches. (a)(2)(A) requires that the location, design, and need for development, as well as the construction activities involved shalt be consistent with the management objective of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas. Consistent: The development is consistent with therntent of this rule. (a)(2)(B) requires that the development shall comply with state and federal water and air quality Consistent: This development will not violate water and air quality. (a)(2)(C) requires that the development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural resources. Consistent: There are no known archaeological or historic resources on the property. (a)(2)(D) requires that the development shall not increase siltation. Consistent: It does not appear that this development will measurably increase siltation. (a)(2) (E) requires that the development shall not create stagnant water bodies. Consistent: It does not appear that the development will create stagnant water bodies. (a)(2)(F) requires that the development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The development will have minimum adverse effects on life cycles or estuarine resources. (a)(2) (G) requires that the development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The development proposal minimal effects on navigation. North Carolina Department of Environmental Quality MEMORANDUM Division of Coastal Management Page 3 of a (b) Specific Use Standards (b)(6) Addresses Piers and Docking Facilities. (b)(6) (A) requires that Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur; Consistent: The proposed pier shall not exceed 6 feet in width (b)(6)(B) requires that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas. Consistent: The proposed docking facility shades a total of 352 square feet which is less than the 400 square feet allowed for the 50 foot shoreline. (b)(6)(1~) requires that piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use. Consistent: The proposed dock and platforms will not have second story use. (b)(6)(G) requires that pier and docking facility lengths shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: The proposed pier will be 20 feet in length. (ii) not extending into the channel portion of the water body; and Consistent: The proposed dock will not extend into the channel portion of the waterbody. (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer R INI L G a'y C.rd -rs 160 North Carolina Department of Environmental Quality Division of Coastal Management MEMORANDUM Page 4of5 than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Consistent: The proposed pier will be 42 foot in length with a Y4 width of the waterbody being 43 feet. (b)(6)(I) requires that piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. The line of division of areas of riparian access shall be established by drawing a line along the channel or deep water in front of the properties, then drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge. Consistent: The proposed dock will remain outside of the 15 foot setback. (b)(7) Addresses Bulkheads. (b)(7) (A) requires that bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level. Possible Inconsistency: The proposed bulkhead will average 2 feet below normal water level, but not exceed the alignment of the neighboring properties. (b)(7)(13) requires that bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources. Consistent: The propose bulkhead will not be in a coastal wetland area. (b)(7)(C) requires that bulkhead backfill material shall be obtained: from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non upland source, the material so obtained may be contained behind the bulkhead. Consistent: The applicant has indicated that the fill will contain sand from an upland location. (b)(7)(D) requires that bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: (1) the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule. Possible inconsistency: The property has a shoreline that is set back from adjacent properties on either side. _ x,y North Carolina Department of Environmental Quality Division of Coastal Management MEMORANDUM Page 5 of 5 (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features. Possible Inconsistency: The property is set back from adjacent properties on both sides. (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners Consistent: The proposed bulkhead meets the intent of this rule. (iv) the need for bulkhead below normal high water or normal water level is documented by the Division of Coastal Management, and Consistent: The proposed bulkhead has a documented need to be place below normal water level to maintain a straight alignment. (v) the property to be bulkheaded is in a non -oceanfront area. Consistent: The proposed bulkhead is in a non -oceanfront area. (b)(7)(B) requires that where possible, sloping rip rap, gabions, or vegetation shall be used rather than bulkheads. Consistent: The proposed development of a bulkhead is placed on a very low profile lot with a bulkhead to the north. Overview: The .23 acre subject property has approximately 50 linear feet of shoreline along Charles Creek which connects to the Pasquotank River. Approximately 532 sq. ft. of Section 404 wetlands are located along the northern edge of the shoreline, with the remainder of the site vegetated with yard grasses and trees. The property has an elevation of approximately 3 feet above Normal Water Level (NWL). Water depths adjacent to the property range from -.5 feet to -3 feet below NWL. The property is in the AE (5) Floodzone. Existing site improvements consist of a single-family house with a carport and an outbuilding. The shoreline is unimproved. The proposed project is located at 706 Southern Avenue, Elizabeth City, within Pasquotank County. The applicant is proposing to construct a 50 linear foot vinyl bulkhead an average of 2' waterward from the normal water line (NWL) with a maximum of 5' and two 20' returns. At the north end of the bulkhead, the applicant proposes to place a 10' by 6' wide low riprap revetment along the base of the wetland plants located waterward of the proposed bulkhead. The applicant is also proposing to construct a 20' by 6' pier with a 16' by 16' upper platform and a 6' by 16' lower platform. Steps will be added to the southern side of the pier and a swinging jet ski lift on the north side of the platform. This area is designated as anadromous fish spawning area (AFSA) under North Carolina Wildlife Resources Commission (WRC), and is in close proximity to AFSA under joint DMF-WRC jurisdiction. Areas that are designated as AFSA have been shown evidence of spawning of anadromous fish, either through direct observation of spawning activity or through indication of eggs/larvae. These areas provide spawning, refuge, and foraging habitat for various ecologically, recreationally, and commercially important species. Taking into consideration the benefits of these habitats on the species utilizing them, their protection is critical. Therefore, DMF would recommend that any permit issued include a 15 February through 30 June moratorium on all in - water work. Thank you for consideration of our comments and concerns. Project Setting The property proposed for development is located at 706 Southern Avenue in Pasquotank County and consists of approximately 9,900 square foot adjacent to the Charles Creek. The property currently contains a single family residence with a carport and one outbuilding. The properties to the north is a city park which contains a bulkhead along most of the shoreline and the property to the south is a residential lot with a natural shoreline. Vegetation on the site includes, but is not limited to, indigenous yard grass, Cypress, Pecan Trees, Penny Wort, and other wetland vegetation. Soil Types include Dungston (DuA). The property has an elevation of approximately 3 feet above normal water level (NWL) along the shoreline with about 523 square feet of USACE jurisdictional 404 wetlands along the northern edge. The shoreline is 50 feet in length and currently has no hardened structures along it. The water classification for this area is Aquatic Life, Secondary Recreation, Fresh Water (C), Swamp Waters (SW) and are estuarine waters that are closed to shellfishing. The water depths within the project area ranges from -0.5 feet to -3 feet. An SAV survey conducted on this site showed there was none present in the proposed project area. Development Proposal The applicant proposes to construct a 50 linear foot vinyl bulkhead an average of 2 feet out from normal water level with a maximum of 5 feet and two 20 foot returns. At the north end of the bulkhead the applicant proposes to place a 10 foot long by 6 foot wide low riprap revetment along the base of the wetland plants waterward of the proposed bulkhead. The applicant also proposed to construct a 20 foot by 6 foot pier with a 16 foot by 16 foot upper platform and a 6 foot by 16 foot lower platform as well as steps off the south side of the pier and a swinging jet ski lift on the north side of the platform. The water level at the terminus of the proposed pier is -3 feet. Anticipated Impacts The proposed development will result in the filling of 684 square feet of Public Trust Area of Environmental Concern, 468 square feet of public Trust Shoreline and 532 square feet of USACE jurisdictional 404 wetlands. The proposed project consists of the installation of a bulkhead, riprap, pier and platform and watercraft lift. The purpose for the bulkhead is to stabilize the shoreline of the property. The purpose of the riprap is to prevent damage to the bulkhead. The purpose of the pier and platform is to provide stable access and enjoyment of the water. The purpose for the lift is to store watercraft over the platform. The bulkhead will span the width of the property and will stop further erosion along the shoreline. Because my property and the adjacent property to the north do not end at the same point there will be an opening between the two bulkheads. Adding 1 Oft of riprap to the space between the bulkheads will help mitigate washout and possible destabilization of my bulkhead. The pier will extend 20 feet from the bulkhead to a 16ft x 16ft foot upper platform with an attached 6ft x 16ft lower platform. On the south side of the pier there will be stairs for water access. A watercraft lift will be attached to the northwest side of the platform. The lift will allow watercraft to be store over the platform when not in use.
