This permit, issued on January 31, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes a maximum of 4 formalized boat slips. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. Signature of Permittee Christopher Scerri Permit No. 5-22 Page 2 of 4 ADDITIONAL CONDITIONS 3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts 4) The authorized docking facility shall not exceed one third the width of the water body as measured from the existing bulkhead. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. Excavation 8) No excavation shall take place outside of the area indicated on the workplan drawings. 9) Excavation shall not exceed -4 feet below the normal high-water level. In no case shall the depth of excavation exceed the depth of connecting waters. 10) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 11) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. Dredge Material Disposal 12) No dredge material shall be placed within 30 feet of the normal high-water line. 13) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the site is graded and stabilized. Christopher Scerri Permit No. 5-22 Page 3 of 4 ADDITIONAL CONDITIONS 14) The dredge material disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. Sedimentation and Erosion Control 17) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 18) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. Maintenance Clause 19) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross-hatching indicating the area to be maintained, the area to be used for dredge material disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the dredge material disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. General 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 21) All construction debris associated with the removal or construction of the permitted docking facilities shall be contained within the authorized project area and disposed of in an approved upland location. 22) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high-water level. The applicant proposes to expand and reconfigure the existing docking facility and perform new dredging under the proposed slips for a total of four slips. The project is located at 125 Parmele Blvd. in Wrightsville Beach. Areas of Environmental Concern (AEC's) impacted by the proposal are ES, EW, and PTA. Waters at the project site are classified as SB and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Wrightsville Beach Land Use Plan Update and offer the following comments. The general area of the project is classified as Low Density Residential. In general, the Wrightsville Beach Land Use Plan contains policies, which allows development in Low Density Residential classified AECs, which is consistent with the State's minimum use standards. The Wrightsville Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these policies appear to be applicable to this project. This project is consistent with the Wrightsville Beach Land Use'Plan Update. The application proposes to reconfigure an existing docking facility and dredge a boat basin within a man- made portion of Lee's Cut. The proposed project is located within Lee's Cut which are class SB waters by the DWR. These impacts are covered by the attached Water Quality General Certification Number 4175 and the conditions listed below. This certification is associated with the use of General Permit No. 198000291 once it is issued to you by the U.S. Army Corps of Engineers. Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non -Discharge, and Water Supply Watershed regulations. PROJECT DESCRIPTION The project site is located at 125 Parmele Boulevard, on a man-made canal in Middle Sound in Wrightsville Beach, New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel east approximately 3.0 miles on Eastwood Rd towards Wrightsville Beach. Cross the drawbridge and after approximately 0.3 miles take a slight left onto W. Salisbury Street. Travel approximately 1.7 miles to the stop light and turn left onto North Lumina Avenue. Travel approximately 0.3 miles and turn left onto Parmele Boulevard and the project site will be 0.2 miles down on the left. The property borders a man-made canal in Middle Sound near the confluence of Lee's Cut and Banks Channel in Wrightsville Beach. According to the applicant the 0.13 acre parcel located at 125 Parmele Blvd. has an elevation between 5'-7' above normal high water (NHW) and has approximately 83' of shoreline frontage, currently stabilized by a wooden bulkhead that approximates normal high water (NHW). The lot has an existing single-family home with the highground vegetation consisting primarily of ornamental landscaping and maintained lawn grasses. To the east of the property is Parmele Boulevard, to the south and west are other single-family homes, and located to the north is the existing bulkhead and a private 2-slip docking facility. The existing 2-slip docking facility is located at the end of a cove, incorporates approximately 717 ftz, and includes a series of fixed platforms and a gazebo that extend waterward from the bulkhead. Moving from west to east along the bulkhead the western fixed platform is 12' by 12', then a 15' by 15' gazebo, followed by a 10' by 12' platform separated in elevation from the other platforms by a step up. An access ramp extends from the western 12' by 12' platform onto the existing 6' by 38' floating dock positioned perpendicular to the shoreline, extending past the 1/3-width. General Permit 77595-D authorized the addition of the 10' by 12' eastern platform at a different elevation and the replacement of the 6' by 38' floating dock 2' to the east to remove it from the 15' riparian setback. Historically, the 38' floating dock had two (2)15' by 4' finger piers attached on the eastern side positioned parallel to the shoreline, however, those were removed in the most recent General Permit. No permit history was found for the original bulkhead or docking facility. A Notice of Violation was issued on August 3, 2021 to the CAMA authorized agent and property owner for violating a permit condition of General Permit 77595-D. Restoration was completed on August 13, 2021, the assessment payments were received on September 8u" from the agent and September 20th from the property owner, A closure letter was sent to the property owner on September 21, 2021. The Town of Wrightsville Beach Land Use Plan classifies the area in the vicinity of the project area as Low Density Residential. The waters in the project area are classified as SB by the N.C. Division of Water Resources. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish, PROPOSED PROJECT The applicant proposes to expand and reconfigure the existing docking facility and perform new dredging under the proposed slips for a total of 4 slips. The expanded docking facility would use the existing float to make a U-shape by moving the existing float back approximately 6' to meet the 1/3-width (see drawing 1 of 2 ) and adding a 6' by 22' float on parallel to the shoreline on landward side of the existing 6' by 38' float. A connecting finger pier approximately 5' by 23' would extend into the water, perpendicular to the shoreline creating a U-shape. A second ramp would be added from the eastern 10' by 12' platform onto the proposed new 5' by 23' finger pier. As mentioned in the narrative, the applicant would like the elevation of the recently authorized 10' by 12' platform to match the elevation of the gazebo. The width of the waterbody varies at the end of the canal. Currently, the existing docking facility extends a maximum of 57' into the approximately 157' water body, over the 113 width. The existing floating dock would be relocated 6' landward to extend a maximum of 51' into the waterbody and comply with the 1/3-width. The proposed new structures would extend a maximum of 45' into an approximately 160' waterbody exceeding the '/a width but not the 1/3-width. Additionally, the proposed new structures would be landward of the existing floating dock that currently exceeds the 1/3-width but would be moved 6' landward to the 113-width. There are no anticipated impediments to navigation since this facility is located at the end of the canal. According to the applicant the current water depths range from -1.5' in the vicinity of the proposed 5' by 23' floating dock to 4 NLW where the proposed dredge footprint meets the connecting bottom contour under the existing floating dock. The proposed dredge footprint would be 60' in width by approximately 40' in length to a connecting depth of -4 normal low water (NLW) (see Page 1 of 2), the DCM verified the water depths on the proposed drawing on October 21, 2020. Approximately 110 to 120 cubic yards (CY) of spoil is estimated to be removed using an excavator and bucket to barge method. Permission for spoil disposal from the Agnes Beane disposal site is included in the application. The Division of Coastal Management (DCM) considers the proposed excavation as new dredging since no permit history can be found for maintenance dredging in the project area and no definitive aerial photographic evidence was found. No development is proposed to be within either 15' riparian setback. 10, ANTICIPATED IMPACTS As proposed, the new 4-slip docking facility would result in the incorporation of approximately an additional 247 ft2 of Public Trust Area and Estuarine Waters for a total of 965 ft2 incorporated. The project area consists of Public Trust Area and Estuarine Water. Excavation would impact approximately 2,400 ft2 of soft bottom and spoil disposal would impact approximately 3,240 ft2 of highground. There would be no impact to vegetated wetlands or encroachment into either adjacent 15' riparian corridor setbacks. The existing structure would be pulled landward to meet the 113 -width of the waterbody and the proposed new floating dock would extend to almost 113 of the waterbody. Since the project site is at the end of the canal a pier headline can't be established but the existing floating dock is in line with the adjacent docking facility to the west. There appear to be no SAV present in the project area. Minor increases in turbidity should be expected during project construction.
