This permit, issued on January 24, 2022 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.

Docking Facility Expansion

1) This permit authorizes only the new tie pilings and piling reconfiguration and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility expansion
without permit modification. No non-water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.

2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharged at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other

ADDITIONAL CONDITIONS
3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.

4) This permit authorizes one (1) additional formalized boat slip for a maximum of three (3)formalized
boat slips at this docking facility.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

6) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.

Sedimentation and Erosion Control

7) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
General
8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
9) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.

10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

NOTE:This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2022-00198).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No.2021-1547.
NOTE: Future development of the permittee’s property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission’s (EMC) Tar Pamlico/Neuse River buffer
regulations in place at the time of such development.
NOTE: An application processing fee of $250 was received by DCM for this project.

Leslie Hewett has submitted a CAMA Major Permit application for his property located off SRl 317 at 559
Mills Rd. near Oriental, NC in Pamlico, County, North Carolina. The applicant proposes to install four tie pilings in
order to create a new wet slip and one tie piling to expand an existing wet slip. Along with an existing boatlift, this
would give Mr. Hewett a total of three (3) slips.
Staff has reviewed the proposed project regarding rules found in Subchapter 7H concerning development
in Public Trust Areas and Public Trust Shoreline. It is staffs recommendation that the proposed project is
consistent with 15A NCAC 07H .0208 as described below.
This office feels the development is consistent with 15A NCAC 07H .208(6) (G) which states in part that
Pier and docking facilities (i) shall not extend beyond established pier or docking facility length along the same
shoreline, (ii)shall not extend into channel or (ii)extend more than one-fourth the width of a natural water body"
Staff recommend the following conditions be included if the project is permitted.
1. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

2.0 Land Use Compatibility
2.1 Pamlico County strongly discourages any uses in estuarine waters that are not compatible with
protection and conservation of their biological and community values.
2.1.1 Only development associated with water -dependent uses is allowed. Examples of appropriate
development may include public access facilities, docks and piers, erosion control structures, or other
uses that are permitted by CAMA use standards iucacTisA: 07H.0208
2.1.2 In all cases, the design of facilities or activities will ensure that any negative impacts on estuarine
waters, during both construction and operation, are minimized and that they comply with all local policies
and the policies of CAMA use standards.
2.3 The county strongly supports management of development in its estuarine shoreline to protect water
quality and the aesthetics of the waterfront.
2.3.1 The county supports the CAMA use standards' lICTIIA:071.0201 for estuarine shorelines.
2.3.3 The county establishes a local, permanent conservation zone within 75 feet of the normal
mean high water level or normal water level for all shorelines bordering public trust waters,
estuarine waters, and any waters designated as primary nursery areas.
2.3.3.1 All development and construction activities will be prohibited in this area except
for the following uses: marinas, docks and piers, boat ramps and similar structures
providing public access; and structures to prevent erosion as described in the Public
Access policies section.
2.3.3.2 This permanent conservation zone is not intended to apply to man-made ditches,
canals, basins, lakes, impoundments, and similar constructed facilities. The policy is not
intended to apply to forestry operations that comply with "best management practices."
2.3.3.3 The conservation zone applies to all subdivisions of land after January 26, 1990,
regardless of the intended use, and to all divisions of land after the certification of this
plan.
5.0 Water Quality
5.1 The county recognizes the importance of water quality to preserving the life-style and
economic well being of its residents and property owners and will implement measuresto address
both point -source and non -point source discharges in order to protect and restore water quality.
5.1.1 The county will continue to enforce a 75-foot permanent conservation zone along
its water bodies. Generally, except as allowed by policy 2.3.3, page 59, no construction is
permitted within this zone on lots or parcels divided after January 26, 1990.

for State approval for development of your property located off SR 1317 at 559 Mills Rd
Oriental Pamlico County, North Carolina. It was received on 14 October 2021, and appears
to be adequate for processing at this time. The projected deadline for making a decision is
28 December 2021. An additional 75-day review period is provided by law when such time
is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day. Kent Vaughan, Field
Representative for the Division of Coastal Management is responsible for processing your

If this agency does not render a permit decision within 70 days from 14 October 2021, you
may request a meeting with the Director of the Division of Coastal Management and permit

days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application,

Mr. Hewett has submitted a CAMAM0jmr Permit application toadd e third wet slip to his
existing pier. The property islocated o1558Mills Rd. onBroad Creek inOriental, NC. The lot is
maintained lawn with ornamental shrubs and upland trees and has ±300ft. of shoreline along Broad
Creek. Structures include a single family dwelling, detached garage, 300ft. bulkhead, 120ft. pier with a
9ft, X 20ft. platform on the end. The pier has one boat lift and one 24ft. X 38ft. wet slip. Depth at the
end Vfthe pier ioapproximately 6.5ft.at0VVL.5'1Oft. ofcoastal marsh extends xvaterv/awdufbulkhead
and depth atthe landward end ofthe pier iuapproximately 1ft.atNVVL.
Adjacent upstream property is developed lot with a single family residence, detached garage,
bulkhead and a 60ft. pier with one wet slip on the Gideon Creek side of the property. Adjacent
downstream property (s acleared lot with construction ofsingle family residence underway and a115ft.
pier with two wet slips.
Broad Creek is listed as coastal waters and thiis section of Broad Creek is a primary nursery area.
It is in the Neuse River Basin and classified as SC;NSW,HQW by the Environmental Management
Commission. No SAV was observed during the site visit on Sept. 14, 2021.
Proiect Description:
The applicant proposed toinstall Three (]) new pilings, move one (1)existing piling landward to
create a third 18ft. X 27ft, wet slip on the upstream side of the existing pier and add one (1) new piling
on the downstream side expanding the existing wet slip to 24ft. X 56ft.
Anticipated impact:
The project will create localized turbidity from piling installation. Total number to slips will

Lesliel-fewett has submitted a CAMA Major Permit application for his property located off SRI 317 at 559
Mills Rd. near Oriental, NC in Pamlico County, North Carolina. The applicant proposes to install four tic pilings in
order to create a new wet slip and one tie piling to expand an existing wet slip. Along with an existing boatlift, this
would give Mr. Hewett a total of three (3) slips.
Staff has reviewed the proposed project regarding rules found in Subehapter 7H concerning development
in Public Trust Areas and Public Trust Shoreline. It is staff s recommendation that the proposed project is
consistent with 15A NCAC 07H.0208 as described below.
This office feels the development is consistent with 15A NCAC 07H .208(6) (G) which states in part that
Pier and docking facilities (i) shall not extend beyond established pier or docking facility length along the same
shoreline, (ii)shall not extend into channel or (ii)extend more than one-fourth the width of a natural water body"
Staff recommend the following conditions be included if the project is permitted.
No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work,
2. This permit authorizes only the structures and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, may
become a permanent part of this docking facility without permit modification. No non -water dependent uses
of structures may be conducted on, in or over public trust waters without permit modification.
3. This permit authorizes a maximum of three boat slips.

1. After contact with and preliminary site visit by Mr. Kent Vaughn, this application
is submitted in accordance with the guidance and provisions of reference (a).
2. As described in enclosure (1) and illustrated in enclosure (3), the addition of four
(4) pilings and the movement of one (1) piling at the existing dock is requested.
3. Currently one (1) sailboat slip and one (1) boat lift are accommodated at the dock.
The requested four (4) new pilings and the requested movement of one (1) piling
will accommodate one (1) additional sailboat (30'-40') on the west side of the dock.
This improvement will raise the number of slips at this dock from two (2) to three
(3). The fourth (4th) piling on the east side of the dock will facilitate leaving the
existing slip in adverse wind conditions.

CAMA Major Development Permit Application Checklist
'ist is provided solely as an informational resource to assists in the
dn of the permit application. Although this checklist is not required to be filled
part of the permitting process, nor is it required that this checklist be provided to
Division of Coastal Management (DCM), the items included within the checklist are
equired to complete the permit application.
During the pre -application or application submittal meeting, a DCM representative will
sit down with you and review the application package for completeness, The Division
representative will refer to this check -list to determine whether or not an application is
deemed to be complete or inmfficient. If an application package is deemed incomplete,
the specific deficiencies will be noted on the application checklist. A copy of the checklist
will be provided to the applicant, or applicant's agent, at the end of the meeting Once
the items have been addressed, the applicant or agent should contact the local field
representative to reschedule afinal meeting.
PERMIT APPLICATION FORMS
All applicants must completely. fill out all three pages of the DCUMP-1 form. Depending
on the scope of the proposed development, you will also need to fill out some or all of the
additionalform(s) listed below. A checkmark beside the applicableform(s) indicates that
the forms are rewired for the proposed development

All questions on the application form(s) must be complete, or the letter "N/A"
must be placed in each item that does not apply to your proposed project.
All of the information provided in these forms must accurately correspond with
the submitted workplan drawings,
WORKPLAN DRAWINGS
All drawings must be neat, clear, and of standard size to permit photographic
reproduction. If blue prints or sheets larger than I I" x 17" are used, 27 copies must be
.1 submitted (it is advisable to request that a Divist 6"n"' representative inspect aftnal copy of
the workplan drawing(s) prior to making the required 27 copies), Drawings larger than
I I" x 17" should be folded to legal size or smaller.
The workplan drawings must be accurately drawn to an engineers scale (1 "-200' or less)
w/(example 1 "=30'J., 1 "=50 1 "=60', 1 "= 100', etc.). The scale must be indicated on the
drawings.
The fallowing list of items must be indicated on the workplan drawings. No application
or workplan drawings will be accepted as complete until all of the applicable items on
the checklist have been approved by the DCM.

has not been "checked oft" indicates that additional information is needed in order to
accept the application as complete, or that the item is "Not Applicable" to the proposed
