Hewett Jr., 559 Mills Rd., Oriental, NC 28571 Authorizing development in Pamlico County at adj. to Broad Creek, at 559 Mills Rd., in Oriental , as requested in the permittee’s application dated 9/17/21, includingattached workplan drawing (1), Drawing 1 of 1 dated 9/18/21. This permit, issued on January 24, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion 1) This permit authorizes only the new tie pilings and piling reconfiguration and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharged at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. Hewett Jr. Permit No. 3-22 Page 2 of2 ADDITIONAL CONDITIONS 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit authorizes one (1) additional formalized boat slip for a maximum of three (3)formalized boat slips at this docking facility. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. Sedimentation and Erosion Control 7) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. General 8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 9) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE:This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2022-00198). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No.2021-1547. NOTE: Future development of the permittee’s property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission’s (EMC) Tar Pamlico/Neuse River buffer regulations in place at the time of such development. NOTE: An application processing fee of $250 was received by DCM for this project. Along with an existing boatlift, this would give Mr. Hewett a total of three (3) slips. Staff has reviewed the proposed project regarding rules found in Subchapter 7H concerning development in Public Trust Areas and Public Trust Shoreline. It is staffs recommendation that the proposed project is consistent with 15A NCAC 07H .0208 as described below. This office feels the development is consistent with 15A NCAC 07H .208(6) (G) which states in part that Pier and docking facilities (i) shall not extend beyond established pier or docking facility length along the same shoreline, (ii)shall not extend into channel or (ii)extend more than one-fourth the width of a natural water body" Staff recommend the following conditions be included if the project is permitted. 1. Dlvislon or Coastal Management Washington Office 1 943 Washington Square Mall I Washington, North Carolina 27869 252.946,6481 2.0 Land Use Compatibility 2.1 Pamlico County strongly discourages any uses in estuarine waters that are not compatible with protection and conservation of their biological and community values. 2.1.1 Only development associated with water -dependent uses is allowed. Examples of appropriate development may include public access facilities, docks and piers, erosion control structures, or other uses that are permitted by CAMA use standards iucacTisA: 07H.0208 2.1.2 In all cases, the design of facilities or activities will ensure that any negative impacts on estuarine waters, during both construction and operation, are minimized and that they comply with all local policies and the policies of CAMA use standards. 2.3 The county strongly supports management of development in its estuarine shoreline to protect water quality and the aesthetics of the waterfront. 2.3.1 The county supports the CAMA use standards' lICTIIA:071.0201 for estuarine shorelines. 2.3.3 The county establishes a local, permanent conservation zone within 75 feet of the normal mean high water level or normal water level for all shorelines bordering public trust waters, estuarine waters, and any waters designated as primary nursery areas. 2.3.3.1 All development and construction activities will be prohibited in this area except for the following uses: marinas, docks and piers, boat ramps and similar structures providing public access; and structures to prevent erosion as described in the Public Access policies section. 2.3.3.2 This permanent conservation zone is not intended to apply to man-made ditches, canals, basins, lakes, impoundments, and similar constructed facilities. The policy is not intended to apply to forestry operations that comply with "best management practices." 2.3.3.3 The conservation zone applies to all subdivisions of land after January 26, 1990, regardless of the intended use, and to all divisions of land after the certification of this plan. 5.0 Water Quality 5.1 The county recognizes the importance of water quality to preserving the life-style and economic well being of its residents and property owners and will implement measuresto address both point -source and non -point source discharges in order to protect and restore water quality. 5.1.1 The county will continue to enforce a 75-foot permanent conservation zone along its water bodies. Generally, except as allowed by policy 2.3.3, page 59, no construction is permitted within this zone on lots or parcels divided after January 26, 1990.
