This permit, issued on November 8, 2021 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation it these terms may be, subject to tines, imprisonment or civu action; or may cause the permit to oe nu i ano vota. Docking Facility 1) This permit authorizes only the dock, pier, gazebo, boatlifts, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions). This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this pemtit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Peter & Carole Kozloski and James & Jane O'Neal Permit No. 147-21 Page 2 of 4 ADDITIONAL CONDITIONS, 3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) This permit authorizes a maximum of two (2) formalized boat slips. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 6) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 7) No attempt shall be made by tite permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 9) The authorized gazebo shall be single story, and shall not be designed to allow for second story use. Shoreline Stabilization - Bulkhead 10) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 11) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. 12) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 13) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 14) The bulkhead shall be constructed prior to any backfilling activities. 15) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 16) The fill material shall be clean and free of any pollutants except in trace quantities. Peter & Carole Kozloski and James & Jane O'Neal Permit No. 147-21 Page 3 of 4 ADDITIONAL CONDITIONS 17) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 18) No backfill material is to be placed within 30 feet of the normal high-water'level, except that which will be used to backfill the area behind the permitted bulkhead. 19) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 20) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 21) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 22) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. USACE Conditions 23) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at httn://www.fws.gov/nc-es/mammal/manatee auidelines.pdf. General 24) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 25) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 26) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 27) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic General Permit No. 198000291 (SAW Action Id. No. 2020-02099). Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-1884. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The proposed project to align a new bulkhead to the adjacent shoreline stabilization measures (i.e. neighboring bulkheads), will resolve and mitigate the hardships resulting from this unusual existing feature (i.e. an existing bulkhead 20' landward of neighboring bulkheads). To mitigate this hardship, we propose constructing a new 4.5-ft vinyl bulkhead, approximately 20-ft waterward of the existing timber bulkhead and aligned with adjacent shoreline stabilization measures (i.e. bulkheads) at 302 E Bay Stand 310 E Bay St. The proposed bulkhead wall will be built landward of the estuarine shoreline. The calculated area to be filled in with clean sand is 1320-SF. The new bulkhead will measure 89LF, of which 16.5LF will be constructed on the adjacent neighbor's riparian corridor. The proposed bulkhead will be stabilized using 1° x 8-ft HDG rods every 8 feet Typical residential pier construction methods will be performed. The vinyl sheet piles designed for this project will be the ESP 4.1 product in 10-fit lengths installed by vibratory hammer to the required depths. The proposed bulkhead wall will align with adjacent Additionally, this project proposes installing newtimber framed 148x5' fixed pier with a 16'x16' gazebo at the end and two new 10,000Ib boat lifts. The fixed pier will be supported by two 12" (diameter) pressure treated timber piles wrapped in vinyl and placed every 8-ft c/o to support a walkway with hand fails. Each boatiift will be supported by four 12" (diameter) pressure treated timber piles placed in a square, offset 12-ft o/c, to support a boat that will be located adjacent and of the gazebo. Give complete description' The proposed project to align a new bulkhead to the adjacent shoreline stabilization measures (i.e. neighboring bulkheads), will resolve and mitigate the hardships resulting from this unusual existing feature (i.e. an existing bulkhead 20' landward of neighboring bulkheads). To mitigate this hardship, we propose constructing a new 4.5-ft vinyl bulkhead, approximately 20-ft waterward of the existing timber bulkhead and aligned with adjacent shoreline stabilization measures (i.e. bulkheads) at 302 E Bay St and 310 E Bay St. The proposed bulkhead wall will be built landward of the estuarine shoreline. The calculated area to be filled in with dean sand is 1320-SF. The new bulkhead will measure 891-F, of which 16.51-F will be constructed on the adjacent neighbors riparian corridor. The proposed bulkhead will be stabilized using 1' x 8-ft HDG rods every 8 feet. Typical residential per construction methods will be performed. The vinyl sheet piles designed for this project will be the ESP 4.1 product in 10-ft lengths installed by vibratory hammer to the required depths. The proposed bulkhead wall will align with adjacent Additionally, this project proposes installing a new timber framed 148'x5' fixed pier with a 16'x16' gazebo at the end and two new 10,000 lb boat lifts. The fixed pier will be supported by two 12' (diameter) pressure treated timber piles wrapped in vinyl and placed every 8-ft o/c to support a walkway with hand rails. Each boatlift will be supported by four 12' (diameter) pressure treated timber piles placed in a square, offset 12-ft o/c, to support a boat that will be located adjacent and of the gazebo. I know you two have discussed issues with the project but I wanted to identify a few additional things and refresh others to make sure I am on the same page with you. At this time the project is on applicant hold for a redesign. The recently provided workplans need additional detail as detailed below... 1. NHW and NLW need to be identified on the workplans. 2. The 30ft CAMA buffer and the 75ft AEC need to be identified on the workplans. 3. The property lines should extend into the waterbody with consistent symbology. It seems that the property lines convert to the symbology of the riparian buffer once they reach the waterbody. a. In addition, can you note the adjacent property owners on the workplans for reference? 4. The existing bulkheads for the riparian neighbors do not accurately reflect aerial images. 5. The application was missing side view drawings depicting the bulkhead and rip rap elevations referencing NHW and NLW. The workplans and aerial photos indicate that the proposed bulkhead alignment enters onto the O'Neal property. The application does not indicate that the O'Neals are co -applicants, which would be required if the bulkhead is to align on their property. If this is the intent then the existing application will need to be withdrawn and a revised application with renotification, and the O'Neals as co -applicants will need to be submitted. This would require a new application with an updated accepted as complete date and permit application fee. Please contact Tara if this is what the applicant wishes. Otherwise the bulkhead alignment should be to the property line with a return wall. Finally, the project as proposed is inconsistent with CRC rule concerning bulkhead alignment and public trust rights. Agency comments from DMF and WRC also express this concern. DCM's position on the location of the bulkhead would be 2 foot in front of the existing bulkhead to be aligned to the subject property with rip rap located directly waterward. This redesign, with the bulkhead and rip rap aligned as detailed entirely on the subject property would not require a new application or neighbor notification since the redesign would be a reduction in area and impact. At this time there are no agency concerns related to the docking facility. Water depths at the proposed two slip docking facility are approximately -6' NLW. The Cape Fear River at this location is classified SC by the Environmental Management Commission. The NCWRC has reviewed the permit application and is concerned with the impacts to estuarine waters and public trust area. While we understand the existing bulkhead may need reinforcement or even - replacement, the extension waterward NHW is concerning. We would be supportive of riprap placement waterward the existing structure to diffuse energy or the installation of a new bulkhead in closer alignment to the existing bulkhead to address structure instability and the addition riprap waterward the new structure. The proposed bulkhead and rip rap would result in the filling of approximately 2,442 sq. ft. of Estuarine Waters and Public Trust Area. The project site is located at 306 E Bay St, adjacent to the Cape Fear River, within the Town of Southport, in Brunswick County. The applicant is proposing to install a new 74 linear ft. bulkhead 20 ft. waterward of NHW, install rip rap an additional 13 ft. waterward of NHW and construct a new private 2-slip docking facility. The Town of Southport Land Use Plan classifies the high ground portion of the project area as residential and the waters of the Cape,Fear River in this location are classified as "SC" by the North Carolina Division of Water Resources. The area is not designated as a Primary Nursery Area by the NCDMF and is closed to the harvest of shellfish. The applicant is proposing to install a new 74linear ft. bulkhead 20 ft. waterward of NHW, install rip rap an additional 13 ft. waterward of NHW and construct a new private 2-slip docking facility. The proposed bulkhead and rip rap would result in the filling of approximately 2,442 sq. ft. of Estuarine Waters and Public Trust Area. The proposed docking facility would result in the shading of approximately 1,244 sq. ft. of open water within the Estuarine Waters and Public Trust Area AECs. This proposed project includes a component to fill a large amount of Public Trust Area and Estuarine waters. The NCDMF would be supportive of project if the total amount of filled public area is minimized, while still mitigating wave action from passing large vessels. Minimization efforts would be either constructing the new bulkhead in closer alignment to the existing adjacent bulkheads with the rip rap installed just waterward of the new structure or to use rip rap only installed close to the existing bulkhead. The site is located at 306 and 310 East Bay Street, Southport, NC. The applicants seek to construct a new 4.5-ft vinyl bulkhead approximately 20-ft waterward of the existing timber bulkhead that will be aligned with adjacent shoreline stabilization measures (i.e. bulkheads) at 302 E Bay St and 310 E Bay St. The new bulkhead will measure 89 linear feet, of which 16.5 linear feet will be constructed on the adjacent neighbor's riparian corridor. The area to be filled behind the bulkhead with clean sand will total 1,320 square feet. Furthermore, the applicants seek to construct a new timber framed 148 feet by 5 feet fixed pier with a 16 feet by16 feet gazebo located to the southwest of the end of the pier. Two 12 feet by 12 feet boatlifts would be located to the northwest and southeast of the gazebo. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: Special Conditions 1. All work authorized by this permit must be performed in strict compliance with the submitted plans, dated October 21, 2021, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. y a . 2. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910) 772-2191. 3. Approval of the structure is based on determinations that there would be no obstruction to navigation. The structure may be damaged by wave wash from passing vessels. Issuance of this permit should not be construed, as relieving the permittee of taking proper steps to ensure the structure and moored boats will not be damaged by wave wash. 4. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 5. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 6. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 7. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 8. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. PROJECT DESCRIPTION The project site is located at 306 E Bay St, adjacent to the Cape Fear River, within the Town of Southport, in Brunswick County. To locate the property from Wilmington, travel south on NC Hwy-133 to Southport. Turn left on N. Howe Street and travel approximately 1.5 miles to E. Bay Streiet. Turn right onto E. Bay Street and travel approximately 0.2 miles to the subject property, which will be located on the left. The property is a 0.18-acre tract of land with an existing single family residence. The existing shoreline is stabilized by a vinyl bulkhead. The property has 69 linear ft. of shoreline and upland areas consist of grasses and native vegetation. There are no wetlands present at this location and Normal High Water (NHW) was flagged by DCM staff at the existing bulkhead. A survey of MHW was not submitted with this application. General Permit No. 69147 was issued on 6/27/17 for shoreline stabilization. The property is bordered by private residences to the west and east, East Bay St. to the north and the Cape Fear River to the south. According to the applicant, the existing bulkhead is structurally independent from both adjacent bulkheads and is located approximately 20 ft. landward of the adjacent bulkheads. The application states that due to the location of the existing bulkhead an "eddy effect occurs during high tides, wind events and when large cargo ships navigate down the channel creating sedimentation and impacting the integrity of the existing wall (see Narrative and attachments). The applicant is proposing to align the new bulkhead with adjacent bulkheads by installing a 4.5 ft. high vinyl wall approximately 20 ft. below Normal High Water (NHW) and adding additional rip rap extending out an additional 13 ft. from the new wall. The entire shoreline stabilization project would extend a total of 33 ft. waterward of the existing NHW line filling approximately 2442 sq. ft. of Estuarine Waters and Public Trust Area. The proposal also includes a new two -slip docking facility extending into the Cape Fear River from the new proposed bulkhead. A 5 ft. wide by 140 ft. long pier would extend waterward to a fixed 16 ft. wide by 16 ft. long L-head platform extending to the west. Two 12 ft. wide by 12 ft. long boatiifts are proposed landward and waterward of the platform in water depths measuring approximately — 6ft. at NLW. The proposed docking facility would not encroach into either adjacent riparian setback, exceed the existing pierhead line or the Y. width rule. 10. ANTICIPATED IMPACTS: The proposed bulkhead and rip rap would result in the filling of approximately 2,442 sq. ft. of Estuarine Waters and Public Trust Area. The existing timber bulkhead structure on this property is located approximately 20-ft landward of the existing adjacent bulkheads (located on the west and east sides). For 306 East Bay St, it is in my professional engineering opinion, not having a bulkhead located at this property address aligned with neighboring bulkheads is/are causing the following issues: 1) The existing conditions generate an eddy effect in the waters directly in -front of this property and the adjacent properties. The eddy effect occurs during mid -to -high wind events and mid to high (raising/falling) tide events. The eddy increases the sediment erosion rate at the toe of the existing bulkhead and on the sandy banks waterward, eventually causing structural failure to this bulkhead, and if left in it's current condition, guarantees complete failure to this bulkhead and the neighboring bulkheads to the east and west, in the future. 2) The existing bulkhead and the neighboring bulkheads, face the direction of the Cape Fear River that receives wind exposure to/from all ocean winds from the Oak Island, Bald Head Island, and New Hanover County facing beaches. Having a bulkhead that is located approximately 20-ft landward of the adjacent bulkhead, and not in alignment, during high wind event, and particularly at higher water levels, dramatically increases the sediment erosion rate and amplifies the eddy effect 3) The existing bulkhead receive wakes from large cargo holding ocean vessels (Panamax to Post Panamax) navigating up and down federally maintained USACE Navigation Channel to Military Ocean Terminal Sunny Point (MOTSU), North Carolina Port, and other inland ports/destinations. This is an issue because the Panamax and Post Panamax ships can only traverse each section of the federally maintained Navigation Channel at its highest tides. This existing bulkhead faces the Lower Swash portion of the channel. When the Panamax size vessels steam past 306 E. The images below show the waterline following the bulkheads with a visible "curved indentation" directly in front of the bulkhead located at 306 e. Bay St Furthermore, Image 4 (dated 10/26/2016) shows the adjacent east side bulkhead failure following Hurricane Matthew. It is in my professional engineering opinion this failure was cause, in part, to a non linear bulkhead wall to act as a whole part, reducing the structural integrity at this section. Please note Image 5 shows evidence of a wake caused by a large cargo ship. Image 7 shows very clear evidence of water at a higher elevation/tide on the existing bulkhead and adjacent bulkheads. Note the "curved indentation" on the bulkhead at 306 e. Bay St. Lastly, Image 8 shows evidence of possible eddy effects visible in the satellite imagery. These eddy effects may be caused by wind and raising/falling tides, at locations where hydrodynamics do not act in unison, and where piers/docks do not restrict/interrupt the frictional forces caused by these events. It is my professional judgement that the erosion rate in front of 306 E Bay St is higher than the adjacent neighbors whose bulkheads are aligned with one another and their adjacent neighbors, as this bulkhead sits landward (-20-ft) significantly more causing an eddy' effect directly infront of 306 E Bay St. This loop of current (i.e. the eddy effect) causes a hydrologic stress/strain current effect on the subsurface soils attributing to a significant lose of sediments due to erosion. I have inspected the existing bulkhead at 306 E Bay St and can state, as a Professional Engineer, I cannot guarantee that this bulkhead will survive another hurricane season, if not replaced.
