The Division of Coastal Management (the Division) did receive your package of information and it was scanned and submitted to Brad and I on or about 08/26/2020. While we received the information, it was still not complete for a permit application. We were not sure based on that correspondence if it was your intentions to make an application in the near future or if you wanted a review of the information. Based upon Brad's site visit to your property at 152 Shell Bank Rd, Carteret County, on July 14, 2020, and based on information provided by you and Mr. Morrison, Division staff believe the dark color bottom substrate in the water adjacent to your property, as seen in the GIS imagery, appears to be a navigation route where commercial fishing vessels, such as shrimp boats, routinely use to make trawls and make their turns. . Coastal Resources Commission's (CRC) rules 7H .1204(c) and 7H .0208(a)(2)(G), both state piers shall not interfere with the use of the water for navigation or for other public trust rights in Public Trust Waters including Estuarine Waters. The 200' pier plan you propose would extend into that area which is apparently used for navigation by commercial fishing vessels such as shrimp boats. In addition, the Division does not concur with your proposed riparian alignment. As such, the Division staff would suggest making an application for a CAMA General Permit for a proposed 125' long docking facility within a riparian access area approved by the Division of Coastal Management which staff believes would be consistent with the CRC's rules; pending your submittal of a permit fee, a site plan, and proof of notifications of the adjacent riparian property owners with no objections. An option to dredge from the proposed 125' pier length to the -2 ft water depth has also been provided to you by Division staff. Staffs findings indicate this excavation would provide you the same benefit and use as you would be getting at 200' offshore based on the information you provided. Otherwise, you may apply through the CAMA Major Development Permit application for your current proposal for a 200' long docking facility which likely would be denied. If your proposal is denied, you could then apply for a variance request from the N.C. Coastal Resources Commission. We scheduled you to come to our site on July 14, but because of your property receiving storm damage the night before, you were unable to attend. If you will review the documents, you should see that there is no channel any where in the area. Measurements have been taken by Land Management Group 700 ft. into the river and there is no evidence of a channel. Is there any more data required to obtain approval for the 200 ft. pier that we have requested and is needed for us to be able to navigate on the river?
