This permit, issued on March 25, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation )t these terms may be subject to tines, imprisonment or civil action; or may cause the permit to oe nuit ana voin. Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No portion of the authorized docking facility shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the normal high water line or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more restrictive. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Timothy Jernigan ADDITIONAL CONDITIONS Permit No. 34-21 Page 2 of 3 3) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 2 formalized boat slips. 6) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource agencies, physical stops shall be placed on the boat lifts and floating dock at a minimum height of 18" above the bottom substrate to prevent the structures from disturbing the bottom substrate. The physical stops shall remain in place for the life of the permitted docking facility. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 9) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. General 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of General Permit 56 (Action ID SAW-2021-00244). Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0337. NOTE: Future development of the permittee's property may require a modification of this permit: Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water line. The proposal is for the construction of a two slip docking facility with boatlifts, fixed platform, floating platform and three finger piers. The water depths within this area range from -2' to -2.6 nlw. The proposed development is consistent with 15A NCAC 7H.0208. The Morehead City District office recommends the project be authorized as proposed on plats dated received 11/18/19 contingent upon all applicable general conditions and the following standard conditions: • The pier and platform should not exceed a maximum distance of approximately 229' waterward of NHW or a max of 26' from the waterward edge of the coastal wetland section along the property. No more than 6' of platform shall extend over coastal wetlands. • All portions of the pier over coastal wetlands shall be a minimum of 3' above marsh substrate. • All work shall follow the plats dated received via email on 12/11/2020 • No more than two slips should be authorized. All slips should be maintained within a minimum water depth of -2' nlw. The floating platform shall be maintained within a minimum water depth of -18 inches nlw. Overview: The project is located adjacent to Dill Creek at 1512 Galley Circle in the Mariners Point subdivision in Morehead City, Carteret County. As a requirement of the subdivisions major permit # 167- 07 each lot would be required to apply for a major permit if individual docks were requested. The property is .31 acres (14,026 sf) in its entirety and is an average of 3' above NHW and has 179' of shoreline along the normal high water contour. Existing development includes a SFR. There are typical lawn grasses, scrub oaks and trees (above NHW) along the high ground portion of the property. The lot to the east has an existing dock. The water depths within the tributary of Dill Creek are shallow depending on location but according to the applicant, they are -2' NL W to -2.6' nlw, within the proposed slips and floating platform area. Extensive field work confirms the soundings. The substrate in this area is thick organic mud. he applicant is proposing a two slip docking facility with boatlifts and finger piers as well as a G x 30' access landward of normal high water, a 6' x 235' pier section over coastal wetlands and a 6' x 5' pier section over open water. The pier would intersect with a 16' x 20' T-head platform. There would be a floating platform extending off of the east side of the proposed fixed t-head platform. Environmental Concern (AEC) in the project area include Estuarine Waters (EW), Coastal Wetlands (CW) and Public Trust Areas (PTA). This section of Dill Creek is classified as SA/HQW, is a Primary Nursery Area, and is closed to shellfishing. There is an expanse (approximately 260' x 179') of Coastal Wetlands present along the shore adjacent to Dill Creek. There is also an oyster resource that is within this area as well. A review of cultural resources and archaeological resources was not provided. Anticipated impacts The proposed pier would incorporate and shade 1,560 ft2 of coastal wetlands. The proposed platforms, boatlifts and finger piers would shade 724ft2 and incorporate 1,625ft2 of open water. There are oyster beds that exist along the costal wetland area along the shoreline but should not be disturbed during the construction process. There is the potential fortemporary turbidity during piling placement. The Division of Land Resources approved the Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ Stormwater permit #SW8060625 issued on 7/12/06 for the existing s/d. Based on the determination of the water body widths by the Division and the District, the structure should not cause a hindrance to navigation due to the location of the proposed pier and platform being located 1-2' landward of the channel edge. Although the water depths within the proposed slip areas are -2'nlw to- 2.6'nlw there may be the potential of turbidity or impacts from prop scarring due to the proposed slips. Basis for Determination: The project site is in the Town of Morehead City and is subject to the 2007 Town of Morehead City Core Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as "Low Density Residential" and "Conservation/Open Space' (due to the sites location in Coastal Wetlands, Estuarine Waters and Public Trust Area AECs). The following LUP policies may be applicable to this request: 4.2.6 Areas of Environmental Concern Policy 1, pg. 94: The Town of Morehead City supports state and federal law regarding land use and development in AECs. Policy 2, pg. 94: Morehead City considers coastal wetland areas to be valuable passive recreation areas. These areas should be protected in their natural state. Only uses which are permitted by 15A NCAC 7H will be allowed. Policy 5, pg. 94: Morehead City supports the use standards for estuarine and public trust areas as specified in 15A NCAC.0207. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 1512 Galley Circle within the Mariners Point SD in Morehead City, NC adjacent to Dill Creek- Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to construct a pier, two slips with boatlifts, three finger piers, one fixed platform, and one floating platform. A circulation of the projected is a requirement of the subdivision's Permit No. 167-07 for additional slip installation. The pier would extend 235' over coastal marsh to a 16' by 20' fixed t-head with a 6' by 14' floating platform along the east side and two boat lifts with three finger pies, along the west side. The piers and lifts would not extend more than 26' from the edge of marsh nor into the channel (V — 2' landward the channel's edge). The water depths within the slips and floating platform are approximately -2' NLW. Oysters are within the area, located along the marsh. The substrate is thick organic mud. Dill Creek at this location is classified SA HQW by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries. The NCWRC is very familiar with the site and the Mariner's Point subdivision. The allowance of the multi -slip facility was to minimize impacts from individual lots developing water access and compromising environmental resources. The waters of Dill Creek are designated a PNA. PNAs are defined as those areas inhabited by the embryonic, larval or juvenile life stages of marine or estuarine fish or crustacean species due to favorable physical, chemical or biological factors. Erosion of the marsh, sediment disturbance, turbidity, and contamination collectively will degrade vital habitat and forage for wildlife in Dill Creek. Resources within the creek and various marsh plants along the shore provide food and cover for a variety of wildlife such as blue heron (Arden herodias), soya rail (Porzana carolina), and pintail (Anas acura). Extensive beds of oysters are also present along the shoreline and would be vulnerable to continuous boating activity. To minimize the impacts this facility may have, we request the floating platform either be removed of stops incorporated to prevent the stmcatre from sitting on the substrate. The thick organic material can cause significant turbidity when disturbed. We also request a construction moratorium from April I — September 30 due to the designation of the water body, the SA 1IWQ water classification, the presence of oysters, and the importance of coastal marsh during the peak period of biological productivity. The proposed work is located 1512 Galley Circle, within Morehead City, North Carolina. The applicant is proposing to install a two -slip docking facility with two boatlifts and two finger piers, 265' of access pier, a T-head platform, and a floating dock. This area is classified as a Primary Nursery Area (PNA), and the waters are designated as SA-HQW. DMF has concerns with the shallow depths of the proposed project, and this concern is exacerbated by the fact that the site is within designated PNA. PNAs are areas that provide food, protection, and proper environmental conditions for post -larval development of many recreationally, commercially, and environmentally important fish and shellfish species. Therefore, it is critical that these areas be protected to the maximum extent possible. As noted in the field report, a docking structure in shallow waters may result in prop scar during times with low water. Placing hardened structures in waterways have the potential to inhibit the movements of fish and may also result in altered sediment movement patterns. Additionally, the proposed boatlifts and floating dock may allow the structure or vessel(s) to repeatedly rest on the ground. This can result in restricted access to shallow habitat for aquatic species, as well as repeated bottom disturbance that can result in increased turbidity. DMF has concerns with the proposed floating dock, as there is not a clear purpose and need, considering that the proposal includes two boat slips. Therefore, DMF would recommend that the floating dock and associated gangway be removed from the design. Exclusion of these structures would significantly minimize many of the potential impacts described above. Narrative Description: The project is located at 1512 Galley Circle off Oglesby Rd which is part of the existing Mariners Point subdivision. Mariners Point was permitted through major permit # 167-07 for infrastructure, 149 lots and a docking facility. Oglesby Rd. is found by turning right off of N. Field Investigation Report: Jernigan 1512 Galley Circle Mariners Point S/D Page 02 20'b St. in Morehead City in the area locally known as Crab Point. Dill Creek borders this site to the east and north. 10. Narrative Description: The project is located at 1512 Galley Circle off Oglesby Rd which is part of the existing Mariners Point subdivision. Mariners Point was permitted through major permit # 167-07 for infrastructure,149 lots and a docking facility. Oglesby Rd. is found by turning right off of N. 20a' St. in Morehead City in the area locally known as Crab Point. Dill Creek borders this site to the east and north. 1512 Galley Circle is .31 acres (14,026sf) in its entirety and is an average of 3' above NHW and has 179' of shoreline along the normal high water contour. There is an expanse (approximately 260' x 179') of Coastal Wetlands present along the shore adjacent to Dill Creek. This coastal wetland area contains Smooth Cordgrass (Spartina alterniflora). There is also an oyster resource that is within this area as well. There are typical lawn grasses, scrub oaks and trees (above NHW) along the high ground portion of the property. The lot to the cast has an existing dock. The water depths within the tributary of Dill Creek are shallow depending on location but according to the applicant, they are —2' NLW to -2.6' nlw within the proposed slips and floating platform area. Extensive field work confirms the soundings. The substrate in this area is thick organic mud. This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in which the proposed project would take place is closed to the taking of shellfish. Morehead City's Land Use Plan dated 2007 classifies this area as Low Density Residential and Conservation within the AECs. 11. Project Description: The applicant is proposing a two slip docking facility with boatlifts and finger piers as well as a 6' x 30' access landward of normal high water, a 6' x 235' pier section over coastal wetlands and a 6' x 5' pier section over open water. The pier would intersect with a 16' x 20' T- head platform. There would be a floating platform extending off of the east side of the proposed fixed t-head platform. The proposed pier would extend from high ground for 30' over coastal wetlands that are landward of NHW then extend north for an additional 235' over coastal wetlands and extend the remaining 5' over open water. It would intersect with a 16' x 20' fixed t-head platform. There would be a 6' x 14' floating platform along the east side of the proposed fixed platform and two boatlifts with three finger piers along the west side of the proposed fixed platform. The most waterward section of the proposed platforms, finger piers and boatlifts would not exceed a maximum of 26' waterward from the edge of marsh and would not extend into the channel (1'-2' landward of channel edge). A maximum of two slips are proposed. The water depths along the slip areas and the floating platform range from -2' nlw to 2,6' n1w. The channel within this area of Dills creek is located approximately 27' waterward of the edge of Field Investigation Report: Jernigan 1512 Galley Circle Mariners Point S/D Page 03 coastal wetlands. The docking facility would be located 60' from the eastern and western riparian access lines and would be for private residential use only. The riparian access lines where determined on the previous original major permit submittal for the subdivision in addition to field visits and aerial photography. The riparian access line is drawn perpendicular to the channel location that runs east to west. All water depths as well as the outermost limit of the coastal wetlands, channel location and water body width have been field verified by DCM staff. 11. Anticipated Impacts: The proposed pier would incorporate and shade 1,560 ftZ of coastal wetlands. The proposed platforms, boatlifts and finger piers would shade 724ft2 and incorporate 1,625ftz of open water. There are oyster beds that exist along the costal wetland area along the shoreline but should not be disturbed during the construction process. There is the potential for temporary turbidity during piling placement. The Division of Land Resources approved the Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ Stormwater permit #SW8060625 issued on 7/12/06 for the existing s/d. Based on the determination of the water body widths by the Division and the District, the structure should not cause a hindrance to navigation due to the location of the proposed pier and platform being located 1-2' landward of the channel edge. Although the water depths within the proposed slip areas are -2'nlw to-2.6'nlw there may be the potential of turbidity or impacts from prop scarring due to the proposed slips.
