This permit, issued on April 16, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Dockine Facility
1) This permit authorizes only the docks, piers, boathouses, finger piers, platforms and floating dock,
and other structures and uses located in or over the water that are expressly and specifically set forth
in the permit application. No other structure, whether floating or stationary, shall become a
permanent part of this docking facility without permit modification. No non -water dependent uses of
structures shall be conducted on, in or over Public Trust waters without permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) This permit authorizes a maximum of two (2) formalized boat slips.

4) The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the
authorized workplans.
5) The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
6) No attempt shall be made by the penmittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
8) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the
federally maintained AIW W channel.
9) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
Boat Ramp
10) Unless specifically altered herein, this permit authorizes one concrete boat ramp, as indicated on the
attached workplan drawings.
11) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or
poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact
waters of the State or waters that will enter waters of the State.
12) Placement of fill materials below normal water level shall be limited to the ramp structure.
13) Excavation and ground disturbing activities, associated with the placement of the boat ramp, above and
below the normal water line shall be limited to that absolutely necessary to establish adequate ramp
slope and provide a ramp no greater in size than specified in the attached permit application and
workplan drawings.
Shoreline Stabilization - Bulkheads
14) The bulkhead alignment shall approximate the normal high-water level at the time of construction.
15) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan
drawings.
16) No open water shall be excavated or filled, even temporarily, outside of the approved b ti &QVED
alignment.

17) The alignment of the authorized bulkheads shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within
a maximum of 30 days prior to the new expected start of construction.
18) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.
19) The bulkhead shall be constructed prior to any backfilling activities.
20) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
21) This permit does not authorize any excavation waterward of the approved alignment.
22) The fill material shall be clean and free of any pollutants except in trace quantities.
23) Unless altered herein, all backfill material shall be obtained from a high ground source and confined
behind the permitted bulkhead.
24) No backfill material is to be placed within 30 feet of the normal high-water level, except that which will
be used to backfill the area behind the permitted bulkhead.
25) All fill material to be placed below normal high-water level shall be confined behind the permitted
bulkhead.
Upland Development
26) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the grading and addition of
gravel to the existing road, all as expressly and specifically set forth in the attached permit application
and workplan drawings.
Sedimentation and Erosion Control
27) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
28) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
29) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly instal"VW61y
landward of the bulkhead cap immediately following completion of backfilling activities.

30) An as -built survey shall be performed docking facility and boat ramp facility, and copies of the survey
provided to the U.S. Army Corps of Engineers and Division of Coastal Management, within 60 days of
completion of construction of these portions of the project.
USACE Conditions
31) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish 8a Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

32) A U.S. Army Corps of Engineers Easement exists over the entire parcel and along the Marina Way from
the AIWW to the oceanfront shoreline. During dredging activities conducted by the Corps, or its
contractors, a pipeline may be placed from the AIW W along Marina Way to the oceanfront shoreline.
The boat ramp would be blocked during the duration of the Corps dredging/disposal activities.
General
33) Due to the ramp being located in the power line transmission easement area, there shall be a [National
Electric Safety Code requirement] minimum of 45 feet of vertical clearance over the boat ramp, the
ramp approach, and associated sailboat rigging areas. Please contact the Jones-Onslow E.M.C. for
additional information at (910) 577-6318.
34) Signage shall be posted at the ramp, in the ramp approach, and ramp staging area warning the public of
the presence of overhead power transmission lines and the risk of possible electrocution hazard.
35) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
NCAC ISA:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
36) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
37) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location.
38) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-1620.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is fiuther advised that many non -water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Proiect Summary: The applicant wishes to construct a docking facility and boat
ramp adjacent to Stump Sound for private use in North Topsail Beach.

Narrative Description:
The property is located adjacent to the Stump Sound IC W at the northern terminus of Marina Way in
North Topsail Beach, Onslow County. This lot is currently undeveloped. The adjacent riparian
properties are developed with single family residences.
The elevation of the adjacent high ground of the parcel is approximately 2' above the normal high
water level (NHL). Vegetation on the parcel mainly consists of Coastal Wetlands, predominantly
Spartina alternii fora. The parcel has 2,483' of continuous shoreline along Stump Sound. Immediate
offshore water depths adjacent to the parcel range from —1.5' to —3.5' normal low water. The
subaqueous substrate is firm with shell.
This proposal is located near a Federal Channel. There is not a cultural resource in the project area.
This waterbody is approximately 480' across at this location. These estuarine waters are classified as
a Primary Nursery Area. Submerged aquatic vegetation was not observed at this location. This area is
open to shellfish harvest and is classified as SA; High Quality Waters. This parcel is within the White
Oak River basin.
Proposed Development:
The applicant is proposing to construct a private docking facility and boat ramp within Stump Sound, -
in North Topsail Beach. The proposed development would take place adjacent to Lot 23 Manna
Way, Onslow County. This proposal is for private use in a residential neighborhood.
The applicant is proposing to construct a fixed 2-slip docking facility 20' west of the existing gravel
drive. The proposed pier access would be 6' by 55'. The proposed pier would connect to a 12' by 18'
fixed platform (partially covered) out on the main waterbody, Stump Sound. Two boathouses, each
containing a boat lift, would be on either side of the fixed platform. Both of the proposed boathouses
would be 13' by 23', with 3' by 47' catwalks.
The proposed boat ramp would be at the end of the existing gravel drive. The proposed boat ramp
would be 12' by 35% with 20' extending below the NHW of Stump Sound. The proposed ramp
would be supported on either side by 19' retaining walls. The applicant is also proposing a 3' by 20'
floating staging pier on the west side of the proposed boat launch.
Anticipated Impacts:
There is a Federal Channel in the nearby vicinity of this proposed docking facility. This proposal
would not be a hazard to navigation. The proposed docking facility and floating staging pier
would usurp 1,594 square feet of Public Trust Area. The proposed boat ramp and supporting
retaining walls would fill 300 square feet of high ground. The proposed boat ramp would fill 240
square feet of shallow bottom PNA habitat. Traditional marine construction methodology will be
utilized during the construction of this project. Turbidity impacts are not anticipated during the

construction activities in Stump Sound. There is not a cultural resource in the vicinity of the
project area. These waters of Stump Sound are classified as a Primary Nursery Area and the
presence of submerged aquatic vegetation was not observed. This area is open to shellfish
harvest and is classified as SA; High Quality Waters.

Narrative

As acting agent for Teena Koury, who owns Lot 23 Marina Way, North Topsail Beach, in
Onslow County, N.C, I am submitting the enclosed CAMA Major Permit Application for a
proposed private docking facility adjacent to the AI W W. Ms. Koury would like to construct a
pier (6' x 55') a partially covered platform (12' x 18') which will be located in between 2
boathouses (13' x 23' each). Each boathouse will contain a boatlift (13'x 13') and will have a 3'
wide walkway around the outside of three sides of the boathouses. These structures are proposed
to be located in existing water depths of approx. -3' to 3.5' @ NLW and would extend approx.
73' into the AIW W which measures approximately 408' wide at the location of the proposed
project thus, conforming to the '/< width of the waterbody limitation and will not encroach into
either of the adjacent 15' riparian corridor setbacks.
Ms. Koury is also proposing to install a new boat ramp (12' x 48' overall, 12' x 34' will be
below NHW) at the waterward end of the existing road. Existing water depths at the waterward
end of the proposed boat ramp are -3' @ NLW. A bulkhead (15' long each with a 4' section
parallel to the AIWW) will be installed adjacent to the boat ramp on each side on the high
ground. Adjacent to the boat ramp on the west side will be a fixed dock (3' x 28') to assist in the
launching and retrieving of boats. There will also be approx. 520 sq. ft. of gravel placed in an
area of the existing road footprint measuring approx. 20'- 30' x 22' to fill in holes at the
approach of the boat ramp. It should be noted that no wetlands will be filled with any gravel.
The DWR pre -filing meeting request has been filled out on the website and a copy of the return
email resulting from that submittal is included in this CAMA Major Permit application.

complete to the best of my knowledge and belief.
• The project proponent hereby requests that the certifying authority review and take action on this
CWA 401 certification request within the applicable reasonable period of time.

Dear Ms. Koury:
The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located adjacent to Stump Sound at Lot 23
Marina Way in North Topsail Beach, Onslow County. It was received on November 3, 2020, and
appears to be adequate for processing at this time. The projected deadline for making a decision
is January 19, 2021. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from November 3, 2020, you
may request a meeting with the Director of the Division of Coastal Management and permit staff
to discuss the status of your project. Such a meeting will be held within five working days from

I've sent an email to the CORPS to discuss, I not too concerned about the boat ramp water depth, can always extend just
a bit to get to -3', my biggest concern is the CORPS and power lines. I'll let you know by Monday about the hold. May

Morning Debbie,
I just received this project and have not had much of a chance to review but I have received a number of comments
(above) of concern that I wanted to get to you asap. In summary, DMF, DWR and WRC have concerns with the depth of
the ramp in PNA being less than 3 feet. DWR also noted potential concerns with easements that were verified by USACE
and the Town. The Town's easement concerns have to do with the power lines. I have also attached comments from
the power company that note a possible path forward on their end.
The most notable comments besides the resource agencies, come from USACE, where they note that the property may
not be able to be developed as proposed.
My suggestion would be to place the project on applicant hold and set up a scoping meeting through Cameron Weaver
to review the project with the agencies so we can get a clear picture of the concerns and discuss any potential options.
think this is preferrable over email since there are a number of concerns, it might get too cumbersome otherwise.
Let me know your thoughts when yob've had time to review.

the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c)
which would make June 4, 2021 the new deadline for reaching a decision on your request.

The following is my assessment and consequent recommendations of the above referenced proposal: This
proposal incorporates 1,894 square feet of Public Trust Area. The proposal is adjacent to a Federal Channel.
These waters of Stump Sound are open to shellfish harvest. This waterbody is a Primary Nursery Area.
The applicant is proposing 1,594 square feet of shading impacts (covered platform and two boathouses) with
over 2,000 feet of shoreline on the property. The applicant is also proposing 240 square feet of shallow
bottom fill and 300 square feet of high ground fill. Assuming other state and federal agencies concur, the
Morehead City District staff recommends that the project be authorized with the following conditions:
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, may become a permanent part of this marina/docking facility without permit
modification. No non -water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.
2) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
3) This permit authorizes a maximum of two boat slips. At no time shall more than two vessels be moored
or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types,
including but not limited to motorboats, sailing vessels and personal watercraft.
4) It is possible that the authorized structure may be damaged by wave wash from passing vessels. The
issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity

of the permitted structure and the safety of moored boats. The permittee shall not hold the United States
liable for any such damage.
5) Approval of the structure was based on a determination that there would be no obstruction to navigation.
Under conditions existing within the AIW W, a possibility exists that the structure may be damaged by
wave wash from passing vessels. Unreasonable slowing down of vessel traffic cannot be required
because such an action would tend to nullify the navigational benefits on which the AIW W was
justified. Issuance of this permit should not be construed as relieving the permittee of taking proper
steps to ensure the structure and moored boats will not be damaged by wave wash normally to be
expected in the AIW W. The permittee shall not hold the United States liable for any such damage.
6) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required,
upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.

This project appears to be consistent and not in conflict with the North Topsail Beach
Land Use Plan update. .
The applicant proposes to construct a docking facility and boat ramp adjacent to Stump
Sound for private use. The property is located at adjacent to Stump Sound/ICW at the
northern terminus of Marina Way in North Topsail Beach, Onslow County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW, PTA and
ES. Waters at the site are classified as SA-HQW and are open to the harvesting of
shellfish. The area is a primary nursery area.
I have reviewed this proposal for consistency with the North Topsail Beach Land Use
Plan and offer the following comments.
The general area of the project is classified Rural, while the AECs impacted by the work
are classified as Conservation.
In general, the North Topsail Beach Land Use Plan allows development in
Rural/Conservation classified AECs which is consistent with the State's minimum use
standards. The North Topsail Beach Land Use Plan contains some policies, which
exceed the State's minimum use standards. However, none of these more restrictive
policies appear to be applicable to this project.
Provided all local, state and federal requirements can be met, this project appears to
be consistent with the North Topsail Beach Land Use Plan Update.

The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request dated received by this office on December 15, 2020 and additional information received on March
2, 2021. The application proposes to construct a two -slip docking facility and boat ramp. The proposed
project is located in the waters of Stump Sound which are classified as SA:HQW by DWR. Please
understand that the waters around your project area have been identified by the Division of Marine
Fisheries as Primary Nursery Area (PNA). Should the need for dredging within the proposed project area
arise in the future, please be aware that new dredging within a PNA is not permitted under 15A NCAC
02B .0221 as it results in degradation of water quality standards and therefore is considered a water
quality violation. [15A NCAC 02B .0221]
DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the Regional
General Permit 291 issued by the US Army Corps of Engineers (USACE). This Certification allows you to
use the Regional General Permit 291 when issued by the US Army Corps of Engineers. In accordance with
the attached General Certification #4175 (GC 4175), the impacts described in your application do not
require written authorization to utilize GC 4175. However, you are required to follow the conditions listed
in the attached certification. You should get or otherwise comply with any other federal, state and local
requirements before you go ahead with your project including (but not limited to) erosion and sediment
control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH). A petition form may be obtained from the OAH at http://www.ncoah.com/ or by calling the OAH
Clews Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition
is considered filed when the original and one (1) copy along with any applicable OAH filing fee is received

The DWR concurs with the concerns raised by WRC regarding the boat ramp. Additionally, it appears that the USACE
maintains an easement on this property that may preclude the placement of permanent structures within the easement
area (see attached email). It is also likely that the Jones-Onslow Electric Membership Corporation maintains a perpetual
easement below the power lines that may affect the project. It may be helpful to have an inter -agency meeting to
discuss the concerns of the resource agencies and the easement holders. Please feel free to call or email me if you have

I looked quickly through the project. It appears the ramp ends in water depths close to -2.5' NLW. NCWRC generally
does not support ramps that terminate in water depths less than -3' NLW. I have objected to several in the past. I'm not
as familiar with the area so I do not know if there are other similar ramps in the vicinity that*may have been permitted
under a GP or have been there for some time. I also am not as familiar with the aquatic resources, but chronic bottom
disturbance would occur regardless of SAV or shellfish presence. At this time I will likely proceed with an objection,
unless there are other agency responses to steer differently. Any thoughts or input would be appreciated.

We appreciate you keeping us informed in this permitting process.
We have carefully studied the plans from the view point of Public Safety, knowing that the boat ramp area is
directly underneath a 12,500 Volt Overhead power facility owned by Jones-Onslow EMC.
Section Table 232 of the National Electric Safety Code requires minimum of 45 feet of vertical
clearance over boat ramps and associated rigging areas at boat ramps ,especially if they can be used for
launching sailboats. This is to prevent contact with the electric power lines during launching and rigging. The
NESC also requires signs to be posted in the area to warn public of the presents of overhead power facilities in
associated rigging areas.
The permitting drawings neither designate rigging areas or vertical clearances.
It is our opinion that a vertical measurement survey of the actual final grade height of electrical facilities be
conducted prior to issue of permit.
This information can be provided by a professional survey crew calculations or Jones- Onslow EMC would be
willing to assist with vertical measurements ,but JOEMC has no view of allowed rigging areas or measurement
of final filled grade.
The Town of North Topsail Beach should be especially interested in this location because this overhead power
line crossing is the primary source of electric power for the North End of Topsail Island.

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of a revised CAMA permit application (see email attachment) , Field
Investigation Report and BioReport (dated December 2020) for the subject project. The attached notice requests
federal agency comments on this project by April 3, 2021.
The site is located within waters of Stump Sound, adjacent to the AIWW, lot 23 Marina Way, in North Topsail Beach,
Onslow County, North Carolina. Coordinates are approximately 34.517148 N,-77.372010 W.
The applicant is proposing to construct a two -slip docking facility and a boat ramp. Specifically, the applicant proposes to
construct a fixed 2-slip docking facility 20' west of the existing gravel drive. The proposed pier access would be 6' W by
55' L. The proposed pier would connect to a 12' by 18' fixed platform (partially covered) out on the main waterbody,
Stump Sound. Two boathouses, each containing a 13'X 13' boat lift, would be on either side of the fixed platform. Both
of the proposed boathouses would be 13' W by 23' L, with 3' W catwalks located on three sides of the exterior of the
boathouses.
The proposed boat ramp would be located at the end of the existing gravel drive, and would measure 12' W by 48' L,
with 34' extending below the NHW of Stump Sound. The ramp was extended in order to reach water depths on -3' NLW.
Additionally proposed is a bulkhead (15' long each with a 4' section parallel to the AIWW) will be installed adjacent to
the boat ramp on each side on the high ground. Adjacent to the boat ramp on the west side will be a fixed dock (3' x 28')
to assist in the launching and retrieving of boats. Further, in order to provide a level access approach to the boat ramp,
approximately 520 sq. ft. of gravel is proposed within the existing road footprint (to fill holes w/in the existing access).
This area measures approximately 20'- 30' x 22'. No wetlands would be impacted by the gravel placement.
The applicant has stated that the facility will be for private use and will not be open to the public.
Dredging is not proposed as a part of this project.

A North Carolina Division of Marine Fisheries (NCDMF) Fisheries Resource Specialist has reviewed
the CAMA Major Permit application for proposed actions that impact fish and fish habitats. The
applicant is proposing to construct a private docking facility and boat ramp within Stump Sound, in
North Topsail Beach adjacent to Lot 23 Marina Way, within in White Oak River basin. The proposed
docking facility is planned as a fixed 2-slip docking facility 20' west of the existing gravel drive. The
proposed pier access would be 6' by 55'. The proposed pier would connect to a 12' by 18' fixed
platform (partially covered) out on the main waterbody, Stump Sound. Two boathouses, each
containing a boat lift, would be on either side of the fixed platform. These estuarine waters are
classified as a Primary Nursery Area (PNA) by the NCDMF. This area is open to shellfish harvest and
is classified as SA; High Quality Waters and no Submerged aquatic vegetation was observed at this
location.
PNAs are estuarine waters where initial post -larval development occurs. Species within this area
are early post -larval to juvenile and include finfish, crabs, and shrimp. Species inhabit PNAs
because they afford food, protection, and proper environmental conditions during vulnerable
periods of their life history, thus protection of these areas are imperative. Increased sedimentation
raises concern for shellfish and shellfish habitat by either the direct burial of oyster beds or
reductions in filtration efficiency, respiration rates, and/or reproduction and settlement. Larval
oysters require a clean hard bottom for attachment and sedimentation as little as 1 or 2 mm may
inhibit settlement. Duration of sedimentation suspension and water quality degradation has been
shown to result in juvenile oyster mortality. Coastal wetlands are considered among the most
productive ecosystems in the world. Coastal wetlands are a productive detritus -based system that
trap nutrients, toxins and sediment, aid in shoreline erosion control, dissipate wave and storm
action, provides a barrier to flood damage, and provide nursery functions and support fish
production.
The NCDMF does not have concerns with the proposed design, however, for the above -mentioned
reasons, the NCDMF would request that a moratorium on in -water work, from 1 April to 30
September is recommended to reduce the negative effects on critical fish life history activities, to
include spawning migrations and nursery functions.

The project site is located directly adjacent to the Corps federal channel. A Corps Easement exists over
the entire parcel and along Marina Way. The Wilmington District Navigation Branch requires a Consent
to construct the boat ramp and must be obtained prior to construction.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report. We recommend that the following conditions be
included in the modification to the State authorization:

1. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at

2. A U.S. Army Corps of Engineers Easement exists over the entire parcel and along
Marina Way from the AI W W to the oceanfront shoreline. During dredging activities conducted
by the Corps, or its contractors, a pipeline may be placed from the AIW W along Marina Way to
the oceanfront shoreline. The boat ramp would be blocked during the duration of the Corps
dredging/disposal activities.
3. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety
Office at (910) 772-2191.
4. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.
5. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
6. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
7. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-
5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
8. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
9. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District

Engineer who will initiate the required coordination procedures.
10. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
11. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project
must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statutes Chapter 1 I3A Article 4).
12. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
13. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre -project condition.
14. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.
