This permit, issued on October 20, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
)fthese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and voic.
Observation Pier
1) This permit authorizes only the pier and platform, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this observation pier without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No portion of the authorized observation pier shall extend more than one quarter of the width of the
water body. Measurements to determine width of the water body shall be made from the normal high-
water line or the waterward edge of any coastal wetland vegetation which borders the water body,
whichever is more restrictive.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2024
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) Any portion of the permitted access pier and platform built over wetlands shall not exceed six feet in
width and shall be elevated a minimum of three feet above the wetland substrate as measured from the
bottom of the decking.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit does not authorize any formalized boat slips.
6) In order to satisfy concerns of the resource agencies, no cleats, tie piles or other formal mooring
structures shall be constructed on any portion of the observation pier. Any vessel shall be considered a
violation of this permit.
7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent northern property owner's area of riparian access.
8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
9) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
10) If the crossing of wetlands with mechanized constriction equipment is necessary, temporary
construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed
immediately upon completion of construction.
Sedimentation and Erosion Control
11) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
12) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
14) All construction debris associated with the removal or construction of the permitted observation pier
shall be contained within the authorized project area and disposed of in appropriate waste receptacles in
an upland location.
15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

ADDITIONAL CONDITIONS
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2021-01935).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2007-1367 v9.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

The following are my comments and recommendations regarding the aforementioned proposal. The

The proposed development is consistent with 15A NCAC 7H.0208. The Morehead City District office
recommends the project be authorized as proposed on plats dated received 2/17/2021 contingent upon
all applicable general conditions and the following standard conditions:
The pier and platform should not exceed a maximum distance of 15' waterward of NHW
due to the 60' water body width.
Due to the shallow water depths and silty sediment (mud fluff) substrate within a PNA the
District recommends no slips should be authorized.
All portions of pier and platform shall not exceed a max width of 6' over any coastal
wetlands and shall have a minimum height of three feet from the marsh substrate.

Consistency Determination: The request is consistent with/not in conflict with the Town of Morehead
City Land Use Plan certified by the CRC on September 28, 2007.
Overview: The project is located adjacent to Dill Creek at 1504 Galley Circle in the Mariners Point
subdivision in Morehead City, Carteret County. Lot 69 is .29 acres (12,633) in its entirety and is an average
of3' above NHW. The total length of the shoreline is 94'. The water depths in Dill Creek are shallow (less
than-2'nlw) and according to the applicant, reach-.25' to .5' NLW within the area of the proposed
structure. The substrate in this area is thick organic mud. The lot is developed with a single familystructure
and all infrastructure.
Environmental Concern (AEC) in the project area include Estuarine Waters (EW), Coastal Wetlands (CW)
and Public Trust Areas (PTA). This section of Dill Creek is classified as SA/HQW, is a Primary Nursery Area,
and is closed to shellfishing. There is a 42' x 94' fringe of Coastal Wetlands present along the shore
adjacent to Dill Creek. This fringe contains Smooth Coordgrass (Spartina altemiflora), Salt Grass (Distichlis
spicato) and Salt Meadow Grass (Spartina patens). A review of SAV, shellfish, cultural resources and
archaeological resources was not provided.
The applicant is proposing a 6' x 100' pier and a 12' x 20' T-head platform. No upland development is
proposed. The pier would cross high ground for approximately 40', coastal wetlands above normal high
water for approximately 30', coastal wetlands below NHW for 12' and open water for 18' with a total
length of 100'. It would then intersect a 12' x 20' platform. There are no slips proposed. The water depths
along the platform area are .25' nlw to .5' nlw. The width of the water body in this area is 60' wide.
The pier and platform would be located 15' from the north riparian access line and 40' from the south
riparian access line. Riparian access lines where determined on the original major permit submittal forthe

subdivision as well as through field visits and aerial photography and are drawn relative to the channel
location.
Anticipated impacts
The proposed pier as would shade and incorporate 240 ft2of high ground while shading and incorporating
252 ft2 of coastal wetlands above and below NHW. A total 348 ft2 of open water of would be shaded and
incorporated by the pier and platform. There would also be temporary turbidity during piling placement.
Basis for Determination: The project site is in the Town of Morehead City and is subject to the 2007 Town
of Morehead City Core Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as
"Low Density Residential" and "Conservation/Open Space' (due to the sites location in Coastal Wetlands,
Estuarine Waters and Public Trust Area AECs).
The following LUP policies may be applicable to this request:
4.2.6 Areas of Environmental Concern
Policy 1, pg. 94: The Town of Morehead City supports state and federal law regarding land use and
development in AECs.
Policy 2, pg. 94: Morehead City considers coastal wetland areas to be valuable passive recreation areas.
These areas should be protected in their natural state. Only uses which are permitted by 15A NCAC 7H
will be allowed.
Policy 5, pg. 94: Morehead City supports the use standards for estuarine and public trust areas as
specified in 15A NCAC .0207.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the CAMA permit application for proposed actions that may impact fish and/or fish
habitats. The proposed work is located at 1504 Galley Circle, Morehead City, within Carteret
County. The applicant is proposing to construct a 6' by 100' pier and a 12' by 20' T-head
platform. The pier would cross high ground for approximately 40', coastal wetlands above
normal high water for approximately 30', coastal wetlands below normal high water (NHW) for
12', and open water for 18'. There are no slips included in this proposal. The water depths
along the platform are 0.25' to 0.5' normal low water (NLW), and the water body is 60' wide.
This section of Dill Creek is designated as a Primary Nursery Area (PNA), and is classified as
SA/HQW waters. This area is closed to the taking of shellfish.
As noted above, the site is designated as a PNA. PNAs are waters that provide the necessary
conditions for post -larval development for a variety of commercially, recreationally, and
environmentally important species. These areas provide sufficient forage, protection, and
environmental conditions during these critical stages in life history for these species. Therefore,
protection of areas that are designated as PNA is of the utmost importance for the protection and
enhancement of these species.
Taking the above into consideration, DMF would object to the proposed project unless the
following avoidance/minimization measures are included as permit requirements. First, the work
should be required to adhere a moratorium of April I through September 30 for all in -water
work. Also, the structure should include design elements that prevent the structure from being
used for docking of vessels. As this structure is being proposed as an observation platform, the
issuance of the permit should be conditioned on the agreement that the structure not be used as a
dock in the future.
DMF also offers the following as suggestions that would help to minimize impacts associated
with this project. The construction design should involve the minimal number of pilings
installed in the marsh area in order to minimize disturbance/destruction of this habitat. Also, the
construction should occur during the lowest tides possible in order to minimize potential
turbidity increases associated with in -water work.

since it's PNA). Once I hear back from Anne, I'll get the comments to you asap. To give you a heads up, I'm
leaning towards the "Approve with modifications" option on the comment sheet. Here are the recommendations
I made in my draft comments (these may change, depending on Anne's feedback): First, the work should be
required to adhere a moratorium of April 1 through September 30 for all in -water work. Second, the elevation
of the pier should be increased or light -penetrating materials should be included in order to reduce the
shading, particularly in the portion that crosses the marsh area. Also, the construction design should involve
the minimal number of pilings installed in the marsh area in order to minimize disturbance/destruction of this
habitat. The structure should also include design elements that prevent the structure from being used for
docking of vessels, such as guardrails. Finally, the construction should occur during the lowest tides possible in
order to minimize potential turbidity increases associated with in -water work.
As for BPG, I was waiting to see the updated plans. If they include the changes that were mentioned in the email chain,
I'm leaning towards "No Comment" since 1'd take that bulkhead realignment as a fairly significant minimization measure.

you must notify the Division and you may be required to submit a new application package with the
appropriate fee. If the property is sold, the new owner must be given a copy of this Certification and is

3. Crab Point Bay is classified as SA;HQW by the Division of Water Resources (DWR) and has been
determined to be a Primary Nursery Area (PNA) by the Division of Marine Fisheries (DMF). Please
understand that the waters around your project area have been identified as a PNA, and should
requests for dredging within the proposed project area arise in the future, they will be denied.
Please be aware that new dredging within a PNA is not permitted under 15A NCAC 02B .0220. This
activity results in degradation of water quality standards and is therefore considered a water

9. Narrative Description:
The James Innamorato (lot 69) project is located at 1504 Galley Circle of Oglesby Rd which is
part of the existing Mariners Point subdivision. Mariners Point was permitted through major
permit # 167-07 for infrastructure, 149 lots and a docking facility. Oglesby Rd. is found by
turning right off of N. 201 St. in Morehead City in the area locally known as Crab Point. The
project area is located within a tributary of Dill Creek.
Lot 69 is .29 acres (12,633) in its entirety and is an average of 3' above NHW. The total length
of the shoreline is 94'. There is a 42' x 94' fringe of Coastal Wetlands present along the shore
adjacent to Dill Creek. This fringe contains Smooth Coordgrass (Spartina altemiflora), Salt
Grass (Distichlis spicata) and Salt Meadow Grass (Spartina patens). The water depths in Dill
Creek are shallow (less than-2'nlw) and according to the applicant, reach —.25' to .5' NLW
within the area of the proposed structure. The substrate in this area is thick organic mud. The
lot is developed with a single family structure and all infrastructure.
This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine
Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in
which the proposed project would take place is closed to the taking of shellfish. Morehead
City's Land Use Plan dated 2007 classifies this area as Low Density Residential and
Conservation within the AECs. A pre filling request with NCDWR was received on 4/14/2021
and reached the 30-day calendar requirement on 5/15/2021.
10. Project Description:
The applicant is proposing a 6' x 100' pier and a 12' x 20' T- head platform. No upland
development is proposed.
The pier would cross high ground for approximately 40', coastal wetlands above normal high
water for approximately 30', coastal wetlands below NHW for 12' and open water for 18'
with a total length of 100'. It would then intersect a 12' x 20' platform. There are no slips
proposed. The water depths along the platform area are .25' nlw to .5' nlw. The width of the
water body in this area is 60' wide.
The pier and platform would be located 15' from the north riparian access line and 40' from
the south riparian access line. Riparian access lines where determined on the original major
permit submittal for the subdivision as well as through field visits and aerial photography and
are drawn relative to the channel location.
II. Anticipated Impacts:
The proposed pier as would shade and incorporate 240ft2 of high ground while shading and
incorporating 252ft2 of coastal wetlands above and below NHW. A total 348 ftz of open
water of would be shaded and incorporated by the pier and platform. There would also be
temporary turbidity during piling placement. The Division of Land Resources approved the
Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ

Stormwater permit #SW8060625 issued on 7/12/06 for the existing s/d. Based on the
determination of the water body widths by the Division and the District, the structure
as proposed would exceed the 'Alimitation but could be permitted if designed to not
exceed a maximum of 15' from the edge of coastal wetlands.

The Department of Environment and Natural Resources hereby gives public notice as required by
NCGS 113A-119(b) that application for a development permit in an Area of Environmental Concern as
designated under the CAMA was received as complete on 6/24/2021. According to said application, Mr. James
Innamorato proposes to install a pier and platform at 1504 Galley Circle in Morehead City, NC. A copy of the
entire application may be examined or copied at the office of Heather Styron, NC Division of Coastal
Management, located at 400 Commerce Avenue, Morehead City, NC, (252) 808-2808 during normal business
