This permit, issued on April 22, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation X these terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization - Bulkhead 1) The permittee shall re -locate the existing rip rap to the location marked "fill area" on Drawing 3 of 4 dated 11/10/20. The toe of rip rap within the "fill area" shall be no greater than 7 feet waterward of the waterward edge of the existing bulkhead at the time of construction. 2) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 3) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Charles and Doris Hudnall ADDITIONAL CONDITIONS Permit No. 50-21 Page 2 of 3 4) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 6) Unless altered herein, the bulkhead shall be constructed prior to any backfilling activities. 7) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 8) The fill material shall be clean and free of any pollutants except in trace quantities. 9) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 10) No backfill material is to be placed within 30 feet of the normal water level, except that which will be used to backfill the area behind the permitted bulkhead. 11) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 12) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 14) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Docking Facility Repair and Replacement 15) This permit authorizes only the repair and replacement of the existing structures within the existing footprint and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 16) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 18) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 19) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 20) The.permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2021-00422). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0547. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. Restaurants; residences, apartments, motels, hotels, trailer parks, ,private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches. Consistent: The development is consistent with the intent of this rule. (a) (2) (B) requires that the development shall comply with state and federal water and air quality Consistent: This development will not violate water and air quality. (a)(2)(C) requires that the development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural resources. Consistent: There are no known archaeological or historic resources on the property. (a) (2)(D) requires that the development shall not increase siltation. Consistent: it does not appear that this development will measurably increase siltation. (a) (2) (E) requires that the development shall not create stagnant water bodies. Consistent: It does not appear that the development will create stagnant water bodies. (a)(2)(F) requires that the development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The development will have minimum adverse effects on life cycles or estuarine resources. (a) (2) (G) requires that the development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The development proposal minimal effects on navigation. (b) Specific Use Standards (b)(7) Addresses Bulkheads. Possible Inconsistency: The proposed bulkhead is to be placed 2 foot out along the majority of its alignment with one section proposed to be 7 feet out from existing. (b)(7)(B) requires that bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources. Consistent: The propose bulkhead will not be constructed near wetlands. (b)(7)(C) requires that bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non upland source; the material so obtained may be contained behind the bulkhead. Consistent: The applicant has indicated that the fill will contain sand from an upland location. (b)(7)(D) requires that bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: (i) the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule. Possible Inconsistency: The property does have riprap in front of the bulkhead where it will extend farther than 2 feet, but not along the entire alignment. (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features. Possible Inconsistency: The property does have riprap in front of the bulkhead where it will extend farther than 2 feet, but not along the entire alignment. (iii)• the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners Consistent: The proposed bulkhead meets the, intent of this rule. DATE: March 9, 2021 Consistency Determination: The request is consistent with/not in conflict with the Chowan County & Town of Edenton Joint Land Use Plan certified by the CRC on November 15, 2018. Overview: The 1.24 acre subject property has approximately 185 linear feet of shoreline along the Albemarle Sound. Water depths at the shoreline average -3.5 feet. The property has an elevation of approximately 4 to 11 feet above Normal Water Level (NWL) along the shoreline. The site is vegetated with grasses, shrubs and trees. The shoreline is located within the VE Floodzone, with a strip of AO Floodzone between the VE and areas outside of the floodzone. Existing site improvements consist of a single-family house with a paved driveway. Existing shoreline improvements consist of 185 linear feet of bulkhead, 81 linear feet of riprap, and a 6 foot wide by 62 foot long pier with a 16 foot by 16 foot platform and a boatlift. The bulkhead follows the irregular shape of the shoreline where half the width is recessed approximately 22 feet. The bulkhead is failing and the pier and platform are damaged. Replacement of 185 linear feet of bulkhead and the 16 foot by 16 foot platform and elevation and repair of the pier are proposed. The bulkhead will be located 2 feet waterward from the existing alignment along 104 feet and 7 feet waterward from the existing alignment along 81 feet. Existing riprap will be removed and used as backfill behind the bulkhead. As indicated in the application, the bulkhead will be 2 feet higher and the pier will be elevated 2 feet. The waters of the Albemarle Sound are classified as SB and Coastal Waters and are closed to shellfishing. Submerged Aquatic Vegetation (SAV) was not observed growing within the proposed alignment. A review of historic and archaeological resources was not included in the Field Investigation Report. Basis for Determination: The subject property is designated as "Medium/High Density Residential" on the Chowan County Future Land Use Map. As indicated on Page 2-10 "...coastal wetlands, estuarine waters, estuarine shoreline, public trust areas, and 'Section 404' wetlands..." are part of the "Conservation" classification. The following LUP policies may be applicable to this request. Land Use Compatibility: Policy LU-2, Page 2-42. "The Town of Edenton and Chowan County support growth and development in keeping with the Future Land Use Maps in this Plan." Policy LU-10, Page 2-42. "The Town of Edenton and Chowan County shall adhere to the state's mitigation requirements, criteria, and concepts to minimize conflicts with natural resources and fragile areas. The Town and County shall also maintain local development standards (such as distance/separation requirements, buffering/screening requirements, etc.) for special and/or conditional uses in order to assist with mitigating potential negative impacts." No surface water may be channeled or directed into a sanitary sewer. -Whenever practicable, the drainage system of a development shall coordinate with and connect to the drainage systems or drainage ways on surrounding properties or roads. Additionally, repairs are proposed to an existing storm damaged docking facility. Project Setting The property proposed for development is located at 226 Mulberry Hill Lane in Chowan County and consists of approximately 54,014 square feet or 1.24 acres, and is adjacent to the Albemarle Sound. The property currently contains a single family residence, a storm damaged pier with a platform and boatlift, a failing bulkhead and riprap along the shoreline. The property to the east is a single family residence and the property to the west is a vacant lot. Vegetation on the site includes, but is not limited to, indigenous yard grasses, ornamental Shrubs and trees. Soil Types include Yeopim Loam (YeB) and Chapanoke Silt (Ch). The property has an elevation of approximately 4-11 feet above normal water level (NWL) along the shoreline. The shoreline is 185 feet in length and is irregularly shaped due to that approximately half the width of the property is recessed approximately 22 feet landward of the other half. It has been hardened by a failing bulkhead along its entirety and riprap exists in front of approximately 81 feet. The water classification for this area is Primary Recreation, Salt Water (SB), and are coastal waters that are closed to shellfishing. The water depths along the alignment average - 3.5 feet. Submerged Aquatic Vegetation (SAV) was not observed growing within the proposed alignment. Development Proposal The applicant proposes to replace an existing 185 foot bulkhead 2 foot out from the existing alignment along 104 feet of the bulkhead and 7' along the other 81 feet. The existing riprap will be removed and used as backfill material. The applicant also proposes to replace the 16 foot by 16 foot platform that was destroyed by Hurricane Isaias as well as make minor repairs to the existing boathouse, boatlift and raise the existing 62 foot by 6 foot pier using the existing piles. Bulkheading and tie -back installation will require a disturbance area 20 foot landward of the existing bulkhead. Anticipated Impacts The proposed development will result in the filling of 735 square feet of Estuarine Waters and Public Trust Areas of Environmental Concern. It will also result in the disturbance of 3,340 square feet of Estuarine Shorelines Area of Environmental Concern. Temporary turbidity will possibly occur during construction. In 1999 when we first considered purchasing lot 87 in Mulberry Hill Plantation, most waterfront lots, including Lot 87, were 100 feet wide. Since Lot 87 was, at the time, the last building lot on the east end, the existing bulkhead ran about 13' beyond the boundary (see black line on Drawing #1). There was, however, another 60 foot parcel on the east end of the development and we negotiated with the Wood family to purchase this section also. This 60 feet of waterfront had no shoreline stabilization at the time. The purchase of the full, expanded lot was completed on June 23, 1999. A copy of the deed is included in this package b. On or about July 12, 2000, after consulting with a CAMA representative, we had approximately 163 tons of rip -rap delivered and placed on the unprotected 60' of waterfront. (See green circles on the Drawing #1). c. In July, 2004, we built a 64' pier with a 16x16' platform and a 24' x 12' boat lift. Work was done by Cahoon Marine Construction (from Bath, NC?), under CAMA General Permit A38265. (See Drawing #2) d. During the 4-5 years after we purchased the lot and built a house, the riparian neighbor on the east showed little interest in their property and refused to make any effort to stabilize the shoreline. Numerous storms were eroding their lot at a rapid rate, averaging about 8 feet per year. By 2005, this erosion was threatening our property, possibly even our house. In July, 2005, Joe Riddick Marine Construction, Hertford, NC, installed a new bulkhead across our remaining 45-50 feet of waterfront, and installed a wing wall of approximately 40 feet back into our lot along the property line. This work was done under CAMA General Permit A40888. (See red line on Drawing #2). In order to install the waterfront bulkhead, Riddick moved most of the existing rip -rap to the west (see red dots on Drawing #2). e. No further additions were made between 2005 and 2020. The adjoining properties on each side of us have changed ownership. Tommy Wood, on the east, has added a bulkhead to stabilize that lot. Paul Halla, on the west, has recently installed a new vinyl bulkhead and our proposed design is similar to his. RECEIVED FEB 2 g 2021 DCM-MHD CITY II. PROPOSED PROJECT a. REPLACEMENT OF BULKHEAD RECEIVED FEB 2 2 2021 DCM-EC From what I have seen in this neighborhood, nearly everyone is facing the same set of problems. The current bulkheads are aging and beginning to fail; the mean water level is at least 12" higher than it was fifteen years ago; even minor storms create significant overwash into the lot; and we seem to get more "named" storms than in years past. My five closest neighbors to the west have all replaced their bulkheads within the past two years. On the western half of the lot, my proposal is to install a vinyl bulkhead, one -to -two feet outside the current bulkhead, and approximately two feet higher than the current bulkhead. These dimensions will allow a seamless joint with my western riparian neighbor's new bulkhead. The reason that I am making a MAJOR PERMIT application is that I propose to build the western portion of the new bulkhead outside some existing rip -rap. This rip -rap is both above and below the waterline and is outside the current bulkhead. In this position, the rip -rap provides no significant benefit. It no longer improves waterfront stabilization; but it seems to attract and trap any trash or fallen trees moving up and down the shoreline, and it provides stepping stones for waves to overwash the bulkhead. The one beneficial purpose for which I can use the rip -rap is to provide 3040% of the fill material that would be required behind the proposed bulkhead. Specifically, on the eastern half of the lot, I propose to build the new bulkhead parallel to the existing bulkhead, and 7 feet outside the current bulkhead. A short distance before reaching the property line on the east, we will turn the bulkhead 90 degrees to the north to meet the old bulkhead. We will extend this northward section through the old bulkhead and approximately ten feet into our yard to provide protection from east wind and waves. See Drawing #3. This eastern section will create a "fill -area" of approximately 565 sq ft. behind the new bulkhead, to be back -filled with new soil and the existing rip -rap. . PROPOSED PROJECT (continued) b. REPAIR OF PIER, W/ PLATFORM and BOAT LIFT DCM-EC As previously mentioned, we have had this structure since 2004. Hurricane Isaias severely damaged a large portion of it. Only the boat lift appears to still be largely intact. The platform was demolished; the only pieces remaining are the pilings upon which the platform was built. The walkway providing access to the platform and to the boatlift has been damaged extensively. Several 8-foot sections are gone entirely and several other support beams are broken. While this will largely be a repair project, there are some design changes that I will mention. Since the new bulkhead will be roughly two feet higher than the current bulkhead, I propose to also raise the walkway by two feet. This will allow the walkway to clear the bulkhead, and more importantly, put the walkway two feet higher above the waves. The second change is that I plan to use "thty-flow" type of decking to lessen the destructive impact of the wave action. I have previously used the "thrri-flow" decking for the first fifteen feet of the pier and it has worked very successfully.
