Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Vermt"t for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 Excavation and/or filling pursuant to NCGS 113-229 Permit Number 89-21 Issued to David and Charlotta Howell, 648 Oak Run, Clarksville, VA 23927 Authorizing development in New Hanover County at adi. to Inlet Point Canal, at 209 Gazebo Court, in Wilmington, as requested in the permittee's application dtd 3/15/21, including attached workolan drawings (6), Sheet 3 of 6 dtd "Rec DCM Wilm 3/26/21", Survey dtd 1/30/20, Sheets 4-7 of 7 all dtd 7/29/20. This permit, issued on July 16, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation )r mese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expnansion 1) This permit authorizes only the docks, piers, jet ski platform and boat lift, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No portion of the docking facility shall exceed a maximum of 21 feet waterward from the waterward edge of the existing bulkhead, to comply the established Dolphin Bay mooring easement as detailed on Sheet 3 of 6. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2024 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Davis, Director Division of Coastal Management This permit and its condi ' as are hereby accepted. �� �1��.]—A David and Charlotta Howell ADDITIONAL CONDITIONS Permit No. 89-21 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit authorizes an additional formalized boat slip for a maximum of three (3) formalized boat slips at this docking facility. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the eastern adjacent property owner's area of riparian access. 8) Should the lot to the west be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian setback, and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. General 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2021-00844). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0149. PROJECT DESCRIPTION: The project site is located at 209 Gazebo Court, off Inlet Point Canal and adjacent to the AIW W/Myrtle Grove Sound, in Wilmington, New Hanover County. To locate the property from Market Street travel south on College Road (NC Hwy 132) and continue south for approximately 5 miles on Carolina Beach Rd. (NC Hwy 421). Make a u-turn on Carolina Beach Road just past the entrance to Inlet Point Harbor Subdivision, then take the first right onto Inlet Point Drive. Take the right onto Inlet Point Drive South, and then take the next left onto Gazebo Court. Continue on Gazebo Couit until you reach the subject property on the right. The project site is approximately 0.28 acres and the primary vegetation consists of maintained lawn grass and ornamental landscaping. The project site has approximately 95 feet of shoreline frontage along Inlet Point Harbor canal, which is currently stabilized with a timber bulkhead. The elevation on the property ranges from 0 to 9 ft above NHW. The current docking facility consists of a fixed platform (10' x 10') extending from bulkhead in a waterward, northerly direction. From the east side of the existing platform, a gangway extends to the east, parallel with the shoreline, and ties into an existing floating dock (49'x 5') that is also parallel with the shoreline. With its currently orientation, the facility serves as two (2) formalized slips. The platform and floating dock were authorized via CAMA General Permit GP-34242D, issued in 2003. The New Hanover County Land Use Plan classifies the area near the project area as Developed. The waters in the project area are classified as SC by the N.C. Division of Water Resources. They ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to reconfigure private a docking facility with a new uncovered fixed platform, rebuild an existing floating dock, construct a new boat lift (14' x 15') for the creation of 1 additional slip, and install a new floating jet ski dock to accommodate two personal watercraft, increasing the total number of slips from 2 to 3, within the Inlet Point Canal. According to the application materials, the existing fixed platform would be removed, and a new fixed platform would be constructed, 15' from the western property comer. The proposed platform would consist of a portion of decking located over the high ground (IS'x8'), connected to a portion overhanging the water from the bulkhead (7' x 15'). Immediately waterward and to the north of the fixed,platform, the applicant is proposing to construct a boat lift (14' x 15'). From the east side of the proposed fixed platform, the applicant is proposing to construct a ramp (9'x3') extending down to the floating dock (49' x 5'), which would be replaced and shifted westward to maintain a 15' riparian corridor setback from the neighboring property to the east at 213 Gazebo Court. To the west of the fixed platform, the applicant is proposing to install a jet ski floating platform (14' x 10'), within the riparian corridor setback of the neighbor to the west, however the appropriate waiver has been obtained. (See Sheet No 4 & 5 of 7). In the area of the proposed (replacement) floating dock, there are water depths of -1.5' @ NLW on the landward side, and -2.5' @ NLW on the waterward side. In the area of the proposed jet ski platform, there are water depths of -1.5 @ NLW on the landward side, and -4.5' @ NLW on the waterward side. In the area of the proposed boatlift, the water depths range from 3.0' @ NLW on the landward side to -6.0' @ NLW on the waterward side. David and Charlotta Howell Page 3 10. ANTICIPATED EVIPACTS: As proposed, the new boatlift and jet ski platform would incorporate an additional 350 SF of public trust area and estuarine waters in water depths of approximately -1.5' to -6' @ NLW. The proposed floating dock replacement would not result in the increase of any additional incorporation, and the proposed fixed platform would shade 105 SF of estuarine water, and disturb 120 SF of highground within the 30' buffer from coastal shorelines. As proposed, the constructed features would extend 21' into a waterbody measuring 70' across, exceeding the '/a width, but consistent with the neighboring pierhead line and local neighborhood docking easement (See attached plat map "Dolphin Bay Section II, dated approved 8/16/90). This proposed development would increase the number of vessels accommodated by the facility, from two existing slips to three (3) total.
