This permit, issued on July 23, 2021 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation n tnese terms may oe subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion 1) This permit authorizes only the pier extension and boat lifts, and structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee ------------------------------------ - Robert Hollis Permit No. 96-21 Page 2 of 3 ADDITIONAL CONDITIONS 3) This permit authorizes 2 additional formalized boat slips for a maximum of 4 formalized boat slips at this docking facility. 4) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the northern adjacent property owner's area of riparian access. 5) Should the lot to the south be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian setback, and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 8) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the federally maintained AIWW channel. 9) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. USACE Conditions 10) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at httms://www.fws. ovg /raleigh/pdfs/ManateeGuidelines20l7.pdf. General 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. 13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0096. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the mean high-water level. The proposed project is adjacent to the AIW W and Masonboro Sound. To find the property one would travel south from Wilmington on South College Road (NC 132) to the intersection of South College, Carolina Beach Road (NC 421) and Piner Road. This intersection is known locally as Monkey Junction. Turn left onto Piner Road and travel approximately 0.75 miles and veer to the left onto Grissom Road. Continue heading north until Grissom Road merges into Masonboro Loop Road. Continue to head north on Masonboro Loop Road until you reach Hollis Lane, which will be on the right. Turn onto Hollis Lane and continue down the unimproved road to the AIW W. The property is located on a parcel that is approximately 10 acres. The lot is relatively flat and has an average elevation ranging approximately 10'-15' above normal high water (NHW). There are multiple single home residences and associated structures on the property. A gravel road on the property leads to the docking facility. The lot has approximately 120' of frontage along the AIW W and Masonboro Sound. A culvert runs under the gravel road allowing a tidal slough on the northern side of the pier to pass under the road. There are coastal wetlands on both sides of the road. Along the applicant's shoreline is an approximately 150' wide border of coastal wetlands consisting primarily of Smooth Cordgrass (Spartina alternii fora) and Black Needlerush (Juncus roemerianus). This section of the waterway measures approximately 855' across. The existing docking facility consists of a 323' by 6' fixed pier, which leads to a 16' by 24 fixed platform L-head with a 12' by 15' covered gazebo on the north side. A ramp extends from the waterward end of the fixed platform to a 24' by 8' floating dock oriented perpendicular to the shoreline. A 14' x 14' boat lift is located on the southern side and an open water slip with two mooring pilings on the northern side for a total of two formalized slips (See Sheet 4 of 4). The initial docking facility was authorized via CAMA General Permit #59107D, issued on 12/16/2011 and the fixed platform was expanded to its current dimensions via CAMA General Permit #62615D, issued on 09/10/2013. The property directly to the north of the applicant's property currently has a shared private docking facility (Nixon Ill) that was authorized under State Permit No. 67-16 on December 16, 2011. The property to the south off Masonboro Loop Rd (Hollis), has a natural shoreline with no development. The Joint City of Wilmington and New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. In the project area, the waters of Masonboro Sound are classified as SA-ORW by the NC Division of Water Resources, and they are CLOSED to the harvest of shellfish. These waters are designated as a Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. PROPOSED PROJECT: The applicant proposes to extend an existing pier, reconfigure an existing docking facility, add a second floating dock, and add a second boat lift to increase the total number of slips from two to four. According to the application materials, the applicant proposes to remove the existing ramp and 8' x 24' floating dock and extend the existing pier waterward by 32'. The new pier would extend approximately 232ft into the waterbody. From the proposed pier extension, a 3' x 16' ramp would extend north to the newly relocated 8' x 24' floating dock running perpendicular to the shoreline. According to the application, the floating dock would be placed 19' from the northern riparian line. Extending south from the proposed pier extension would be a 6' x 24' floating dock running parallel to the shoreline. Two boat lifts are proposed, one on the east and one on the west side of the proposed 6' x 24' floating dock. The existing boat lift would be reconfigured to create one of the proposed lifts. The proposed docking facility would extend approximately eight feet waterward of the existing docking facility but would not exceed the existing pier headline. The floating dock and boat lifts would be placed within the southern riparian corridor setback; however the appropriate waiver has been obtained (See Sheet 3 of 4). In the area of the proposed northern floating dock, there are water depths of approximately -3' at NLW on the landward side and -4' at NLW on the waterward. In the area of the proposed boat lifts on the southern side, there are water depths of-3' at NLW on the landward side and -4' at NLW on the waterward side. ANTICIPATED IMPACTS: The proposed reconfigured docking facility would incorporate approximately 906 sq. ft. of Public Trust Area and Estuarine Waters, of which 388 sq. ft. was previously accounted for. The existing pier and platform shade approximately 1,132 sq. ft. of estuarine water and approximately 966 sq. ft. of coastal wetlands that has previously been accounted for (GP #62615D & #59107D). The proposed structures would extend approximately 238' into a waterbody, which measures approximately 855' across. As proposed, the docking facility appears to exceed the 1/4 width rule (but not the 1/3 width) and would not exceed the pier headline or encroach into the 80' federal channel setback. The proposed structures would allow the facility to accommodate up to four (4) vessels in water depths of approximately -3' to -4' @ NL W. Minor increases in turbidity should be expected during construction; however, no long-term impacts are anticipated.
