Additional Docking Facility 1) This permit authorizes only the second pier with a floating dock, two boat lifts, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The authorized docking facility shall not exceed the quarter width of the water body as measured from the waterward edge of the existing bulkhead. Holt Permit No.55-21 Page 2 of 3 ADDITIONAL CONDITIONS 3) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes two (2) additional formalized boat slips for a maximum of three (3) formalized boat slips at this docking facility. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. USACE Conditions h) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws. ovg /raleigh/pdfs/ManateeGuidelines20l7.pdf. General 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2021-00526). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-0569. William R. There is currently a single family residence with driveway, bulkhead and existing two slip docking facility. No written concurrence and no fee split for DWR GC 4175 was required. 9. Project Description The existing .23-acre (10,149sf) tract is located at 153 Pond Drive, Atlantic Beach, Carteret County. The project area is found by turning off Highway 70 East in Morehead City (Arendell Street) onto the on - ramp for Atlantic Beach. Follow the Atlantic Beach Causeway for approximately 2,774.41' (.53 miles) then turn right onto Old Causeway Road. The lot is approximately 1500' and on the left. The site is located along the west side of the existing canal and is contiguous with Bogue Sound. The property shoreline is stabilized with a bulkhead. The elevation is 3' above NHW with no wetlands on the property. The property has 20V of shoreline and a canal width of 162'. The waters of Bogue Sound adjacent to the project areas are classified as "SA, HQW" by the Division of Water Resources and have been previously dredged within the canal area. There are no nearby Primary Nursery Areas. According to the maps provided by the Shellfish Sanitation Section of the NC Division of Marine Fisheries, the waters of Bogue Sound are predominately open to shellfish harvesting adjacent to the proposed project however, the canal area is closed to shellfish harvesting. No SAV were observed within the project area. There is no dredging proposed within navigable waters and there are no known historic or archaeological areas of value known within the project sites. 9. Proposed Proiect The applicant is proposing a pier addition, floating platform with gangway and a third slip with boatlift. The canal has a width is 162' wide along the property. The '/4 rule would limit dock length to a maximum of 40' from NHW, which is the bulkhead. The applicant is proposing a 6' x 16' second pier along the south side of the existing docking facility. A gangway would extend waterward and intersect a 6' x 20' floating platform. A 13' x13' boatlift is also proposed and would be located along the south side of the proposed floating platform. All proposed development would be located a distance of approximately 100' from the William Waters riparian line and approximately 75' from the Pond Drive riparian line. 10. Anticipated Impacts: The development would shade 216 sf and incorporate 540 sf of shallow bottom habitat. The proposed docking facilities would not interfere with navigation and would meet the '/4 width rule and not extend into the channel portion of the canal. Sound. No dredging is proposed at this time due to -3' nlw to -5' nlw water depths within the proposed slip areas. There would be no impacts to wetlands, shellfish or SAV resources. The development conforms to the guidelines set forth under 15A NCAC 07H .0208. The waters of the Bogue Sound area are open to shellfish harvest and is not designated as a Primary Nursery Area with the waters of the canal closed to shellfish harvest and also not designated as a primary nursery area. Overview: The project is located at 153 Pond Dr, Atlantic Beach, Carteret County a .23-acre tract. The site is located along the west side of the existing canal and is contiguous with Bogue Sound. The property shoreline is stabilized with a bulkhead. The elevation is 3' above NHW with no wetlands on the property. The property has 201' of shoreline and a canal width of 162'. AECs onsite include PTA (Public Trust Area). Bogue Sound within this area carries a water classification of SA/HQW and the site has been previously dredged within the canal area. There are no nearby Primary Nursery Areas. According to the maps provided by the Shellfish Sanitation Section of the NC Division of Marine Fisheries, the waters of Bogue Sound are predominately open to shellfish harvesting adjacent to the proposed project however, the canal area is closed to shellfish harvesting. No SAV were observed within the project area. There is no dredging proposed within navigable waters and there are no known historic or archaeological areas of value known within the project sites.
