This permit, issued on October 4, 2021 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Excavation 1) No excavation shall take place outside of the area indicated on the workplan drawings. 2) Excavation shall not exceed -3 feet (DI), -3.5 feet (D2, D4), -4 feet (D3), -7.5 feet (D5), all below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 3) The temporary placement or doable handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 4) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Perm ittee I Historical Society of Topsail Island ADDITIONAL CONDITIONS Permit No.136-21 Page 2 of 3 5) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. Dredge Material Disposal 6) No dredge material shall be placed within 30 feet of the normal high-water line. 7) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the site is graded and stabilized. 8) The dredge material disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 9) The permittee and/or their contractor shall take all necessary precautions to ensure that the dredge material is properly contained during transport to the disposal site, and that all the proper coordination has taken place with the local or state governments to ensure that any damage to public streets caused by transport of the dredge material has been addressed. Maintenance Clause 10) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for dredge material disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the dredge material disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. Sedimentation and Erosion Control 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. Historical Society of Topsail Island ADDITIONAL CONDITIONS USACAE Conditions Permit No. 136-21 Page 3 of 3 13) In order to further protect the endangered West Indian Manatee, Trichechus inanalus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/rateigh/pdfs/ManateeGuidelines20l7.pdf. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 15) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in appropriate waste receptacles in an upland location. 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2008-00407-071). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-1060. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. Based on this determination, it is recommended that a permit be issued. This office has ne objections to the proposed project provided it is consistent with all other state and federal permitting requirements. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 8. PROJECT DESCRIPTION The project site is located at 720 Channel Blvd., adjacent to Banks Channel and Topsail Sound, in Topsail Beach, Pender County. According to the permit application this property is 200' x 138' or 27,600 sq. it There is an existing commercial structure on this property, known as the Assembly Building with a 7,200 sq. ft gravel parking area and docking facility. There is an existing bulkhead that runs the length of the shoreline at the project site (+/- 208'). The existing docking facility includes an access pier is 6' x 40' that connects to a Boating dock measuring approximately 7' x 140' that runs parallel to the bulkhead and terminates 31' into Banks Channel. The normal high water at this site is located at the base of the existing bulkhead. Banks Channel is approximately 1800' wide at this location. Banks Channel provides access to properties to the north and south of the project site. The vegetation on the high ground area includes bermuda grass and other ornamental plants. There are no coastal wetlands located on, or adjacent to the project site, nor is there any SAV present along this section of shoreline. The Topsail Beach Land Use Plan classifies this area as developed. In the project area, the NC Division of Water Quality classifies the waters of the Banks Channel / AIW W and Topsail Sound, as SA. This area of Topsail Sound is M designated as primary nursery area by the NC Division of Marine Fisheries and is o =to the harvesting of shellfish. On June 1, 2005, CAMA Major permit 86-05 was issued to Topsail Offshore for the construction of a docking facility at the subject property. On March 14, 2008, CAMA permit 86-05 was modified, authorizing an extension to the previously permitted floating dock Lastly, on December 10, 2014, the permit was modified (minor) to allow for the construction of another section of floating dock, this one located along the southern side of the property, adjacent to the existing bulkhead. According to the last permit modification, a total of seven (7) boat slips have been authorized. The last known CAMA permit associated with the subject property expired on October 18, 2015. PROPOSED PROJECT According to the project narrative and application package, the applicant proposes to perform dredging activities around an existing docking facility. The application states there are five (5) target areas that require dredging at this time and those areas are identified on sheet No.14, as Area Dl, D2, D3, D4 and D5. Areas "D1, D2 and D3", when combined, account for approximately \2��1328 sq. ft. of shallow bottom area. These three cuts are technically one rectangular area located along the southern side of the exiting pier, immediately adjacent to the existing bulkhead, around the existing 6' x 18' section of floating dock. Existing water depths at D1, D2 and D3 vary from -1.0 to -3.0' at normal low water (NLW) and the applicant proposes to remove approximately -2.0' of material, for a total of 67 cubic yards. The proposed "D4" dredge area is located along the northern side of the property, and it too is located immediately adjacent to the existing bulkhead. While there are no formal slips at this location, the narrative states this site is a "turning basin" for two of their recreational slips. The footprint for proposed dredging activities in this area is approximately 16' x 75', with a proposed final dredge depth of -5.0, NLW. Current water depths are reported at-1.5'to -3.0' at NLW. The amount of material removed from the D4 area would total approximately 88 cubic yards. At this location, the applicant is requesting to remove material from an 8' x 24' area along the northern dock terminus. The application package states this area is the berthing location for the F/V Queen Jean, which drafts approximately 5.0' of water. Current water depths at this location are reported to be approximately 5.5' at NLW, and the proposed is to remove approximately 2.0, bringing the total dredge depth to -7.0' at normal low water. Total yardage removed at this location would be approximately 14 cubic yards. The existing Tx 140' floating dock is located along the edge of the side channel that provides access to the commercial/business shoreline of Topsail Beach, and while the US Army Corp of Engineers does not maintain a federal channel at this location, the Town of Topsail Beach has an active CAMA Major Permit for the side channel. Existing depths at the site transition from -1.0' (along the bulkhead) to -12' along the outer edge of the existing Tx 140' section of floating dock, which demonstrates a transition to deeper water along the existing floating docks cross section. As reported in the applicant's project narrative, all material would be removed via a bucket to barge type operation. Dredge spoil would be unloaded from the barge at the end of Scott Avenue, in Topsail Beach, NC, which is owned and approved for use by the Town of Topsail Beach. The material would then be transported to a private residential lot located at 805 Channel Boulevard, Topsail Beach. The owner of the disposal site is Quinn Ventures, LLC and a copy of the permission statement is enclosed for verification. The disposal site is not located within a CAMA Area of Environmental Concern (AEC). 10. ANTICIPATED IMPACTS The proposed dredging would disturb approximately 2,604 sq. R of shallow bottom area. Minor increases in turbidity should be expected during the dredging event; However, no long term adverse impacts are anticipated. Spoil disposal would disturb up to 6,500 sq. it (0.15 acres) of high ground at Quinn Ventures, LLC property, Topsail Beach, NC, which is approximately 300-350' feet from the project site. The proposed project would not exceed a final depth of -7' @ NLW and would taper off along the edge of the maintained channel. We are a non-profit organization dedicated to the collection, preservation, and promotion of the history of the Greater Topsail area. Our building, located on the shores of Topsail Sound, was built in 1948 by the U.S. Navy, and was the home of Operation Bumblebee, the Top Secret missile program operated by the Navy between 1946 and 1948. Today our building consists of The Assembly Building, originally used to assemble rockets, but now used to accommodate community events and wedding parties, and The Missiles & More Museum, open to the public free of charge, which houses displays about the USA's first missile program, and other items of local interest, such as the Marine's Osprey program. Our members provide financial support for our various endeavors by conducting Autumn With Topsail, a popular fall festival, by renting the Assembly Building for private events, by hosting a summertime Bingo operation, and by renting recreational and commercial dock space to tourists and area fishermen. One of the highlights of our year is our annual scholarship program where we donate college scholarships to some of our most outstanding area high school graduates. The dredging project we wish to undertake involves our eight rental boat slips. In the past two years a newly emerged silting problem has left deposits that are threatening the viability of some of our slips. We have attached three exhibits for information purposes.
